There was a quorum. Present: Cal Osterhaven, City Attorney Roy Pugh, Building Safety Dave Card, Public Service Staff: Vernon Fountain, Planning Department Michael Gillison, Planning Department Absent: Dave Berridge, Traffic Engineer Hearings FYP #186 - 3830 Churchill This is a request by Carlos A. Zapata, of 3830 Churchill Street, to widen his driveway. Mr. Zapata was not present. Mr. Zapata states on his application that he has three (3) vehicles and at present time parking one in garage, two (2) outside even with both right together one hangs over sidewalk and he has been given tickets by the police department. Mr. Zapata also stated in his application that he has a son that will be moving away in about 6-8 months, therefore the area will be only temporary, because there will only be two (2) vehicles. Mr. Zapata also hopes to sell the home in one (1) year and move to Florida, therefore the parking would not be needed possibly by the new owners. Card made a motion to approve the request. Second by Pugh. Motion carried. Yeas - Card, Fountain, Osterhaven, Pugh. Motion APPROVED. The Front Yard Parking Administrative Committee approved the request to widen the existing driveway to the south an additional six feet giving a total of sixteen feet of driveway, with a drive approach to match. The Committee found, based on testimony and evidence, that the change would not seriously affect the adjoining properties or the general welfare and is in keeping with the general intent of the Code. . FYP Minutes Page 2 FYP #187 - 2800 Chatham This is a request by Barbara J. Thornburg, to widen the existing driveway an additional eight (8' ) feet upon the premises known as 2800 Chatham. Ms. Thornburg was present. Ms. Thornburg stated her request was to expand the existing driveway to allow access for parking extra vehicles. There are five (5) vehicles at her residence. She has two (2) children staying with her until they graduate in June. Osterhaven made a motion to approve the request. Second by Card. Motion carried. Yeas - Osterhaven, Pugh, Card, Fountain Request APPROVED. This request was approved with the stipulation that the area be hardsurfaced with either asphalt or concrete by July 1, 1982. The Committee found, based on testimony and evidence, that a hardship did exist, and that the change would not seriously affect the adjoining properties or the general welfare and is in keeping with the general intent of the Code. FYP. #188 - 1311 Mark Twain CThis is a request by Michael D. Chaffee, to widen the existing driveway an additional seven (7' ) feet, giving a total of seventeen (17 ' ) feet of driveway. Mr. Chaffee was not present. Mr. Chaffee stated on his application "to permit approach to an extra parking space". He also stated that he would like to park his car behind the front line of the house but needed access to it. He has two cars and this would allow both to be parked out of the front yard. Jessica Gilbert of 1317 Mark Twain, objects to the request. Osterhaven made a motion to approve the request. Second by Pugh. Motion carried. Yeas - Card, Fountain, Osterhaven, Pugh. Request APPROVED. This request was approved with the stipulation that the area be hardsurfaced with either asphalt or concrete by July 1, 1982. FYP Minutes Page 3 C. FYP #189 - 2016 Lyons This is a request by Maynard Middleton to enlarge the existing driveway in the required front yard upon the premises. Mrs.Middleton was present. Mrs. Middleton requested to widen -the-..driveway six (6' ) feet to allow the parking of a fourth vehicle. The driveway is too short to accommodate four (4) cars. Would like to widen it six (6' ) feet to extend the width of the front porch. There is only room for three (3) vehicles in the driveway. One (1) car is parked in front of the porch overnite only. There is no way to get to the backyard. The garage is stored for motorcycles, snowblowers, etc. Osterhaven made a motion to deny the request. Second by Pugh. Motion carried. Yeas - Pugh, Card, Fountain, Osterhaven Request DENIED. This request was denied. The Committee found, based on testimony and evidence, that this would establish parking directly in front of the house which is not in keeping with the- general intent of the code. The Committee further believes that there is adequate room to park in the existing drive if the garage was properly utilized. The Committee believes that approval of this request would extend beyond the general intent of the Code. It was further discussed that someone in the Planning Department would go out and check the length of the driveway and measure the cars. FYP #190 - 2121 West Mt. Hope This is a request by Gordon Clinger to widen the existing driveway an additional twelve (12' ) feet. Mr. Clinger was present. Mr. Clinger requests to expand his driveway for parking along the side of the garage, not in front of the house, for one (1) car. He and his wife both have cars and work different hours. Mrs. Clinger's mother now lives with them and also owns a car. They have a two (2) car garage. There is no parking in front of the house from 7:00 a.m. - 7:00 p.m. Because they have three (3) vehicles they are