(SEG) under their Level of Effort (LOE) contract to provide professional engineering services to design an exposure barrier to mitigate public health and environmental hazards posed by contaminated soils at the Foster Street Abandoned Plating Site (Site ID # 330016) in the City of Lansing, .Ingham County, Michigan. This Remedial Action Plan (RAP) will serve as a planning and guidance document ( Work Plan) detailing the scope of work to be performed during the project and as the document for the public notification process required under section 20d of part 201 (Environmental Remediation) of the Michigan Natural Resources and Environmental Protection Act (NREPA), PA 451 of 1994. Development of this RAP was based upon the August 1996 Remedial Alternatives Evaluation for the Foster Street Abandoned Plating Site prepared by ABB Environmental Services of Farmington • Hills, Michigan. SEG has prepared this RAP to achieve the following objectives which were outlined in the scope of work developed during the Kick-off meeting with MDEQ and subsequent site visit on November 7, 1996. These objectives are as follows: 1. Provide design plans and specifications to construct an earthen cap over soils at the site known to be contaminated with metals. 2. Provide engineering guidelines to evaluate and abandon one damaged monitoring well and a drain tile which is known to traverse at least part of the site. 3. Solicit bids from contractors to complete the work in objectives 1 and 2 above, and make a recommendation for the award of contract. 4. Provide a scope of work and a preliminary budget for a construction oversight work plan for the implementation of the remedial action. In addition to the four (4) objectives stated above which will be performed by SEG, the RAP also includes a Qroundwater monitoring plan which will be implemented by the MDEQ. The monitoring plan will consist of the following components: 1) Four of the existing monitor wells on the site, MW-3, MW-7, MW-8 and MW-11, will 1-1 • L-1 Foster Street Plating Site Remedial Action Plan Section 1 - Revision 0 January 1997 be monitored each year in May. Each well will be bailed and sampled using standard protocols. Static water levels will be recorded to establish groundwater flow direction. 2) The groundwater samples will be analyzed for the following dissolved metals: arsenic, barium, chromium and zinc. 3) If the levels of contaminants in groundwater exceed the appropriate criteria, further investigation will be undertaken to determine if contaminants are leaving the site. If contaminants are determined to be leaving the site, other measures to control them will be evaluated for implementation. 4) After five years of monitoring, all of the data will be evaluated to determine future groundwater monitoring needs. The monitoring concentrations is program may be discontinued if a decreasing trend in contaminantindicated. 1.2 Scope of Work The scope of work provided by SEG and included in Appendix A includes: Task 1 Review of Past Work Task 2 Selective Site Survey Task 3 Evaluation, Design and Specification Standards for Well and Drain Tile Abandonment Task 4 Design and Specification Standards for Excavating and Capping Site Task 5 Prepare bid package and solicit bids Task 6 Construction Oversight Proposal 1.3 Work Plan Outline The work plan has been divided into multiple sections: Section 1 introduces the project and scope of work various tasks. 1-2 I Foster Street Platin- Site Remedial Action Plan Section I - Revision 0 January 1997 Section 2 provides background information on the project. Section 3 highlights the project planning. Section 4 incorporates tasks 1 through 4: review of past work, selective site survey, design and specification for well and drain tile abandonment, and design and specification for excavation and capping of contaminated areas at the site. Section 5 discusses pre -bid activities, bid evaluation, and bid recommendation (Task 5). Section 6 defines Construction Oversight Proposal (Task 6). Section 7 details data recording and storage. Section 8 discusses the Quality Assurance Project Plan. Section 9 reviews the Health and Safety Plan. Section 10 specifies project management, project management reports, schedule, labor and personnel requirements. Section 11 provides estimated costs for implementing the work plan. 1-3 • SECTION 2 PROJECT BACKGROUND • Uj Foster Street Plating Site Remedial Action Plan Section 1 - Revision 0 January 1997 • Foster Street Plating Site Remedial Action Plan Section 2 - Revision 0 December 1996 2.0 PROJECT BACKGROUND 2.1 Site Location The Foster Street Abandoned Plating Site is located in Section 23, Township 4 North, Range 2 West, City of Lansing, Ingham County, Michigan. Figure 2-1 shows the site location. The site is situated at the southern end of Foster Street. It is a 1.6 acre parcel surrounding the cul-de-sac at the end of