Capitol Ave. at 6:00 pm, September 27, 2007 C*.`'-, co The September 2007 meeting of the City of Lansing Demolition Board was called to order at 6 00 p.in. by L. Peters. The following members were in attendance: David Muylle MEMBERS ABSENT: Mark Hiaeshutter STAFF PRESENT: Laura Peters; Craig Whitford PUBLIC PRESENT: Chuck Pabst; Bruce Gaugush; Cindy Gaugush; James Finley; Adrien Vlach, Jacqualyn Garcia L. Peters stated that J.McCue could not attend the meeting tonight due to a family emergency. Demolitions Hearing Officer David Muylle moved to approve an excused absence for Mark Hiaeshutter. L. Peters asked for approval of the 8/23/07 meeting minutes. Demolitions Hearing Officer David Muylle moved to approve minutes as written. OLD BUSINESS: Case No.: 2006-034 Address: 717 S. Francis Ave. L. Peters updated the Board on this case. It was last tabled on 7/26/07 in order to allow time for the owner to get ALL trade rough-ins done and inspected. As of today, there has been no action on the building permit; there has been a rough correction on 9/19/07 for the electrical permit; there has been no action on the mechanical permit; and there has been a rough correction on 9/17/07 for the plumbing permit. Apparently, the entire plumbing system needs to be redone as it was installed incorrectly. CCO Craig Whitford submitted a status report on this property with updated pictures stating that he met with the owner, Mr. Finley yesterday, 9/26/07. A comparison with the photographs taken on 7/24/07 shows that very little progress has been made. In addition, Mr. Finley stated that he needs to start over with the plumbing. Interim Code Compliance Manager Jim McCue was on-site today and spoke with someone who was in the house and stated that they were doing drywall work. Mr. McCue did not see any drywall. He did see, however, a sleeping bag, several empty 40 oz. beer bottles and a small TV. Based on this information, staff recommends that this property be made safe or demolished in 30 days. James Finley, owner, addressed the Board. He stated that the plumbing was not as bad as it sounded. It only needed 8 joints to be replaced. He has called for an electrical rough inspection that has been scheduled for next week. He just started a new job working 12-14 hours a day and can only work on the house on the weekend. Case No.: 2007-018 Address: 226 S.Foster Ave. L. Peters updated the Board on this case. It was last tabled on 8/23/07 with the following conditions: 1)the owner MUST present a plan to fix the house and show what type of assistance he is receiving; 2)the owner and his family MUST MOVE OUT of the property as of August 24, 2007 and MUST NOT OCCUPY THE RED TAGGED STRUCTURE. As of today,none of the required permits have been pulled. CCO Craig Whitford submitted a status report on this property with updated pictures stating that he met with the owner, Mr. Boonyasith yesterday, 9/26/07. Mr. Whitford stated that the owner told him that nothing has changed on the property. However,he has a plan, but no money. The owner also stated that he is not living in the structure. He explained to the owner that the ladder must come down as it is a safety hazard for the surrounding area. The owner said he would remove the ladder. Peters presented the case. The listed taxpayer of record is Darin Daugard. Interested parties include Darin Daugard and Federal National Mortgage Association. The SEV of the property is $52,400. Land value is $5,600. Building value is $46,800. Original red tag date is 6/23/06. The property is zoned `C' Residential. Estimate of repairs is $53,000. Per the historic report from the Zoning Administrator, Sue Stachowiak, the property has historically been used as a 4-unit. However, it has lost its non-conforming status and can only be used as a single family dwelling. The other issue on this property is that there is no parking and the lot, by itself, is too small to accommodate the construction of a new building. Staff has had numerous phone calls and counter contacts regarding-this-property. Based-on-this-information,-sta-ff recommends-3-0-days-to-make-safe-or_demolish_this property. Charles Pabst, representing the real estate company that has the property for sale for Fannie Mae, addressed the Board. He stated that they are supposed to close on the property tomorrow morning at 10:00 am. However, after hearing the information on the structure, it doesn't seem like there is much hope to close on the property. He asked the Board if it would be possible to secure parking from the Black Child &Family Institute across the street. Adrien Vlach, 731 W. Genesee, addressed the Board. He stated that he is one of the perspective buyers of the property. He has an accepted offer from the bank, but was unaware that a closing was taking place tomorrow morning. He is slow to close on this as he is still investigating it. He wants to renovate the property and live in it as a single family dwelling. Jacqualyn Garcia, 427 N. Butler, addressed the Board. She stated that there have been parking issues there for quite some time. She also stated that the structure is too close to the structures on either side of it. If there were a fire, all three houses would burn down. It is unsafe. Bruce Gaugush, 905 W. Genesee, addressed the Board. He stated that the eaves touch his building. The property line in the back is 6" to 1' behind the structure. The history of this house when it was rented was unsafe. LPD was there several times. They want to see the structure demolished because it is unsafe. He will not sell any of