The Board of Ethics has attempted to review a disclosure of
a conflict of interest filed by you. Your disclosure contains
insufficient information to allow such review, however. To assist
you to make the full disclosure required by law, the Board of
Ethics has adopted a revised form for use in disclosing conflicts.
While you are not required to use this specific form, anv
disclosure you file must contain the information called for in it.
Enclosed is a copy of your original filing, along with a blank form
with instructions, which you are requested to complete and resubmit
to the City Clerk as soon as possible.
If your disclosure pertains to a contract with the City, it
must contain the information required by MCL 15 . 323 (c) . To the
extent it pertains to other government decisions, it must meet
Charter requirements for a full and complete disclosure. "Blanket
disclosures" do not comply with either state law or local charter
and ordinance requirements. Officers and employees are required
to file a separate disclosure for each specific transaction
involving an actual or potential conflict of interest before any
dealing with the City takes place. A disclosure must also indicate
how the officer or employee intends to resolve the disclosed
conflict.

CONFLICTS OF INTEREST. IT REPLACES THE ONE PAGE FORM PREVIOUSLY
DISTRIBUTED BY THE CITY CLERK' S OFFICE.
THE INFORMATION SUPPLIED IN THIS FORM MUST BE GIVEN UNDER
OATH. THERE MAY BE EMPLOYMENT, CIVIL AND/OR CRIMINAL SANCTIONS
IMPOSED UPON ANYONE MAKING A FALSE OR MISLEADING OATH OR STATEMENT
ON THIS FORM.

Choose the alternative or alternatives that describe your

The completed form should be dated and executed, and your
signature notarized.
Disclosures of financial conflicts of interest should be filed
with the City Clerk. Disclosures of nonfinancial conflicts of
interest should be filed with the City Attorney. Two copies of
your Affidavit should also be supplied to the City Clerk or the
City Attorney so that it can also be sent, as appropriate, to the
Mayor or City Council President and your Department Head, if
applicable.
After filing, your form will be reviewed by the Board of
Ethics for completeness and conformity to state law, the charter,
and any applicable ordinances . You will be advised if any
additional information or if further action is required.
Generally, the review will occur within 2-4 weeks of your filing.
If speedier review is required, please indicate the date your
review is needed by and your reasons for the request, in a separate
letter filed with your affidavit.
COMMONLY ASKED QUESTIONS
1. Why do I have to fill out this form?
Both state law and local charter provisions require timely,
full and complete disclosure, in writing, of actual and potential
conflicts of interest. These provisions have been in effect since
the mid and late 1970s.

2. When is an officer or employee required to file an Affidavit
of Disclosure?
As soon as a conflict exists, an officer or employee must
promptly file an Affidavit of Disclosure with the City Clerk or the
City Attorney, but in no event less than 10 days before any meeting
of any governing body at which the matter will be discussed or
considered. Where an officer or employee serves on a governing
body responsible for approval of the matter in which there is a
conflict, the disclosure must be made at the same time as the
filing with the City Clerk, to the governing body (the Council
President, in the case of Councilmembers) and be included in the
public record of the proceedings .
Last minute disclosures, except in an unusual circumstances,
do not comply with state law or the Charter. However, in the event
the issue unavoidably arises for the first time at a particular
meeting, the governing body may determine by vote of an affirmative
majority of disinterested members if a conflict exists which
requires or permits a member to be excused from voting. At the
very least, the nature of the conflict and the reasons for excusal
or nonexcusal from voting should always appear in the record of the
meeting. An Affidavit of Disclosure must then be filed as soon as
practible after the meeting.
3. Does a person have to file an Affidavit of Disclosure on each
transaction in which they are or may be in conflict, or may the
Affidavit be generic in nature?
An officer or employee must file an Affidavit of Disclosure
on each separate transaction that involves a financial conflict.
4. What level of detail satisfies the requirement to fully
disclose a conflict of interest?
State law, the Charter and Conflict of Interest Ordinance
require complete and specific details in order to satisfy the
requirement of a full disclosure. The form is designed so that if
fully completed, it will satisfy the disclosure requirement.
5. Is the purpose of the Affidavit of Disclosure to serve notice
that I am unable to speak or vote on a matter, or does it simply
serve as notice to other parties in the decision making process
that I have a self interest as opposed to a public one?
Both. In the appropriate case, it also notifies a governing
body (and the public) , on the record, why the officer or employee
with the conflict believes he or she can, in light of the conflict,
make or participate in making a decision on the matter f airly,

objectively, and in the public interest.
6. Is the filing of an Affidavit of Disclosure required even if
I have already been excused from voting or participating in the
decision of the matter?
Yes.
7. What standards of conduct apply if I have a conflict of
interest?
When there is a conflict of interest relative to a public
contract, state law sets the standards of conduct which apply.
Officers and employees who contemplate being a party to a contract
with the City are referred to MCL 15. 321 et seq. , entitled,
"Contracts Of Public Servants With Public Entities" . As a general
rule, state law prohibits a full time officer or employee from
having direct business dealings with the City. Volunteer and part
time officers and employees may, if state law is complied with,
have business dealings with the City. Violation of the state
statute is a misdemeanor.
In all other cases, Chapter 5 of the Charter and Chapter 290
of the Code of Ordinances supply the applicable rules.
Any officer or employee may seek an advisory opinion from the
Board of Ethics based on the facts of their specific situation, if
they are uncertain about what rules apply to them, or about what
they are required to do to resolve a conflict of interest.
8. Who am I allowed to communicate with about this matter, once
I have filed an Affidavit of Disclosure?
If you have a conflict of interest, whether or not you have
filed an Affidavit of Disclosure, you may not officially or
unofficially participate in the discussion or consideration of the
item in conflict in any way, shape, or form, either directly or
indirectly, either in furtherance of your public responsibilities
or of your private interests , at any stage of the consideration of
the matter in which you have a conflict, except in compliance with
State law or Ordinance 290 .
9. Does being excused from voting or late filing of an Affidavit
of Disclosure absolve any prior actions I may have taken on behalf
of the matter in which I have a conflict of interest?

indicates that she was involved in the canvassing of the
neighborhoods regarding the property on Pennsylvania in July
1989 . This involvement with Mrs . Schmidt in July 1989 clearly
indicates that Mrs . Schmidt was actively involved in this issue
before he son expressed an interest later in August 1989 .

I am writing in response to the recent controversy
surrounding the installation of a left turn signal at the
corner of Pennsylvania Avenue and Mt. Hope Avenue, and to
reinforce the initial intention of the petition.
I helped circulate this petition between July 14, 1989 and
July 31 , 1989 , and truly believe all 600 city taxpayer
signatures I obtained had one common goal, making a safe
intersection at Pennsylvania and Mt. Hope.
I can' t help but feel the integrity and ethics of all those
who signed the petition have also been challenged in this
controversy.
Your support and assistance in getting this petition through
is very much appreciated. Each individual who travels
through this intersection is by far, the most important one
to benefit.

