Commissioner Clyde Carnegie _- Commissioner Bill Renfrew MEMBERS OF THE PUBLIC/GUESTS: Commissioner Jan Kolp None MEMBERS EXCUSED: Commissioner Maria Mejorado Commissioner Patty Farhat CALL TO ORDER-Commissioner Noordhoek After having established a quorum, Commissioner Noordhoek called the meeting to order at 11:31 a.m. PUBLIC COMMENT-Agenda Items None. ADDITIONS TO THE AGENDA None. EDUCATION PRESENTATION None. ADMINISTRATIVE REPORT—Chief Alley Chief Alley briefed the Board on the recent shooting at the Super 8 Motel noting that the Michigan State Police investigation will now be referred to the Genessee County Prosecutor's office. He assured them LPD will also be conducting a review through the Internal Affairs office. He gave an overview of the days' occurrences remarking that several things went wrong including some miscommunication and recording malfunctions. However, it appears that procedures were followed. He has been open to the public and to the victim's family, attending the funeral and offering to meet with the NAACP. The Board commended his outreach efforts and discussed the importance of community trust in performing day-to-day law enforcement activities. The Chief updated the Board on radio system developments and is optimistic that problems in the southern area of the City are being resolved. Unfortunately, the remedies have triggered new problems occurring on the north side. MA/ COM will be bringing in additional expertise next week. The County is considering withholding payments, but is willing to explore spending $800,000 toward a coverage fix. The dropped call issue remains separate from these fixes to the coverage problems. He informed the Board of a recent mobile data outage but assured them that the system is now back up and running. He thanked them for their support of the surveillance camera introduction by appearing before City Council and speaking in favor of the use of contributed funds. Commissioner Renfrew Board of Police Commissioners Meeting Minutes of December 14, 2007 Page 2 commented that the Northwest Advisory Board was also voicing its support. Regarding the introduction of a mobile video recorder (MVR) system, Chief Alley encouraged the Board to support funding this important endeavor through the budgeting process. It is being proposed as an FY2009 Capital Improvement Project (CIP). The Chief announced that Sgt. Stevens will tentatively be assigned to the administrative division to assist in updating procedures. He also announced the introduction of the "hot spot" card program and acknowledged Jim DeLine for his recent performance in light of his staff member being on medical leave. Finally, he announced that, while it has been a rough two weeks, good news came today in the awarding of $100,000 by the Granger firm to the HOPE Connections program. He wished everyone a Merry Christmas and expressed his appreciation to the Board for its continuing support. APPROVAL OF MINUTES -Commissioner Noordhoek The minutes of the regular meeting of November 20 approved as submitted and placed on file. UNFINISHED BUSINESS—Commissioner Noordhoek None. FRATERNAL ORDER OF POLICE No representative present. CORRESPONDENCE -Commissioner Noordhoek Correspondence for the month of November was accepted and placed on file. DEPARTMENTAL REPORTS Commissioner Kowalk welcomed the introduction of a Canine Unit newsletter. Board members all spoke highly of Lt. Yankowski and his many contributions to the Department. Departmental Reports for the month of November were accepted and placed on file. BOARD COMMITTEE REPORTS Liaison Committee — Commissioner Kowalk noted that recent Board member appearances at the City Council meeting were commendable as important liaison activity. Awards & Incentives Committee— No report. Budget Committee— Commissioner Carnegie noted that the committee had recently met with Jim DeLine and that the FY2009 budget request is being completed. The Mayor has promised that the budget will not be cut from the FY2008 level. The complete budget request will be available for review at the January meeting. Complaint Committee - Commissioner Renfrew announced that the committee had not yet held its December meeting, but felt that it was being kept up-to-date as needed between meetings. Commission Investigator Report — Bernard Brantley referred the Board to his written report and wished all Happy Holidays. He invited the Board to attend the Holiday Open House of the Human Relations and Community Services Department and thanked members for their continued support. Board of Police Commissioners Meeting Minutes of December 14, 2007 Page 3 HUMAN RELATIONS AND COMMUNITY SERVICES LIAISON Commissioner Sims relayed comments from Dr. Joan Jackson Johnson thanking the Board for her inclusion in its regular monthly meetings. She reported the foreclosures of 400 homes this month as the foreclosure issue remains a top concern of the Human Relations & Community Services Department. It is continuing to make every effort to get important information on the issue out to the community. She communicated Dr. Johnson's continued appreciation to Bernard Brantley for his assistance with individuals who arrive at the Department's door with various concerns. Finally, Dr. Johnson wished the Board Happy Holidays. Commissioner Noordhoek asked Commissioner Sims to relay the Board's appreciation to Dr. Johnson for sharing important information to the Board on a monthly basis. COMMISSIONER COMMENTS Commissioner Renfrew — updated the Board on efforts to establish a downtown employee entrance on Ottawa Street. He commended Chief Alley for his contribution in achieving this goal. He is proud to be associated with Chief Alley and wishes everyone a Happy Christmas and New Year. Commissioner Kolp — Merry Christmas to all. She will be spending the holiday with her sister and grandchildren in Tulsa. Commissioner Carnegie — expressed his appreciation to Chief Alley for his strong standing in the community and for his accessibility. He encouraged the Department to maintain an espirit de corps and noted the "common touch" with which Department personnel deal with the public. He expressed his appreciation to Michael Mathis for his contributions including his patience and understanding. It is an honor to serve on this Board. Good Holidays to all. Commissioner Kowalk—echoed Commissioner Carnegie's comments regarding Chief Alley. He is doing a "super job." She wished everyone Happy Holidays and reminded all to keep officers in our thoughts and prayers as they struggle to do their best out in the inclement weather. Commissioner Sims — noted that is has been an honor to serve on the Board in this rough year. She wished Chief Alley and his family the best as they are going through changes and expressed her appreciation to Michelle Reddish for keeping Board members informed. The Captains are also to be commended for their excellent communication skills. She commended the Board's chair and secretary for their contributions this year and to Bernard Brantley for keeping members informed of citizen concerns. Happy New Year. May we be thankful for our many blessings. Commissioner Noordhoek — echoed the comments of the previous speakers and commended the LPD leadership. He commended the Board for doing a "wonderful"job this year and noted that he is proud to be a member. OTHER BUSINESS Commissioners moved and supported a motion to correspond with City Council in support of the Department's request to fund a mobile video system. 2009 Meeting Schedule — Commissioners moved and supported a motion adopting the proposed 2009 meeting schedule. PUBLIC COMMENT-Agenda Items None. ADDITIONS TO THE AGENDA It was requested that a report of the site committee for the incoming surveillance cameras be added to the agenda. Commissioner Mejorado added the item to the agenda under"Other Business." EDUCATION PRESENTATION Sgt. Tony Nettles distributed the Training Schedule which he compiles. He pointed out the great variety of training types necessary for Department personnel and noted that the majority of training funds come from the State of Michigan's Public Act 32 / MCOLES funding. This is specific to sworn personnel. He discussed the "annual" training required of sworn personnel and distributed copies of the January Annual Training Instruction Schedule. In answer to a request from the Board, Sgt. Nettles and Chief Alley invited Board members to observe the sessions. He explained the efficiencies being used this year in the Annual Training including the use of the Lansing Center. Sgt. Nettles also discussed the relative ease of conducting in-house training as opposed to coordinating attendance out-of-town / out-of-state due to the many approvals and logistics necessary. He explained how training hours are calculated for reporting purposes and, in answer to a question from the Board, discussed training officers to detect marijuana without actually entering a domain. Commissioner Kowalk commended the "tremendous"job he is doing. ADMINISTRATIVE REPORT—Chief Alley Chief Alley discussed several aspects of the new surveillance cameras and distributed a copy of the LPD Procedure relative to their use. He has recently spoken with TV6, the Lansing State Journal and the ACLU on the introduction of the cameras. In answer to a question from the Board, he reviewed the criteria used in site selection. He noted that City Council will be discussing the transfer of donated funds for the project and suggested Board support would be welcome. He also discussed the use of signs to make the public aware of surveillance camera locations. He noted that the camera resolution is quite Board of Police Commissioners Meeting Minutes of November 23, 2007 Page 2 good and told the Board to expect the