The Plumbing Board members present spent considerable time going over qualifications for
Plumbing Board members, the resignation of long time member and Journeyman Plumber Robert
Burns, and how difficult it is to have a quorum for meetings with the current vacancy on the board
and busy schedules of current members.

Chairman Steve Reck called the meeting to order at 7:32 p.m. The members of the Plumbing Board congratulated
Frank Eirosius, Sr., for his appointment as Chief Plumbing Inspector. They also welcomed Tim Waite to the Board.
Old Business: The Plumbing board approved the minutes of September 14, 2000. The motion was made by Bill
Pond to accept the minutes; seconded by Tim Waite. The minutes were approved unanimously.
New Business: The Board interviewed four Drain-layers (Kevin Douma, Robert Faidley, John Verlinde & Douglas
Miller) and found them qualified to take the Drain-layers exam. Frank Eirosius, Sr., Chief Plumbing Inspector
administered the exam. The scores were as follows:
Kevin Douma - 76%
Robert Faidley-54%
John Verlinde- 82%
Douglas Miller- 76%
The Plumbing Board members present spent considerable time discussing how the new IPC or the MIPC would
affect the City of Lansing. They also discussed the following:
• The effective date of the new Michigan International Plumbing Code will be approximately March 31, 2001.
• The medical gas provisions addressed in the MIPC and plumbing laws (House Bill 4003).
• How the MIPC would affect the venting on commercial buildings with the use of studor valves or any other
prescribed venting methods.
Next Plumbing Board meeting—In order to have a quorum will be Tuesday, March 6, 2001.

Chairman Steve Reck called the meeting to order at 7:35 p.m., with a motion by Tim Haggart to
accept the minutes of February 8, 2001 and March 6, 2001 (No Quorum) and supported by Bill
Pond. The minutes were approved unanimously.
Old Business: The Plumbing board members present spent considerable time discussing the
plumbing law and the Michigan International Plumbing Code.
❖ The estimated date for the Michigan International Plumbing Code is July 31, 2001.
❖ The language change in the plumbing laws on water softeners, regarding 15 gallons/30
gallons is to be strictly used in the one-family and two-family dwelling code.
❖ Medical Gas — The language addressing medical gas in the plumbing laws is too vague
and needs to specify the installation, testing and certification.
❖ Mechanical vent/studor valves — The Board expressed concerns about how the valve is
working and how safe it really is. The Board has a health and safety issue with that device
and expressed their wish that this device not be used in the City of Lansing, because they
are concerned about the citizens of Lansing. This device is approved under the IPC.
New Business: The Board wants to reschedule their meeting dates and times to a new
scheduled date effective the second Monday of each month and change the time from 7:30pm to
7:00pm, starting September 10, 2001. A motion was made to change the meeting dates and time
by Lynn Gunthorpe and seconded by Tim Waite. The change was approved unanimously.
A motion to adjourn was made by Tim Haggart and seconded by Lynn Gunthorpe. The meeting
adjourned at 8:57pm.The next scheduled Plumbing Board meeting is May 10, 2001.

On a motion by Tim Haggart, supported by Bill Pond, the minutes of April 12, 2001, were approved
unanimously.

Mrs. Diane Burns, property owner, was present for the appeal. The petitioner requesting a
variance on a code interpretation requiring the owner to provide toilets in sufficient capacity to
handle the occupant load at the floors where the toilet rooms are located.
The Building was formerly a church and is being redeveloped as a night club/bar/restaurant. The
building has three levels; a lower level, a main level and a balcony level. The building has received
a State Barrier Free Exception for vertical access to the main lobby and balcony levels. Previously
all toilet room facilities were provided on the lower level.
The owner/developer has submitted construction drawings that add additional toilet fixtures to the
lower level and new men and women's toilet rooms at the main and balcony levels.
Minutes for Plumbing Board of Appeals—August 10, 2001 2
The Plumbing Code requires that a number of toilet fixtures for a given occupant load of a floor be
provided on that floor so that occupants do not have to travel to another floor to access required
toilet facilities. The main and the balcony levels do not have the required number of fixtures to
serve the respective occupant loads of each floor. However, since the lower level has more than
the required fixtures for that floor the total number of fixtures required for the building as a whole
are provided (using urinal substitution for one of the water closets).
The owner would provide signage on the main and balcony levels at the toilet rooms indicating that
additional facilities are located on the other levels. Should a waiting line begin to form at a toilet
room, the occupants would have an informed choice to remain in line or travel to another floor to
use the facilities.
After a lengthy discussion, a motion was made to grant a variance to substitute a urinal for a water
closet on the main floor men's bathroom that will eliminate a lavatory and provide room for that
urinal. That variance will authorize relief from table 9.3 of the amendments of the Plumbing Code.
The motion was made by Chris Sherwood, seconded by Bill Pond and carried unanimously.
Meeting with the BW&L
The Board wishes to meet with Bill Meyers from the Board of Water and Light, to discuss the
backflow prevention program at their next scheduled meeting.
Adjournment
Bill Pond made a motion, seconded by Tim Waite, to adjourn the meeting at 8:37p.m. Motion
carried unanimously.