September 6, 1989: Mayor McKane ordered Public Service Department
to conduct a complete & thorough study of S. Pennsylvania
Avenue from 496 south to E. Mt. Hope to determine if the
removal of the median was needed. (Time allotted to
complete study was 45 to 60 days. )
April 3, 1990: Public- Service report sent tb Mayor McKane bn'-the- -
area of S. Pennsylvania Avenue covered only the area
between Fayette and E. Mt. Hope. (Area neglected by
study is 1, 185 lineal feet of Pennsylvania Avenue
frontage. )
April 16, 1990: Mayor McKane acknowledges that the Public Service
report does not include the entire area that he ordered
to be studied.
April 16, 1990: Mayor McKane also acknowledges that he does not
approve of the letter sent to residents and property
owners that was used to complete the study ordered.
Survey letter sent to residents and property owners by Public
Service Department contained many inaccuracies:
1. Median is NOT in good physical condition as stated by Public
Service Department letter.
2. No landscape architect in any Lansing department has any
knowledge of plans to landscape the median as stated by Public
Service Department letter.
3. The cost of safe travel for all travelers cannot be considered
"not necessary" as stated by Public Service Department letter.
4. The traffic flow benefits are tremendous as shown by the many
supporters of the removal of median. (Public Service states
that traffic flow benefits are limited. )
5. The residential character has NOT been destroyed in areas of
South Pennsylvania and North Pennsylvania where the median has
been recently removed with full support of the Public Service
Department. (Public Service states that the median preserves
the residential character in this area. )
Survey Question 42 on the Public Service survey states that the
cost of removing the median is estimated at a cost of527. 50 per
lineal foot of Pennsylvania Avenue frontage.
In the report (dated 4-3-90) to the Mayor this cost is listed as
$77, 000. 00 for the median removal from Fayette to East Mt. Hope.
On September 6, 1989 Howard McCafferty reported to the Mayor that
the cost of removal of the median would be $82, 000. 00 from 496
south to East Mt. Hope that cost is approximately $15. 95 per lineal
foot of frontage on all property.
It is obvious that there is a serious problem in determining what -
the cost would -be because of: the conflicting dollar--amounts that
have been stated by the Public Service Department and the $27. 50
cost per lineal foot of frontage, that was used in the Public
Service Survey, should not have been used and could be suspect in
trying to scare and intimidate responses in the favor of the
retention of the median.
We would ask the City of Lansing to remove the median on South
Pennsylvania between 496 and East Mt. Hope Avenue.

Re: Removal of the median on South Pennsylvania Ave.
Dear Mr. Mertz ,
None of the five parcels you requested will be affected to the
extent that value changes could be measured in an appraisal due
to the removal of a median.
No adjustment is included on any of our appraisal cards with
respect to whether a median exists on any property in Lansing,
and to the best of my knowledge has the characteristic ever been
a factor in appraisals of any kind.
This seems to indicate that value changes attributed to the
removal of (or addition of) a median are so insignificant, and so
far down the list of measurable characteristics that inclusion of
any dollar amount for the existence of or removal of a median
would seem to imply sales and appraisals are somehow exact.
Note: The base land value for assessment purposes in this and
the surrounding area has not changed in several years, they are
subject to review and change in the near future, therefore any
value change to the land in this area should not be implied to be
a result of the removal of the median if that should happen.

Median Strip Issue
John Mertz, Chairman of the Ethics Board, has instructed me to
request a video tape that would include all of the discussion that
has taken place in Council meetings regarding the South
Pennsylvania Median Strip Issue (began in the fall of 1989 ) .
If possible, we would like all of this information to be
incorporated into one VCR tape.
Thank you for your assistance in this matter.

Dear Members of the Lansing Board of Ethics :
in accordance with Article 5, chapter 5-503 . 1 of the Lansing City
Charter, I am requesting your opinion on whether I may vote on or
participate in any issue regarding the resurfacing/repaving
and/or elimination of the median for Pennsylvania Avenue between
Mt. Hope and I-496 . My son, Jim Schmidt, has an ownership
interest in the Hyacinth House Greenery, 1800 South Pennsylvania.
He also has an ownership interest in the properties located at
1720 and 1726 South Pennsylvania Avenue.
For your benefit, I am enclosing a copy of a written Affidavit
of Disclosure of Potential Conflict of Interest that has been
filed with the City Clerk and Council President Belen. This
should provide you with the necessary information to respond to
my request. If you need additional information, please feel free
to call me at your convenience.
Until I receive your opinion, I am informing you that I shall not
take part in any action affecting this issue.

Alfreda Schmidt, being duly sworn, says under oath:
1 . I am an elected officer of the City of Lansing
holding the position of City Councilwoman, for the 2nd Ward.
This position is part-time ( less than 25 hours per week) .
2 . My son, James Schmidt, a member of my immediate
family, as defined in Lansing City Ordinance 290 . 02 ( i) , has an
interest in a business partnership, as defined by Lansing City
Ordinance 290 . 02 (b) ( 2) . The name of that business is Hyacinth
House Greenery. It is located in the 1800 block of South
Pennsylvania. My son also has an ownership interest in the
properties at 1720 South Pennsylvania and 1726 South
Pennsylvania.
3 . My son' s business may derive benefits as a result
of the repaving/resurfacing of Pennsylvania Avenue, the removal
of the median on Pennsylvania Avenue between Mt. Hope and I-496 ,
and the installation of a left-turn phase for the Pennsylvania
and Mt . Hope traffice signal . The benefits that may be derived
would include the following:
a. An improved condition of the street for
employees , customers and potential customers ;
b. Improved traffic flow of northbound and
southbound traffic;
C . Improved safety in that it is anticipated
fewer drivers will make U-turns on Pennsylvania Avenue in
the vicinity of the properties in which my son has an
ownership interest.
4 . I have lobbied for the installation of a left-turn
only signal phase at the intersection of Mt. Hope and
Pennsylvania, as well as for the removal of the median on
Pennsylvania Avenue, since late last fall . As Councilwoman for
the 2nd Ward, I believe it my responsibility to represent the
interests of my constituency. The only reason I have lobbied for
these changes is safety. The traffic conditions on Pennsylvania
Avenue have been deplorable, and I believe the neighborhood and
the city will benefit not only by the installation of the left-
turn only signal phase, but by removal of the median on
Pennsylvania Avenue between Mt. Hope and I-496 . Because the
business in which my son has an ownership interest has property
on Pennsylvania Avenue with frontage of approximately 286 feet, I
dial not oerceive this to be a conflict of interest. Neither I
nor my husband have an ownership interest or any financial
interest in the business that my son is in.
5 . My son informs me that approximately 1 . 2 percent
of the Hyacinth House Greenery' s business is derived from walk-in
retail . The balance of the revenues come from wholesale and
service aspects of his business . My son informs me that he does

