Tim Haggart, Chairman called the meeting to order at 7:09 p.m. With a motion made by Tim
Waite, supported by Bill Pond, the minutes of December 9, 2002, were approved. They also,
approved the revision of the Plumbing Fee Schedule for the year of 2003.
Old Business:
The Plumbing Board spent considerable time discussing a Backflow Prevention Program. The
Board is continuing with that discussion, as soon as they get more information from Bill Meier,
Board of Water & Light or another of their representatives.
New Business:
The Plumbing Board spent considerable time discussing the new plumbing laws "House Bill
#4003" was signed and approved by the Governor on December 30, 2002 and will go into affect
March 31, 2003. Under the new plumbing laws this Act will regulate the installation, alteration,
maintenance, improvement, and inspections of plumbing and provide certain powers and duties to
certain agencies and departments, to define plumbing and set standards for those classifications,
to prescribe remedies and penalties and repeal acts and part of acts.
The meeting was adjourned at 8:21 p.m. The next Plumbing Board meeting will be February 13,
2003 at 7:00 p.m.

Therefore, no official business was conducted.
Drain Layers Exam
The Plumbing Board members present interviewed, Norman J. Bass and found him qualified to
take the drain layer exam. Dave Burton, Plumbing Inspector, administered the drain layers exam.
Norman J. Bass had a 90% on his exam.
The Plumbing Board members present spent considerable time discussing the new Michigan
Plumbing Laws, the new Educational Act known as Bill #358, and Cross Connection Control
Program from the Board of Water and Light and also how to improve attendance.
Old Business: Need to approve Plumbing Board Minutes from January 9, 2003.
New Business: none
Next Plumbing Board meeting will be March 13, 2003 at 7:00 p.m.

Tim Haggart called the meeting to order at 7:08 p.m. On a motion by Steve Reck, supported by
Bill Pond, the minutes of February 9, 2003, were unanimously approved.
Drain Layers Exam
The Board interviewed Albert Joe Crenshaw and found him qualified to take the drain layers
exam. Dave Burton, Plumbing Inspector, administered the drain layers exam.
Albert Joe Crenshaw scored a 70% on the drain layers exam.

Capital City Deli
Issue Of Appeal:
It is requested to allow Capital City Deli to conduct restaurant business with one barrier free
bathroom and one employee bathroom. The building is located at 121-123 E. Kalamazoo Street.
The petitioner, James B. Perry, presented his appeal that was heard by the Plumbing Board.
After viewing the blueprints and taking in consideration the limited space available in his
restaurant, the Board had a lengthy discussion with the petitioner and granted him a variance on
his appeal that required him to have two barrier free bathrooms for the occupant load presented to
the Board of 30 people. The Board agreed that limited space is an issue and granted him the
variance that one barrier free bathroom shall be provided with the existing employee's bathroom.

It was brought to the Plumbing Board's attention that the plumbing division is having compliance
issues with Jenks Brothers Plumbing and Heating at 3313 W. Mount Hope Avenue. That site has
4 buildings, with 8 apartment units per building. The issues that were presented to the Plumbing
Board were non-compliance on their Apollo Water Heating/Space Heating System. It was brought
to the Board's attention that the Apollo systems installed at that site are not in compliance and do
not meet the 2000 Michigan Pluming Code. The Code requirements are that the water at the
domestic outlet site shall not be more than 140 degrees. To maintain 140 degrees temperature at
the outlet site the temperature shall be controlled with a thermostatic mixing valve and that the
floor drains shall have trapped/primer valves and that the valves isolating the heating coil shall be
approved type of valves that protect from contamination and/or have an approved circulating
pump or a lock out type of valves to protect water in the coils from getting stagnated. The Board
had a lengthy discussion on that issue and agreed with the Plumbing division that those issues be
addressed A.S.A.P. and if the units are not in compliance by final inspection request by Jenks
Brothers Plumbing 7 Heating that they shall appear in front of the Plumbing Board for their
explanation on why the Apollo Domestic/Heating system is not up to 2000 Michigan Plumbing
Code. The Plumbing Board is also concerned with the disrespect that has been demonstrated by
Jenks Brothers Plumbing & Heating toward the Plumbing Divisions Inspectors/Staff. The Board
requested that the Chief Plumbing Inspector stays in close contact/communication with the
Plumbing Board regarding this disrespectful and offensive/threatening attitude displayed by Jenks
Brothers Plumbing & Heating regarding the situation at 3313 W. Mount Hope Avenue.
A motion was made by Name, seconded by Name, to adjourn the meeting at 8:23 p.m. Motion
carried unanimously. The next Plumbing Board meeting will be held April 17, 2003 at 7:00 p.m.