Foster Street. It* is bounded by residences on the north and west, interstate I-496 right of way on the south, and Francis Avenue to the east. Figure 2-2 shows the existing site layout. Major site features consist of the I-496 embankment to the south, and 2 shallow depressions located south and east of the cul-de-sac. Vegetative cover consists of small and large trees and brush. There are no designated vehicle entrances to the site. 2.2 Project History According to documentation received by 'the MDEQ, the majority of the project area is undeveloped property owned by the City of Lansing and is designated as a neighborhood park. The rest of the area is owned by the State of Michigan and is the former site of a metal plating facility. The metal plating facility was demolished and removed in 1983. In 1984, the MDEQ (formerly known as the MDNR) identified the presence of contaminated soil at the former facility location. In 1985, approximately 150 cubic yards of surface soil was excavated from the site for off -site disposal. In 1991 and 1992, the environmental consulting firm of Roy F. Weston, Inc. was hired by MDEQ to conduct a preliminary remedial investigation to assess the nature and extent of contamination in the groundwater and soil. It was determined that there was a presence of arsenic at concentrations above applicable cleanup criteria in the soil and groundwater, but the nature and extent was not fully delineated. In 1994, under contract of the MDEQ, the environmental consulting firm of ABB Environmental Services of Michigan, Inc. performed additional evaluation of the contaminants for the purpose of developing and evaluating potential remedial alternatives for the protection of human health and environment. Additional site visits may be necessary during the execution of the Work Plan. 3.3 Administrative Tasks • SEG will preform the necessary reporting, cost tracking and scheduling tasks during the implementation of the work plan. 3-1 • SECTION 4 SITE DESIGN (TASKS 1-4) • • • Foster Street Platine Site Remedial Action Plan Section 4- Revision 0 January 1997 4.0 SITE DESIGN (TASKS 1-4) 4.1 Review of Past Work (Task 1) Existing reports and drawings will be reviewed to determine the availability of information needed to develop design plans and specifications for the proposed remedial work. Electronic files, provided by MDEQ staff, of existing site drawings will be utilized to develop design drawings. 4.2 Selective Site Survey (Task 2) In order to provide proper drainage and the restoration of certain areas to their existing condition, additional survey information will be recommended to achieve the intent of the design and help minimize future problems. The following survey information will be required to complete the site design. SEG will utilize MDEQ vertical and horizontal controls, after verification, to obtain the following: 1. Define top of curb elevation along Foster Avenue cul-de-sac to help define drainage constraints for design purposes. 2. Obtain vertical elevations of the contaminated area to be excavated and replaced in the southeast corner of the site to provide proper restoration and eliminate future ponding at the site. 3. Conduct selective elevation survey of potential drainage concern areas prior to initiation of design. 4. Locate and stake out damaged tile drain. 4.3 Design and Specification Standards for Well and Drain Tile Abandonment (Task 3) 4.3.1 Monitoring Well Abandonment SEG will evaluate the condition of damaged well no. 5 and provide Details and specifications for all wells recommended for abandonment. 4.3.2 Drain Tile Abandonment SEG will assist MDEQ staff in locating the broken drain tile traversing the site and help define i the extent of the section to be abandoned. Based on the available information, details and 4-1 Foster Street Platin_ Site Remedial Action Plan Section 4- Revision 0 January 1997 specifications will be developed for the proper abandonment and/or repair of the damaged drain tile. 4.4 Design and Specifications for Excavation and Capping (Task 4) 4.4.1 Excavation Plans and specifications will be developed to show the areas to be excavated for the purpose of providing an exposure barrier to contaminated soils, all of which will be left on site. No contaminated soils will be disposed off site. Contaminated soils from topographically high areas will be moved to topographically low areas and will be covered by a clay cap as outlined in the August 1996 Remedial Alternatives Evaluation for the Foster Street Abandoned Plating Site prepared by ABB Environmental Services, Inc. of Farmington Hills, Michigan. Verification sampling for contaminated soils which are moved onsite in order to establish a suitable grade for storm water runoff will be conducted according to the MDNR Guidance Document, April 1994 (VSR). Based upon the results of these analyses, additional excavation and movement of contaminated soils, and subsequent verification sampling may be necessary. 