not expect his walk-in retail to be affected by any contemplated
changes on Pennsylvania Avenue between Mt. Hope and I-496 .
6 . This project will not benefit exclusively or
principally my son' s business, as my son' s business owns only
. 065 of one percent of the total frontage privately owned between
Mt. Hope and I-496 .
7 . When I was canvassing the surrounding neighbor-
hoods last fall to circulate petitions regarding installation of
a left-turn arrow light at the corner of Pennsylvania and Mt.
Hope Avenues, I also discussed the pros and cons of removing the
median on South Pennsylvania Avenue. Many of these people
approved the removal of the median.
8 . I am also attaching a copy of my April 17 , 1990
letter addressed to Mr. John E . Mertz, Chairman of the Lansing
Board of Ethics, for your review and consideration in connection
with my request and my Affidavit of Disclosure of Potential
Conflict of Interest.
9 . Despite the potential conflict of interest, I will
not make or participate in any decisions affecting the
Pennsylvania Avenue median removal and resurfacing/repaving
issues until such time as I receive an opinion from your board or
the Lansing City Council that it would be appropriate for me to
participate in such action and/or decisions . I believe, however,
that I can participate in making the affected decision regarding
these issues fairly, objectively and in the public interest
because my only concern involving these issues is the public ' s

safety. If, however, you believe that my son' s business
interest on Pennsylvania Avenue constitutes a conflict of
interest with respect to any action I may take regarding the
resurfacing/repaving of Pennsylvania Avenue, I will not
participate in the making of that decision.
10 . I hereby certify that this disclosure is complete
and accurate to the best of my knowledge, information and belief .
Due to the time constraints involved between the time I
discovered the correspondence from Mr. Mertz on April 18, 1990,
and this meeting, I have been unable to duplicate everything in
my file, however, I wish to inform you that I have copies of
additional documents, and if you desire them, I would be happy to
furnish copies to you. Those documents are as follows :

It is my understanding that on Monday, April 23 the Lansing Board of Ethics
will take up the issue of my involvement in facilitating street improvements
along South Pennsylvania Avenue between I-496 and Mt. Hope Avenue.
Specifically, the question before the Board of Ethics centers on my efforts as
Second Ward Councilwoman, to improve this stretch of roadway and the potential
impact it will have on the Hyacinth House Greenery at 1800 South Pennsylvania
which is operated and co-owned by my son, Jim Schmidt.
On Tuesday, March 27, 1990, I delivered a written communication to City
Attorney and Ethics Board Member Al Knot posing the question of whether by
responding to area residents requesting that the median be removed, would I be
in conflict of interest? Mr. Knot, who is a member of the Board of Ethics has
not formally responded to my question.
I have great regard for the Board of Ethic's role in deliberating such
questions and, in fact, made the necessary disclosures when Hyacinth House
Greenery was awarded a city contract by bid. Once again, I would like to
disclose information that will assist the Board of Ethics in deciding the
issue before you.
First, neither I nor my husband, Frank Schmidt Jr. , have any ownership in
Hyacinth House Greenery, a well -established business that has operated in
Lansing for 15 years, the last 13 years at 1800 South Pennsylvania.
My commitment to projects such as the South Pennsylvania street improvements
is well -documented. In my eight years on the Lansing City Council I have
consistently worked to improve the flow of traffic through the Second Ward in
the name of safety and service to my constituents and to people who must
travel through the Second Ward to their business or place of employment.
Improvements to Edgewood Blvd. , Forest Road and Cedar Street are but a few of
those projects. Additionally, I have worked with the Public Service
Department to add sidewalks, stop signs, traffic signals and crossing guards
at intersections where personal safety has been threatened.
In response to neighbors, area residents and business owners, last summer I
inquired about the Public Service Department's plans to improve the roadway in
question. I specifically asked about the possible removal of the median and
the installation of a left-turn directional signal for north and south bound
traffic at the Mt. Hope intersection. When it became apparent that neither
option was being considered by the Public Service Department, more than 600
people signed petitions requesting that a directional turn signal be
installed. This petition drive was strongly supported by employees at Lansing
General Hospital , many of whom must travel Pennsylvania Avenue to and from
work.
Upon being presented to City Council , the petitions were referred to the
Public Safety Committee which I chaired at the time. The committee
recommended that a turn signal be installed for north and south bound traffic
on Pennsylvania at Mt. Hope and the City Council , including myself, voted to
fund the project. I was very happy with this compromise on the part of city
government. This project was so fundamental to safety in the Second Ward and
so consistent with the kind of projects I have undertaken, that the question
of whether I was in conflict of interest did not exist.
However, the nature of the issue has changed.
At approximately the same time that I undertook my petition drive late last
summer several business owners, including Jim Schmidt, came before City
Council regarding the improvement plans for South Pennsylvania. Mayor McKane
invited the business owners to meet with him the following day to discuss
their concerns. I did not attend that meeting. The Mayor, however, ordered a
full study of the problem which the Public Service Department conducted in
February, 1990.
In the past several weeks the business owners' interest in having the median
removed has escalated considerably. While I am understanding of their
interest in this project, it has gone far beyond my original goal of improving
the flow of north and south bound traffic. Since mid-February I have
questioned whether I can be involved in these discussions. I have stated my
reservations to fellow council members and, again, asked a member of your
board for guidance on this issue in March.
Until the Board of Ethics rules on the appropriateness of my involvement on
this issue, I will not discuss it or vote on any measure related to the South
Pennsylvania street improvement issue that comes before the City Council .
However, I am deeply committed to representing the interests of the Second
Ward. Therefore, it is my hope that the Ethics Board will resolve this matter
quickly so that I can carry out my responsibilities as the Second Ward's
representative.

The section of Pennsylvania that is involved here is primarily
residential in nature . Because of this , I feel the interests of
the residents should take precedence over the business interests
of only two or three businesses located in the same area . Since
the majority of the residents are in favor of keeping the median,
I believe. the city should maintain its original plan of action,
which was to keep the median intact .
My greatest concern in the matter is the actions of Council-
member Alfreda Schmidt . I do not feel she is fairly representing
her ward members ' interests , since she is so blatantly involved
in her son' s business interests . Her son, who owns The Hyacinth
House ,greenery, is the primary instigator of the campaign to
remove-+he median. Because of this , I feel Councilmember Schmidt
sh6.uldYz1-emove herself from any proceedings or vote taken on this
matter since she is obviously not impartial. If she is not

as many of our neighbors, on this issue. We believe Mrs. Schmidts
objectivity in this matter is clouded by the fact that her son, Jim

would like the median removed. We respect the fact that a mother
would like to see her son do well, but think she has neglected a large
number of her constituents in forming an opinion on this matter. It
is obvious by watching the City Council meeting that Mrs. Schmidt has
decided how to vote on this issue. Her son and his employees have
voiced their views week after week and now Mr. Schmidt has even joined
the coalition. Is this not a conflict of interest for Mrs. Schmidt?
How can we as tax payers know our views are being considered when
they conflict with her sons? Why would Mr. Schmidt, a homeowner not
directly affected by this proposal, collect signatures on a petition
in favor of removing the median?
This behavior seems unethical to many of us and makes us feel we have
an unfair disadvantage. We have signed a petition along with many of
our neighbors in favor of keeping the median. When this was submitted
to the City Council, Mrs. Schmidt immediately raised concerns over the
wording of the petition and how the signatures were collected. She
raised no questions when her husbands petition was submitted. Two of
our neighbors tried to meet with Mrs. Schmidt after a Council meeting
but we were told she was rude and unresponsive to their concerns.