introduction to have a noticeable impact. Cameras in the north end should be operational by the end of January and those in the south end operational by the end of March. The Chief announced the recent addition of six newly hired police officers and explained the new Hot Spot card initiative in conjunction with the group, Action. He also announced that negotiations to renew the labor agreement with the FOP — 911 bargaining unit will begin soon and he will assist in those negotiations. He noted that many of the LPD procedures are being reviewed and updated with the assistance of retired Detective Cassie Alley's assistance. He briefed the Board on the Silver Bells in the City celebration, calling it "another huge success." He noted that precautions put in place due to a recent bomb scare resulted in a new relationship with channel 53 and he will appear on the station soon assuring children of Santa's security in the Lansing area. Finally, Chief Alley wished all a happy Thanksgiving and noted the return of Sgt. Mary Stevens to work on a light duty basis. APPROVAL OF MINUTES -Commissioner Mejorado Commissioner Sims requested changes to the minutes via an e-mail to Jim DeLine reference the Roundtable discussion on Charter responsibilities. The minutes of the regular meeting of September 18 were approved as amended and placed on file. UNFINISHED BUSINESS -Commissioner Mejorado None. FRATERNAL ORDER OF POLICE No representative present. CORRESPONDENCE -Commissioner Noordhoek Correspondence for the month of October was accepted and placed on file. DEPARTMENTAL REPORTS Commissioner Kowalk noted the duplication of crime statistics in the North and South Precincts and questioned the coincidence. Jim DeLine agreed to inquire to the report writers and communicate the results before the December meeting. Commissioner Kolp had a question on the names listed in the Staffing Report (p. 14) and Chief Alley explained that each personnel vacancy is labeled with the name of the incumbent who left which created the vacancy. She also asked for an explanation on the situation of the Youth Home refusing to house a young person and the Chief explained both their limited capacity and policies. Michael Mathis was commended for including a page of requested information in the monthly packet. Departmental Reports for the month of October were accepted and placed on file. BOARD COMMITTEE REPORTS Liaison Committee— No report. Awards & Incentives Committee — Commissioner Farhat reported that she is working to secure another grant to help with expenses incurred in holding an awards ceremony. Chief Alley informed the Board of Board of Police Commissioners Meeting Minutes of November 23, 2007 Page 3 the many positive comments which he received regarding this year's event. Budget Committee — Jim DeLine reported that he has not yet met with the Budget Committee due to guidelines from the City Finance Department not yet being received. He is working with Department supervisors to develop funding requests and work programs in a new Excel format in the interim. Complaint Committee- The committee held its meeting on October 29 and feels things are going well. Commission Investigator Report — Bernard Brantley attended domestic violence training with members of the Board and is assisting the Department as it reviews the present complaint procedure. HUMAN RELATIONS AND COMMUNITY SERVICES LIAISON Dr. Joan Jackson Johnson discussed the recent community summit expressing her appreciation to Det. Elizabeth Bonello for her participation. She brought the Board's attention to local foreclosure issues noting that there are 20-25 foreclosures per week in Ingham County. She is attempting to identify MSHDA funds for help in this area. The local homelessness situation is also worsening with shelters housing record numbers of people and charitable night stays in motels totaling 15,000 last month. Meanwhile, she continues to work with the community on the issue of utilizing Oliver Towers to house people. Dr. Johnson also noted that as Thanksgiving approaches, we will see an influx of volunteers working to support local programs. Holidays are like that. COMMISSIONER COMMENTS Commissioner Kolp - reported on her involvement with the surveillance camera site selection committee. She commended Capt. Hall for his comments and also commended the decision to withhold video from the Grand River School from the Internet. A discussion on potential video manipulation was held. As the committee proceeds, it will find issues, conduct discussions, question assumptions and explore alternatives. Commissioner Renfrew— commended the Department in general, and the Traffic Unit specifically, for its conduct during Silver Bells in the City. He also commended the Chief for his presentation on surveillance cameras to the City Council. He feels the public is strongly in favor of their introduction. Commissioner Kowalk—wished everyone Happy Holidays. Commissioner Farhat—expressed her appreciation to Chief Alley for his attendance at the Neighborhood Watch coordinators' meeting. She commended Det. Elizabeth Bonello and Sgt. Cherie Ballor for the assistance in their given areas of expertise. Happy Holidays to all. Commissioner Mejorado — noted how instructive and well run the domestic assault training was. She wished everyone Happy Holidays and will soon be heading to Texas for the winter months. He led those present in a moment of silence out of respect for the recent passing of Commissioner Kolp's mother. PUBLIC COMMENT-Agenda Items None. ADDITIONS TO THE AGENDA None. ROUNDTABLE DISCUSSION In lieu of an education presentation, the Board participated in a roundtable discussion on its responsibilities as outlined in the City Charter. Michael Mathis provided pages from the Charter which refer to the Board. Mention is made in several areas. The Board of Police Commissioners is considered to be an advisory board with extra powers, including the establishment of administrative rules and consulting on the budget. Further discussion included some history of the board and required timing of appointments. Commissioner Carnegie reminded everyone that Board members are empowered only when convened as a board. Any public comments made individually are made as an individual or even as a Board member, but are not to be construed as being made on the Board's behalf. It was the consensus of the Board that Charter responsibilities are worthwhile to review on a periodic basis. ADMINISTRATIVE REPORT—Chief Alley Chief Alley announced the upcoming Public Safety Career Day being held on November 3 at the South Precinct. There will be several recruitment booths to answer questions from people whether they are students thinking long term or current job seekers. He announced that October is Domestic Violence Awareness Month and invited Board members to attend a seminar to be conducted by Sgt. Cherie Ballor and Desirae Kelly Kato. The Chief brought word from Mayor Bernero on the Board's consideration of forming a facility committee. There are several sites being considered and discussions will start in earnest in early 2008. The Board Board of Police Commissioners Meeting Minutes of October 16, 2007 Page 2 will delay taking any action for the time being. He discussed the need for a policy regarding surveillance cameras. A draft is being reviewed by the City Attorney which would include the formation of a committee to discuss when / if placement of cameras should change. An appointee of the Board would be included on the committee. In answer to a question from the Board, the Chief noted that patrol officers will have the potential to monitor a camera from their patrol car once the wireless pipeline from the current COPS grant is operational. Chief Alley distributed a copy of the City Council's FY2009 budget priorities which were pertinent to the Police Department. He noted that the County Commission has authorized the use of a third party consultant to review problems with the radio system. They are currently gathering information and testing the deployment of a new south Lansing tower. He noted the forthcoming visit of Rev. Jesse Jackson and mentioned the many locations and times of his visits. Commissioner Sims distributed a handout of them. He also noted that the construction of a traffic circle at Michigan Avenue and Washington Avenue is scheduled to be completed tomorrow. The opening will include several events. He brought to the Board's attention the October 25 Neighborhood Watch training at the Hill center and thanked those who attended Det. Cassie Alley's retirement party held earlier in the day. APPROVAL OF MINUTES -Commissioner Noordhoek The minutes of the regular meeting of September 18 were approved as presented and placed on file. UNFINISHED BUSINESS -Commissioner Noordhoek Commissioner Noordhoek updated the Board on their expected response to correspondence sent to the County Commission. He met with Commissioner Mark Thomas and requested that a response be forthcoming. FRATERNAL ORDER OF POLICE No representative present. CORRESPONDENCE -Commissioner Noordhoek Correspondence for the month of September was accepted and placed on file. DEPARTMENTAL REPORTS Commissioner Farhat noted the precinct monthly comparisons to last year (p.23) and asked if comparisons were made month-to-month or to the prior fiscal year-to-date. Chief Alley noted that they are month-to-month comparisons. Departmental Reports for the month of September were accepted and placed on file. BOARD COMMITTEE REPORTS Liaison Committee— No report. Awards & Incentives Committee— No report. Budget Committee— City Council priorities were noted. Board of Police Commissioners Meeting Minutes of October 16, 2007 Page 3 Complaint Committee - The committee held a productive