0 4.4.2 Capping Establish an earthen cap with a clay layer which is as thick as possible up to a maximum of eighteen (18) inches. The clay portion of the cap must be at a minimum six (6) inches thick everywhere. The clay portion .of the cap will be topped by six (6) inches of topsoil upon which turf cover will be established which will resist damage from flooding. The Earthen cap must be graded to provide proper drainage at the site to channel storm water runoff to catch basins in the Foster street cul-de-sac. The City of Lansing has committed to the installation of two (2) catch basins within the Foster street cul-de-sac which will be connected to storm drain outlets by July 15, 1997. Compaction of the clay portion of the earthen cap will be limited to the extent needed to prevent settling. Compaction of the clay portion of the cap to landfill cap specifications has been deemed unnecessary by the MDEQ. 4.4.3 Grading A grading plan will be devised based on the cap cross-section, slope stability, constructibility, soil erosion susceptibility and cost. The grading plan will be approved by MDEQ prior to finalizing 4-2 Foster Street Plating Site Remedial Action Plan Section 4- Revision 0 January 1997 the design. Cross sections, contouring (1' intervals), and cut and fill calculations will be provided. SEG will also coordinate with City of Lansing Forester and with Michigan State University Forestry experts to preserve as many trees on site as possible. SEG will assist MDEQ in incorporating the soil washing technique being formulated by Michigan State University experts and MDEQ staff to remove contaminated soils from the roots of trees along the perimeter of the caps which are deemed worthy of saving. SEG will also coordinate the replanting of trees at the site with City of Lansing Forester. 4.4.4 Storm water Management/Soil Erosion and Sedimentation Control (SESC) Based on the evaluation of the existing topography, a stormwater management/soil erosion and sedimentation control (SESC) plan will be submitted to MDEQ for approval. SEG will assist MDEQ in obtaining soil erosion control permit from the City of Lansing if required. The plan will be consistent with all local, state , and federal regulations. Upon approval, all necessary design and specifications to implement the plan will be devised. The plan will include at a minimum controls to prevent offsite transmittal of sediments through runoff and wind erosion. 4.5 Construction Drawings and Specifications All of the elements described in Task 1 through 4 will be incorporated into a design package. This package will include a set of specifications and construction drawings with all necessary grading plans, survey information, quantities, cross sections, details, and general instructions to the Contractor for public bidding. The MDEQ will be supplied with 1 reproducible set of construction drawings and specifications, for copying, of the final version. A computer disk(s) will also be supplied for the final version of the construction drawings and specifications. 4-3 11 • SECTION 5 PREPARE BID PACKAGE AND SOLICIT BIDS (TASK 5) i, 1 Foster Street Platine Site Remedial Action Plan Section 5 - Revision 0 January 1997 5.0 PREPARE BID PACKAGE AND SOLICIT BIDS (TASK 5) 5.1 Pre -bid Activities SEG will prepare bid specifications package, attend pre -bid meeting, develop contract addendums, and distribute plans and specifications. 5.2 Bid Evaluation and Recommendation SEG will review the qualifications of the bidding contractors, evaluate the received bids and make an award recommendation of the qualified low bid contractor to perform the work. SEG will attend a pre -award meeting to review the contractors qualifications and understanding of the project. SEG will also be available to provide technical support as needed during the process. • r '9' • SECTION 6 CONSTRUCTION OVERSIGHT PROPOSAL (TASK 6) Foster Street Platine Site Remedial Action Plan Section 6 - Revision 0 January 1997 6.0 CONSTRUCTION OVERSIGHT Construction oversight will be a part of a separate contract order. SEG will submit a scope of work and a preliminary budget for construction oversight during the bidletting process in order to allow MDEQ staff the time for review and approval prior to the start of construction and they will include the following items: • Preconstruction Meeting • Submittal • Construction Oversight/Observation • Quality Assurance Testing • Biweekly Project Meetings • Final Report • Administrative Tasks - ;, • SECTION 7 DATA RECORDING AND STORAGE 0 I • ,7 Foster Street Plating Site Remedial Action Plan Section 7 - Revision 0 January 1997 7.0 DATA RECORDING AND STORAGE The purpose of document control is to assure that all documents for the project are accounted for upon project completion. Accountable documents include log books, field equipment calibration records, data records, field forms, correspondence, sample tags, graphs, figures, chain of custody records, and photographs. All field staff and equipment operators/maintainers will keep detailed records of inspection, investigation, photographs taken, and review notes. These documents will be stored in the project files. The Standard field forms are located in Appendix C. Data generated during• site and office activities will be maintained in a central file at SEG, Inc. The project file will include a hard copy of all project related paperwork, communication, documents and reports. 