We would like to know if the City of Lansing has any guidelines regarding

Dear Board Members :
Enclosed for your review and consideration are several of the
documents we referred to when you allowed us an opportunity to
discuss the subject of Councilmember Schmidt ' s potential conflict
of interest. You will note that I have also included some
materials regarding Councilmember Schmidt ' s son, Jim Schmidt, and
his place of business , the Hyacinth House Greenery located at
1800 South Pennsylvania.
It is our contention that Councilmember Schmidt was not in a
conflict of interest when she supported the removal of the
medians on South Pennsylvania north of Mt . Hope. Lansing City
Ordinance 290 . 05(a) in pertinent part, reads :
No officer or employee shall make or participate in
making a decision in his or her capacity as an officer
or employee knowing that the decision will provide such
officer or employee, or member of the officer' s or
employee ' s immediate family, or business of which the
officer or employee is associated, a financial benefit
of more than a de minimis nature which is
distinguishable from the benefits to the person as a
member of the public or as a member of a broad segment
of the public . . . .
In reviewing the Affidavit submitted by Jim Schmidt, it is clear
that the elimination of the medians on South Pennsylvania Avenue
would not provide him with a financial benefit of even a de
minimis nature for a variety of reasons . First, northbound
Pennsylvania traffic has immediate access to his properties on
South Pennsylvania because of the left-hand turn tail . Because

of that access, the removal of the medians would not affect the
volume of drive-in or walk-in business at either the Hyacinth
House Greenery or VanPeenen' s, which he just bought last month.
Second, the only benefit that Mr. Schmidt and his business would
receive is identical to that which would be received by the
public in that there would be an improved traffic flow on South
Pennsylvania, particularly during peak traffic use. As indicated
in Councilmember Schmidt ' s Affidavit of Disclosure of Potential
Conflict of Interest, Jim Schmidt ' s business would benefit
because of the improved street condition, the improved traffic
flow for north, as well as southbound traffic and improved
overall safety since fewer drivers would make U-turns on
Pennsylvania, and because emergency vehicles would have direct
access into the properties along South Pennsylvania. These
benefits would be shared equally with the neighborhood and people
who drive on South Pennsylvania.
While we recognize the concept of "public interest" is difficult
if not impossible to define, it is clear that Mr. Schmidt would
not receive a benefit which would be distinguishable from
benefits to any member of the public or member of a broad segment
of the public .
We would also like to point out that Councilmember Schmidt ' s
interest in this traffic situation occurred before Jim Schmidt
started lobbying City Council for removal of the median. We
have submitted Petitions for your review, some of which were
signed before Mr. Schmidt started lobbying the Lansing City
Council for removal of the median. This clearly indicates that
Councilmember Schmidt ' s interest in the traffic problems in the
vicinity of Pennsylvania and Mt. Hope predated her son' s lobbying
efforts .
In light of the information submitted, it is clear that a
conflict of interest did not exist when Councilmember Schmidt
advanced the cause of promoting improved traffic conditions on
South Pennsylvania by seeking the installation of a left-hand
turn signal at the intersection of Mt . Hope and Pennsylvania
Avenue, and to remove the medians on South Pennsylvania north of
Mt. Hope.

In light of the controversy generated by this situation, and in
view of the acknowledgement by special assistant counsel Donald
Reisig in his December 22 , 1988 opinion that the controlling act
is not a model of " . . .clarity, precision or legislative
draftsmanship" , it would be our recommendation that the Board of
Ethics conduct regular annual or semi-annual seminars for the
benefit of all employees and officers affected by the state law,
city charter and ordinance dealing with conflicts of interest.

1 . I am an elected officer of the --ity of Lansing
holding the posi=ion of City Councilwoman, f--= the 2nd Ward.
This position is ,..art-time ( less than 25 hours p=r week) .
2 . My son, James Schmidt, a member of my immediate
family, as defined in Lansing City Ordinance 2:0 . 02 ( i) , has an
interest in a business partnership, as define: by Lansing City
Ordinance 290 . 02 (b) (2 ) . The name of that business is Hyacinth
House Greenery. It is located in the 180..1 block of South
Pennsylvania . Mti, son also has an ownership 'nterest in the
properties at 7-720 South Pennsylvania aat 1726 South
Pennsylvania.
3 . My son ' s business may derive bea=_its as a result
of the repaving/resurfacing of Pennsylvania A:=-_.:e, the removal
of the median on Pennsylvania Avenue between M'_ . Hope and I-496,
and the installation of a left-turn phase for she Pennsylvania
and Mt. Hope traf=ice signal . The benefits t=i=i may be derived
would include the following:
a . An improved condition of .he street for
employees, customers and potential customer-- ;
b. Imprvved traffic flow of northbound and
southbound traffic;
C . Improved safety in that it is anticipated
fewer drivers will make U-turns on Pennsylvania Avenue in
the vicinity of :-he properties in which my son has an
ownership interest .
4 . I have lobbied for the installation of a ;eft-turn
only signal phase at the intersection of Mt. =ope and
Pennsylvania, as well as for the removal of the median on
Pennsylvania Avenue, s--i_e late last fall . As Councilwoman for
the 2nd Ward, I believe it my responsibility to represent the
interests of my cons ti:aency. The only reason I have -!Dbbied for
these changes is safety. The traffic conditions on Pennsylvania
Avenue have been deplorable, and I believe the neighborhood and
the city will benefit nrt only by the installation of r.he left-
turn only signal pha-se , but by removal of the median on
Pennsylvania Avenue b==ween Mt. Hope and I-496 . Because the
business in which my =:- has an ownership interest ra= property
on Pennsylvania Avenue k_th frontage of approximately 2_E� feet, I
did not perceive this be a conflict of interest . Neither I
nor my husband have_ -_ ownership interest or any financial
interest in the business that my son is in.
5 . My son _=forms me that approximately percent
of the Hyacinth House �:_reienery' s business is derived frog walk-in
retail . The balance the revenues come from whc scale and
service aspects of his business . 'My son informs me tha= he does

not expect his walk-in retail to be affected by any contemplated
changes on Pennsylvania Avenue between Mt. Hope and I-496 .
6 . This project will not benefit exclusively or
principally my son' s business , as my son' s business owns o_y