meeting last month with Sgt. Ballor of the Internal Affairs Unit. Commissioner Noordhoek asked about the ability of the Department to recruit supervisors for the IA Unit. Chief Alley noted that the position can be considered a good stepping stone to a promotion given its high visibility in the administration. Supervisors routinely remain in the Unit for approximately three years. Commission Investigator Report — Bernard Brantley noted his role in the City's United Way campaign. He has recently been busy attending mediation training and working on the Jesse Jackson visit. He opened two new cases this week. HUMAN RELATIONS AND COMMUNITY SERVICES LIAISON In the absence of Dr. Jackson, Commissioner Sims reported that the Department continues to be busy. Current projects include work with the Jesse Jackson visit, continued discussion on the Oliver Towers use, and monitoring City contracts. COMMISSIONER COMMENTS Commissioner Carnegie — commended the Chief on the initial placement of the surveillance cameras. The placement was well thought out. He suggested that a sign at the City limits relating to the use of surveillance cameras may be appropriate. He also suggested that it would be appropriate for the Board to make a decision on its appointee to the placement committee as well as to go on record with a position on the use of surveillance cameras. Commissioner Kolp — expressed her appreciation to the Board for its support on the loss of her mother. She was especially appreciative to those who attended the funeral. Commissioner Renfrew — noted the many tools available in the enforcement of our laws by police professionals. He feels the surveillance cameras are an additional useful tool. Commissioner Mejorado—noted with regret her inability to attend the tour of camera sights. Commissioner Sims — noted her appreciation for being offered a tour of camera sights. She also announced her submission of a $20,000 Kellogg Healthy Communities grant. She spoke highly of Rev. Jackson's upcoming visit noting that he is encouraging action and will be sharing useful information. She expressed her appreciation to the Chief for his distribution of good news and remarked on her appreciation for the fine men and women who serve in the Lansing Police Department. Commissioner Farhat— encouraged all to attend the October 25 Neighborhood Watch training and noted that it is open to the public. She discussed the recent attention to the proposed construction of a cell tower in her neighborhood and announced a candidate's night forum to be held this Wednesday. Finally, she expressed her best wishes to Commissioner Renfrew for his upcoming medical procedure. Commissioner Noordhoek — expressed his appreciation for the tour of camera sights and congratulated the Chief for the recent HOPE scholarship media attention and forthcoming graduates. He also appreciates that the Chief gives members of the Boards a "heads up" on evolving issues. OTHER BUSINESS A motion was made and unanimously passed that the Board of Police Commissioners supports the implementation of surveillance cameras in the City of Lansing. ADJOURNMENT -Commissioner Noordhoek There being no other agenda items, Commissioner Noordhoek adjourned the meeting at 7:24 p.m., but it was quickly reconvened to deal with the matter of a Board appointee to the proposed committee on the placement of surveillance cameras. A motion was made and passed that a member of the Board's leadership team and an alternate be named to serve on the surveillance camera placement committee. Commissioner Sims noted that it may be appropriate for the Mayor to also appoint a member of City Council to this committee. A discussion was held on the domestic violence training to be held by Sgt. Ballor and the consensus of the Board was to request the date of November 5 Commissioner Sims noted that on election night, she would once again be hosting a cable television program. He led those present in a moment of silence out of respect for the recent traumatic occurrences to Sgt. Mary Stevens. PUBLIC COMMENT-Agenda Items None. ADDITIONS TO THE AGENDA None. In order to accommodate speakers' schedules, some agenda items will be in an order other than that on the printed agenda. ADMINISTRATIVE REPORT—Chief Alley Chief Alley briefed the Board on recent Neighborhood Watch training held in conjunction with the Ingham County Sheriffs office. He acknowledged Commissioner Renfrew's participation and Det. Elizabeth Bonello's role as trainer. Officers Jeromy Churchill and Sarah Nolen, new Community Service Officers, also attended. It was noteworthy that the national organization played a role in this training. Commissioner Renfrew discussed the role of the National Sheriffs Association in the formation of the neighborhood watch movement and noted the potential for using church organizations and teen volunteers in the effort. The Chief also noted recent interactions with a group of twelve local churches interested in getting involved in local issues, calling themselves, "Action." Members of the group are sponsoring a forum on September 24 and are particularly interested in devising a system for members of the public to submit anonymous information to the Department. The organization is based on a model used in other municipalities and has distributed a flyer which has a confrontational tone. Commissioners Carnegie and Kolp commented that the Department is very good at responding to concerns and has processes in place which may be presented to the group. Commissioner Farhat asked if Board members can assist in working with the Action group, but the Chief indicated that we should wait a bit to see the demeanor of the group as it comes together. Commissioner Kowalk pointed out that the premise is worth exploring as some people with information may wish to "avoid" police. Board of Police Commissioners Meeting Minutes of September 18, 2007 Page 2 Chief Alley discussed the Mayor's proposal to purchase and install surveillance cameras in public areas. With Council's split (4-4) vote on authorizing an Act 99 loan, other funding options are being explored. Commissioner Renfrew suggested that, given the assumption that the cameras are a deterrent, there could be value in buying thirty camera housings, but only twenty cameras. Chief Alley also brought Judge Cherry's gag order in the Macon case to the attention of the Board. The order is very inclusive and Brigham Smith will work with the judge to see if the order can be modified so as to allow reasonable inquiries to be addressed. In answer to Board member questions, he indicated that the order applies to comments they might make. Michael Mathis added that even FOIA requests are covered by the order. The Chief welcomed the Board's concern for Sgt. Mary Stevens' condition and acknowledged HIPPA considerations in giving an update on her condition. She is doing "surprisingly well." He discussed his published comments in City Pulse saying that, in his seven years as Chief, this is the first time he has responded to an editorial piece. He was strongly motivated to respond and his article also appeared in a publication of the Police Executive Research Forum (PERF). Chief Alley mentioned that he had heard a comment that "the computers in the cars don't work," and he said that this was not true, but the network can be slow. Speed will improve with the upgrade being done with COPS grant money. Concerning the ongoing radio problems, he announced that the County is expected to authorize the introduction of a third party consultant. The Chief announced an Allen Street / Hunter Park forum to be held this evening at the Foster Center. He also commented on the recent 9/11 memorial ceremony and expressed appreciation to Commissioner Sims for her attendance. He announced the retirement of Det. Cassie Alley who will be retiring on October 15 after having served LPD for twenty-five years. In response to published comments, he noted that LPD does, in fact, need a motorcycle/special events unit and he acknowledged Sgt. Leith Curtis for doing a "great job" in supervising the unit. EDUCATION PRESENTATION Sgt. Leith Curtis outlined the basic structure of the Traffic / Special events Unit, noting that it consists of six officers and himself down from a time when LPD had 15 motorcycles available. The unit is primarily responsible for traffic enforcement which includes parking, speeding, the traffic follow-up unit (TFU), accident investigation and Office of Highway Safety Planning grants. They self train since he and another LPD officer are nationally certified instructors. Special events number 55 — 60 per year with the heaviest month being May and will include visits by presidential candidates next year. In response to questions from Board members, Sgt. Curtis noted that the assignment to the unit is for a length of three years, in winter they perform the same traffic-related functions but are in patrol cars, female officers are welcome (two recently qualified), and no prior experience is required for the assignment to the unit. He noted being part of the unit is "a great job." HUMAN RELATIONS AND COMMUNITY SERVICES LIAISON Dr. Joan Jackson Johnson commended Det. Elizabeth Bonello for her outstanding work at recent community events. She acknowledged the contributions of Captains Forrest and Szymanski at the recent Healthy Community event with the Baker-Donora neighborhood group and the Food Coalition, as well as the contributions of Captains Szymanski and Hall in the Breaking the Cycle program. Dr. Jackson Johnson announced the impending return of Rev Jess Jackson to Lansing for a foreclosure Board of Police Commissioners Meeting Minutes of September 18, 2007 Page 3 discussion. Foreclosures are running very high right now and