7-1 SECTION 8 QUALITY ASSURANCE PROJECT PLAN 171 r: 4 r • Foster Street Platin_ Site Remedial action Plan Section 3 - Revision 0 lanuan, 1997 8.0 QUALITY ASSURANCE PROJECT PLAN The Quality Assurance Project Plan (QAPP) for this project will fulfill MDEQ requirements. The document will refer to or include site -specific details on sampling techniques, field testing, chain of custody, sample handling, shipping, record keeping and documentation. The QAPP is as follows: 8.1 Introduction This Quality Assurance Project Plan (QAPP) will serve as a guidance document detailing the Quality Assurance/Quality Control (QA/QC) measures to be adhered to while conducting this project. 8.1.1 Purpose The purpose of the QAPP is to produce reliable data which will be generated throughout the study by: • Validating data obtained • Providing mechanisms for ongoing control of data quality • Evaluating data quality in terms of precision, accuracy, reproducibility and data capture (recovery), and • Providing usable, quantitative data for analysis, interpretation and decision -making 8.1.2 Scope The following sections describe QAPP methods utilized to enhance data quality during the performance evaluation of soil sampling at the project site. The QA/QC procedures to be used for field operations and laboratory analysis are summarized below: Field QA/QC methods include: • Sample Custody (sample documentation, logging, and shipment) • Field Measures of QA/QC • Field Sampling Procedures • Standard Operating Procedures (SOPS) for field equipment calibration, operation, and maintenance 8-1 Foster Street Plating Site Remedial Action Plan Section 8 - Revision 0 January 1997 8.2 Quality Assurance Objectives for Data Measurement The overall QA objective is to develop and implement procedures for field sampling, investigation and reporting that will provide accurate data and document quality. Data quality objectives (DQO) for the measurement of data in terms of precision, accuracy, -, representation, completeness, and comparability (PARCC) are established to ensure data collection is sufficient and of adequate quality for its intended use. Data collected and analyzed in conformance with the DQO process described in the QAPP will be used in assessing the uncertainty associated with any decisions related to a site. Specific objectives relative to this project include those established to characterize and evaluate soil quality. Details are discussed in the subsequent sections. 8.3 Calibration Procedures and Frequency 8.3.1 Calibration of Field Instruments Calibration of field instruments will be performed according to the procedures specified by the manufacturer's instrument operation manual. Instrument operation manuals and all necessary accessories and/or solutions to perform the calibration will be furnished with each instrument. Prior to their use, the instruments will be inspected and calibrated daily by the field technician. Calibration checks will be documented on the appropriate field sampling form and in the site log book. 8.4 Data Reduction, Validation and Reporting r Data reduction, evaluation and reporting of those samples analyzed by the DLZ laboratory will be completed in accordance with MDEQ standard operating procedures and ASTM Standards. Data reduction is the process which takes the raw data generated by the different instrumentation, both in the laboratory and in the field, and converts these data into a usable form. ` The laboratory will supply the consultant with a data package including the analytical results. SEG will then review the package and validate the results with respect to the project objectives. i g_2 gap • SECTION 9 HEALTH AND SAFETY PLAN 0 t • ..i r x r J L ?S Foster Street Plating Site Remedial Action Plan Section 10 - Revision 0 January 1997 9.0 HEALTH RIND SAFETY PLAN A Health and Safety Plan (HASP) provides guidelines and procedures to protect the health and safety of personnel conducting field activities. A copy of the site specific HASP is presented in Appendix D. This plan is based on information available to date and is subject to revision as new data and information on potential health and safety hazards at the site become available. 9-1 r .