7 . When I was cane=_sing the surrounding neighbor-
hoods last fall to circulate p=-itions regarding installation of

Dear Mr. Mertz:
It is my understanding that on Monday, April 23 the Lansing Board of Ethics
will take up the issue of my involvement in facilitating street improvements
along South Pennsylvania =.venue between I-496 and Mt. Hope Avenue.
Specifically, the questio-: before the Board of Ethics centers on my efforts as
Second Ward Councilwoman. to improve this stretch of roadway ant the potential
impact it will have on -_nle Hyacinth House Greenery at 1800 Sown Pennsylvania
which is operated and c-1-Dwned by my son, Jim Schmidt.
On Tuesday, March 27, 10-90, I delivered a written communication to City
Attorney and Ethics Boarc Member Al Knot posing the question of whether by
responding to area residents requesting that the median be removed, would I be
in conflict of interest? Mr. Knot, who is a member of the Board of Ethics has
not formally responded to my question.
I have great regard for the Board of Ethic's role in deliberating such
questions and, in fact, wade the necessary disclosures when Hyacinth House
Greenery was awarded a city contract by bid. Once again, I mould like to
disclose information that will assist the Board of Ethics in deciding the
issue before you.
First, neither I nor my fjsband, Frank Schmidt Jr. , have any ownership in
Hyacinth House Greenery. a well-established business that has aperated in
Lansing for 15 years, tn_ last 13 years at 1800 South Pennsylvania.
My commitment to projects such as the South Pennsylvania street improvements
is well -documented. In my eight years on the Lansing City Council I have
consistently worked to improve the flow of traffic through the Second Ward in
the name of safety and service to my constituents and to people who must
travel through the Seccn: Ward to their business or place of enoloyment.
Improvements to Edgewoo, Blvd. , Forest Road and Cedar Street are but a few of
those projects. Additionally, I have worked with the Public Service
Department to add sidewalks, stop signs, traffic signals and crossing guards
at intersections where pe-sonal safety has been threatened.
In response to neighbors. area residents and business owners. last summer I
inquired about the Pubic Service Department's plans to improve the roadway in
question. I specifically asked about the possible removal of the median and
the installation of a lest-turn directional signal for north and south bound
traffic at the Mt. Hope =ntersection. When it became apparent that neither
option was being considered by the Public Service Department, more than 600
people signed petitions requesting that a directional turn signal be
installed. This petition drive was strongly supported by employees at Lansing
General Hospital , many of whom must travel Pennsylvania Avenue to and fram
work.
Upon being presented to City Council , the petitions were referred to the
Public Safety Committee which I chaired at the time. The committee
recommended that a turn signal be installed for north and south bound traffic
on Pennsylvania at Mt. Hope and the City Council , including myself, voter to
fund the project. I was very happy with this compromise on the part of city
government. This project was so fundamental to safety in the Second War: and
so consistent with the kind of protects I have undertaken, that the question
of whether I was in conflict of interest did not exist.
However, the nature of the issue has changed.
At approximately the same time that I undertook my petition drive late '_st
summer several. business owners, including Jim Schmidt, came before City
Council regarding the improvement plans for South Pennsylvania. Mayor %--Kane
invited the business owners to meet with him the following day to discuss
their concerns. I did not attend that meeting. The Mayor, however, or==-red a
full study of the problem which the Public Service Department conducted n
February, 1990.
In the past several weeks the business owners' interest in having the median
removed has escalated considerably. While I am understanding of their
interest in this project, it has gone far beyond my original goal of isgroving
the flow of north and south bound traffic. Since mid-February I have
questioned whether I can be in in these discussions. I have stag' my
reservations to fellow council members and, again, asked a member of yo4
board for guidance on this issue in March.
Until the Board of Ethics rules on the appropriateness of my involvement on
this issue, I will not discuss it or vote on any measure related to the South
Pennsylvania street improvement issue that comes before the City Council .
However, I am deeply committed to representing the interests of the Sec.-nd
Ward. Therefore, it is my hope that the Ethics Board will resolve this Batter
quickly so that I can carry out my responsibilities as the Second Ward's
representative.

financially solvent . It is current on all i financial
obligations, including taxes , and as evidence of its financial
solvency, recently received a substantial business loan from a
local lending institution .
7 . The Hyacinth douse Greenery partnership i= a
wholesale business and rec=lves approximately one percen_ of
gross sales from walk-in ret;_l . Northbound Pennsylvania traffic
has access to all three of _he properties referred to in phis
Affidavit because there is a left-hand turn lane for nort: Dund
traffic at that location.

Letter to residents and businesses of Pennsylvania Avenue between
Potter Park entrance and Mt. Hope Avenue
To Whom It May Concern:
This letter is in regard to the construction and resurfacing
of Pennsylvania Avenue which is to start September 11, 1969. Please
see attached letter. There are no plans at this time to eliminate
the unsightly and inconvenient median. We feel this is wrong.
As you know, the median is a great inconvenience and a traffic
hazard, because of U-turns, illegal left turns, etc., to those of
us who live and work on this stretch of Pennsylvania Avenue. If
you feel the same way, please join us at the City Council meeting
on Monday, August 28th and voice your concern over this very
important matter. The median should/and must be removed to allow
normal left turns to all residences and businesses along this
part of Pennsylvania Avenue.

In some cases, cut-thru pri-.ate property is being d-)r,e to prevent
these nediaris in naking deliveries of heating fuels. r`y o±_'ice has
received complaints fror.: these property- owners.
Since our trucks use 'enr,syltania Avenue frequently in raking
deliveries, we find that the center turn lane north of I-L9E. has greatly
improved conditions in that area.
I have discussed these medians Tith other drivers such as; Truck Drivers,
Wrecker .'rivers, v_re Depart!:ent 7:ivers, arar:jecic Drivers, and they have
indicated that the median re^�-�? north o{' I-LO6 has been to their acceptance,
and find the area such safer to rive in.
I would only hope that trees are not planted in these melt ns, since
that z-rill only obstruct driver x-ews, and cause other prnblsns such as;
animal crossings, etc.
In r,.any cases, I have witnessed blocked tra_`fic where these medians
are present, and if a center t= lane was available, at 1uast an emergency
vehicle would have another lane to use.
Pennsylvania Avenue north or I-496 has been cleared llp, I 14) uld only hope
that the same type of planning would be done tir-th the balance of Dennsylvania
Avenue where these nedians are resent. In addition, costs o_' this uroject
should probably be assessed as -hey were north of I-496.