Special Board Meeting

Chairman Tim Haggart called the meeting to order at 7:00 p.m.
The reason for the meeting is to interpret a Correction Order that was written by Dave Burton to a
contractor doing work at 3313 W. Mt. Hope Avenue (a 4-building, 8-unit complex). The violation(s)
pertains to the installation of an Apollo System.
An explanation was requested by the Board from Chief Plumbing Inspector Eirosius. Chief
Eirosius explained the situation at 3313 W. Mt. Hope Avenue. The Plumbing division received a
phone call from the contractor regarding the Apollo System at that location. After a lengthy
conversation regarding the Apollo System, the question came up to the contractor how is he
controlling the water temperature throughout the system. The contractor made a statement that he
is maintaining the water temperature throughout the system by setting the temperature adjustment
knob on the gas control valve to not more than 140 degrees and that's the only obligation he has to
maintain his 140 degree water temperature throughout the system.
This department disagrees with using a temperature adjustment knob on the gas control valve for
setting the 140 degrees temperature. A temperature adjustment knob cannot be used to control
hot water temperature. The contractor disagreed with this decision. Jim Ruff, Director of Planning
& Neighborhood Development, received a phone call from that contractor stating that an Inspector
left a Violation Notice at 3313 W. Mt. Hope. He told Mr. Ruff that most of the items listed on the
Violation Notice were not Code requirements but preferences, and said the Apollo units are okay
by Code; they are individual units and are supposed to operate at 138 degrees. Also, the system
is designed by Code with approved material.
A meeting was held on March 24, 2003, with Mr. Ruff, Jack Nelson (Manager of Building Safety),
Frank Eirosius, Dave Burton and the contractor. The Violation Notice was discussed at the
meeting and the Plumbing Division expressed their concern to the requirements needed to satisfy
Code sections listed on the Correction Notice.

After a lengthy discussion, both parties could not agree on Code sections and need interpretation
on all those Code Violations. Chief Plumbing Inspector Eirosius explained to the Board that a
special meeting was called for the Board to interpret the intent of all the Code sections listed in the
Correction Notice.
501.2 —Water Heaters Used As Space Heaters
501.8—Temperature Controls
Where a combination of potable water heating and space heating requires water for space heating
at temperatures higher than 140 degrees a tempering valve shall be provided to limit the water
supply to the potable hot water system to temperatures of 140 degrees. The potability of the water
shall be maintained throughout the system. The Board recommended a tempering valve shall be
provided or a thermostat that has a maximum setting of 140 degrees at the gas valve with the
conjunction of manufacturer's installation instructions. After a lengthy discussion, the Board
recommended that a circulating pump on a timer be required to maintain the potability of the water
throughout the system. A motion was made by Bill Pond, seconded by Steve Reck passed
unanimously to accept the Board's recommendation.
1002.4-Trap Seals
Where the trap seal is subject to loss by evaporation a deep seal trap consisting of a 4" seal or a
trap primer valve shall be installed. After a lengthy discussion, the Board interpreted the 4" seal or
trap primer valve as either/or and if a 4" seal is provided, the conditions are met. The Board
agrees with that Code section. A motion was made by Steve Reck, seconded by Tim Waite
passed unanimously to accept the Board's interpretation.
504.6.1 — Discharge
The relief valve discharge pipe shall be rigid pipe approved for water distribution with a rating of
210 degrees F. The discharge pipe used at the job site is a Watts Model No. 100DT relief valve
drain. This department disagrees with the use of the Watts discharge pipe. It does not meet the
Code requirement in section 504.6.1 and also 504.6.2 that reads, "Materials listed in section 506.5
shall be tested, rated, and approved for such use in accordance with ASME Al 12.4.1." The Board
interpreted that the Watts discharge pipe is not rigid and does not have a rating of 210 degrees F.
A notion was made by Tim Waite, seconded by Bill Pond, passed unanimously to accept the
Board's interpretation.
504.7 — Required Pan
Where a water heater or hot water storage tank are installed in a location where the leak of the
tank or connection will cause damage, the tank or water heater shall be installed in galvanized
steel pan having a minimum thickness of 24 gage or other pan approved for such use. The pan
shall not be less than 1 1/2 " in depth, sufficient size and shape to receive all drippings or
condensation from the water heater. After discussing the location of the water heaters in question,
the Board agreed that a water heater pan is required and the water heater must be installed in a
pan. A motion was made by Tim Haggart, seconded by Tim Waite, passed unanimously to accept
the Board's interpretation.
The Plumbing board feels they gave much consideration to the situation and feels that this
department is properly interpreting the design and installation of the Apollo system. The purpose
of the Code is to provide minimum standards to safeguard life or limb, health, property and public
welfare by regulating and controlling the design, construction, installation, quality of materials,
location, operation, and maintenance or use of plumbing equipment throughout the system.