• SECTION 10 PROJECT MANAGEMENT • Foster Street Platine Site Remedial Action Plan Section 10 - Revision 0 Januan, 1997 10.0 PROJECT MANAGEMENT 10.1 Project Organization and Key Personnel If the MDEQ approves SEG to implement this work plan, the following project organization and key personnel will be used. Overall organization and personnel for the project are depicted in Figure 10-1. All lines of communication, management activities, and technical direction within the project team will follow this organization and arrangement. Directions/communications from the MDEQ Project Manager, Mr. Wayne Morse, to SEG will be directed through the Project Director or the Site Manager depending on the nature of the subject matter. MDEQ Project Manager will be updated weekly of the week's activities by telephone from the Site Manager. Any proposed changes in personnel of the project team will be subject to the approval of MDEQ Project Manager. • Mr. Dayal Saran will serve as SEG Project Director for the project. Mr. Samir Matta will serve as the Site Manager. Engineering services will be provided under the direction of Mr. Samir Matta and geological services will be provided under the direction of Mr. Tom Pavlik. Technical review will be performed by Mr. Scott Lidgard. Supporting staff from our environmental group pool, which includes geologists, engineers and chemists, will be available on an as needed basis. Resumes of key personnel are included in Appendix E. 10.2 Project Management Reports During field activities, a weekly summary report will be prepared and submitted to the MDEQ Project Manager. The report will include details of the field activities during the week, problems which were encountered and if the field work schedule is being met. During the time period when there is no field activity, a monthly summary report will be prepared. The report will indicate office activities which have occurred, such as file/report review, report writing and modeling. 10.3 Schedule Provided in Table 10-1 is the anticipated schedule for the proposed work. These storm water drains will be constructed in the Foster St. cul- de-sac by the City of Lansing. The clay portion of the cap must be a minimum of 6 inches thick everywhere. Compaction of clay cap necessary only to degree to prevent settling. Compaction to landfill cap specifications is not necessary. Cap will have 6 inches of topsoil to support turf cover which will resist damag,e from flooding. —� - Work with foresters to protect trees as much as possible 4. Coordinate with City of Lansing Forester and with Michigan State University Forestry experts to preserve as many trees on site as possible. Use soil washing technique to remove contaminated soils from the roots of trees on the perimeter of the caps which are deemed worthy of saving. By execution of this Agreement the MDEQ and the City stipulate and agree to be bound by all of the recitals, • terms and conditions herein. RECITALS Whereas, any remedial action undertaken pursuant to Section 20120b(3) of Part 201 of the Natural Resources and Environmental Protection Act (NREPA), 1994 PA 451, as amended, MCL 324.20101 et se , or the Part 201 Rules, 1990 AACS R 299.5101 et sec , which may include land use or resource use restrictions, monitoring, operation and maintenance, installation of permanent markers and continued financial responsibility, if determined by the MDEQ as necessary, shall be stipulated in a legally enforceable agreement with the MDEQ; and Whereas, this Agreement pertains to the Facility located in the City of Lansing, County of Ingham, State of Michigan described in Attachment A and commonly known as the Foster Street Abandoned Plating Site; and Whereas, the RAP for a Limited Residential Remedy submitted by the Snell Environmental Group on January 14, 1997, as approved by MDEQ, including its attachments and any MDEQ approved modifications thereto, complies with applicable requirements under Part 201 of NREPA and the Part 201 administrative rules; and Whereas, this Agreement satisfies the requirements of Section 20120b(3) of NREPA, as • amended in June 1995. Based on the foregoing Recitals the MDEQ and the City hereby stipulate and agree as follows: DRAFT I. PARTIES BOUND 1.1 This Agreement shall apply to and be binding upon MDEQ and the City and its successors and assigns. No change in ownership or corporate status of the City shall in any way alter the City's responsibilities under this Agreement. Any agreement assigning or transferring the rights, duties and benefits of this Agreement shall provide that the terms and conditions of this Agreement are binding upon the assignee or transferee. The City shall provide the MDEQ with written notice of the intent to transfer ownership of part or all of their ownership interest in the property at the Foster Street Abandoned Plating Site. Such transfer or assignment shall not occur without adequate and complete provision for the continued operation and maintenance of the remedy and the prevention of exposures as described in the Restrictive Covenant. 