Dear Mr. McCaffery,
I recently received a letter from Kevin L. Reynolds who
maintains that the boulevard median sections of South Pennsylvania
Avenue are "unsightly, inconvenient" and should be eliminated
(copy enclosed) . Along with that letter was a memo from you about
the proposed improvement to South Pennsylvania (copy also
enclosed) .
I DO NOT AGREE with Mr. Reynolds! I believe that you have
assessed the situation more reasonably. I understand that there
was an opportunity to voice opinions during the City Council
meeting the evening of August 28 . Unfortunately I received the
information too late to change my plans and attend that meeting.
Please let me take this opportunity to express my. opinions. Let' s
take the various facets of the situation individually:
APPEARANCE--I do not consider the median to be "unsightly. "
On the contrary, I feel it adds to the residential character of
the area. To remove the median and replace it with a left turn
lane would make Pennsylvania the same as West Saginaw Highway
between Waverly Road and the Lansing Mall . That would be fine if
it was intended that the South Pennsylvania area be rezoned
commercial . If I had a business like Mr. Reynolds I would
probably also advocate removing the median for the convenience of
my customers.
PROPERTY VALUES--Removing the median would denigrate the
residential character of the area and make living on Pennsylvania
less desirable. This would certainly lower the value of the
residential properties.
CONVENIENCE--This goes hand-in-hand with SAFETY. Living in
the middle of the block on a boulevard is like living on a one-way
street. If you are coming from the "wrong" way you have to go
around the block to get home. However, there is a flip side. The
median helps control and regulate traffic. Most of the residents
along Pennsylvania have to back onto the street when leaving home
by motor vehicle. Have you ever tried to back out onto West
Saginaw? On a five-lane thoroughfare cars are apt to be coming
from any direction. With the median they can only be coming from

' one direction. Pennsylvania is a rather busy street now. If it
was a five-lane thoroughfare the amount of traffic is most likely
to increase and probably travel faster.
SAFETY CONTINUED--Many of us on South Pennsylvania have young
children. Our youngest is only six-years-old. We try to teach
our children to cross only at the corner but there is no guarantee
that children won't be children. Also, there is not a light at
every corner. With a median the children only have to cross
against traffic coming from one direction and then have a safety
island before having to worry about traffic coming from the other
way. Have you ever tried, or even watched pedestrians trying, to
cross West Saginaw? It is literally a case of one taking one's
own life in one's hands!
COST--There must be better uses for my tax dollars than
removing the median on South Pennsylvania.
I apologize for such a long letter but I hope that all
factors will be considered before any action is taken to signifi-
cantly alter the character of South Pennsylvania.

I believe that the front page story on the lobbying
charge on Alfreda Schmidt on April 11 in the Lansing State
Journal did not consider all the facts : Mrs . Schmidt lives
in the Sycamore Park Subdivision--the area that is most
affected by cut-through traffic avoiding the light at
Pennsylvania and Mt . Hope . Alfreda has a petition with dozens
of signatures of homeowners in our subdivision , all concerned
about one thing--nonresidents cutting through and driving at
a high rate of speed across Lindbergh , up Alpha and Shubel .
Those taxpayers who signed that petition for a left-hand turn
arrow (and consequent median removal ) wanted their represent-
ative on the City Council to do something about our traffic
problem . They did not sign that petition to help Alfreda ' s
son . I feel sure that Alfreda ' s "lobbying" was for her
constituents and neighbors .
I think that investigation of the situation will easily
clear up this matter .

The section of South Pennsylvania in question forms the
western boundary of part of my county commissioner district.
Inasmuch as I use this route regularly, I have personally
felt for years that the median was more of an impediment
to good traffic flow than a help. Many times I have been
forced to drive several extra blocks when a left turn lane
on Pennsylvania would have made the task of getting where
I was going much easier and simpler .
Recently I have learned of residents ' petitioning efforts
to have the median removed without a special assessment.
I support the petition request as a sensible adjunct to
the planned pavement resurfacing , providing that a majority
of the residents immediately affected are in favor of this
course of action.

The section of Pennsylvania that is involve-4 here is primarily
residential in nature . Because of this , I feel the interests of
the residents should take precedence over the business interests
cf only two or three businesses located in .he same area . Since
the majority of the residents are in favor of kCening the median,
I believe the city should maintain its original plan of action,
which was to keep the median intact.
My greatest concern in the matter is the actions of Council-
member Alfreda Schmidt . I do not feel she is fairly representing
her ward members ' interests , since she is so blatantly involved
in her son ' s business interests . Her son, who owns The Hyacinth

Dear Mr. Blair,
We are writins you to voice our concern over Councilwoman Schmidts
involvement in the ongoing debate over whether or not the median on
S. Pennsylvania should be removed. As the homeowners of 1609 S.
Pennsylvania we feel she is not accurately representing us, as well
as many of our neighbors, on this issue. We believe Mrs. Schmidts
objectivity in this matter is clouded by the fact that her son, Jim
Schmidt, owner of the Hyacinth House Greenery 1800 S. Pennsylvania,
would like the median removed. We respect the fact that a mother
would like to see her son do well, but think she has neglected a large
number of her constituents in forming an opinion on this matter. It
is obvious by watching the City Council meeting that Mrs. Schmidt has
decided how to vote on this issue. Her son and his employees have
voiced their views week after week and now Mr. Schmidt has even joined
the coalition. Is this not a conflict of interest for Mrs. Schmidt?
How can we as tax payers know our views are being considered when
they conflict with her sons? Why would Mr. Schmidt, a homeowner not
directly affected by this proposal, collect signatures on a petition
in favor of removing the median?
This behavior seems unethical to many of us and makes us feel we have
an unfair disadvantage. We have signed a petition along with many of
our neighbors in favor of keeping the median. When this was submitted
to the City Council, Mrs. Schmidt immediately raised concerns over the
wording of the petition and how the signatures were collected. She
raised no questions when her husbands petition was submitted. Two of
our neighbors tried to meet with Mrs. Schmidt after a Council meeting
but we were told she was rude and unresponsive to their concerns.
We would like to know if the City of Lansing has any guidelines regarding
the conduct e_ its Council Members? Are Council Members allowed to vote
on proposals when it is obvious they have personal reasons for seeing
it passed or rejected? If there are no rules it may be wise to adopt
some so other neighborhoods do not feel the pressure we are feeling now.

residential and most of these homes are very well maintained. This section
should not be compared with other areas. These homes all sit very close
to the road, unlike homes on other sections of Pennsylvania where the
median has been removed.
Our neighborhood has been very straight forward and honest in discussing
this with the City Council. We are not only thinking of our personal
gain but also are concerned with how this will reflect on our neighborhood.
Removing the median would make our residential area one step closer to
becoming like S. Cedar streets ugly commercial concrete jungle.