his property to create any space for parking for this structure. Cindy Gaugush, 905 W. Genesee, addressed the Board. She stated that this structure has been an unnerving issue for quite some time. They have had to deal with extremely rude and threatening people. They have had people taking pictures of their home and have even been approached by strangers. They are concerned for their safety along with the fact that there are animals infesting the structure. They are not willing to give up their garden area and are not interested in purchasing the property. The required electrical and mechanical permits have not yet been pulled. CCO Kevin Goforth submitted a status report on this property with pictures showing progress being made. The owner contacted the Code Compliance Office and stated that he had a scheduling conflict and could not attend the meeting tonight. However, he did fax a letter stating the progress made and a scheduled target date of November 2007 to be completed. The listed taxpayer of record and interested party is Surin Boonyasith. The SEV of the property is $33,300. Land value is $5,100. Building value is $28,200. Original red tag date is 5/30/06. The property is zoned `C' Residential. Estimate of repairs is $74,500. Per the historic report from the Zoning Administrator, Sue Stachowiak, a portion of the lot is in the 100 year floodplain. New construction may have to meet Building, Zoning & MDEQ codes for residential construction in the 100 year floodplain. Mr. McCue stated that the Code Compliance Office has had issues with this property since 2004. Our office has received reports from the neighbors that Mr. Boonyasith and his family are currently living in this red tagged structure. Mr. McCue also stated that they have had several problems with Mr.Boonyasith which includes a ticket issued on this property which has evolved into a bench warrant, as well as the fact that the Code Compliance Office had to get a search warrant to enter this property to do an inspection. After getting into the structure to do the inspection, it was found that the structure contains a deteriorated fuel oil tank, located in the southeast corner of the basement, which has caused the fuel oil to spill onto the basement floor. The fuel oil may require special abatement procedures. This has been a problem house for quite some time. Based on this information, staff recommends 30 days to make safe or demolish this property. Mr. Boonyasith, owner, addressed the Board. He stated that they have had problems with money. His wife is the only one working in the household. He takes care of the children. He wants to bring the house up to code, but he has no money. They have lived in the house for 20 years and he also stated that they are currently living in the home because they have nowhere else to go. They contact the Red Cross frequently and are told that they do not have any room for them. He has tried several avenues to get assistance, but can't seem to get any. He stated that the neighbors expect perfection at his property and he can't do that. He stated that is unrealistic. He requested more time to continue to try and find assistance because he and his family have no where else to go. Mr. McCue stated that hearing Mr. Boonyasith admit that he is living in a red tagged dwelling, especially with the fuel oil issue, he is extremely concerned for the safety and welfare of him and his family. He told Mr. Boonyasith that he was in the house when the inspection was done via search warrant. The house is a fire trap and he is extremely concerned. Demolitions Hearing Officer Mark Hiaeshutter told Mr. Boonyasith that he cannot stay in a red tagged dwelling. It is not a safe environment for his family. He suggested that Mr. Boonyasith check with Peckham Industries, as well as Michigan Works,who both assist people in finding jobs. Demolitions Hearing Officer Mark Hiaeshutter ordered the case be tabled to September 27, 2007 with the following conditions: 1) the owner MUST present a plan to fix the house and show what type of assistance he is receiving; 2) the owner and his family MUST MOVE OUT of the property as of August 24, 2007 and MUST NOT OCCUPY THE RED TAGGED STRUCTURE. Case No.: 2007-019 Address: 835 May St. J. McCue presented the case. The listed taxpayer of record and interested party is Citimortgage, Inc.. The SEV of the property is $44,700. Land value is $3,700. Building value is $41,000. Original red tag date is 3/14/06. The property is zoned `H' Light Industrial which means that any new residential construction will require a special land use permit.. Estimate of repairs is $51,000. The structural part of this estimate includes the fact that there is no functioning kitchen or bathroom in the structure, there has been severe water damage and the interior has been severely stripped out. Mr. McCue stated that the garage is currently sitting in the middle of the lot line between 831 and 835 May St. However, due to the zoning, the fact that the house would be torn down and the garage would remain would be a mute point. Apparently, the driveway and garage are shared. This is a foreclosed property, As of today, none of the required permits have been pulled. Staff recommends 30 days to make safe or demolish this property. The listed taxpayer of record and interested party is Surin Boonyasith. The SEV of the property is $33,300. Land value is $5,100. Building value is $28,200. Original red tag date is 5/30/06. The property is zoned `C' Residential. Estimate of repairs is $74,500. Per the historic report