there are many Red Cross hotel nights occurring in the Lansing area. She also noted that members of her staff are presently being trained in mediation techniques. She continues to enjoy her working relationship with Chief Alley and commented that Bernard Brantley is "jumping" along with members of her staff as they cope with and "overwhelming" demand for services. She was surprised to learn that not all commissioners were aware of the problems. A New Orleans firm is expected to receive the contract to act as a third party consultant to analyze the situation and she has information on this firm should Board members wish to see it. She feels things are moving very slowly and additional pressure on the County may be necessary. Commissioner Renfrew—expressed his concern that City Council needs to be better educated on the use of surveillance cameras. Commissioner Sims — is concerned that the Board's communication to the County did not receive a response. She also wished to explore the Board's role / responsibility in the purchase of surveillance cameras and suggested the City Charter be reviewed to this end. Commissioner Farhat — expressed her appreciation to Det. Bonello for her training expertise. She announced a Neighborhood Watch coordinators' meeting for October 25 and noted that it is open to the general public for the first time. Commissioner Kowalk— noted that Sgt. Stevens is in her prayers and encouraged Chief Alley to "hang in there"during times of controversy. Commissioner Mejorado — expressed sorrow at the loss of Parks employee, Tony Noyola. The City has lost a great leader. She also announced the success of her husband's softball team as they went undefeated in a Georgia tournament. He was named to the All-American team. Commissioner Noordhoek — also noted the passing of Tony Noyola and led the Board in a moment of silence for him. OTHER BUSINESS It was the consensus of the Board that a discussion of its Charter responsibilities would be conducted at the October meeting in lieu of an education presentation. PUBLIC COMMENT-Agenda Items Christine Timmons addressed the Board with concerns on placing surveillance cameras in public areas saying this results in a loss of freedom, is similar to stalking, is harassment and is a form of oppression. She also questioned what she called an "excessive use of police" in the Genesee neighborhood, as well as the use of the LPD Honor Guard for private funeral services. ADDITIONS TO THE AGENDA Councilmember Wood noted that a discussion on the radio system needs to be included in today's discussion. Councilmember Dunbar commented that the radio system and technology in general should be addressed. JOINT COUNCIL/BOARD DISCUSSION Commissioner Noordhoek welcomed City Council members present and invited them to a croissant sandwich lunch followed by a moment of silence for Ruth Hallman. The opening discussion was introduced by Councilmember Leeman and addressed the re-appointment of Board members. It was noted that City Clerk Chris Swope is assisting on these matters to ensure that the charter requirements are being met. Re-appointments of Commissioners Noordhoek and Sims have yet to be made. Board of Police Commissioners Meeting Minutes of August 14, 2007 Page 2 Councilmember Wood introduced the topic of radio operations. She is concerned that radio problems have resulted in officers "doubling up" in cars which could leave some team areas without coverage. Board members requested that County Commissioner Copedge see to it that they receive a response to their recent correspondence relative to the County addressing the radio problems. He assured them that addressing radio problems experienced by law enforcement officers is a top priority. There was discussion on the possibility of bringing in a third party to review the situation and propose remedies. It was also suggested that the initial agreement with the vendor be examined in order to hold them as accountable as possible. Councilmember Dunbar suggested that new technology allowing officers to swipe a driver's license in order to gather information and technology which permits officers to produce tickets electronically be examined. Capt. Forrest reported that these technologies are presently being researched. She also suggested that LPD look into the possibility of using 911 personnel or others to take reports on low priority situations. She also introduced a discussion on having security personnel other than LPD officers serve at meetings of City Council. Budget difficulties were discussed with a tax increase mentioned as a possible solution. Not everyone agreed that the public would support a law enforcement initiated millage increase. Building purchase vs. rent discussion was held and, while it is incumbent upon the administration to make a proposal concerning police facilities, it was suggested that both the Council and the Board may wish to take a position. The largest expense in the Police Department is personnel and it was noted that additional personnel might allow for the position of Assistant Chief to be filled as well as increase the officer to general populace ratio. Commissioner Renfrew gave examples of the increased activity conducted by officers. It was the consensus of Board and Council members that the discussion was worthwhile and many expressed the opinion that they need to get together more frequently. Councilmember Wood suggested that a joint building committee might be appropriate. Commissioner Noordhoek thanked all for their participation and expressed his appreciation to Margo Norris for the delicious lunch. ADMINISTRATIVE REPORT—Chief Alley Chief Alley expressed his appreciation to Commissioners Noordhoek and Farhat for their efforts toward the National Night Out event. He also noted Mayor Bernero's participation. He commended Det. Ruiz and Sgt. Southworth for their participation in helping LPD co-host the Senior Citizen Prom. It was a great collaborative effort. The Chief commented on what a good time was had at the African American Parade and picnic in which Mayor Bernero also participated. He commended those who helped put on the picnic at the Black Child and Family Institute including Ofc. Ken Callison. The Chief mentioned that he has met with the new Lansing School District Superintendent, T.C. Wallace, and is enthusiastic that good LPD/LSD relations will continue. He updated the Board on four unresolved homicides noting that we are moving forward on them all and have recruited the assistance of Special Operations, Patrol, the Michigan State Police and the FBI. The investigations, of course, are causing a strain on the overtime budget. Commissioner Kolp asked about the cooperation being received from the community and Chief Alley noted that some community members are willing to assist more than others. Chief Alley discussed Mayor Bernero's anti-crime plan which will be introduced on Thursday. He noted that it will include the use of cameras, some of which will be monitored and some will simply record. In answer to a question from Commissioner Sims, he noted that this is not considered a pilot project, but an investment. Another component of the plan will be the involvement of the community. He mentioned a break-the-cycle program which will be headed by Dr. Joan Jackson Johnson addressing issues of young people. The Chief expressed his appreciation to Board members for their willingness to serve the community by their participation on the Board. He believes that volunteer boards are very important. Finally, he noted that Part One crimes are down 9.9% this year. Commissioner Sims commented that this weekend, officer visibility was particularly good. Commissioner Farhat expressed her appreciation to having for additional Neighborhood Watch Officer. She is quite pleased with Ofc. Sarah Nolen. Commissioner Farhat — expressed her appreciation to the Mayor and LPD administration for the recent Lansing Lugnuts outing. She announced that she has made arrangements to acquire Board of Police Commissioner polo shirts at a cost of $20.00 each with an extra $8.00 to cover embroidery. See her if interested. She distributed information on the Lewton-Rich neighborhood picnic being held this Thursday and commented on the successful, but hot, Target Night Out event. City Council presented the Neighborhood Watch National Night Out with a special recognition award. Finally, she congratulated Councilmember Quinney on his recent primary win. Commissioner Kolp — called today's discussion with City Council members "a real success" and commented on the recent community forum addressing neighborhood concerns on the murder of activist Ruth Hallman. She compared it to a small town meeting and said that Chief Alley and Mayor Bernero were both excellent in their participation. Commissioner Carnegie—had no additional comments. Commissioner Renfrew — expressed his appreciation for the presence of County Commissioner Dale Copedge at today's discussion. He commented that these discussions should happen more frequently and spoke highly of Chief Alley, LPD captains, sworn personnel and support staff. Commissioner Kowalk — noted that the good turnout by councilmembers today was a positive comment on the Board's credibility. She apologized for missing several meetings recently and commended Board members for their involvement in events surrounding the murder of Ruth Hallman. It showed character. PUBLIC COMMENT-Agenda Items Tom Krug, Executive Director of the Fraternal Order of Police, addressed the Board concerning the ongoing problems with the new radio system. He said that he has seen a "snowball effect" over the past few weeks and wished to make the Board aware of officer concerns. He discussed the coverage problems in the southwestern