1.2 The signatories to this Agreement certify that they are authorized to execute and legally bind the parties they represent. • '\ II. DEFINITIONS 2.1 The terms "State" or "State of Michigan" shall mean the MDEQ and any authorized representatives acting on their behalf. 2.2 The "Operation and Maintenance Plan" or "O&M Plan" means the Operation, Maintenance and Long -Term Monitoring:Plan attached hereto as Attachment B, Part 1 and Part 2, and which constitutes a portion of the approved Remedial Action Plan. 2.3 "Remedial Action Plan," "Limited Land Use or Site -Specific, Criteria Based Remedial Action Plan" or "RAP" means the Remedial Action Plan for the Foster Street Abandoned Plating Site prepared by Snell Environmental Group and submitted to MDEQ on January 14, 1997, including any MDEQ-approved modifications to the RAP. 2.4 "Property" shall mean that portion of the Foster Street Abandoned Plating facility which is owned by the City. 1* 2 III. PROVISION OF A FINANCIAL ASSURANCE MECHANISM To the extent permitted by law, in entering into this Agreement, the City acknowledges the financial commitment to maintain the effectiveness and integrity of the earthen exposure barrier at the Foster Street Abandoned Plating facility as described in the operation and maintenance plan in perpetuity unless the City submits and implements an MDEQ-approved alternative remedial action plan which does not require maintaining the effectiveness and integrity of the exposure barrier in perpetuity. IV. IMPLEMENTATION DRAFT 4.1 The City agrees to implement and comply with the terms and conditions of the MDEQ-approved RAP, including the O&M Plan, and shall provide an annual report to the MDEQ project coordinator'describing the operation and maintenance activities that have been undertaken by the City for the prior year. Said report shall describe any changes or modifications to the O&M Plan that should be implemented in order to assure its continued effectiveness and integrity. 4.2 The MDEQ reserves the right to review the records describing the operation and maintenance activities that have been undertaken by the City. • 4.3 Approval of the O&M Plan shall not be construed to mean that the MDEQ concurs with all conclusions, methods or statements in the O&M Plan or warrants that the submission comports with law. 4.4 The MDEQ shall properly remove or plug all monitor wells which were installed as part of the response activity at or related to the facility and which will not be utilized for long term monitoring at the facility within 180 days of the effective date of this Agreement. Proper well abandonment procedures described in the Michigan Water Well Construction and Pumping Installation Code, Part 127 of 1978 PA 368, as amended, and its rules, shall be utilized by the MDEQ in plugging all wells. 4.5 The MDEQ shall, upon completion of the response activities detailed in the RAP, including operation and maintenance and long term monitoring, properly remove or plug all remaining monitor wells at or related to the facility pursuant to the Michigan Water Well Construction and Pumping Installation Code, Part 127 of 1978 PA 368, as amended, and its rules. The Certificate of Land Use Based Closure Completion for the Facility shall be awarded to the City pursuant to Section XII after all remaining monitor wells at or related to the facility have been properly plugged. 0 3 • V. RESTRICTIVE COVENANT LD`R,4FT 5.1 The City shall record with the Ingham County Register of Deeds the Restrictive Covenant attached hereto as Attachment C within 21 days of the completion of construction of the exposure barrier. 5.2 The City shall provide a true copy of the recorded Restrictive Covenant to MDEQ within ten (10) days after the document is recorded and returned. The copy provided to MDEQ shall include the liber and page number. VI. ACCESS TO PROPERTY AND RECORDS 6.1 From and after the Effective Date of this Agreement, MDEQ and its authorized employees and representatives shall have an irrevocable right -of -access at all reasonable times to the Property for the purpose of determining and monitoring compliance with the RAP, including the right to take samples, inspect the operation of remedial action measures and inspect records related to the RAP. 6.2 This Agreement does not restrict or limit any right that the MDEQ may have to enter the Property or other properties to which access is required for the protection of the public health, safety or the environment pursuant to specific statutory or regulatory authority. Consistent with MDEQ's responsibilities under federal or state law, MDEQ and its authorized representatives shall use its best efforts to minimize interference and whenever possible employ efforts that are the least intrusive to the operations and commercial activities on the Property. "Best efforts" shall not require MDEQ to incur any material cost increases in carrying out its responsibilities to protect the public health, safety or the environment. VII. REMEDIES FOR BREACH OF AGREEMENT 7.1 This Agreement shall not be construed as discharging the liability of any person or entity who may have liability under Part 201 of NREPA. 