Jim Sellek, representative for Charlie Rich III, was present for the Appeal.
Issue of Appeal: Because of limited space and excessive cost of construction, the petitioner is
requesting to install only one (1) unisex, handicap accessible restroom instead of two (2) (one male
and one female) currently required by the Plumbing Code.
After reviewing the 2 sets of blueprints that were submitted by the petitioner (one set for a unisex
restroom and the other set for two restrooms, one male and one female) the Board advised the
petitioner that either set would be acceptable if resubmitted to the Building Safety Office with an
architectural seal.

PBA-03-2003 3313 W. Mt. Hope Ave. Jenks Brothers Plumbing & Heating Inc.
The petitioners Clyde Jenks, Marilyn Jenks, and Bill Jenks were present for the Appeal.
Issue of Appeal: They are requesting that the Code be enforced the same in Lansing as in
all areas per Chapter 5, Water Heaters, Section 501.2 as cited in the
2000 Michigan Plumbing Code.
The petitioner explained to the Board that he is doing work at 3313 W. Mt. Hope Avenue,
(A 4-Building 8 Unit Complex) and the violation that was written by the Plumbing Division was
pertaining to the installation of the Apollo system. He said he is proposing to maintain a 140
degrees water temperature throughout the system by setting the temperature-adjusting knob on
the gas control valve to not more than 140 degrees. He stated that's all he needs to do.
The Board explained to the petitioner that the violation that was written for 3313 W. Mt. Hope
Avenue pertains to the Apollo system.
The violation called for a trap primer. The board agreed unanimously that either a deep seal
trap or trap primer was acceptable, therefore the deep seal trap is approved.
The Violation called for a discharge pipe. The discharge pipe that was supplied by the petitioner
at the job site is a Watts Model 100 DT Relief Valve Drain. The Board agreed unanimously that
the relief valve drain discharge pipe is approved.
The Violation called for water heater pans. The petitioner explained to the Board that the owner
required him to install pans for the water heaters and the Board agreed unanimously.
The Violation cited the requirement that where a combination potable water heating and space
heating system is used, a tempering valve shall be provided to limit the water supply to the
potable hot water system to a temperature of 140 degrees.
After a lengthy discussion on how to maintain the water temperature at 140 degrees or below,
the Board explained to the petitioner that their interpretation is as follows:
Section 501.2 Water Heaters and Space Heaters. Reads that a tempering valve is
required.
Section 401.8 temperature Controls. All hot water supply systems shall be equipped
with automatic temperature controls capable of adjustments from the lowest to the
highest capability of temperature setting for the intended temperature operating range.
Manufacturer's Instruction Manual For Residential Gas Water Heaters. As per a
manufacturer's temperature regulations on page 16 of the installation guide this section
reads due to the nature of the typical gas water heater, the water temperature in certain
situations may vary up to 30 degrees F higher or lower at the point of use such as
bathtubs, showers, sinks, etc.
This means that when the temperature adjustment dial is set at the mark approximating
120 degrees F, the actual water temperature at any hot water tap could be as high as
150 degrees F or as low as 90 degrees F. The thermostat at this water heater has been
factory set at its lowest position to reduce the risk of scald injury.