area of the City as well as the dropped / missed calls. He feels that the County signed off its acceptance of the system prematurely and he requested that the Board voice its support of the County Commission's Law Enforcement Committee in its efforts to address the problems. Board members responded by noting that they have been kept informed of the problems on an ongoing basis. Chief Alley distributed a prepared update to Board members and voiced his support for Chief Radio Engineer Jeff Kludy's ability to analyze needs and work with the vendor to made sure they are addressed. The Chief discussed microphone concerns and fixes as well as various attempts to identify the problem of dropped/missed calls. Board members discussed the magnitude of radio problems in Lansing as opposed to smaller communities and outlying areas. They also discussed the forthrightness of Lansing officers in making the administration aware of concerns. Tom Krug commended LPD administration as it has "always" been open to officers concerns no matter how frank they are. Commissioner Renfrew requested whether technological difficulties might occur due to frequency interference from the various pieces of equipment within the patrol car. Chief Alley agreed to see if this possibility had been investigated. Mr. Krug thanked the Board for their attention. ADDITIONS TO THE AGENDA Jim DeLine reminded the Board of the upcoming Lugnuts game and of their desire to make individual contributions toward a PAL tee sponsorship. He also asked the Board to make clear their wishes for an August meeting. It was the consensus of the Board that the August meeting be a lunch meeting held on August 14 and that, in lieu of an education presentation, City Council members be invited for an open forum discussion on police matters including the radio system. EDUCATIONAL PRESENTATION Michael Mathis, LPD Legal Advisor, shared information on his recent training in Glynco, Georgia. This training, funded with Homeland Security funds, was held on a former air / naval base and included approximately 4,000 people with 30 of them focused on police legal administration. Training included classroom discussions, played out scenarios, homework assignments and debriefings. They dealt with constitutional matters and potential conflicts given legal advisors varying responsibilities. Mr. Mathis passed around texts used and cds used in the training. He characterized it as"very worthwhile." ADMINISTRATIVE REPORT—Chief Alley Chief Alley reviewed the recent Common Ground festival and commended Lt. Lisa Phillips for doing a "fantastic job." There were few incidents. He apologized to Board members for not being able to supply them with single day tickets as in past years. The Chief announced the recent medical disability retirement of Lt. Steve Mitchell and noted that Sgt. Mike Yankowski is being promoted to lieutenant and Ofc. Brian Ellis is being promoted to sergeant as a result. Other changes will result from shift picks and from a rotation of Lieutenants Baylis, Horning and Medrano. He gave an update on homicides and, in response to an inquiry from a Board member, discussed the use of pepperball guns in the detention center. He thanked those Board members who attended the memorial service for canine officer, Pluto, who served LPD very well. Chief Alley noted that the National Night Out flyer is currently under review by the Mayor's office and should be available for distribution soon. He also noted that he will meet with Bob Alexander yet this week related to the African American Parade and Family Picnic. In answer to questions from Board members, the Chief clarified his position on the Governor's plan for the reduction of many prison sentences. In a public forum, he told Gov. Granholm that, "we have our concerns." He also discussed enforcement of fireworks ordinances. Chief Alley responded that, in fact, they were down for the year, but delivery people and convenience stores are being hard hit. Commissioner Kolp noted that arrests are down and asked if that were correlated to a reduction in crime or a shortage of personnel. She also asked the Chief to discuss slow response times. Chief Alley commented that crime is down. He also discussed the increased officer involvement at emergency calls and, for emergency calls said that we have a "great" response time. Un CALL TO ORDER -Commissioner Farhat The start of the meeting was delayed as the Board was offered the opportunity to sit in on a START pre- deployment briefing. After having established a quorum, Commissioner Farhat called the meeting to order at 5:40 p.m. PUBLIC COMMENT -Agenda Items None ADDITIONS TO THE AGENDA None EDUCATIONAL PRESENTATION Sgt. Steve Relyea, START Team Supervisor, discussed the planning which precedes a callout of the unit for a drug raid including the pre-deployment briefing just witnessed by the Board. The START Team was established with a federal grant in 1973 and began with just six members. It now has forty-one members rotating in on incidents and includes Canine Officers, the 911 Communications Center, and negotiators. They average 150 callouts per year. Sgt Relyea showed and discussed the many equipment items used by the team and told the estimated cost of each item. He discussed the team's work with other area municipalities and its adherence to "Use of Force" procedures. He also discussed the many teams- within-teams such as perimeter team, hostage rescue team, supervisory team, etc. He discussed the qualifications for joining the START Team and, in answer to a question from the Board talked about how people rotate in/out as incidents occur rather than form set response teams that always work together. Finally, he gave a brief overview of the range, itself. ADMINISTRATIVE REPORT—Chief Alley Chief Alley discussed raids including potential problems and the many possible forfeitures which can result. He announced the Mayor's upcoming camp for HOPE scholars and his office's recent issuance of Board of Police Commissioners Meeting Minutes of June 19, 2007 Page 2 approximately 500 thank-you letters to HOPE supporters. He told the Board of the recent "Touch A Truck" promotion held at the North Precinct which drew 500—600 people. The Chief invited all to come to "Blues on the Square" being held most Thursday evenings in the 200 block of Washington Avenue. This new event features good music and many participating vendors. He discussed the staffing of Common Ground this year, noting that by adjusting staff to meet the demands of varying music venues, he is looking forward to another great year. Chief Alley noted that he would not be available to attend the August Board meeting as presently scheduled. After some discussion, the consensus of the Board was to move the August meeting to August 14 at 11:30 a.m. at the South Precinct. Jim DeLine will ensure that the requirements of the Open Meetings Act are met. APPROVAL OF MINUTES -Commissioner Farhat Commissioner Mejorado noted corrections to a recognition awarded to her and to the correct speaker in the Other Business section. Commissioner Sims noted a correction to the Attendance table. The minutes of the regular meeting of May 15 were approved as corrected and placed on file. FRATERNAL ORDER OF POLICE No representative present CORRESPONDENCE -Commissioner Farhat Commissioner Mejorado noted how impressive the apology letter was which was submitted by a truant high school student. Commissioner Sims noted that the letter of recognition reference Sgt. Darin Southworth was very good. Correspondence for the month of May was accepted and placed on file. DEPARTMENTAL REPORTS Departmental Reports for the month of May were accepted and placed on file. BOARD COMMITTEE REPORTS Liaison Committee — Commissioner Noordhoek led a discussion on potential gatherings with City Council. Ideas included meeting at either the zoo or Hawk Island, or inviting Council members to the August mid-day meeting and encourage a dialog in lieu of the monthly educational presentation. Awards & Incentives Committee — Commissioner Mejorado was very pleased with the May 16 awards ceremony. Budget Committee— No report. Complaint Committee - The Committee's June meeting is not yet set and the May meeting was not held. There is little to review at the present time. Commission Investigator Report — Bernard Brantley closed three cases in the past month. He commented on how well Dr. Joan Jackson Johnson is able to handle difficult/challenging people. Board of Police Commissioners Meeting Minutes of June 19, 2007 Page 3 HUMAN RELATIONS AND COMMUNITY SERVICES LIAISON Joan Jackson Johnson discussed the state of the Oliver Towers proposals and also changes occurring at the Salvation Army. She discussed the community summits which she and Chief Alley are planning. The first is scheduled for July. It is hoped that these forums can help educate the community on substance abuse, domestic violence and hunger issues and will be received positively. She announced that her staff is receiving mediation training and commented that this training may also be appropriate for police officers. In response to questions from the Board, she and Commissioner Sims discussed the recent Diversity Day noting that it was well planned and contained good events and entertainment, but the attendance probably suffered due to the many community events being held the same day. She also reminded the Board that discretionary funds are held by each Council member which may be available for special needs which the Board may identify. COMMISSIONER COMMENTS Commissioner Kolp — treated the Board to delicious homemade cake. She updated the Board on the South Precinct Advisory Board's challenges to hosting events such as the luncheon to honor students for overcoming