Lamar, - Second Shields - Vote - Passed >Flood PolicfNotice — Discussion/Motion to use, for counter `hand outs' by Mr. Metoyer, Second by Mr. Shields, - Vote Passed. >Adontion of Landlord's Policy Letter — >Much discussion about this issue. The Board wants this issue `on hold', until they can submit to the State Mechanical Board for an Opinion of this issue. A committee was designated by Chairman Paul Gilmore to draft a letter for the State Board's Opinion. Marcus Metoyer, Eric Shields were assigned to the task. The City of Lansing Mechanical Board felt the State Ruling on the `return air from one dwelling to another dwelling' should be changed to the new Code Requirements with the old furnace removal. Reasons: The furnace `installation directions' with new furnaces `prohibit' this practice, and for citizen health concerns, the Board wants the State Board Opinion. Page Two Of Two. >Member's Appreciation expressed for the City of Lansing for Holiday Dinner on the last meeting date. NEW BUSINESS: >Mayor's year-end letter. >Panetta Complaint — On site Inspection with Jim Lamar Board Member helped to satisfy Mr. Panetta's complaint. >New State Mechanical Code(s) Adoption December 31St 2003 — >Further Discussion of new Codes for next three-year cycle. DIVISIONAL ACTIONS REPORT: Department Investigation found a discrepancy with Sears Store and their mechanical contractors not pulling proper permits. A Mechanical Division investigation launched from a phone tip, found that two mechanical contractors for Sears were not pulling permits for Sears Contracted Work for at least the past two years. One of the contractors volunteered to come forward immediately, and submitted 47 Permit Applications the last of December 2003 to clear their previous work in Lansing. This contractor volunteered to pay Additional Division Administrative Fees to prevent further Administrative Action. The Second Contractor is still pending continued action. The total mechanical permits obtained for this year was 1863, and the total on site mechanical inspections made by the Division Inspectors for 2003 year, was 5,615 stops, including fire Investigation(s). >Chief Biddinger also expressed his pleasure with his co-workers, Inspector Shields and Inspector Baxter, for the continued excellent job they have performed in helping to maintain the high number of inspections. The courtesy they extend to the Mechanical Contractors, as well as the public in their daily contacts, and the exemplary manner they self generate their work, and the dedication they have performed to the task(s) to keep the Lansing Citizens safer, are very mush appreciated, and definitely noteworthy. Many thanks also to the dedication of the City of Lansing Board Members who volunteer their time, expertise, and judgement on the internal workings of the Mechanical Department as these are very helpful in the operation of the Department. The Members field vigilance is appreciated for suspected `non - permitted' work and has been very productive maintaining compliance with city codes. Mr. Lamar has been `especially helpful' volunteering, (his unpaid time), when it comes to on site inspections, offering to be a neutral party in conflicts, and to help solve matters that are major issues for the City of Lansing, at times. Update —Manager Gary Brydges personally took this issue to the Council Representative for consideration — Being placed on the Council Agenda and should receive a reply soon. >Adoption of Landlord's Policy Letter on Co -Min lg ina. — Tabled last meeting. Discussion followed, after an update of events since Board Member Mr. Metoyer drafted a letter that was sent to the State Mechanical Board for an opinion. Copies of the Letter sent to State Board was also discussed favorably by the City Board Members. The City of Lansing Mechanical Board felt the New State Ruling on the `return air from one dwelling to another dwelling' should meet the new Code Requirements, when the old furnace is removed, as the State Previously Recommended when this Code went into effect for the City of Lansing in July of 2001. The letter submitted to the State Mechanical Board, was heard at the Jan 28th meeting. T. Berry briefed the State Mechanical Board on his decision to reconsider the State's position on this Section of the Code. Chief Berry explained his position Page Two of Two — Mechanical Board Meeting Feb 10th, 2004 Con't.) on the Sections pertaining to the Michigan Mechanical Code(s), to the State Board. Chief Berry explained that this was only to inform the State Mechanical Board of his decision to `modify this requirement under Lawfully Existing Equipment', and that his position on this matter would be sent to the `State Construction Board' for review, and to ask for the input at that level. [Pending their input, at this time]. Chief Berry's position on this topic will be enclosed in the