Motion - Courter 2°d -Metoyer Vote -Passed HEARINGS/DELEGATES/INDIVIDUALS FROM THE FLOOR: None OLD BUSINESS: >Flag has been installed in the Meeting Room. >Calendar Year end Letter to Mayor Hollister was read, sent by Chairman Chandler. >Proposal for Code Change submittal to the ICC by Chief Biddinger discussed, and approval asked for by the Board. The Issue MMC 918.8 & MRC 1602.3(4)- `Prohibited' — "Return air co - mingling from different dwellings". Chief Biddinger proposed a Code Change regarding this matter to the International Code Council, ICC, for considering an exception of this Code Section in the next Code Change, which will transpire at the Jan 2002 Meeting of the ICC. If this Code change is acceptable at this level it will be approximately 2 years until it is reflected in the State Code. At this time it should be noted, that several complaints have been recorded to date from Landlord's in this Jurisdiction to the Department of Code Compliance & to the Building Safety Mechanical Division, and these complains are being referred to the City of Lansing Mechanical Board. The expense incurred to the Landlords of having to supply new heating units to all dwellings under this Section of the State Mechanical Code is very expensive on change outs. Large Board Discussion of proposed change? Consideration of action on this Code Section? Courter — So Moved, Because the City of Lansing has a high incident of Landlords having one forced air furnace in multi -Dwellings, and due to the large amount of complaints received we would ask that the Building Manager/Official, bring this matter to the City of Lansing Building Board of Appeals. It is further asked that the Building Board submit their recommendations and/or approval back to the City of Lansing Mechanical Board. Our Mechanical Board would like to draft a letter or petition to the State Mechanical Board of Rules for their support, to recommend to the State Board of Commissioners to have this Code Section be amended soon with an exception, such as submitted to the ICC by Chief Biddinger. Second — Metoyer Vote- Carried Unanimously. Further discussion: We are sure there will be appeals on this matter with the City Boards, so we may as well take some action now to lay some groundwork. Undo Costs to landlords will be passed on to tenants. We feel this section could have other methods performed to meet the intent. NEW BUSINESS: >Reported — I" State Board Meeting went well for Chief Biddinger with some tough issues brought before the Members. Also new Amendments to Act 54 proposed in HB 5487. Discussed. Fiberglass insulation restriction in a Senate Bill looks to be failing in Committee. School Bill for Mechanical Inspections is also floundering. Page Two Other Business/Board Member Comments: Courter -extended a thank -you for Christmas Dinner, and it was very good, and we all had a good time. Positive responses from all the other members and they reflected thanks. DIVISIONAL ACTIONS/REPORTS FOR THIS MONTH: 1902 Permits issued for 2001. Large number of complaints discussed above. Inspector Brian Shields presented a run down of permits from 1993 to present for comparisons. Last year being the most permits issued. Response: It is a Mechanical Board Issue. Discussion >Update - ICC response regarding this issue. Discussion. Henry Green & Tennison Berry on this issue, and provided the Mechanical official the following results of that meeting: Gary Caulkens. Ph 285-1851, from the Lansing Landlord's Association, Stated Mr. Green and Tennison Berry stated to him that; "Buildings prior to 1978 State BOCA Code, (which added this section into the State Mechanical BOCA Code at that time), should be allowed to replace furnaces upon individual appeal, as per Code Section 102.2. `If Lawfully installed that time and previously approved', may be allowed now'. This was in State BOCA Codes, and City has always had IMC. Discussion of City Ordinance, 1986 to 2001 regarding this issue. Board was informed that the new state code and the state administrators advised that this code section regards health issues, as well as fire issues. Board is scheduled to hear an appeal next month on this same issue. Jim LaMar asked to inspect site prior to the next meeting. Several Cases of CO problems were investigated, with one death reported, and one sent to Hospital in Critical condition, where a generator was running in their home overnight. Other cases were victims that were sent to the hospital, fire department