adversities and the Chat with the Chief. She feels these important events may have better volunteer support if they also include the North Precinct. She is very appreciative of the North Precinct Captain, Ray Hall, for his successful acquisition of needed tables. Commissioner Renfrew — announced his upcoming surgery for his ankle. The entire Board wishes him the best. Commissioner Mejorado — expressed her appreciation to Chief Alley for the weekly updates. His office does a terrific job. She also wished to make the Board aware of a new Cost Recovery ordinance being drafted which will pertain to the expense of executing a drug raid. Commissioner Carnegie — also expressed his appreciation for the updates. He is encouraged by the many summer activities occurring in the City and the positive presence of the Police Department at them. People visiting Lansing are sure to be impressed. He expressed his appreciation to the Department for the escort provided at a recent funeral. This showed great sensitivity was a positive community relations act. He also expressed how impressive (and efficient)the awards ceremony was this year, particularly in light of the reduced funds available. The committee did an excellent job. Members of the Board agreed and requested Jim DeLine prepare a letter for the Board Chair's signature showing its appreciation to Sgt. Nettles and the committee. Commissioner Sims — discussed community concerns regarding a motorcycle club which has a growing presence on South Martin Luther King, Jr. Boulevard. She discussed how she and Chief Alley met with a representative from Battle Creek and their Legacy Scholar program. She announced that this year's African American Family Parade will be held on August 4 and congratulated Commissioner Renfrew on his graduation from Michigan State University. She also expressed appreciation from the Visitors and Convention Bureau for LPD's support of the Be a Tourist in Your Own Town event. Commissioner Noordhoek — commented on how well the awards ceremony went. The committee did a great job, but it's too bad not all recipients were in attendance. He expressed his appreciation to the FOP for inviting him to the 40`h Annual Picnic. It was a nice event. He also echoed the positive comments on the weekly updates. It's too bad everyone isn't made aware of the many positive things going on. Commissioner Kowalk— communicated her comments via Commissioner Farhat. She is suffering from a head cold and is unable to attend tonight's meeting. She congratulates Sgt. Ryan Cressman for winning the law enforcement community race at Springport Raceway to benefit MADD. She attended the race to support Sgt. Cressman. It was very exciting. She also congratulates Sgt. Darin Southworth for being Board of Police Commissioners Meeting Minutes of June 19, 2007 Page 4 selected to light the flame of hope to officially begin the Special Olympic Summer Games. What a great honor for Sgt. Southworth and the Lansing Police Department. Commissioner Farhat — encouraged everyone to attend the neighborhood garage sale going on this weekend in her neighborhood. She also noted her upcoming neighborhood picnic and the August 2 annual Board use of the City's Lansing Lugnuts suite. She discussed the grant award of$750 to be used toward the award ceremony and expressed her appreciation to Detective Vicki Dahlke for the apprehension of the hit-and-run driver who caused injury to her uncle. OTHER BUSINESS PAL Sponsorship — Commissioner Farhat reminded the Board that the PAL Golf Outing would be coming up in early September and the Board has traditionally sponsored a tee flag at the $100 level. It was the consensus of the Board that they continue this tradition. Members should give $12.50 each to Jim DeLine who will arrange the sponsorship. Election of Board Chair/Vice Chair—Commissioner Farhat nominated Commissioner Noordhoek to be Chair of the Board for the coming year. She has been very thankful for his dignified service to the Board. Commissioner Renfrew nominated Commissioner Mejorado for Vice Chair. Her being named to a Board leadership position is overdue. He discussed his training and the curriculum used and also went through a "typical day" on the job. He commented on how welcome he is by the schools and how he is gaining the trust of even some very difficult kids. In answer to questions from Board members, Ofc. Macon noted that he performs his duties at the schools while in uniform, and yes, he does have to do prep work to present each day's lesson. He is very grateful for the mentor he has from his national training and feels he gets support from the Chief, Captain and Lieutenant. He feels the project is very worthwhile. "It's about the kids," he commented. They do great work and are very receptive. "I couldn't be prouder of them." ADMINISTRATIVE REPORT—Chief Alley The Chief commended Officers Macon and Anderson for the "wonderful"job they are doing in the GREAT program. He also announced that the year's first homicide had been solved by the North Precinct Detective Bureau. Recently, he met with County officials concerning the 911 consolidation. Plans are continuing with proposals being offered by East Lansing to continue using two centers. Chief Alley felt that the recent LPD budget hearing in front of Council's Committee of the Whole, went well. He reminded the Board that he and Joan Jackson Johnson are continuing to form outreach efforts Board of Police Commissioners Meeting Minutes of May 15, 2007 Page 2 which will soon be presented to the Mayor before being rolled out. He commented on the recent Law Enforcement Memorial Ceremony hosted by LPD. He commended Commissioner Carnegie for his participation and also Capt. Szymanski, LPD clerical staff, and the advisory board for handling the logistics necessary for this meaningful event. The Chief announced the passing of retired Officer Greg DeSonia, a 25-year veteran of LPD. He noted with sadness the difficulties that his widow endured as her home was struck by lightning in the days following Greg's death. Recently the Chief attended a meeting of the Neighborhood Watch Advisory Board. He noted that is was good to stop in and he noted that this board is doing a "fantastic" job. He reminded everyone of the Homerun for HOPE fundraiser being held this Saturday and announced that, for the first time, the annual awards ceremony being held this week is scheduled to be videotaped so that it may be televised on the City cable channel. Commissioner Farhat commented that she was successful in procuring a grant award of$750.00 toward the event. As part of the Administrative Report, Jim DeLine announced that the Board has been granted use of the City suite at Oldsmobile Park for the evening of August 2. He also announced that LPD will be represented by Sgt. Ryan Cressman at an upcoming stock car race to raise money for MADD. Commissioner Renfew asked the Chief to comment on coverage at local high schools in light of the comments in the monthly report (p. 16, p. 24)which made it seem that two schools were without coverage for the month. Chief Alley noted that there was some coverage miscommunication which has been cleared up. Commissioner Kolp asked the Chief to comment on the quickness of shutting down drug houses. The Chief said that drug houses weren't necessarily being shut down quicker, but the REACH unit under the supervision of Lt. Larry Klaus is doing some very"good raids." UNFINISHED BUSINESS -Commissioner Farhat Commissioner Renfrew asked if there was an update on the 911 communications technicians having access to the Ottawa Street doors. Commissioner Farhat reported that she has been in contact with the appropriate maintenance personnel and the project is scheduled to be completed in July. The delay is primarily due to the need for a revision of the swipe card system which will be utilized at the exit. Board of Police Commissioners Meeting Minutes of May 15, 2007 Page 3 BOARD COMMITTEE REPORTS Liaison Committee — Commissioner Kowalk has been in contact with Councilmember Carol Wood, who agreed that a joint activity would be appropriate, particularly due to turnover in both Council and in the Board. Everyone should be on the lookout for an appropriate event. Awards & Incentives Committee — Commissioner Mejorado reminded everyone to attend the May 16 ceremony. Budget Committee— No additional report to Chief Alley's comments. Complaint Committee - The Committee is meeting on a regular basis. It was noted that the Notification of Sexual Harassment Complaint was placed in the monthly packet by the Internal Affairs Lieutenant per procedure and is for information only. Commission Investigator Report— Bernard Brantley reported that he received the sixth complaint for the month today. He is not looking forward to interviewing a complainant currently in the Ingham County Jail. He has some concerns about confidentiality and will work with Michael Mathis regarding these concerns. HUMAN RELATIONS AND COMMUNITY SERVICES LIAISON Joan Jackson Johnson announced that she "survived" her budget hearing. She noted that, with the announcement that officers may make referrals to her Department, a few have been forthcoming. Bernard Brantley is assisting with them. Dr. Jackson Johnson also said that HR&CS plans to be very proactive this summer. She discussed the problem of people who lose their homes due to code compliance issues (even if no drugs are involved). The State has cut off emergency aid for utility bills which compounds the problem; however some Federal funds are available. Finally, she reiterated her appreciation to the Board for its support of Bernard Brantley lending assistance on HR&CS projects when time permits. COMMISSIONER COMMENTS Commissioner Carnegie — spoke highly