constantly moving cars around. Mr. Walrath of 2200 Belaire Drive, wrote a letter of approval to the request. Card made a motion to approve the request. Osterhaven second. Motion carried. Yeas - Pugh, Card, Fountain, Osterhaven ``` Request APPROVED. FYP Minutes Page 4 This request was approved with the stipulation that the area be hardsurfaced with either asphalt or concrete by July 1, 1982. The Committee found, based on testimony and evidence, that the residence fronted on West Mount Hope Avenue, a major arterial and having to switch cars and back out onto West Mount Hope Avenue, can be hazardous. The Committee believes that the change would not seriously affect the adjoining properties or the general welfare and is in keeping with the general intent of the Code. Osterhaven made a motion to approve the minutes of the December 3, 1981 meeting. Second by Pugh. Motion carried UNANIMOUSLY. Fountain, Zoning Administrator Michael Gillison, Zoning Officer HEARINGS FYP #191 - 1032 South Pennsylvania This is a request by Velma Suchanko, of 1032 S. Pennsylvania Avenue, to allow parking for an apartment. On her application, Ms. Suchanko stated that she used the lot next door for 32 years, now it is sold and there can' t be parking C there. Having a single drive and narrow lot, she has no other choice. The lot is only 40 feet wide with no way to set parking even in back yard with the garage. Need the front lawn parking which of course will tar or cement and landscape. There is no parking on the street, which was allowed for all night at the time the house was moved there. Ms. Suchanko said there is no way to rent the apartment without the variance. Presently has a pick-up and three cars. Osterhaven - move the garage. Berridge - park one vehicle in the garage and three in the driveway. Pugh - tear down the garage. Suchanko - do not want to tear down the garage, use it for storing snow plow, deep freeze, etc. Fountain - move the garge or use the Industrial building land to the south to shuffle cars. If the request is granted, will set precedent to other residential homes. Lease the north side yard from the Industrial Building. Osterhaven made a motion to Table the request. Second by Berridge. Motion carried. Yeas: Osterhaven, Berridge;.Pugh, Card; Fountain. '= This request was Tabled with the idea of allowing Ms. Suchanko time to secure an `f agreement with the property owner to the south to encroach on his property approximately seven feet with an improved driveway. FYP Minutes April 1, 1982 C This additional seven feet would allow Ms. Suchanko to park two cars side by side without utilizing the front yard in front of the residence. This agreement must be submitted prior to the next scheduled meeting of the Front Yard Parking Administrative Committee which is May 6, 1982. FYP #192 1019 Smith This is a request from Kurt A. Kuhn, 1019 Smith Avenue, to park one vehicle in yard .next to driveway. Mr. Kuhn stated on his application that he owns two cars and one truck. The garage and driveway already stores vehicles and parking the truck on the side yard is .really the only practical solution. Mr. Kuhn was not present. There was no discussion. Berridge made a motion to deny the request. Second by Card. Motion carried. Yeas : Pugh, Card, Fountain, Osterhaven, Berridge. CRequest DENIED. The Committee found based on testimony and evidence, that there was no substantial change since Mr. Kuhn appeared before the Committee on November 5, 1981, at which time a request was denied as filed, an approval was given to widen driveway to the south an additional four feet giving a total of sixteen feet. Present: Gerald Spagnolly, Traffic Department Dave Card, Public Service Roy Pugh, Building Department Staff: Vern Fountain, Zoning Administrator Michael Gillison, Zoning Officer There was a quorum. Hearings FYP #193 - 819 N. Hayford Avenue This is a request by Steven C. Tornga of 819 North Hayford, to allow him to widen his driveway an additional two (2' ) feet. Mr. Tornga stated he has a C shared driveway and an additional two (2' ) feet of paved surface would correct his problems. Pugh - Do .you have two cars? Tornga - Yes. Pugh - Why don' t you park in the rear? Tornga - There isn' t enough yard space, it will not fit in the rear. Card made a motion to approve the two foot slab. Second by Pugh. Motion carried. Yeas: Spagnolly, Card, Pugh, Fountain. This request was approved under Chapter 36A-12 of the Code of Ordinances with the stipulation that the area be hardsurfaced with either asphalt or concrete within one year from the date of approval . Any modification to the existing drive approach between the street curb and sidewalk requires a permit from the Public Service Department. FYP #194 - 3517 Creston Avenue This is a request by Robert R. Glaister of 3517 Creston Avenue, to add a second drive with access off Sheridan Road. Mr. Glaister stated that he and his wife FYP Minutes/5-13-82/2 are both unable to walk far and carry gorceries, etc. The- drive is on the south side of the house. To get to the back door there is a 24 ft. sidewalk and it turns north about 26 ft. to the back door. Sam Tumminllo of 3509 Creston