Dear Council Members:
I am a resident of the City of Lansing and have been for
over 10 years . I recently have been viewing the Monday
night meetings that have been aired on a cable channel and I
noted that a great deal of time has been utilized by persons
regarding the median on South Pennsylvania. Please note
that I am not connected with any of the residents or
business owners whom are directly affected by this median.
I send you this memo in concern for what is being projected
to me as a resident of Lansing, Michigan.
I have carefully listened, with interest, to the valid
arguments presented to you from various members of the
business and residential community in the S . Pennsylvania
area. My concern lies with you, the City Council, regarding
the allocation of funds which are read to the public as
being utilized to the best interests of Lansing, Michigan.
My evaluation of the median situation is that it is in the
best interest of the City of Lansing to have this median
removed.
I have noted from listening to the arguments on Monday
nights that there are many good reasons for this removal at
the City " s expense. I do not frequently travel down S.
Pennsylvania. I have, however, been dismayed by this median
when I do travel this route. I have seen many near
accidents and witnessed "jumping" of the median on some
occasions when I am in the area. I to have personally
experienced a "bad experience" on behalf of this median when
I was trying to avoid an accident and got "hung up" on the
median. I will note that it would have been much easier and
a great deal safer for me, who was 8 months pregnant at the
time , if this median had been a left turn lane instead.
The arguments I have heard on Monday nights are so valid
that I am really surprised that no action has been taken on
the matter except that "it is under financial evaluation" .
I strongly believe that the only reason that there has not
been an agreement to remove the median at the City' s expense
is because it would be at the City' s expense. This is where
my decision for this memo has come from.
I , as a City tax payer, am lead to believe that my taxes are
to be allocated in what is in the best interest of the City
of Lansing among other factors . Why then won' t you agree to
remove this median at your expense? It is in the obvious
best interest to have it removed. The reasons are presented
to your meetings in a repetitive format so I do not wish to
repeat them here . I do, however, wish to express that not
only do the immediate residents and businesses involved wish
for this removal, but, other members of the City of Lansing
wish for this removal as well . To see that the City of
Lansing cares for its residents as well as business members
without a "price tag" would be greatly satisfying to us tax
payers . We would see that the City strives to better its
appearance and ease in traveling. We would see that our
taxes are being spent appropriately. We would see and feel
that the best interests of Lansing are not up to the people
to pay for , but, paid by the City through the taxes
collected for just such a purpose.
I have learned by watching the Monday night meetings that
other parts of Pennsylvania had the median removed at the
City' s expense. Why, then, won' t you remove the median in
question in the same manner? The only reason that I can
logically assume is because you just don' t want to spend the
money. I have heard from these aired meetings that if the
people want it removed then they can pay the special
assessments to have it removed. This only further proves my
disappointment that the City will do what is best for the
City at the people ' s out-of-pocket expense while we continue
to pay taxes that are supposed to cover these matters .
This concerns me a great deal. I feel that I am being taken
advantage of . The arguments which are against the removal
are weak at best. The arguments in favor of the median
removal are extremely valid and I , as a resident of the City
of Lansing, agree with this removal. It would improve the
appearance and greatly ease the travel in this part of our
fair City of Lansing, Michigan.
I appreciate your time in reading this memo in support of
the complete removal of the S. Pennsylvania median and I
hope to hear a response at your earliest convenience.

Per your request, I have consulted with David Berridge and Gerald
Spagnolly of the Transportation Division to determine the cost of
modifying the signal at South Pennsylvania and East Mt. Hope. The
maximum cost of changing this signal to a full eight-phase cycle is
$30,000.
In an eight-phase cycle, such as is used at the intersection of Jolly and
South Cedar, through traffic pairs turn red at the same time. But in the
left turn lanes, green light time is determined by demand. For example,
northbound-to-westbound traffic in the left turn lane will get their green
arrow at the same time as the south bound-to-eastbound traffic, but the
green arrow will last longer for whichever leg has more cars backed up.
The lesser-traffic turn lane's arrow will turn red and the opposite through
traffic lanes will turn green.
A more-detailed estimate will be available after an engineering study of
the current signal is performed. This process is estimated to take 30
days. Since the $30,000 estimate is a reliable maximum, this is the
figure that should be used for an appropriation of funds to change the
signal. If the engineering study reveals that fewer phases in the cycle
are needed to handle the traffic flow, enough money will still be there to
perform the needed work.

South Pennsylvania Avenue between I-496 and Mt . Hope Avenue is
. scheduled for improvements next month. The proposed improvements
will include curb and gutter repair, rotomilling , and total
street resurfacing. It does not include removal of the median .
The existing median is in fairly good condition, has proper
drainage flow, and does not impede traffic. It was our opinion
the median should stay to help retain the residential character
of the neighborhood and the aesthetic qualities of this segment .
Another benefit is to prevent cut through traffic from using the
residential streets east of Pennsylvania Avenue . In addition,
the extra expense would have far exceeded our original cost
estimates to complete the improvements for this segment of Penn.
Ave.
We have received bids for this project, and a public hearing is
scheduled for August 28, 1989 , for that segment of Pennsylvania
Avenue between Cavanaugh Rd. and Kendon Ave. , which will be
assessed.
The construction improvements should start no later than the week
of September 11 , 1989 .

HISTORY
The City of Lansing has been reconstructing and rehabilitating Pennsylvania
Avenue for the past several years. A contract was awarded to resurface the
roadway on Pennsylvania Avenue between Mount Hope Avenue and Fayette Avenue in
the fall of 1989. At that time the City was petitioned by a group of property
owners requesting that the median be removed and replaced with a center lane for
left turns. The decision was made to defer construction until the spring of 1990
and study the median removal issue.
Technical Analysis
There are several technical reasons for removal and for retention of the median.
Stated simply, removal of the median improves accessibility to adjacent
properties, improves the functionality of this section of Pennsylvania Avenue
as a major arterial street and eliminates median maintenance costs. Conversely,
this section of Pennsylvania Avenue is predominately residential and retention
of the median helps to preserve this atmosphere and softens the impacts of this
major arterial street and its traffic on the adjacent property owners. Attached
are detailed technical comments about removal and retention of the median.
Public Opinion Survey
The Transportation Division has surveyed the property owners and tenants adjacent
to the project area in order to gather public opinion about the removal of the
median. Attached is a report which details the results of the survey and the
public comments regarding this issue.
In summary, 62% of ,the respondents opposed median removal and 38% favored
removal. 85% of the respondents opposed paying for the median removal through
a special assessment and 13% indicated a willingness to pay for removal. The
survey response rate was 50% of all property owners and tenants.
Aggregate Public Opinion
There have been three methods of public opinion input regarding this issue.
These include: a petition circulated in the fall of 1989, the mail survey
detailed above and a petition circulated in lurch 1990. The results have been
plotted on a strip map and are attached. There are 58 properties comprising

approximately 3188 lineal feet of frontage on Pennsylvania Avenue.
In summary, 48% of the property owners (28) favor retaining the median, 23% of
the property owners (13) favor removal of the median and 29% of the property
owners ( 17) have offered no response to the surveys. These opinions have been
weighted in terms of frontage on Pennsylvania Avenue represented by each property
owner's opinion. 43.5% of the frontage favors retaining the median, 34.5% of
the frontage favors removal of the median and 22% of the frontage has offered
no response.
Funding
The estimated cost for median removal is $77,000. This cost has not been
budgeted as part of the existing project. Funds for street improvements are
limited and the median removal must compete with other projects for funding.
If funding for street projects were unlimited, then the median removal issue
could be reduced to a matter of public opinion versus traffic flow benefits.
Summary
1. Funds are not budgeted for removal at the present time.
2. The removal project should compete with other system deficiencies for
funding.
3. There are traffic flow benefits if the median is removed. However, most
of the benefits are related to property accessibility. Benefits to through
traffic are limited.
4. This section of Pennsylvania Avenue operates satisfactorily given the
existing capacity restrictions related to the intersection at Mount Hope
Avenue.
5. There is general public sentiment for retention of the median.
Recommendation
It is recommended that the median be retained at this time.