of the UAW ceremony honoring Commissioner Mejorado. He is honored to work with her. He commented that community recognition boosts the stature of the Board as a whole as well as the individual member involved. Commissioner Renfrew—expressed his appreciation to Jim DeLine and Chief Alley for arranging tonight's outstanding Education Presentation given by Ofc. Macon. He also announced that he will participate in a sunset memorial on May 25 for Ricky Rosas, who died in Iraq. Commissioner Kolp—congratulated Commissioner Mejorado on her community recognition. Commissioner Kowalk — commented on how emotional the Law Enforcement Memorial Ceremony was and encouraged everyone to attend in the future. She apologized for her absence at the Lugnuts game where the Board was hosted by the Visitors and Convention Bureau and noted that she will be present at the awards ceremony, though will have to leave early. She informed the Board of a situation at the Boy's and Girl's Club where the driver of a stolen car entered the parking lot in what could have been a very dangerous situation. She was very impressed with the manner in which the officers handled things and was told by Sgt. Ryan Cressman that he was very proud of the officers' conduct as well. Finally, she congratulated Commissioner Mejorado on her recognition. Commissioner Mejorado — announced that she was recently the recipient of second community recognition award, this one related to the LCC Cinco de Mayo celebration in recognition of her Board of Police Commissioners Meeting Minutes of May 15, 2007 Page 4 contributions to the local Latino community. And she expressed her appreciation to Commissioner Carnegie for his contribution to the UAW award ceremony. She invited everyone to the upcoming LPD awards ceremony, to the Latin American Coed Softball event and to the Cristo Rey Festival She announced that her grandson will be playing ball for Eastern High School in the Homerun for HOPE event. Commissioner Noordhoek— congratulated Commissioner Mejorado on her recognition awards and noted how moving the Memorial ceremony was. Good job by both LPD and Commissioner Carnegie. He also commented on how good the Educational Presentation was tonight. Commissioner Farhat— congratulated our new MSU graduate, Commissioner Renfrew, and commented oh how enjoyable it was to meet Commissioner Mejorado's family at the UAW awards presentation. She also expressed her appreciation to Commissioner Sims for hosting the Board at a Lugnut's game and expressed her appreciation to Ofc. Bob Tucker for his problem-solving skills which were utilized at a recent parent drop-off predicament at Lewton Elementary School. Finally, she announced a $750 grant award to the Neighborhood Watch for assistance with signage. OTHER BUSINESS Per a request from Commissioner Mejorado, Michael Mathis gave a verbal report on his recent training held in Glencoe, Georgia. While the week involved approximately 4,000 people receiving law enforcement training, his class consisted of thirty individuals specifically enrolled in a legal advisor class. Topics included issues presented by the fourth, fifth and sixth amendments, using teaching methods including lectures, videos, role playing and debriefing sessions. Commissioner Kowalk suggested that Michael be scheduled as a future Educational Presentation. The consensus of the Board was this would be worthwhile and the secretary will arrange it. Szymanski also offered those present tickets to a performance of the Blue Light Players PUBLIC COMMENT-Agenda Items None ADDITIONS TO THE AGENDA None EDUCATIONAL PRESENTATION Officer Tony Sandoval, School / Community Resource Officer for Eastern High School, went through a typical day relating his relationship with the students, public safety officers, faculty and staff at the school. He highlighted particular problems such as trespassing and use of controlled substances. He is proud that he is now gaining the confidence of students and they confide in him. In answer to questions from Board members, Ofc. Sandoval discussed relationships with parents, gangs and information sharing with the other three School / Community Resource Officers. When asked if he liked the assignment, he said that he did. He concluded, "We are accomplishing our goal." ADMINISTRATIVE REPORT—Chief Alley Prior to Chief Alley's report, the Board expressed condolences on the loss of his father. He thanked them for their thoughts and prayers as well as flowers and their presence at the visitation and service. The Chief reported on the Active Violent Intervention (AV]) philosophy in recognition of the recent shootings at Virginia Tech. LPD uses AVI which calls for confrontation with the shooter as soon as possible. He also reminded the Board of the Department's switch to rifle use as opposed to shotguns. Board of Police Commissioners Meeting Minutes of April 17, 2007 Page 2 He expressed his appreciation to Board members who attended the LPD staff recognition of Emly Horn and Denise Packer for their assistance in helping to unravel the actions by the accused in the NYPPP office. They were instrumental in getting evidence which led to fraud convictions. He reminded everyone of the May 16 award ceremony to be held in Council Chambers from 6:00 p.m. to 9:00 P.M. Chief Alley brought the Board's attention to the letter from the FOP directed to the Ingham County Board of Commissioners. He is in agreement with the request for County funds to address the difficulties which LPD has experienced with the new radio system. He anticipates that the funding will be granted. He acknowledged the work Jeff Kludy, of the LPD Electronics Equipment Maintenance Unit, has performed to address officer concerns. The Chief updated the Board on the FY2008 budget process noting that a "pre-budget" hearing was held recently before City Council which was meant to address operations questions. He commended Jim DeLine for having the administration well prepared for the hearing. The LPD administration will have its budget hearing on May 2. He announced the attendance of Michael Mathis at a special training school for legal advisors. Chief Alley spoke highly of Michael's experience noting the advantages of networking with other legal advisors and being presented with new ideas. He announced that an agreement with the FOP (non-supervisory, supervisory and 911 units) regarding their unfair labor practices charge has been reached. Their concern was with the Blue Team system of reporting complaints and use of the new matrix discipline system. The administration will address these concerns with some changes to the procedure which will come before the Board in the near future. Chief Alley announced a forfeiture gain of approximately $266,000 due to a special operations investigation. The case will go through the court system and, when all is said and done, LPD will receive about 80% of the funds. Board members commented on their appreciation of weekly "good news" e- mails from the Chiefs office. Finally, he noted his recent attendance at a "train the trainer" school for incident command and encouraged all to attend the HOPE scholarship event, "Homerun for HOPE" on May 19. FRATERNAL ORDER OF POLICE No representative present CORRESPONDENCE -Commissioner Farhat Commissioner Sims introduced a discussion on the discrepancy between sentences among those Board of Police Commissioners Meeting Minutes of April 17, 2007 Page 3 involved in the NYPPP fraud case (p. 11 of March packet). Chief Alley noted that often the choice of lawyers and the plea system can result in differences among defendants' sentences. Correspondence for the months of February and March were accepted and placed on file. DEPARTMENTAL REPORTS Commissioner Kowalk commented on the seeming discrepancy on the precinct reports when they report zero murders, yet in the narrative discuss recent homicides (p. 22 of March packet). Chief Alley agreed to resolve this issue. Commissioner Sims noted that the homicide mentioned was not defined as a homicide for several days. Chief Alley commented that the prosecutor's office makes that determination. Departmental Reports for the months of February and March were accepted and placed on file. Commissioner Sims reported on a recent discussion relative to Bernard Brantley's role within the Human Relations & Community Services structure as he is physically located on their floor and can make himself available at times to assist them. Commissioner Kowalk requested that his report differentiate between activities for the Board and those for HR&CS. Commission Investigator Report — Bernard Brantley was not present. His activity report is included in the monthly packet. HUMAN RELATIONS AND COMMUNITY SERVICES LIAISON Joan Jackson Johnson announced that her Department is downsizing by one position in the budget currently under discussion. She appreciates the times when Bernard Brantley is able to assist and acknowledged that his first responsibility is to the Board. Dr. Jackson Johnson informed the Board that she and Chief Alley are working together to address joint outreach concerns and expects a plan to be in place by fall. She discussed the use of "formal referrals" by LPD officers and noted that they are useful in getting a situation addressed on a timely basis. Chief Alley informed her that the use of referrals by officers had been discontinued at the request of a prior HR&CS Director. Dr. Jackson Johnson assured him that their use is being restored and that he may inform the sworn personnel of that. She also discussed a homeless ordinance passed by the East Lansing City Council and noted that this is a regional problem requiring both funds and inter-governmental cooperation. In a discussion of sobering centers, she noted the need