On a motion by Bill Pond, supported by Tim Waite, the minutes of December 9, 2004 were approved unanimously Old Business: None New Business: Case No. Address Petitioner PBA-001-05 215 Townsend St. Kebler Pig. & Htg. Co. for BOJI Charlie Hausman, representative for petitioner, was present for the Appeal. The petitioner requested a variance on Ch.9 Vents, Sec. 904 Vent Terminals and 904.6 Extension through the wall. As per section 904.6 Vent terminals extending through the wall should terminate a minimum of 10 ft. from the lot line and 1 Oft. above average ground level. Vent terminals should not terminate under the overhang of a structure with sulfur vents. Sidewall vent terminals should be protected to prevent birds or rodents from blocking the vent opening. The petitioner explained to the plumbing board that the building at 215 Townsend St., a parking structure, is built on the property line and doesn't meet the 10 ft. requirement from the lot line as per Sec. 904.6 Extension through the wall. The petitioner explained to the plumbing board that all requirements will be met for sidewall venting including as per Sec. 904.7 Extensions outside of structures, Vent pipes installed on a exterior of structures shall be protected against freezing by insulation or heat or both. After lengthily discussion with the petitioner, the plumbing board granted a variance for the approval of side wall venting. A motion was made by Bill Pond and seconded by Steve Reck. The motion carried unanimously. The plumbing board members present spent considerable time discussing how to deal with enforcing the new plumbing codes and plumbing laws and working with other city boards to accomplish compliance. Old Business: None New Business: Frank Eirosius, Chief Plumbing Inspector, informed the members of the plumbing board that there are two house bills and one senate bill that will change "The State Plumbing Lavin' and also make changes in Public Act 54. The two house bills are No. 4206 and No.4207. Those house bills were introduced by representative Stackoe. House bill No. 4206 that amends 1986 PA 54 entitled "The Building Officials and Registration Act" by amending section 10(mc1338.2310) and house bill No. 4207 to amend the 2002 pa 733 entitled "State Plumbing Act" by amending section 39(mcl338.3549). The senate bill No. 150 introduced by senator Kuipers to amend the 1986 PA 54 entitled "The Building Officials and Inspectors Registration Act" by amending the title and sections 2,3,4,6,7,8,10,12 and 13( mcl338.2302, 338.2303, 338.2304, 338.2306, 338.2307, 338.2308, 338.2310, 338.2312 and 338.2313). Section 3 is amended by 1998 pa 50 by adding section 2a, 8a, 8b, 8c, 8d, 8e, 8f, and 8g and to repeal acts and parts of act. After a lengthily discussion the board agreed with the house bills and the senate bill that there should be a uniformity between all code officials. To accomplish uniformity, instead of one code official being discriminated by state laws, all code officials end up under one state law. Chief Inspector Eirosius also brought up that back in Nov. 16, 2004, the plumbing division and the building department was approached by the BW&L to have a discussion with this office to get permission to reattach customers existing plumbing to the outlet side of the water meter settings. LBW&L is replacing non-standard services in the Lansing area and when inside the customer dwelling we are replacing the water meter and associated meter setting. It would be Minutes for Plumbing Board or )eals— February 10, 2005 2 significant improvement in our program for our crew to re-establish these connections to the house plumbing while we are on-site. In the past the connections were made by a license plumber and to not inconvenience of the customer and at the expense of the LBW&L. An agreement was drafted by the building safety office/plumbing division for replacement of non- standard water services in the city and with the understanding that significant number of such services will be replaced over the next few years by the LBW&L. The project will more likely run for 10+ years with several thousand installations. The office is willing to grant leave from a normal building permit and that this is being done in the interest of both parties and to minimize inconvenience to the BW&L customers and citizens to the city. This policy will only extend to residential dwellings. The Michigan building code contains a provision for annual permits. This concept will be utilized and will extend water services being installed throughout the city. This permit will be renewable on annual bases untilled the non-standard water services have all been replaced and the policy agreement may be amended from time to time. After a lengthily discussion the plumbing board members informed the staff present that according to the Michigan Plumbing Code 2003 section 106 permits exemptions from permit work of this code shall not be deemed or granted. Application for a permit shall be made by a licensed plumbing contractor in accordance 2002 pa 733(mcl388.3511) and the plumbing board members present want to set up a meeting with the BW&L representative to clarify and establish a policy