7.2 Nothing in this Agreement shall affect the duties and obligations the City may have with respect to permits or other governmental approvals or waive the City's duties and obligations under other applicable federal or state laws. 0 4 7.3 If provisions for any of the following lapse or are not complied with as provided in the Agreement or RAP, MDEQ's approval of the RAP is void from the time of the lapse or violation, unless the lapse or violation is corrected to the satisfaction of MDEQ: (A) Land Use or Resource -Use Restrictions (B) Monitoring (C) Operation and Maintenance (D) Permanent Markers If the City fails to correct the lapse or violation within thirty (30) days of written notification of such lapse, MDEQ, at its option, may perform the work necessary to bring the Foster Street Abandoned Plating Site back into compliance with this Agreement. VIII. RESERVATIONS OF RIGHTS BY -THE STATE AND THE CITY 10.1 The State reserves all rights available under all applicable laws. . The State expressly reserves any and all rights and defenses that it may have to enforce this Agreement against the City, including the State's right to disapprove of response activities performed by the City and to require the City to perform tasks in addition to those detailed in this Agreement. The State reserves any rights it may have to undertake actions under federal and state law. Execution of this Agreement shall not affect or limit in any way any rights which the State may have in relation to any liabilities or obligations which the City or other persons may be subject to under Part 201 of NREPA or other laws by virtue of any connections that the City or those other persons have or may have had with the Facility. The State reserves any and all rights it may have to take any enforcement action pursuant to any available legal authority, including the right to compel response activity; to seek injunctive relief, response costs, monetary penalties, and punitive damages; or seek other legal remedies that may be available for any violation of law or this Agreement, including the State's right to disapprove of the manner in which City is implementing the RAP. 10.2 Nothing in this Agreement shall constitute or be construed as a release or covenant not to sue by the State regarding any claim, cause of action, or demand in law or equity against any person, firm, trust, trustee, joint venture, partnership, corporation, or other entity, for any liability it may have arising out of or relating in any way to the generation, storage, treatment, handling, transportation, release, or disposal of any hazardous substances, hazardous wastes, • pollutants, contaminants, or injurious substances found at, taken to, or taken from the Facility. This Agreement shall not estop or limit any legal or equitable claims of the State against the City, its employees, authorized representatives or assigns, including, but not limited to, claims related to releases of hazardous substances, pollutants, contaminants, or injurious substances except as specifically provided for herein. 10.3 The City reserve all rights available under all applicable laws. XI. APPLICABLE LAW 11.1 This Agreement shall be construed in accordance with the laws of the State of Michigan. All actions required to be taken pursuant to this Agreement shall be undertaken in accordance with the requirements of Part 201 of NREPA and its applicable Administrative Rules. 11.2 All terms used in this Agreement which are defined in Part 201 of NREPA, MCL 324.20101 et sec and/or the Part 201 Rules, 1990 AACS R 299.5101 et seg, shall have the same meaning in this Agreement as in Part 201 of NREPA and the Part 201 Rules. If a conflict exists between the Rules and the statute, the statute prevails. 0 6 • XII. CERTIFICATION FT 12.1 When the City determines that it has completed all the response activities required by this Agreement and the RAP, it shall submit to the MDEQ a notification of completion and a draft final report. The draft final report shall summarize all response activities performed under this Agreement. The draft final report shall include or reference any supporting documentation. 