Avenue, called the office and said that the Glaister' s do not need additional parking, that they have a large bus parked in the driveway and it is creating a traffic hazard. Pugh made a motion to deny the request. Second by Card. Motion carried. Fountain and Pugh said that they will go out to 3517 Creston and offer suggestions in regards to parking the bus. The request was denied under Chapter 36A-12 of the Code of Ordinance. The Committee found based on testimony and evidence, that there is adequate room to park in the driveway off Creston Avenue. The bus could be parked south and adjacent to the garage. The Committee felt the existing garage and driveway provided four parking spaces. The Committee believes that approval of this request would extend beyond the general intent of the Code. C FYP #195 - 206 Willard Avenue This is a request by Simon McKhayel of 2119 Colvin Court, to widen his existing driveway an additional six (6' ) feet, giving a total of 16 feet of driveway, with a sixteen foot drive approach to match the driveway. Mr. McKhayel use to live there. Now it is a rental house. The present occupants have one large car and one small car. Card made a motion to approve the request. Second by Pugh. Motion carried. This request was approved under Chapter 36A-12 of the Code of Ordinances with the stipulations that the area be hardsurfaced with either asphalt or concrete within one year from the date of approval . Purchase of 1905 West Main Street, to permit the widening of his driveway in the front yard. There are three parking areas in the rear. The garage and a tree prohibit the additional space needed for the fourth unit of parking. The house is a two family dwelling and needs four parking positions, fwo for each unit. He talked to both neighbors and they have no objections. He only wants to widen it about six (6' ) feet. i Vernon C. Hearings FYP #201 - 3950 Glenburne Boulevard This is a request by Ruth. J. Cameron of 3950 Glenburne Boulevard. Ms Cameron is requesting to widen her existing driveway for two more vehicles. IT is a corner lot which leaves only one parking place legally. Ms. Cameron needs the extra space for a man who helps .her in work of the house and one who helps with her mentally incapacitated son. Ms. Cameron gave five names of people who park in the front yard. Fountain - They have not been overlooked. Gillison - They have received tickets. Fountain - How many cars do you -have; Cameron - one plus two. I have trouble with my son, he lives at home plus two men live at the house. Pugh - I 'm not opposed to a double drive just a three car drive. Fountain - Why not take the existing drive and extend it. Cameron - Then we )could have to shuffle cars. 3 ' The Committee approved the request to widen the existing driveway an additional 121 , giving a total of 24' , with a 24' drive approach to match. This request was approved with the stipulation that the area be hardsurfaced with wither asphalt or concrete withion one year from the date of approval . Card made a motion to adjourn. Present: Calien Lewis, City Attorney Office Dave Berridge, Traffic Department Steve Zelski , Building Department Absent: Dave Card, Public Service Staff: Michael Gillison, Planning Department Betty Gunter Hearings FYP #209 - 2,318 Benton Boulevard This is a request by Hugh and Pat Allen of 2818 Benton Boulevard to widen the driveway. Mr. Allen was present and stated that the problem and the reason to widen the drive is that the distance between the adjacent drive is a couple inches. We have two cars and a single driveway and a single car garage. Berridge - What is the hardship? Allen - It'-is hard to move the cars. Lewis - Do you use your garage? Allen - yes Zelski - Are you asking for a permit because it is hard to move the cars? Allen - Our working hours are not the same. The neighbors drive is double and we can' t back in and out without moving a car. Berridge - Is there an excessive traffic problem on that street. Allen - The apartments cause a lot of traffic, there is a lot of speeding. Berridge - Based on the fact that the petitioner has only two cars and a single garage, I move for denial . Zelski - It is more of an inconvenience than a hardship. Berridge made a motion to deny the request. Second by Zeski . Yeas: Lewis, Berridge, Zelski ,Gillison Request DENIED. The Committee found, based on testimony and evidence, that there is adequate room to park in the existing drive and one car garage, and that approval of this request would only serve as a convenience, and that a hardship did not exist. The Committee further believes that approval of this request would extend beyond the general intent of the Code. FYP #208 - 4220 Stabler This is a request by Julie A. Nicol of 4220 Stabler to allow her to park a car adjacent to the existing drive to allow in and out access to the garage at all times; or two cars, side by side. Ms. Nicol was not present. Zelski - She' s asking to go to the south? Gillison - yes. Fountain - It would keep it in front of the breezeway. Zelski - Parking to the south would be a traffic hazard. Gillison - You would also get in the public right of way. Zelski - She has a problem, this is a hardship. Berridge - I would ./like to see any encroachment to the south. We could allow an 8 ft h 20 ft pad extending to the north of the existing driveway. Zelski - That would give her a 17' 7" - of driveway. Berridge made a motion to widen the driveway to the north an additional 8 ft. Second by Zelski . Yeas: Zelski , Gillison, Lewis, Berridge. Request APPROVED. This request was approved with the stipulation that the area be hardsurfaced with either asphalt or concrete within one year from the date of approval . Fountain, Chairman Front Yard Parking Administrative Committee FRONT YARD PARKING ADMINISTRATIVE COMMITTEE November 4, 1982 FRONT YARD PARKING ADMINISTRATIVE COMMITTEE MEETING Washington Square Annex, 2nd floor, Conference Room December 2, 1982 - 1:30 p.m. MINUTES The meeting was called to order by Vern Fountain at 1:30 p.m. Roll call was taken: Present: Dave Card, Public Service Steve Zelski , Building Department Absent: Dave Berridge, Traffic Department Calien Lewis, City Attorney Staff: Vern Fountain, Planning Department Mike Gillison, Zoning Officer Betty Gunter Hearings FYP #210 - '1015 Kelsey Avenue This is a request by Dennis & Valerie Hilliard of 1015 Kelsey Drive to widen their existing drive. Mrs. Hilliard would like one vehicle to be parked along side their 9.5' wide driveway. This area does not block the roadway nor the walkway. She would like to widen it to the east, just enough to get two cars parked side by side. Fountain - You intend to widen it in one direction. Hilliard - Yes it is a single car drive and a single car garage. Zelski - How many cars do you have? Hilliard - We have 3 vehicles. The garage is small and a large car does not fit. Zelski - You might habe to put in a retaining wall . Fountain - I would suggest that it be widened 3 ft to the east and 3 ft to the west. Zelski made a motion to extend the drive 3 ft to the east and 3 or 4 ft to the west. Second by Card. Yeas: Zelski , Card, Fountain. Request APPROVED. 2 The Committee approved a request to widen the existing driveway to the east up to a maximum of four feet, giving a total of thirteen feet of driveway with a drive approach to match. This request was approved under Chapter 36A-12 of the Code of Ordinance with the stipulation that the area be hardsurfaced with either asphalt or concrete within one year from the date of approval . FYP #211 - 6271 Hilliard Road This is a request by Richard C. Regis of 6271 ;Hilliard Road to widen his drive, because of job hours and time schedules it is very inconvenient -'car three cars. We would like to appeal to the Board to widen our drive einht feet. Daniel Regis was present and said they have two big cars. That there are a lot of accidents in from of the house. I do not get out of work til late. Fountain - How many cars do you have? Regis - Two Fountain - Do you use your garage? Regis - no Zelski - Why don't you use your garage? Regis - My father has a tractor and snow plow in it. Card - Do you use your shed? Regis - For bikes Zelski - You will be close to the property line. Gillison - About 8". Fountain - Even if the garage was not used, you could still park in the drive. You have sufficient parking, you do not have to widen for three cars. You may have to just shuffle cars. Card - What is the situation on Hilliard? Gillison - Most are one car drive. Several tickets have been issued. Fountain - There is enough room to park cars. Regis - I have parked there for three years and never got a ticket. 3 Zelski made a motion to deny the request for the reason that the garage and drive is large enough for a car. Second by Card. Yeas: Card, Zelski , Fountain. Request DENIED. If they are extended in the back it will cut up all the landscaping. Card - How long have you had the fence. Cameron - About 4 years. No one spoke in opposition. Pugh made a motion to deny the request as filed. Second by Card. Motion carried. _ Yeas: Pugh, Card, Fountain. Appeal DENIED. The Committee approved to widen the existing driveway, up to a total of eighteen feet, with an 18' drive approach to match. This request.was approved with the stipulation that the area be hardsurfaced with either asphalt or concrete within one year from the date of approval . The appeal as approved would allow you to park four automobiles on an improved drive, two of which would be accessible. FYP #202 - 2305 Herrick This is a request by Michael G. Swartz of 2305 Herrick. Drive, to expand his present concrete driveway (12' X 28' ). The driveway expansion will b.e 12' X 28' , making future driveway parking area 24' X 28' . The property is located -at a corner lot. Mr. Swartz said future expansion plans call for a 2 car garage at the south end of the existing and proposed driveway within 2 years. Fountain - How many cars do you have? Swartz - 2 cars. Card - Why do you want is 24' ? Swartz - I want at least a two car garage with. a work area. Fountain - The building permit would allow a 30.' wide drive. Swartz - The street is real messy especially when it rains, it drains in our yard. There is no curbing. No one spoke in opposition. Pugh made a motion to approve the request.
