I am an elected or appointed officer or employee of the City of Lansing, holding the position of chief Mechanical InspectogTitle) in the Planning & Neighborhood Development Department. CONTINUED) 3. 1 have a conflict between a personal interest and the public interest, the nature of which is disclosed below: (Charter 5-505.2; Lansing Code 290.04 (1)): I have been offered a position as an instructor to conduct Mechanical Code classes outside of the State of Michigan. I believe that this employment does not violate the City's Ethics Ordinance and is in - complicince with rG 412 datede-teber 22-, 1990, whic-.hpgrtains to inspectors work outside the office. However since I am an inspector in the Building Safety Office I would like to disclose this employment to ensurethat the Board is cognizant of this activity an no impropriety exists. 4. 1 have a financial interest in a matter proposed to be acted upon by the City of. Lansing as described below (Lansing Code 290.04(I): N/A (Paragraph 4. Expansion is our plan beginning in the Fall of this year. Our plans include adding instructors to teach HVAC code, system design, and service troubleshooting courses. One of our possible instructors works for your department; Gary Biddinger. I have known Gary Biddinger for about 10 years and have sat through some of his courses at Lansing Community College and witnessed his presentations at many Lansing Chapter of ACCA meetings during this time. I would like your approval to discuss hiring Gary to instruct code classes for us outside of Michigan. All courses will be conducted on Saturdays and I would not think there would be a conflict with the City of Lansing. He would only work about 10 Saturdays a year. Please let me know in writing whether I may talk to Gary and offer him a part time position. THE DISCLOSURE INDICATES THAT NO WORK OF THAT KIND IS DONE BY THE INDIVIDUAL OR HIS BUSINESS FOR ANY INDIVIDUAL OR BUSINESS IN THE CITY OF LANSING, NO PERMITS FROM THE CITY OF LANSING ARE INVOLVED, AND NO APPROVALS OR INSPECTIONS BY THE CITY OF LANSING ARE INVOLVED. OPINION AFTER REVIEWING STATE LAW, THE CITY CHARTER AND THE CITYS ETHICS ORDINANCE, THE BOARD OF ETHICS CONCLUDES THAT THE CONDUCT WHICH WAS THE SUBJECT OF THE EMPLOYEES DISCLOSURE DOES NOT GIVE RISE TO A CONFLICT OF INTEREST AS LONG AS NO WORK IS DONE IN THE CITY OF LANSING, NO PERMITS FROM THE CITY ARE INVOLVED AND THE WORK IS INSPECTED AND APPROVED BY JURISDICTIONS OTHER THAN THE CITY OF LANSING.