agreement for the replacement of non-standard water services in the city. Old Business: Tim Haggert reported he gave Public Service a copy of the Plumbing Laws New Business: Dave Burton brought up to the Board Members about conflict with contractors, about using band iron for supports on PVC Soil and Vent systems without isolating banding from pipe. (To prevent chaffing) It was agreed that the pipe should be isolated. It was also discussed that Journey Licenses were about to expire in April. Emmett informed us that his classes were full, but there were still a lot of Plumbers that have not gotten the required hours needed to renew their licenses. We will have to look out for expired licenses. Dave Burton brought up another question that is being raised by contractors about vertical leg for waste fixture drains. It was asked if one could run out each portion of vertical leg to the max stated for each size pipe. It was said that the State was allowing that. It was agreed that nothing could be found in the Code Book approving that practice. A motion was made by Tim Haggart and seconded by Tim Waite to adjourn. The motion was carried unanimously. Old Business: Approve the minutes of the March 10, 2005. New Business: Drainlayer's exam. Drainlayer's exam was given to Chris Beard, Chad Cadwell, and Jason Staff. The remaining plumbing board members present found Chris Beard, Chad Cadwell, and Jason Staff to be qualified to take the Drainlayer's test. Dave Burton, plumbing inspector, administered the Drainlayer's exam. Chris Beard passed the Drainlayer's test with a score of 76%. Chad Cadwell passed the Drainlayer's test with a score of 92%. Jason Staff passed the Drainlayer's test with a score of 74%. Also present was Nicholas T. Burwell, manager of Environmental Services Resource Center for the Board of Water & Light and Daniel J. Flynn, P.E., Principal Consultant, Project Engineering Resource Center for the Board of Water & Light. The plumbing board members present spent considerable time discussing with Mr. Burwell and Mr. Flynn how to accomplish the replacing of non-standard water service piping in the city of Lansing. After lengthily discussion the only question that was left unanswered was, when is a license not required and the only time a license is not required for the following work: minor repair work. And the definition as for Public Act 733 of 2002 as per section 7 as used in this act the definition for minor repair reads as follows, "Minor repair, means a repair which involves only the clearance of stoppages, repair, or replacements of a faucet, valve, reinstallation of the same Minutes for Plumbing Board of Appeals— 17'11Y/ 0,3_ 2 plumbing fixture, provided that no modifications are made to the plumbing system, or residential domestic water treatment and filtering equipment. Minor repair does not include any of the following, the repair or replacement of a back flow preventer and air admittance valves and a repair or replacement that is only a part of a larger or major renovation or repair." As soon as the representatives from the Board of Water & Light get more information on how to deal with the replacing of non-standard water service piping in the city of Lansing and securing plumbing permits from this office. Old Business: None New Business: Case No.: Address: Petitioner: PBA-002-05 1540 N. High St. Tamara Farrell Tamara Farrell, the petitioner, was present for the appeal. The petitioner requested a variance for the use of a store bought refinishing kit for tubs that was used at a tub in one of her rental units. The petitioner stated that the kit is U/L approved and is being used all over and the petitioner had a letter from the manufacturer (Klenk's Tub, Tile & Sink Refinishing Kits). The Klenk's brand Tub; Tile & Sink Refinishing Kits have been on the market for several decades nationwide. It is a two-part chemically curing epoxy paint that provides a non-porous, tough, durable coating. It is recommended for porcelain, ceramic, cast, iron, and fiberglass tubs and sinks. The Plumbing Board asked the petitioner if she had a listing or product approval for the refinishing kit. She did not. The Plumbing Board asked her to get the manufacturer to apply for product approval from the Michigan Department of Consumer and Industry Services/Bureau of Construction Codes and Fire Safety. The Plumbing Board also advised the petitioner that the City of Lansing Plumbing Board is not an approval agency, but only enforces the Michigan Residential and Michigan Plumbing Code and if that product confirms the standards sighted in these codes and if the product had met a standard the Plumbing Board would have considered a variance of this appeal. The Plumbing Board was highly concerned of that information and the documentation that was presented by the petitioner especially the material safety data Minutes for Plumbing Board of Appeals— July 2005 2 sheet that pointed out a warning: This product contains chemicals known to the California State that cause cancer. The Petitioner stated that we are not in California and the Plumbing Board showed their concern that the toxicity level and chemical substances in that refinishing