The City of Lansing Charter in Chapter 5 and specifically 5-505 Conflict of Interest states as follows: .1 At least ten (10) days prior to the first of any of the events set forth in (A), (B), (C), (D), and (E) below, a City officer or employee who may derive ajp3 income or benefit, directly or indirectly, from a contract with the City or from ae City action, shall file an affidavit with the City Clerk detailing such income aA6 benefit to be derived: -tm, o n (A) The bidding of the contract; m (B) The negotiation of the contract; (C) The solicitation of the contract; rte-- . The above provisions shall not apply to individual or collective bargaining agreements pursuant to which a City officer or employee directly or indirectly receives income or benefits in the form of official remuneration as an officer or employee, or any City action pursuant to which a City officer or employee directly or indirectly receives income or benefit as a member of the public at large or any class thereof. At the first regularly scheduled City Council meeting following the filing of an Affidavit pursuant to this section, the City Clerk shall notify the City Council of such filing. In particular cases and for good cause shown, the Board may waive the ten (10) day prior notice requirement contained herein. .2 An officer or employee who has any other conflict between a personal interest and the public interest as defined by State law, this Charter, or ordinance shall fully disclose to the City Attorney the nature of the conflict. .3 Except as provided by law, no elected officer, appointee or employee of the City may participate in, vote upon or act upon any matter if a conflict exists. 2. I provide this Affidavit solely to avoid the appearance of impropriety because I may have inadvertently come within the disclosure provision provided in Section 5-505.1 (E), despite the fact that I have provided full disclosure to the former City Attorney. 3. Prior to becoming a full time City of Lansing (the "City") employee, I was actively involved in the practice of law in the Abood Law Firm (the"Firm"). 4. The Firm was at all times pertinent a law firm on the City's outside counsel list of preapproved law firms established by City Council resolution. 5. After I started City employment, I have had no involvement with the operation of the Abood Law Firm and have placed all my interest in the Firm in trust with the principle partner of the Firm, Andrew Abood, and I hereby assert that I retain no active authority or have engaged in any legal practice on behalf of the Firm, except that I retain an interest in accounts receivables of the Firm, which are for amounts earned but not paid for legal services performed prior to my employment with the City. 6. At all times pertinent to my city employment, the City Attorney was fully informed and aware of my affiliation and limited interest in the Firm. 7. As I am informed and believe, a question has been raised relative to the former City Attorney awarding work on a legal matter to the Firm. 8. As I am informed and believe, the former City Attorney employed the services of the Firm on or about August, 2015. 9. The City Attorney did not request my approval or seek my consent before engaging the services of the Firm to handle any legal matter for the City nor did I ever authorize the use of the Firm. 10. The former City Attorney did not request my review or approval or have me authorize payment of any bills for the Firm's services nor did I ever authorize any such payment. 11. 1 have separated myself from all matters that involve the City and the Firm, including, but not limited to, all 54A District Court ordinance work during all periods of my City employment and I have further maintained, and continued to maintain, an informational firewall between my City employment and the Firm. I hereby assert that the foregoing statements are true and accurate to the best of my knowledge, information and belief.
