Capitol Ave. at 7:00 pm r JANUARY 8, 2003 MEMBERS PRESENT: TIM HAGGART, STEVE RECK; TIM WAITE, BILL POND, CHRIS SHERWOOD MEMBERS ABSENT: LYNN GUNTHORPE, STAFF PRESENT: FRANK EIROSIUS, SR., CHIEF PLUMBING INSPECTOR DAVE BURTON, PLUMBING INSPECTOR Chairman Tim Haggart called the meeting to order at 7:04 p.m. On a motion by Bill Pond, supported by Steve Reck, the minutes of December 11, 2003, were approved unanimously. Washtenaw St. Charles Hausmann for Boji Group Also present with the petitioner: Keith Kelly (Boji Group), Mike Peplowski (Boji Group), Joe Thompson (Clark Construction) Charles Hausmann presented his argument in support of the appeal constructing a parking ramp without separate toilet facilities and providing direct access to the direct connecting office tower building toilet rooms. Mr. Hausmann quoted that section 403 of the 2000 Michigan Plumbing Code specifies the minimum plumbing facilities requirements as identified by Table 403.1. This Section also stipulates that where the type of occupancy is not listed in the Table, the requirements shall be considered individually by the Code Official. Mr. Hausmann stated that the parking ramps are not listed in the tables. Mr. Hausmann also stated that the distance from parking attendants booths to the adjacent office tower would be within approximately 400 feet of walking distance. Mr. Peplowski stated that the Boji development project was originally conceived as a combined office building/parking ramp with direct access from the parking ramp to the office building on each level. Public toilet rooms are provided on each level of the office building and the City of Lansing has accepted the direct access from the ramp to the office building and that the Boji group will agree to a permanent access for any ramp employees. If the Minutes for Plumbing Board of Appeals—January 8, 2004 2 Plumbing Board would grant the variance it would keep the original cost from escalating and also the Boji Group is willing to rough in for future toilet rooms so that the City of Lansing can finish the work in the near future or as needed. The Plumbing Board is agreeing with Mr. Peplowski and Mr. Hausmann that the direct access from the parking ramp to the office tower is provided and the cost of providing a unisex toilet room is not a Code issue and that the parking structure is on a separate parcel and under it's own Building Permit and that as per the 2000 Michigan Plumbing Code Chapter 4 (minimum plumbing fixtures required, Section 403.1.1 unisex toilet rooms and bath fixtures) that a unisex toilet room is required as per the original Plan Review. Mr. Kelly also made a statement that security guards are provided for the office building and they will be there until midnight and in the near future there will be a restaurant on the first floor level and there will definitely be direct access provided for the ramp employees. After a lengthy discussion and taking into consideration the concern from Shane Silsby, Transportation Engineer for the City of Lansing/Transportation and Parking Office, that having a toilet facility in the parking structure will provide unlimited access now and in the near future to all parking staff and that an agreement to allow parking staff to utilize the restrooms in the office towers may not be guaranteed. The Plumbing Board came to a conclusion that a unisex toilet shall be provided for the parking structure as per Plan Review. A motion made by Bill Pond and seconded by Steve Reck to deny the appeal. Motion carried unanimously. Old Business: Inspector Burton shared information and pictures with the Plumbing Board regarding the situation with 2702 S. Cedar Street regarding contractor Rod Tenniswood not being in compliance with the 2000 Michigan Plumbing Code separating the storm drains (roof conductors) from building sewer piping inside the building. The Plumbing Board asked Inspector Burton to keep the Board up to date on the outcome of this violation. A motion was made by Chris Sherwood and seconded by Tim Waite to adjourn. Motion carried unanimously. Old Business: Approve minutes of January 8, 2004 New Business: None The Drain Layers test was given to Joel Barnes and Lonnie Crowe. The remaining Plumbing Board members present found Mr. Barnes and Mr. Crowe to be qualified to take the drain layers test. Joel Barnes passed the Drain Layers test with a score of 72%. Lonnie Crowe passed the Drain layers test with a score of 86%. The Plumbing Board members present spent considerable time discussing how to deal with enforcing the new Plumbing Codes and Plumbing Laws to the fullest and working with the other city boards to accomplish compliance. Old Business: On a motion by Tim Waite supported by Bill Pond, the minutes of March 11, 2004 were approved. On a motion by Emmett Kelly supported by Bill Pond, the minutes of April 8, 2004 were approved. On a motion by Tim Waite supported by Bill Pond, the minutes of May 13, 2004 were approved. On a motion by Steve Reck supported by Tim Waite, that the plumbing board elections for chairman and vice chair shall be held at the October 14, 2004 plumbing board meeting. New Business: It was brought to the plumbing board's attention that November 11, 2004 plumbing board meeting falls on Veterans Day. The board made a motion to move November 11, 2004 plumbing board meeting to November 9, 2004. It was seconded by Bill Pond and supported by Emmett Kelly and was approved unanimously. Drain Layers Exam The plumbing board members present found Cheyenne Sherman qualified to take the drain layers exam. Dave Burton, plumbing inspector, administered the drain layers exam. Cheyenne Sherman had a 92% on his exam. Minutes for Plumbing Board of Appeals— September 9, 2004 2 The plumbing board members present spent considerable time discussing the new plumbing laws, the possible changes to the plumbing laws, how to deal with enforcing the new plumbing codes and working with other city boards to accomplish compliance. It was brought to the board's attention that Frank Eirosius, Chief plumbing inspector, and Gary Brydges, Building Safety Manager, are working with public service on a city ordinance regarding `grease trap interceptors'. A motion was made by Bill Pond and seconded by Emmett Kelly to adjourn. Motion carried unanimously.