kit are not approved in the State of Michigan. After a lengthy discussion the Plumbing Board stated that the petitioner shall contact the manufacturer and the manufacturer shall seek approval from the Bureau of Construction Codes and Fire Safety. The purpose of this code is to require minimum standards to safeguard health and public welfare by regulating and controlling the design of the quality of materials, the operation and maintenance and the use of plumbing equipment and systems. After a lengthy discussion with the petitioner the Plumbing Board denied that appeal on grounds that it is an unapproved type of product. A motion made by Steve Reck and seconded by Emmett Kelly that the appeal has been denied and the motion was carried unanimously. Old Business: None New Business: Case No.: Address: Petitioner: PBA-003-05 920 Townsend St. Robert Grant/GM (1014) LGRA Body Shop 5 Bay/ 33 Bay Addition Issue of Appeal: They want to combine primary and secondary roof drainage piping underground to storm piping. Bob Grant/GM, Jay Youngquest/GM,and Ray Delbridge/Goyette representing General Motors were present for the appeal. The petitioner is requesting approval for their design for overflow roof drains tied together with the regular roof drain piping underground inside the building. As per 2003 Michigan Plumbing Code, Chapter 11 — Storm Drainage, Section 1107(Secondary (Emergency) Roof Drains) 1107.1- Secondary Drainage Required. Secondary (Emergency) roof drains or scuppers shall be provided where the roof perimeter construction extends above the roof in such manner that water will be entrapped if the primary drains allow build up for any reason, 1107.2 — Separate System Required. Secondary roof drain systems shall have the end point of discharge separated from the primary system. Discharge shall be above grade, in a location which would normally be observed by the building occupants or maintenance personnel. The petitioner presented a set of blueprints for the 5/33 Bay storm drainage system. The petitioner also stated that the storm drainage system is separate from the original drainage system that was installed in 2000 and a variance that was granted then, under the uniform plumbing code, for the 1014 Townsend General Motors assembly building. The petitioner is seeking the variance for the 5/33 Bay addition at 920 Townsend Street— (1014) LGRA Body Shop. Petitioner stated that the roof was designed for ponding and General Motors inspects the roof annually to maintain the warranty. GM has complete confidence in the roof drains and that the roof drains are all oversized. Minutes for Plumbing Board of Appeals—November 10, 2005 2 After a lengthy discussion, Mr. Pond made a motion to grant a variance to General Motors/ Robert Grant for the 5 Bay and 33 Bay additions that the secondary roof drains be tied into the regular roof drains under the floor and combine to a man hole outside the building. The motion was seconded by Mr. Kelly. The motion carried unanimously. Case No.: Address: Petitioner: PBA-004-06 201 W. Jolly Rd Cedar Place Apts./Rod Brannon Issue of Appeal: To change out the balancing spools and stops in the existing Delta shower units vs. replacing the entire shower unit. Thomas Miner, Kathleen Vogel, Rod Brannon representing Forest City/ Cedar Place were present for the appeal. The petitioner stated that they made arrangements with Home Depot to purchase 240 shower valve spools and the reason they want to replace the spools only is that there is not enough room to replace a complete shower valve. As per 2003 Michigan Plumbing Code, Chapter 4 — Fixtures, Faucets, and Fixture Fittings, Section 424.3 — Shower Valves, shower and tub shower combination valves shall be balanced pressure, thermostatic, or carbonation balanced- pressure/thermostatic valves that conform to the requirement of ASSE 1016 or CAS B125. Valves shall be equipped with means to limit the maximum setting of the valve to 120 F which shall be field adjusted with accordance with the manufacturer's instructions. The petitioner stated that over the last 30 years nobody ever got scalded using the old shower valves. Chief Inspector Eirosius stated to the board the reason why he was called in by Steve Maloney, Code Compliance Officer, and the complaint was that the water heating system lacks the capability of providing an adequate amount of hot water to be drawn at every sink, bathtub/shower, lavatory. The petitioner stated that over the last years they have been having problems with the domestic hot water system and by replacing shower valves that would supply hot water to all bathtub/shower fixtures and they are also working on refurbishing hot and cold water supply system. The petitioner also stated that if new shower valves would be installed that would leave too big of an opening and they don't make a cover plate to take care of the opening. After a lengthy discussion, the board replied that the shower valves used shall meet the ASSE 1016 or CAS B125 requirement. After a motion was made by Mr. Kelly and seconded by Mr. Pond to deny the appeal. The motion carried unanimously. The motion was made by Bill Pond and seconded by Tim Waite to adjourn.