next Newsletter from the State to all Contractors. NEW BUSINESS: New Contact Lists given to Members. DIVISIONAL ACTIONS REPORT: Results of the Mechanical Department Investigation on Sears: Sears Company sent a check for all permit applications from Affordable 1 work contracted through Sears for 25 jobs submitted. The contractor did not have the funds for the 25 Applications that were submitted in the amount of 2,425.00 declared as the final count by Affordable 1 for previous jobs performed in the City of Lansing for Sears Company. This Contractor is still under continued action on other permits filed with us, not performed through Sears Contracting, pending fees are to be paid soon, and action against this Company will be Administrative Fees (Fine) as determined by the Administration, so the charges can stay with the Department. Cobra Heating also paid internal Department fees last month. Both Contractors notified that Citations should immediately follow any further jobs found not to be permitted. Berry stated his position on the previous issue in the State Bulletin, [Copy Attached] and it will stand as written, by the last information received from the State Offices. Chief Biddinger informed his inspectors and City of Lansing Code Officer's of this new position, and updated the Mechanical Board Members. Landlord's/Contractors will receive this information as the situation presents itself in the future, and Staff will review the "Lawfully Existing Systems" as circumstances are presented to determine if they may have their system Grandfathered. NEW BUSINESS: New Michigan Energy Code — Handout —Discussion. DIVISIONAL ACTIONS REPORT: New Investigation under way for Menard's, Home Depot, and Lowe's, after information received that possibly they are contracting Water Heaters, and furnaces and receiving the Permit Fees. Allegations work is performed without pulling permits and having required Inspections. Turned over to Plumbing Chief Con't) Page Two of Two. for Action. Mr. Lamar stated he would go out to Home Depot and ask for a furnace, and see what their policy is on this issue. Permits received year to date is 340 permits to date, compared to 314 last year. GMC plant going in. The lengthy Safety Certification for inspectors was discussed. BOARD MEMBER COMMENTS: Setting equipment, with people not the Contractors Employees as required by State Code, raised a lot of questions and comments. DIVISIONAL ACTIONS REPORT: >Due to a tip, a fine was imposed on a Detroit Area Contractor for work without a permit at a Pharmacy on W. Mt. Hope. Class introduced, and was presented an overview of activities of Mechanical Board. APPROVAL OF MINUTES OF LAST MEETING > Motion for Approval April 2004 Minutes— , Second - - Passed. APPEALS: OLD BUSINESS: Lugnuts game May 24th and the free tickets were appreciated by the Board Members attending, in the Mayor's Suite. State Police 8 Hr. training on Damage Assessment was completed, and certificate of completion received. EOC was implemented the last week of May for flooded basements due to rainfall. Inspections were made of several homes effected, and FEMA is involved with these residences. NEW BUSINESS: >At a recent Legislative Code Study Committee through MIAM, various contractors attended and expressed complaints about procedures, and Code requirements. Two of the Major complaints were that different areas charge different Administrative Fees for registration of Licenses, the excess amounts over 15.00 by Code, were called "Administrative Fees". Second complaint was some Jurisdictions throughout the State were making the Contractor provide Access for inspections, and charging additional fees for going back for inspections on property that no one was initially home, for the inspection. It was spelled out that 15.00 dollar fee for registering license is the max. to be charged by Act 230. And Section R109.3 spells out the requirement for the contractors to provide inspections by State Residential Code. It did seem unfair for inspection agencies to add additional fees, if the inspection had not been arranged. Contractors stated their appeals on this matter were not being handled at the State Level. NEW BUSINESS: >Flood Issues discussed for equipment under water. >New Water Heater introduced on market was denied by the State as not having the proper Testing Reference/discussion followed. >Rate Hike approved for July 1St fee schedule on Single family 200.00, Multiple Dwellings 100.00, Mfg. Housing 80.00 and Hotels & motels per unit 80.00. These are the only charges that were raised on the mechanical fee schedule. DIVISIONAL ACTIONS REPORT: Permits so far this year1200, compared to last years of 1190. Over the last 2 months we have had a lot of change outs occurring in the rental housing areas with permits having more than one furnace on change outs in multi -unit buildings. DIVISIONAL