12.2 Upon receipt of the Notification of Completion, the MDEQ will review the Notification of Completion, the draft final report, any supporting documentation and the actual response activities performed pursuant to this Agreement. Within ninety (90) days of receipt of the Notification of Completion, the MDEQ will determine whether the City has satisfactorily completed all response activities required by this Agreement and the RAP, including, operation and maintenance activities, long term monitoring and proper abandonment of all remaining monitor wells. If the MDEQ determines that all response activities have been completed, the MDEQ will so notify the City, and upon receipt of a "Final" final report, shall issue a Certificate of Land Use Based Closure Completion. XIII. SEVERABILITY The provisions of this Agreement shall be severable, and if any provision is declared by a court of competent jurisdiction to be inconsistent with federal or state law and, therefore, unenforceable, the remaining provisions of this Agreement shall remain in full force and effect; except that such severance shall not be allowed if the severance of such provision causes the Agreement to fail in its essential purposes. XIV. UNILATERAL WAIVER OF TERMS AND CONDITIONS Unilateral waiver by either party of any breach or failure to enforce any of the terms and conditions of this Agreement at any time, shall not in any way affect, limit or waive such party's rights thereafter to enforce and compel strict compliance with every other term and condition of this Agreement. XV. SEPARATE DOCUMENTS This Agreement may be executed in two (2) or more counterparts, each of which shall be • deemed an original, but all of which together shall constitute one and the same instrument. 7 � DRAFT XVI. As such, residential criteria are being applied to all relevant exposure pathways which have been developed and issued by MDEQ. The Property will be used as a park and is currently zoned residential. After placement of an earthen cap consisting of a minimum of six inches of clay compacted to a density of 90% and six inches of topsoil to support a vegetative cover as specified in the RAP, all surface soils found on the Property will comprise an exposure barrier and will meet the Residential Soil Direct Contact criteria used as a basis for the presumptive remedy for the Property. The City of Lansing, as owner of the Property, will be responsible for maintaining the integrity of the exposure barrier. As part of its regular parks maintenance operations, the City of Lansing will perform monthly inspections to identify and address potential exposure to contaminated soils and ensure the operation and maintenance of the exposure barrier. 40 Exposure barrier repairs will be performed based upon the following trigger mechanisms and according to the following time schedules. • If the top layer of the exposure barrier, comprised of topsoil, is reduced by an amount that exposes the clay substrate, the damage will be noted in a monthly inspection report and the exposure barrier repairs will be completed by the next monthly inspection. • If the exposure barrier is reduced to the extent that contaminated soils underlying the topsoil and clay exposure barrier are exposed, the repairs will be completed within one week of the monthly inspection during which the discovery is made. Repairs will proceed until the exposure barrier repair is complete and the repaired areas have been restored to the original specifications used for construction of the earthen cap including reseeding the vegetative cover. The Owner shall restrict activities at the Property that may interfere with a remedial action, operation and maintenance, monitoring, or other measures necessary to assure the effectiveness and integrity of the remedial action. - 3. The Owner shall restrict activities at the Property that may result in exposures above levels established in the RAP. These activities include: a) Restricting any and all excavation activities at the site without notifying and securing prior approval from the MDEQ. b) Restricting the use of groundwater underlying the property for drinking. 4. The Owner shall provide notice to the MDEQ of the Owner's intent to convey any interest in the Facility 14 days prior to consummating the conveyance. These activities include: a) Restricting any and all excavation activities at the site without notifying and securing prior approval from the MDEQ. b) Restricting the use of groundwater underlying the property for drinking. 4. The Owner shall provide notice to the MDEQ of the Owner's intent to convey any interest in the Facility 14 days prior to consummatingthe conveyance. A conveyance of title, an easement, or other interest in the Property shall not be consummated by the Property owner without adequate and complete provision for compliance with the terms and conditions of this Covenant. 5. The Owner shall grant to the MDEQ and its designated representativesthe right to enter the Property at reasonable times for the purpose of determining and monitoring compliance with the RAP, including the right to take samples, inspect the operation of the remedial action measures and inspect records. 6.
