I, Patrick E. Lindemann, .first being duly sworn deposes and says
that I have been contacted by a solid waste handling firm regarding
possible employment. No decision has been made but I will be
having further discussions. Since. I am the Chairperson of the Ad
Hoc Committee on recycling, and the Public Service Committee of
Council I am now informing you of this potential conflict. If I
take a position with the firm, I will immediately inform you.

COurC:iln:er,iber Lindemann explained that the delay in submission
of the form was attributable to your office which was preparing
same, and to a Cl o week vacation he had taken in the interim. Ue.
agreed to have the form submitted by Monday, February 4 , 1.991 ,
however. I was surprised, therefore, when you indicated on the
telephone WednesOay that lie might refuse to make further disclosure
of details of .his potential conflict of i.r.terest on the grounds
that the official form asks for irforrnation that 4 s not applicable
to his situation.
The official form was adopted by the Board to assist persons
making a disclosure by providing a checklist of the' information
most often, needed by the Board to evaluate a conflict situation.
It follows the language of the existing City Ethics Ordinance, but
has peen repeatedly used to raise issues not addressed by the
Ordinance, without problem up to now. The form clearly anticipates
that you might have to supplement answer.s . to Question 2 with
additional information relevant to the investigation of the issue
presented. Even if you believe that Questions 2. a . to d . do not
apply, therefore, there are still Questions 2.e. and 3 which do.
Furthermore, Question 4 is applicable, as the Councilmember has the
burden of establishing that he can continue in his official. duties

can the committees despite any conflict of interest. It is expected
that the disclosure will be sufficiently detailed and complete
as not to require further documentation or. i.nt�:�—1%;

standards . The- disclosure becomes part of the public record,
must, therefore, stand on its own to adequatel- e:. plain ':In
situation.
The Board has recently ruled that a complete and prompt
disclosure on the Board' s form must be filed even if the si.tuat l oi-i
involves only an apparent conflict of interest that is at best only
a potential conflict of interest. This situation would appear to
meet at least that minimum criteria. Mr. Lindemann was supplied
a copy of Opinion No. 11 when it was issued October 9 , 1990. If
he does not still -have his, a copy may be obtained from the City
Clerk.
After filinq the disclosure., if. further clarifi_c,ation or
discussJon of the matter_ is called for, you and the Counc. :lm6mhE,".r
will be invited to meet with the Beard of Ethics as you. offeree. t o
do. However, the Board requires submission of the disclosure as
a first step. Your anticipated cooperation, therefore, in helping
the Councilmember meet his deadline is appreciated.

Dear Council President Belen:
Since most of t11--ie members. of the Council have direct or
indirect affiliations with at least one local group outside their
government post, the Board of Ethics requests that you remind the
Council, at your early convenience, that allocation or
appropriation of funds to persons, groups or organizations with
which a Councilmember is associated may give rise to conflicts of
interest. The Board of Ethics has previously opined that when a
possible conflict exists, the applicable ethical standard requires
. disclosure at or before the first time the matter is presented. to
City government, * whether at the Council level or before a
subsidiary governing body, such as a Committee, Board, Agency,
Department or Commission. ' Additio-nally, the Councilmember with the
conflict is required to abstain fromany contact with any member
of City government concerning the matter.
This letter does not imply- that any Councilmember has a
conflict, but rather is intended to spur the Council to be
sensitive to ' possible conflicts that may arise in the budgeting
process. As always, the Board remains available to answer any
questions individual Councilmembers or the Council as a whole may
have respecting any possible conflicts of interests or the
applicability of the ethics rules to their situation.

Re: Patrick Lindemann
Dear Mr. Mertz:
Please be informed that Mr. Lindemann filed an Affidavit of
Disclosure at my suggestion because he had been contacted by a
solid waste handling firm about possible employment. At that time
no decision had been made. Councilman Lindemann is no longer
considering such employment.
Mr. Lindemann was presented then with a form Affidavit of
Disclosure of a Conflict of Interest and requested to execute that
document. I have reviewed the document. There is nothing in the
document which is applicable. Mr. Lindemann does not have a
conflict of interest and he is not presently associated with any
business as defined in the Ordinance 290. 02 (b) , (c) and (d) .