6 . Provides unlimited storage for left turn vehicles, especially
at signalized intersections ( i.e. Mt. Hope Avenue) .
7 . Median is not fully developed to adequately provide for
indirect left turn (i .e. u-turns) . Therefore, all
intersections are open. This median does not provide the same
safety benefits of separation of traffic as does Edgewood
Boulevard median.

from Fayette to Mount Hope in the spring of 1990. The city has been approached

SURVEY COMMENTS
004. The median is an attractive break from the hard surface road. It produces
a more serene setting that should be preserved and enhanced. (Supports
retention. )
008. The median is a safety feature for children crossing to the ballpark.
(Supports retention. )
010. It would be a lot easier to get in and out of my driveway. Now I have to
go around the block or in someone else' s driveway to turn around, this in
itself creates a traffic hazard. (Supports removal. )
013. This property has no drive on Pennsylvania, only frontage. It would be
of no benefit to this property. (Supports retention. )
014. While you're resurfacing where are residents of Pennsylvania Ave. to park?
It would be helpful if you attacked this problem rather than the nonsense
about the median. (Supports retention. )
017. We certainly agree that this is not worthwhile. (Supports retention. )
018. We strongly disagree with reason (4) . We feel the benefits to traffic
flow resulting from the removal of the median will be enormous, especially
to business customers, but also to residents. We also feel that (5) is off
the mark as the median dramatically hinders access to homes; we fail to
understand how such an inconvenience can preserve the residential character
of this section of Pennsylvania. (Supports removal. )
020. Character of the neighborhood has changed dramatically in the past five
years towards commercial/professional usage and boulevard is less
appropriate than in past. (Supports removal. )
021. First, I would like to make the observation that this requested survey
unfairly represents the justification for the removal of the median. It
is not mentioned that there will be city funds spent on the repair of the
median where needed, and indeed there are many. Second, it does not
mention that the removal of the median would considerably reduce the "cut
through" traffic in the adjoining neighborhoods. Third, it does not
mention how dangerous the median is for all traffic, not to mention that
the median and the heavy traffic combination on Pennsylvania restricts the
flow of emergency vehicles attempting to get to Lansing General Hospital.
In answer to paragraph 2 of the letter requesting survey information,
which lists reasons for there being no plans to remove the median.

at the very least, a false statement.
2. If there are plans to improve landscaping on the median, why is
it that Parks and Recreation Department, city landscape architects
and public service department does not have any knowledge of tree
plantings on the South Pennsylvania Avenue median.
3. It is strictly the opinion of city bureaucrats who obviously do
not live, work or travel in this area that the median removal is
costly and not necessary. I would also point out again that the
city is planning to spend taxpayer funds on the repair of the
median and that the maintenance of the median, although being
poor, is an on-going expense for the city.
4. The opinion that traffic flow benefits are limited is the
opinion of a city bureaucrat who does not live or do business in
this area.
5. The view that retention of the median helps to preserve the
residential character was obviously not considered when the median
was removed between Potter Park and Hazel Street, and between 496
and Kalamazoo, and between Kalamazoo and Michigan, and between
Michigan and Saginaw, and between Saginaw and Grand River Avenue.
These areas by far are considered residential areas and are zoned
residential. The same city bureaucrats who encouraged the removal
of the median in these areas are the same people who are fighting
to save the median now. Please face the fact that Pennsylvania
is a main thoroughfare for all Lansing area residents. Their
opinions and safety should also be taken into consideration.
My suggestion would be that when any major improvements are being
considered for South Pennsylvania Avenue, the median should be removed at
that time and at no cost to property owners. DO THE JOB RIGHT! ! ! ! !

022. It does not seem fair that property owners be charged to remove the median
(which is in terrible condition in many places) when there was no charge
to property owners when the median was removed on the northern part of
Pennsylvania. I am also concerned that emergency vehicles are impeded by
the median during heavy traffic hours. I do not agree with any of the
statements in paragraph 2 above. It is my opinion as a property owner,
that the median is a nuisance, an eyesore, and a hazard. The city would
be well advised to remove the median which would be less costly in the long
run, than to repair, landscape, and maintain the median. (Supports

023. It is unfair to assess property owners for the same upgrade & improvements
that property owners on North & South Pennsylvania received without
assessment. The median is unsightly, unsafe, & inconvenient to all
citizens not just Pennsylvania residents & businesses.-Please consider the
citizens of Lansing & their opinions & needs. (This questionnaire was
obviously prepared by someone that wants the median to remain, despite all

024. Reasons for not removing the median are good ones. (Supports retention. )
025. You have to mow the grass-if you planted trees they would have to be
pruned-why not pay to get rid of the bother now. And as far as taxing me
to pay for the removal, I think the city does a horrendous job of snow
removal so why don't you put that wasted money in the pot to pay for the
median removal. (Supports removal. )
026. We would like to keep the residential flavor. We would like to see improved
landscaping. (Supports retention. )
030. The median is a problem for me. It is a real hassle. (Supports removal. )
031. I believe the median-removal would only benefit the few businesses located

effort spent on it. I very much endorse the idea of planting trees in the

retain median (as is) but plant trees-in the 47 years we've lived (existed)
here (1606) you've tried unsuccessfully to grow trees 3 times-so if its

height to help retain moisture. Estimated cost-?-prefer as is-mowing.

matter which involves the removal of the remaining median on South
Pennsylvania Avenue. The Board wishes to inquire of your
department whether removal of the median would affect the value of
properties located at 1720, 1726 and 1800 South Pennsylvania
Avenue, and if so, to what extent. Additionally, the Board. wishes
to inquire whether removal of the median would affect the values
of the properties located at 1609 and 1610 South Pennsylvania
Avenue, and if so, to what extent.
Our next meeting is scheduled for Monday, May 21 , 1990 at 2 : 00
p.m. in the Finance Office Conference Room. It would be
appreciated if your report was reduced to writing and supplied to