for working with area hospitals and that a female sobering center also needs to be considered. COMMISSIONER COMMENTS Commissioner Noordhoek — commended Dr. Jackson Johnson on her active participation in discussions on community issues. Commissioner Kowalk — commended Dr. Jackson Johnson on her involvement and also expressed her appreciation to Michelle Reddish for assisting in transportation to the funeral of Chief Alley's father. Board of Police Commissioners Meeting Minutes of April 17, 2007 Page 4 Commissioner Renfrew — voiced his support for Dr. Jackson Johnson and informed the board of his participation in the upcoming services commemorating the anniversary of the death of a local man killed in Iraq. Commissioner Carnegie — welcomed Commissioner Mejorado back to Michigan and commended Dr. Jackson Johnson on her contributions to Board meetings. Commissioner Mejorado—said it was good to have Dr. Jackson Johnson on board. She reminded Board members of the Cesar Chavez dinner to be held tomorrow and also announced the upcoming UAW celebration honoring local people for their contributions to the community. She and her husband are this year's recipients. Commissioner Kolp — welcomed Commissioner Mejorado back and expressed her appreciation to Chief Alley for"all that you do." Commissioner Sims — announced that she is heading into a very busy time due to work and family commitments and apologized in advance if she is unable to attend some Board functions. She also announced that she had one ticket to the Cesar Chavez dinner available should someone need one. She continues to work on the May 19 diversity celebration. The event is in need of funding and prizes. She invited Board members to the May 11 game of the Lansing Lugnuts as guests of the Visitors and Convention Bureau in their suite. She will work with Jim DeLine to arrange distribution of the available tickets. Commissioner Sims informed the Board that Terry Curry, known to the Board as the outside consultant on several Department matters, including revision of the disciplinary system, has been appointed to the positions of associate provost and associate vice president for academic human resources at Michigan State University. Finally, she related an experience at the jail as she and Joan Jackson Johnson worked with a young man from New Orleans come to grips with his situation. She commented that when Dr. Jackson Johnson arrived at the jail, "everyone knew her." Commissioner Farhat — informed the Board of a recent situation with her uncle who was in a serious accident. Det. Vickie Vaughan is working diligently on the case, but sadly, the uncle is not in good shape. She expressed her appreciation to Chief Alley for the Department's efforts. ADMINISTRATIVE REPORT—Chief Alley Chief Alley informed the Board of discussions with the FOP regarding a possible move to 12-hour patrol shifts. Union members voted against making such a move. The current 10-hour shift format is very Board of Police Commissioners Meeting Minutes of January 16, 2007 Page 2 popular. The Chief distributed a packet compiled by Lt. Judy Horning comparing Lansing to other Michigan cities in several areas. This "bench marking" exercise was prompted by the Mayor's office and, as noted by Chief Alley, resulted in demonstrating that LPD is typically near the middle of the highs and lows seen elsewhere. Areas reviewed included calls for service and size of the sworn workforce. Without objection, Chief Alley's budget update was combined with the monthly report of the Budget Committee. Commissioner Farhat commended the committee for including notes from their recent meeting in the monthly packet. Commissioner Carnegie commended the Department on the thoroughness of its budget document and expressed his confidence in Department personnel to address budgetary concerns. Jim DeLine noted that the budget document was not a requirement of the City administration. Instead, they required submission of three scenarios whereby the Department would be funded at the 95%, 90% and 85% level. This packet had been submitted earlier in the day. Commissioner Noordhoek requested what items / services would be cut per our scenarios and Jim went over them. It was the consensus of the Board that they support the FY2008 funding of the Department at the 100% level. The budget committee moved the following: "The Budget Committee moves the acceptance of the Lansing Police Department's FY2008 budget proposal at the 100% funding level and direct that it be forwarded to Mayor Bernero for his consideration. We further voice our support of Chief Alley and his staff in discussions with the Mayor as a final proposal is prepared for presentation to City Council. We are confident they will ensure the integrity of the Department and its mission at whatever funding level is ultimately deemed appropriate." The motion was passed unanimously. Chief Alley reported that Jerry Ambrose and Angie Bennett had begun getting staff input on budget needs by holding a forum with Police Department employees. The Chief was pleased that 75 employees were in attendance which, he felt, showed that our employees care about this crucial area. He also noted that this was a positive thing for the administration to do. Continuing with the Administrative Report, Chief Alley updated the Board on two recent homicides, noting that last year the City had only six homicides, a record low. He announced that one of the two 2007 homicides had been solved. He talked about the Lapeer Street neighborhood where one of the homicides had taken place. This is a "very engaged" neighborhood and the City will accommodate their request for the placement of traffic barriers to stem the flow of vehicles in the area. This "crime prevention through environmental design" has been used effectively in other areas. Plans will be made to replace barriers with a more aesthetic permanent curb redesign at a later date. Another active neighborhood he discussed was the Baker Street area, where the ACORN group had recently begun approaching speeders in their neighborhood. Sgt. Yankowski will meet and discuss this and alternatives. Statistically, it appears that drivers in the area are no more inclined to violate speed limits than those in other neighborhoods. The Chief expressed his appreciation to Board members who attended the inaugural kick-off of the Lansing Police Historical Preservation Association. It was a special day for him, for past Chiefs of Police and for other LPD retirees in attendance. He commended retired Deputy Chief Jim Heyden, Jim's wife Pat, and the entire association committee. LEGAL UPDATE Michael Mathis had no report, noting that if the Department were analogous to a tanker, he is not the pilot, but"just a guy helping to patch the leaks." Board of Police Commissioners Meeting Minutes of January 16, 2007 Page 3 DEPARTMENTAL REPORTS Commissioner Sims brought the Board's attention to the newly designed staffing report (p. 9). Commissioner Farhat inquired as to the GREAT grant (p. 9) and Chief Alley explained the grant-funded program which brings gang resource officers to local middle schools. The program's summer activities are centered at the Boys and Girls Club. Departmental reports for the month of December were accepted and placed on file. BOARD COMMITTEE REPORTS Liaison Committee— Commissioners Farhat, Noordhoek and Carnegie attended the kick-off the Lansing Police Historical Preservation Association. Commissioner Farhat asked if plans were being developed for a joint activity with City Council. It is believed that Council President Leeman is still aware of the Board's desire for a joint activity. Further inquiry will be made once that vacant Council seat is filled. Awards & Incentives Committee — Commissioner Farhat has submitted a grant request for additional funding for the awards ceremony.. Budget Committee— included in Administration Report above. Complaint Committee - Commissioner Noordhoek announced that the next committee meeting is scheduled for January 25. Commission Investigator Report— Bernard Brantley had nothing further to add to his report in the monthly packet. HUMAN RELATIONS AND COMMUNITY SERVICES LIAISON Dr. Joan Jackson Johnson was not present due to a conflict with budget matters. She sent word to the Board that she is hopeful that she will soon be able to attend Board meetings on a regular basis. COMMISSIONER COMMENTS Commissioner Renfrew—had no additional comments. Commissioner Sims — related an incident of a five-year-old youth who had the awareness to phone the police when needed. She is looking forward to a new riverfront association. She also commended Mr. Brantley for his e-mail on the history association and to Chief Alley for the updates which generate from his office. She asked him to review under what conditions Board members receive phone calls. The calls are very appreciated. Commissioner Noordhoek— expressed his appreciation to Chief Alley for the update on twelve-hour shift concerns and his availability to address questions on same. He also commented on the positive new officer event and the historical association's event. He expressed his appreciation to Commissioners Carnegie and Renfrew, and to Jim DeLine, for their work on the budget. Commissioner Farhat —expressed her appreciation to the Department for successfully apprehending the "balcony bandit." She also expressed her appreciation to Sgt. Frank Koenigsknecht for his attendance at the recent Neighborhood Watch meeting. She commented favorably on the Department holiday parties and the South Precinct Advisory Board's new hire reception. She updated the Board on the health of Commissioner Kolp and spoke favorably of the historical association's kick-off and the annual MLK, Jr. luncheon.