ACTIONS REPORT: 1771 Permits so far this year, compared to last years of 1575. We have had a lot of change outs occurring in the rental housing areas with permits having more than one furnace on single permits, in multi -unit buildings. Over 500 Units are expected to be inspected. Department is handling these very well, with inspectors teaming up to accomplish final inspections. Dear Mayor, The Board Members and Staff were pleased with your election as Mayor of the City of Lansing. Your continued progress to make Lansing a Model City is appreciated. This has been a year of learning for all the Mechanical Board Members, as over this past year the Mechanical Staff has presented mounds of information to Board Members on new State Codes and changes that went into effect during the year. A new State Rehabilitation Code altered our policy for mechanical equipment in flood zones with buildings constructed prior to 1974, but our City Policy for other buildings in the flood zone will remain as written. This Policy should help lower flood insurance rates for Lansing Citizens. The State Energy Code ASHRAE Standard 90.1 for Energy Conservation in New Buildings and existing buildings undergoing changes also was implemented. Mechanical Staff advised the Board of these new requirements. The new code should lower the energy use in buildings. Third, was a Code Interpretation from the State reversing an earlier opinion regarding the issue of mingling air between dwellings in the same building. The Code states that air from one dwelling cannot mingle with another dwelling through a single warm air furnace in the building. State now indicates that if the building had been inspected and approved previously with one warm air furnace as its heat source, it could have the old furnace changed out without putting in additional furnaces, or an alternate heat source in each dwelling. A Landlord Notice is being developed to inform them of the changes, for distribution Jan 1St, 2004. Forth, was the implementation of the new 2003 State Codes, which will be in effect for the next three years? The Division will now have to enforce (7) Main codes, and Several Mechanical Reference Standards, as well as various Installation Manuals and Supplements. This is truly mind boggling, and the Mechanical Staff is doing a great job handling these requirements. Page Two of Two- Mechanical Board Calendar Report. Chief Biddinger was appointed to the State Code Amendments Committee by Chief Tennison Berry, and assumed his tasks by helping develop a good Amended State Mechanical Code and Residential Code in effect for the next three years. The SMACNA Sheet Metal Association of Michigan Representative praised amendments at the Public Hearings as very workable. Chief Biddinger also finished his 2 -year term of Office with the State Mechanical Board, of which Governor Engler Appointed him for two years in December of 2001. Chief Biddinger was recently notified he is again on the Governor Appointment List of qualified people to serve, and he has received copies of support letters that were sent to Governor Granholm. Support came from the Michigan Mechanical Inspectors Association, and by Lynn Briggs Representative of the Sheet Metal Assn. urging her consideration for another two-year Appointment. No Appeals were heard this year, which means the Mechanical Division Staff must have been doing a great job with the Contractors, and the Public. Especially with the number of permits handled each year and the excessive contact with people that these require. They have kept up very well with the high number of final inspections, rough inspections, underground duct inspections, and fire investigations which totaled 5,615 inspection stops for the year 2003, and the mechanical division recorded 1863 permits. In December Chief Mechanical Inspector Gary Biddinger launched a Sears Investigation due to a phone tip, along with Senior Mechanical Inspector Brian Shields. They found sears `contract sales' and their mechanical contractors installing for Sears were not always pulling permits for the installations. This action has produced (47) Additional Permits to date from one delinquent mechanical contractor. After a meeting with the Sears Representative, a large amount of permits are still expected to come in from a second contractor at fault. Mechanical Inspector Cal Baxter is arranging inspections with the homeowners for these installations and inspections will be performed as soon as possible. The year ended with a great evening holiday dinner of which all members attending were pleased. This dinner and a Lug Nuts Ball Game each year are very much appreciated for our volunteer time on the Board. We are pleased to be members of the City Mechanical Board, to work with the Mechanical Staff on decisions to help make the City of Lansing safer for its citizens. Thank You Mayor.