referred 2 calls, and discovered one to have mechanical equipment installed without permits and inspections, by owners. and a case of plugged vent due to birds, (Wrens nest). >Deposition: Death case from flue products, investigated by the Mechanical Chief in 1999, at Dorrance Pl ce, due to a lawsuit filed by the family against owner and mec/contractor. MINUTES OF LAST MEETING: Motion for approval of Feb Meeting Minutes, 2002. Motion -Downs 2"d Lamar - Vote -Carried. HEARINGS/DELEGATES/INDIVIDUALS FROM THE FLOOR: Appeal from Mr.Victor & Matt Whipple Landlord of 832 E. Shiawassee street regarding return air co -mingling from more than one dwelling, on an emergency changeout, performed by J & J Heating, John Gross also present to present facts regarding appeal. Correction Order/Violation of Code Section MMC 918.9, R -Code 1602.3 (4), and Violation of International Fuel Gas Code was issued previously by Chief Gary Biddinger. Information presented that area Contractor's had proper notice(s) of new Code requirements. John Gross, of J&J Plbg. & Heating, presented information to the Board Members, that he was not aware of multiple units when bidding this unit. Owners discussed their concerns regarding this issue, of how to comply, and the damaging costs that will be incurred for compliance. Lengthy Discussion followed on several items of concern by the Board Members: As to age of the original furnace, validity of Contractor claim of not knowing that property was multi- dwelling, questions to City Mechanical Officials regarding State of Michigan Administration contacts regarding this issue, and the Code Section rational in the Mechanical Commentary. City Records were checked to determine the age of old furnace removed, and the old furnace at this address was not found in computer system records, and assumed to be previous to computer records. No plan for an alternate method was stated to the Board in the appeal. >Motion by Board Member Mike Courter to deny the appeal, and extend the time for completion/compliance, if the owners are fully responsible for any health issues, alleviating City of Lansing responsibility, that may occur during extended time to comply system. Owners to contact the Mechanical Board in person, or Written Notice to the Chief Mechanical Inspector Board Secretary, by the May 14`h, 2002 Board Meeting. Details of Notice must have a plan for compliance, or notification that appeal has been taken to the State Mechanical Board of Rules for resolution and the results, [which is part of the Lawful Appeal Process]. At the May Board Meeting the Board will determine any further actions after receiving information. >Second Lamar, >Carried Unanimously. After motion discussion took place regarding conforming methods. OLD BUSINESS: Discussion of other landlord's situations called in. Specifically one at 509 Cherry Street referenced in letter sent to owner to attend this Meeting. This Address was previously looked over with Board Member Jim LaMar and Chief Biddinger, last week. Discussion took place regarding this address, and that owner did not attend this meeting. Courter related that this issue was a major discussion at Lansing ACCA Meeting last Oct. 2001, and information was given to all participants of the new requirements of Code. NEW BUSINESS: None. DIVISIONAL ACTIONS/REPORTS FOR THIS MONTH: 273 Permits to calendar date. Cal Baxter off work until further notice with back problems. He will not be able to attend Spring Conference due to Dr. report relieving him of City Work until the 28d' of March. MIAM Conference is the 21 thru 23rd. MINUTES OF LAST MEETING: Motion for approval of March 2002 Minutes. c Motion - Downs 2"d Courter -Vote - Passed -- HEARINGS/DELEGATES/INDIVIDUALS FROM THE FLOOR - None" _ �70 OLD BUSINESS: Several more 1 furnace multi-dwelling problems have surface this; past month, and multi units are complying, or have been issued correction orders _; ►T indicating the requirements of separate warm air systems to be installed. >U date- Fred McKinney from the ICC Code Amendment Committee called M� p Y :1� April 8`h, from Asheville North Carolina, and asked for further information regardingc - ' intended filters to be used. Mr. McKinney reported that about 3/4 of the Code Change Committee are in support of the Amendment submitted by Chief Biddinger, and they wanted additional information before the Amendment Hearings this week in Pittsburgh PA. Information on intended Filters and also it was recommended that the