HomeMy WebLinkAboutKulhanekDonald Affidavit Disclosure 2015 Mr. Kulhanek, I am writing you in response to the Ethics Boards questions as stated in your July 6 letter. I will attempt to address the questions in order: 1. I personally paid for the training, along with the travel expenses and used my own time off from work, to obtain my Federal Certification for commercial vehicle inspection. I did the same with the truck crash investigation courses I have taken. It is these courses and certifications that have given me the credentials and specialty needed for consulting. 2. Commercial Traffic Safety Consulting proposes to train law enforcement officers at outside facilities. Truck Safety Services proposes to work as a consultant for businesses at their location. Neither will use city facilities. As someone who enjoys the city, I would like to be able to use a private facility within city limits,bringing more revenue into the city. I do not see how such a contract could violate ethical standards. 3. Commercial Traffic Safety Consulting is a group focused on training law enforcement officers. Classes are set up to provide training on how to enforce commercial vehicle regulations. Truck Safety Services works the private sector. Classes are set to teach commercial vehicle regulations to drivers, mechanics, and company officials, about the commercial regulations and their responsibilities. It should be noted that nothing in my job requires that I use my skill set or specialized training. I have performed functions for the city voluntarily. As the city has decided not to use those skills, I am requesting that I be allowed to use them on my own. 4. My registered dba is Beattie Reconstruction. This dba has entered an agreement with Commercial Traffic Safety Consulting and been offered a partnership in Truck Safety Services. (Truck Safety Services is currently suffering financial difficulties. If that company folds, I would likely seek a similar partnership, knowing that I would need to update the city on those activities.) 5. Of course it is possible not to say something. I can simply say that I have worked as a police officer for a municipality. My federal certifications were obtained through the Tennessee Highway Patrol and my truck crash investigation training comes from the State of Pennsylvania. I do not have flyers that mention any of this, nor do I intend to mention the city. Additionally, I should like to mention that my first request was for me to work as Beattie Reconstruction. MSU had asked that I join their training program for police officers in crash investigation. I did not include that in this request because enrollment is down and they do not currently need another instructor. However, teaching is a portion of being considered an expert witness for court purposes. As the city's leading crash investigator, this would be quite beneficial for the city. If the Board deems it appropriate, I would like to pursue that avenue as well. In my capacity as Chief Deputy City Attorney, I supervise attorneys who provide legal advice to the Office of Code Compliance ("OCC"). I review or approve legal opinions which may impact the operations and enforcement activity of the OCC, and my wife may be impacted by any change in operations or enforcement activity. It is my intent to comply with the Michigan Rules of Professional Conduct, which governs attorneys practicing law, and which would require me to recuse myself from any matter which gives rise to a conflict of interest.