The petitioner also stated that he needs 138 degrees temperature to maintain 70 degrees of
room temperature throughout the units.
Following this lengthy discussion, the Board's conclusion is a tempering valve shall be provided
to limit the water temperature supply to the potable hot water system to a maximum 140
degrees. The potability of the water shall be maintained throughout the system. As an
alterative an engineering report from the manufacturer stating that the thermostat has a
maximum setting of 140 degrees at the gas valve would also be acceptable.
After a motion made by Bill Pond, seconded by Chris Sherwood to deny the appeal the motions
carried unanimously.
A motion made by Tim Waite and seconded by Bill Pond to adjourn. Motion carried
unanimously.
The next Plumbing Board meeting will be held May 8, 2003, at 7:00 p.m.

unanimously.
Old Business:
The Plumbing Board spent considerable time discussing the appeals pertaining to the Apollo
Systems. The Plumbing Board was satisfied with the decision of the State Plumbing Board that
was made to deny the appeal that was made by Clyde Jenks Plumbing and Heating Inc. and
that the tempering valves shall be provided to limit the water supply to the potable hot water
system to a temperature of 140 degrees F. Motion carried.
New Business:
Elections were held. A motion was made by Tim Waite, seconded by Bill Pond that Tim
Haggart is voted in as Chair of the Lansing Plumbing Board. A motion was made by Bill Pond
and seconded by Tim Haggart that Steve Reck be the Vice Chair of the Plumbing Board. It was
moved, seconded and passed that the nominees be accepted as presented.
The Plumbing Board spent considerable time discussing and planning how to fill the vacancy on
the Plumbing Board.

With absences, there were not enough Plumbing Board members present to make a quorum.
Therefore, no official business was conducted.
Old Business: Approve minutes of October 9, 2003
New Business: None
The Drain Layers test was given to Jeff Humes. The remaining Plumbing Board members present
found Mr. Humes to be qualified to take the Drain Layers test.
Jeff Humes passed the Drain Layers test with a score of 78%.
The Plumbing Board members present spent considerable time discussing how to deal with
enforcing the new Plumbing Codes to the fullest and working with the other city boards to
accomplish compliance in correction violations.
Next Plumbing Board meeting will be December 11, 2003 at 6:30 p.m.

Chairman Tim Haggart called the meeting to order at 6:38 p.m. On a motion by Steve Reck,
supported by Bill Pond, the minutes of October 9, 2003, were approved unanimously.

Jeff Vernon, representative for Petitioner, was present for the Appeal.
Issue of Appeal:
Petitioner requested variance for a shower stall that does not meet the 2000 Michigan Residential
Code as per section P2708 (showers) P2708.1 the shower compartment shall have at least 900
square inches of floor area and be of sufficient size to inscribe a circle with a diameter that is not less
than 30 inches."
The petitioner explained to the Plumbing Board that there is no room to install a larger shower and that
the dimensions on the shower in question are 30 by 27.5 inches. The owner purchased the shower
and the rest of the plumbing, in that given area, was updated and completed to accommodate the
current shower. The petitioner also presented pictures to the Board and an explanation that there was
not enough room to get a larger shower into the given area. Inspector Burton has been working on
that project with the petitioner regarding the shower stall. Inspector Burton stated that, "there is room
for a larger shower that would meet the bare minimum intent of the 2000 Michigan Residential Code
(section P2708)."
After lengthy discussion and viewing the pictures that were presented by the petitioner the Plumbing
Board came to the conclusion that it is possible to install and meet the bare minimum requirement.

A motion was made by Bill Pond and seconded by Steve Reck to deny the appeal. The motion carried
unanimously.
Other Business:
Also present at the board meeting were Darrel Kessler and Rod Tenniswood regarding a storm and
sanitary separation at 2704 S. Cedar Street. Mr. Kessler and Mr. Tenniswood were invited by Chief
Plumbing Inspector, Frank Eirosius and Building Safety Manager, Gary Brydges to present their
argument and/or file for variance with the Plumbing Board. Mr. Kessler presented the argument that
he is not separating the storm drains from the present sanitary building drains and the building has a
combination storm and sanitary drainage system that conveys it's discharge to a public sewer. Mr.
Kessler's argument is that he separated in the transmission area and he will not separate the system
in the Kirby's area. After a lengthy discussion the board advised Mr. Kessler to follow the appeals
process and then Mr. Kessler shall be given an opportunity to present an oral or written argument on
issues of law and policy and to present evidence and arguments on issues of fact. Mr. Kessler didn't
agree with the Board's statement and his misdemeanor turned belligerent and vulgar by making
comments to the Board by calling them a kangaroo Plumbing Board and he does not need them
because he is going to go up and see the City Council.
The chairman took control of the situation and called for a motion to adjourn. Seconded by Steve
Reck the motion carried unanimously.
The meeting was adjourned at 7:23 p.m.
The next Plumbing Board meeting will be held January 8, 2004, at 7:00 p.m.