new ultra violet light with information for decontamination of the supply air was faxed to the committee for their consideration. Said he would call with results of hearing. NEW BUSINESS: Board Members with terms expiring in June 2002 must indicate intentions of remaining aboard at this time. Members expiring- Neal Chandler, Bill Downs & Jim Lamar. >Motion/Vote should be made by remaining Board Members at the next meeting prior to summer break, to recommend retention of Term Ending Members wishing for additional Term. This recommendation will add support, and consideration of the Mayor & his Appointment Official to retain these members for another term of duty, starting in September IO', 2002. DIVISIONAL ACTIONS/REPORTS FOR THIS MONTH: Chief Gary Biddinger and Inspector George Brian Shields, attended State MIAM Training Courses to receive Certified Credits as required by State Act 54 to comply with Inspector Qualifications. It was reported to Members that the Conference held in Port Huron was very informative, and the training was excellent in content. 394 Permits processed to date for this calendar year, with additional load on remaining inspectors, as Mechanical Inspector Calvin Baxter is still on medical leave. Inspector Shields showed Board Members a new Material that can be used for draft stopping according to the Company. Motion for Approval- Downs 2°a Courter -Vote- Carried - SPECIAL PRESENTATION: To Bill Downs for his many years of faithful service to the Mechanical Board, presented by Bob Johnson of the Mayors Office. Mr. Johnson reflected the City of Lansing appreciation and presented Mr. Downs with a Certificate of Service Award. Mr. Downs will definitely will be missed, his expertise, and decision making have directly helped the City of Lansing to become a world class city. HEARINGS/DELEGATESANDIVIDUALS FROM THE FLOOR — 509 Cherry Street Appeal — One furnace 3 dwellings. [ Appeal & Extra time to comply ]. Brian gave Board an update of correction ordered at this address and other facts. Rich Colby of AOK Heating stated his concerns as being the installer of the property and not being aware of the multi -dwelling situation. Mr. Celedon owner of the property expressed his concerns of not being informed also by his contractor and the Code Officers. Several discussions transpired regarding this issue, which included the fact that all contractors were made aware of the new State Codes prior to implementation July 31 St/Ag 1St of 2001, by the State of Michigan and shortly thereafter by the City Mechanical Department mailings with new permit fee schedules. >Update regarding appeal issues were relayed to the Board and Landlords regarding the proposed amendment sent to the ICC- Fred McKinney from the ICC Code Amendment Committee from Asheville North Carolina, 828-259-5652 called with information that the ICC met in Pittsburg, Pa. And that the amendment failed to pass regarding an Page 2 of 3 — Mechanical Board Meeting May 14th, 2002 alternate means of installing one furnace in a multi dwelling, with a smoke detector added and a more sophisticated filtration system as proposed by Chief Biddinger 8 to 3. >After a long discussion regarding this issue by all the concerned guests the Board made a motion to grant Mr. Celedon an extension of time to September l St for compliance of,,, the Code Section, and to grant Mr. Meridith the same time limit. " UPDATE: Previous Whipple Appeal on E. Shiawassee Street. Mr. Victor Whipple presented the Board with bids from contractors, expressed concern on his costs For complying, and asking the Board for another extension to comply. Mr. Whipple stated he would comply the Dwelling by Sept. 1St Motion: Mr. Courter proposed to extend the time until Sept. 1St for compliance with the same stipulations as were previously stated as to hazards being the sole responsibility of the Owner and the City of Lansing have no responsibility for any possible hazards during the compliance time to comply. OLD BUSINESS >Board Members with terms expiring- Neal Chandler, Bill Downs & Jim Lamar. >Chairman Neal Chandler went through triple by-pass heart surgery and will be moving to Toledo with his daughter. If accepted by the Mayor they will Officially Participate at the next Meeting on September 10th, or any special meeting called after this date. >Boiler recall notice relayed to Board Members. >Vote for Chairman and Vice Chairman for 2002-03. Page 3, of 3 Mechanical Board Meeting May 14, 2002 DIVISIONAL ACTIONS/REPORTS