from the Zoning Administrator, Sue Stachowiak, a portion of the lot is in the 100 year floodplain. New construction may have to meet Building, Zoning & MDEQ codes for residential construction in the 100 year floodplain. Mr. McCue stated that the Code Compliance Office has had issues with this property since 2004. Our office has received reports from the neighbors that Mr. Boonyasith and his family are currently living in this red tagged structure. Mr. McCue also stated that they have had several problems with Mr. Boonyasith which includes a ticket issued on this property which has evolved into a bench warrant, as well as the fact that the Code Compliance Office had to get a search warrant to enter this property to do an inspection. After getting into the structure to do the inspection, it was found that the structure contains a deteriorated fuel oil tank, located in the southeast corner of the basement, which has caused the fuel oil to spill onto the basement floor. The fuel oil may require special abatement procedures. This has been a problem house for quite some time. Based on this information, staff recommends 30 days to make safe or demolish this property. Mr. Boonyasith, owner, addressed the Board. He stated that they have had problems with money. His wife is the only one working in the household. He takes care of the children. He wants to bring the house up to code, but he has no money. They have lived in the house for 20 years and he also stated that they are currently living in the home because they have nowhere else to go. They contact the Red Cross frequently and are told that they do not have any room for them. He has tried several avenues to get assistance, but can't seem to get any. He stated that the neighbors expect perfection at his property and he can't do that. He stated that is unrealistic. He requested more time to continue to try and find assistance because he and his family have no where else to go. Mr. McCue stated that hearing Mr. Boonyasith admit that he is living in a red tagged dwelling, especially with the fuel oil issue, he is extremely concerned for the safety and welfare of him and his family. He told Mr. Boonyasith that he was in the house when the inspection was done via search warrant. The house is a fire trap and he is extremely concerned. Demolitions Hearing Officer Mark Hiaeshutter told Mr. Boonyasith that he cannot stay in a red tagged dwelling. It is not a safe environment for his family. He suggested that Mr. Boonyasith check with Peckham Industries, as well as Michigan Works, who both assist people in finding jobs. This property was sold on a land contract that seems to have been abandoned. The condition of the structure is extremely poor and there have been multiple board-ups done at this property as well. As of today, the only permits pulled are an electrical permit which was issued on 2/27/07; no action since issuance. A mechanical permit was issued on 1/31/07 for the furnace and was finalized on 2/2/07. The required building and plumbing permits have not yet been pulled. Staff recommends that this property be made safe or demolished in 30 days. Ms. Luann Pfeifer, owner, addressed the Board. She stated that the electrical is almost done. It only needs new plugs, smoke alarms, etc. Capital City Electric is doing the work and they have already been paid. She wants to re-hab everything in the house, but is working with only one income due to personal issues. She has gutted out the house from the trash and debris that the land contract holders left her when they abandoned the property. She is currently getting estimates to replace the roof as well. Concerns were noted by both Mr. McCue, as well as Demolitions Hearing Officer David Muylle regarding the fact that there has been no action or calling for a rough inspection on the electrical permit. Land value is $4,000. Building value is $15,800. Original red tag date is 3/22/05. The property is zoned `A' Residential. Estimate of repairs is $34,000. As of today, the only permits pulled are a building permit to repair a carport, interior remodel and re-frame roof and a plumbing permit for various work which has had no action since issuance. He went through the list of corrections with CCO Whitford and every item on the list has either been removed or replaced. He stated that he got pulled off of the work on the house for three weeks to do a job for Ingham County. He also stated that he is waiting for BWL due to the fact that the electrical needs to be moved from one side of the house to another to comply with the code. There are new windows, new structural, floors have been replaced, new doors, structural beams are in and the framing is done. He has hired a contractor to do the roof and is planning on keeping the property. He stated that he should have the roof and the rough electrical done in 60 days. Case No.: 2007-015 Address: 2212 StirlinL Ave. J. McCue presented the case. The listed taxpayer of record and interested party is Guadalupe Quesada. The SEV of the property is $44,000. Land value is $6,700. Building value is $37,300. Original red tag date is 3/6/06. The property is zoned `B' Residential. Estimate of repairs is $55,000. Back taxes and assessments add up to approximately $5,000 currently. As of today, none of the required permits have been pulled. The Code Compliance Office received a petition from the neighbors of this address today in support of demolition of the structure. Mr. McCue also stated that CCO Scrimger tried to rectify this situation by issuing a Court Ordered Compliance