FOR THIS MONTH: 620 Permits issued to date, ahead of last years permit activity. Administrative Action taken against (3) Mechanical Contractors not pulling proper permits prior to starting work. Several problems with one furnace -multi units this month are being resolved. Inspectors are continuing Act 54 training, and are close to complied hours required or have exceeded some of the training required by the State. Part time interviews have been performed to contract for 90 days an extra inspector to help with backlog created by Mr. Baxter being off with back problems. Mr. Baxter reported back to full duty today. BOARD COMMENTS: Board and City of Lansing Staff, Congratulated Mr. Downs on his many years of service and appreciation for his work. Further Discussion on the Appeal Issues: Mr. Courter suggested that the Department send out another mass mailing regarding the appeal issue. It was clarified to the Board Members that the responsibility for educating Mechanical Contractors and Landlords of the Code Requirements, is not a function of the Building Safety Division. We do try and keep Contractors updated with changes as a voluntary courtesy, and made an effort during the State Code changes to highlight items known to effect them, but the sole responsibility for knowing the Code is with the Contractors performing the work. Building Safety performs inspections to assure they meet the Code Standards we have to enforce, and is not responsible for training, or designing, or assisting Contractors with any system by law, and duties are only to inspect and decide if the system meets the Code Requirements for Approval. The Division Chief, will however approach the Managers of Code Compliance and Building Safety to see if a note can be attached to the Rental Inspections Form, to let Landlords be more aware of the new requirement. Motion for Adjournment — until Tuesday Sept. 11th as the Board takes its summer break, unless there is an appeal during this time period. If there is an Appeal, a notice will be sent out for a special meeting during this time period. His Contractor Rich Colby, AOK Heating, is presently installing additional furnaces in his dwelling units at the property discussed at the last meeting. >509 Cherry Street Appeal — Action /Update - Called after advisement letter last week of August, that a Contract was signed with AOK for additional furnace. >E. Shiawassee-Whipple Appeal — Action /Update - Called last week of Aug. after advisement letter to state the building was to go to electric heat which is in progress now. >Ball Game Results Aug. 5th. Acting Chief Brian Shields hosted the annual ball game, as Chief Inspector Gary Biddinger was off work 3 weeks on sick leave due to major surgery to left shoulder. Motion — Gilmore: To have the Board Secretary ask Bob Johnson Chief of Staff if its possible to get Mechanical License Holders on the Board, if their business is located in the City of Lansing and primary work is done within the City of Lansing, even though they do not reside within the City limits. Due to the fact that not many knowledgeable candidates are available to fill seats on the Board. Passed. DIVISIONAL ACTIONS/REPORTS FOR THIS MONTH: 1247 Permits issued to date and slightly over last years figures. Business is at a normal pace. More multi dwellings have been found on inspections with one furnace installed, and they are complying with new code for additional furnaces. DIVISIONAL ACTIONS/REPORTS FOR THIS MONTH: 1400 Permits issued to date, slightly over last year's figures. Business is at a fast pace but Mechanical Inspectors are doing a dedicated job in maintaining schedules, and their efforts do not go unnoticed. Housing areas hit with news media, on violations found by code compliance officers, and this caused extra work for our Division, securing compliance on mechanical systems that needed updated, repair, and permits were ordered for equipment installed that was not permitted/inspected previously. Multi dwellings were found on inspections with extra furnaces installed, by the new code. The word seems to be out regarding this requirement and most landlords are complying in advance. Cal Baxter investigating, and gathering information on two complaints brought to my attention. Discussed issues with Board Members, regarding the administrative actions.taken with these cases. Mr. Courter moved out of the City of Lansing Jurisdiction and was forced to give up his seat. FROM: Chairman Jim Lamar ` ? City of Lansing Mechanical Board 1 Greetings Mr. Mayor, The following is a calendar year 2002 report of Board Activities. This year was eventful, with many challenges for the Board. The Mechanical Division' Staff kept the Board Members very well informed of the new Mechanical Code requirements, with timely updates of equipment recalls, and with the various internal Divisional Actions of concern. Decisions are made a lot easier, when we are well informed by such a considerate Mechanical Staff. The new State Mechanical Code requirements, created several `Appeals' that were heard, regarding the mingling of ventilation, and return air from multi -dwellings. This was a new requirement for the City of Lansing. The previous City of Lansing Ordinance resolved this code issue, by adding Smoke detectors and alarms, which allowed a single warm air furnace to heat multi -dwellings. Landlords are now required to have separate unit warm air heating systems in multi -dwellings. The State reflected that this was a health issue, and not just a fire issue of spreading smoke to other units. Secondary smoke from smokers, and disease migration was also a concern for the Board Members, in hearing appeals on this issue. This was a hardship on the landlord's in many cases, as the Appeals were denied. Attempts to have this Code Section Amended at the State, and the International Code Counsel levels, with an alternate means of applications failed to pass. The Mechanical Staff did a great job of handling, and processing these complaints. The Appeals could have been taken to the State Level after our decision was rendered, but the individuals have not appealed to the State Board. Reluctantly, we said goodbye to one of the first and continuing Board Member over the years for the City, Mr. William Downs at the May 14th Meeting. Chief of Staff Mr. Bob Johnson honored his retirement by presenting Mr. Downs with a Document from your office regarding this dedication to the Mechanical Board. The action was very much appreciated by Mr. Downs. The Mechanical Division Staff, and present Board Members also conveyed how much Mr. Downs will be missed, and wished him well during his retirement. We also had to see Mr. Mike Courter leave the Board after he moved out of the City of Lansing Jurisdiction. This of course leaves an open seat on the Board. We are searching for a replacement at this time. The Previous Chairman Neal Chandler underwent open-heart surgery, and then moved to his daughter's house in Toledo, Ohio. Mr. Chandler's term expired officially July 2002. My Term of Office also expired in July. This left the Board with three Member openings. Chief Gary Biddinger promptly found replacements for two of these positions, with Mr. Page 2 of 2 Mechanical Board Annual Report to the Mayor.. Eric Shields — Citizen at large, and Mr. Cliff Branklyn a Mechanical Contractor. These two new members started after our summer break September 10th, and have been a welcome addition to the Board. I was voted in as Chairman for 2002-2003 fiscal year, and supported for another Term of Office by the Board. The Board Secretary, Chief Mechanical Inspector Gary Biddinger, promptly forwarded the Board Recommendation to the Chief of Staff, Mr. Bob Johnson, for consideration of my re -appointment, which was approved by the Mayor's Office. The August 5th Ball Game, with seats in the Mayors Box, was appreciated as well as a great Christmas Dinner that the Mechanical Staff hosts each year. The Board thanks the City for these events, as our time is not compensated in any other way, as you are aware. The Board Secretary, Chief Gary Biddinger, had major surgery Aug. 6th, on his left shoulder, and made huge efforts to return to his duties as quickly as possible, with required therapy and recovery time minimal. Inspector Brian G. Shields assumed Chief Duty during this absence, and performed the tasks in an exceptional manner. Inspector Calvin Baxter, also did a great job keeping Inspections timely and assisting that daily operations run smoothly. I am very happy to report that no deaths, fires or injury occurred, to my knowledge, regarding failure of mechanical systems in the city this past year. Another record permits year kept the Inspectors very busy. It has been a personal pleasure to work with the City of Lansing, and Mechanical Division Staff. The Board appreciates our input, to help maintain Lansing as a World Class City. Maintaining the safety of its Citizens is the Mechanical Boards goal.