ticket. Ms. Quesada was found guilty and fined $500. The fine was paid; however, the property was not brought up to code as was part of the stipulation of the ticket. The Code Compliance Office could have pursued this more since the house was supposed to be brought up to code and wasn't which would have meant that Ms. Quesada could have been arrested. Instead, Mr. McCue dismissed the ticket and the property was placed in the demolition process. There are several back taxes on the property as well as a lien with the City of Lansing Development Office in the amount of$8,900. Staff recommends that this property be made safe or demolished in 30 days. Yndalecio Riveno, son of the owner (who was also present), addressed the Board. He stated that they tried to come in and pull permits to fix the house, but the Building Department would not let them pull permits. He stated that CCO Scrimger also spoke to their builder. They want to fix the house, but they are not allowed to get the required permits. Keila McKenna, 2213 Stirling Avenue, addressed the Board. She submitted a 2"d signed petition from neighbors supporting demolition of the structure. She runs a daycare out of her home and is representing the neighborhood at this meeting. He also stated that he is waiting for BWL due to the fact that the electrical needs to be moved from one side of the house to another to comply with the code. There are new windows, new structural, floors have been replaced,new doors, structural beams are in and the framing is done. He has hired a contractor to do the roof and is planning on keeping the property. He stated that he should have the roof and the rough electrical done in 60 days. Steve Lonzo, representing the new owner and his sister-in-law Real Yarrell, addressed the Board. He stated that they dug out the foundation already. He has masonry ready to start work next week. They will be doing a section at a time. The interior work will begin which will include drywall, insulating, etc. while the foundation work is being done. He estimates that the foundation will be done in 3-4 days. He wants to have all work completed and the house brought up to code by the end of April 2007. McCue updated the Board on this case. It was last tabled on 12/7/06 to allow time for the owner to continue repairs and show progress. As of today, there has been no action on the building, electrical or mechanical permits. The required plumbing permit still has not been pulled. CCO Craig Whitford submitted a status report on this property. Per his report, he stated that no action has been taken on the permits. Mr. Gutierrez came into the office on 1/24/07 and provided a schedule for the work with drawings and stated that he would like to have it done within 2 months or by May 1, 2007. Staff recommends this property be made safe or demolished in 30 days. Staci Garcia,representing the owner, addressed the Board. She stated that she is the owner's niece. She stated that Mr. Gutierrez has rectified the situation with Washington Mutual. She also stated that the electric has been turned back orl at the house so that the siding can be finished. She also stated that Mac's Electric will begin running the electrical on 1/29/07 and the heating will begin on 1/26/07. She stated that the siding and soffit should be completed by 2/9/07. Staff recommends 30 days make safe or demolish on this property. Linda Hatt, owner, addressed the Board. She stated that she has not been in the house in 2 months. She has moved her belongings out. She sold the house on land contract and then there seemed to be some problems with Mr. Wirt's partner, Jason Vanderstelt. She informed the Board that E.T. Mackenzie is planning on demolishing the house in 1-2 weeks. She also provided the Board with a receipt that something was registered with Ingham County Register of Deeds. She stated that it was a copy of the land contract. Interim CC Manager Jim McCue explained the issues that the Code Compliance Office has been facing regarding land contract and mortgage fraud. He tried to explain the importance of having everything recorded with Ingham County Register of Deeds and making sure that we receive a copy of such paperwork. Staff recommends that this property be made safe or demolished in 30 days. ;Mr. James Finley, owner, addressed the Board. He stated that extensive work has been done on the house—most of that work was done before he purchased the house. New wiring, plumbing, mechanical were already done. There were also new doors and windows put in. All of the work that was done was good work, but was done before he purchase the house. He asked the Board why that work has to be counted as part of the dollar amount for a flood plain rehab. He stated that he has invested $15,000 in the property. He also feels that he has been intimidated by CCO Craig Whitford who allegedly told him that he would do everything in his power to make sure that Mr. Finley could not rehab this property. CC Manager Jim McCue explained to Mr. Finley that he would have to speak with Sue Stachowiak, Zoning Administrator to see if the Zoning Code will allow him to do what he is planning on doing. He will also have to speak with the Building Safety Department regarding permits to see if the Building Code will allow him to complete his plans. It all depends on what he intends to do with the property, the costs involved and how that falls under the Zoning Code and Building Code based on the fact that the property is in the flood plain. These issues are not enforced by the Code Compliance Office.