Meeting was called to order at 7:02 pm by Vice Chairman, Tim Haggart. With absences, there were not enough
Plumbing Board members present to make a quorum. Therefore, no official business was conducted.

Informal Business: Since the test for two drainlayers was administered by Public Service during the
summer and the applications were not reviewed by the Plumbing Board, the Plumbing Board reviewed the
applicants' qualifications and found them to be qualified. The applicants' names are James Dinkey and David
Skiver. Approval is expected at the next Plumbing Board meeting.
The Plumbing Board members present spent considerable time discussing the 2000 Michigan Plumbing Code.
o Mechanical vents/studor valves—The Board expressed concerns about how the valve is working and
now safe it really is. The Board has a health and safety issue with that device. The device is approved
under the 2000 Michigan Plumbing Code.
The Board also discussed the upcoming installation of a second water meter for use in the irrigation system and
the need to follow up with the Board of Water& Light on what should be done to get the proper backflow
prevention device installed. The Board is seriously concerned about the flooding problem and what to do to
prevent flooding into dwelling and/or commercial properties and discussed the use of a backwater valve that can
be used to solve the problem. The Board is highly concerned that by using that device, we are getting into a law
suit. We need to invite Public Service to the next Board meeting to get their cooperation and input.

Drain Layers Exam
The Board interviewed 5 drain layers: Robert Faidle, Chet Lupnitz, Leonard Schneider, Jr., Danny
L. Babcock and Ronald D. Berry and found them qualified to take the Drain Layers Exam. The

The buildings in question are located on Bardaville Street. The Petitioner is appealing the City of
Lansing's Correction Order to bring the discharge off the water heaters to Code and provide a
water heater pan with a drain in the Bardaville Apartment Complex. The Petitioner believes the
water heaters have been like this ever since the Complex was built and the only thing was draining

to the lower floors was the discharge off the relief valves on the water heaters. He believes that
the water heaters were approved by the City of Lansing at that time, and that new replacement
water heaters shouldn't be brought up to Code. The Code requirements is that the water heaters
at Bardaville Apts. She be installed to meet the 1994 Uniform Plumbing Code, which reads " When
a water heater is located in an attic or furred space, where damage may result from a leaking water
heater, a water tight pan of corrosion resistant material shall be installed beneath the water heater
with a minimum 3/" diameter drain to an approved location". Also, the 200 Michigan Plumbing
Code reads, "Where a water heater or a hot water storage tank are installed in a location where
leakage off the tanks or connection will cause damage, the tank or water heater shall be installed
in a galvanized steel pan having a minimum thinness of 24 gauge or other pans approved for such
use. The pan shall be not less than 1 1/2" deep and shall be sufficient size and shape to receive all
dripping or condensate from the tank or water heater. The pan shall be drained by indirect waste
pipe having a minimum diameter of 3/ of an inch.
The argument in support of this appeal is that the relief valves were plumbed together to a
common drain ( %" drain) in the wall to a lower drain in the basement. If the relief valves or pan
drains are plumbed the way the City of Lansing would like them, there is a potential problem that if
the water heater pan drain would plug and overflow, that would go through the ceiling space in to
the lower apartment unit. The Petitioner stated it cannot be done according to the Code without
tearing down walls and causing more damage than necessary. He also feels it is not necessary to
add a pan.
The Board was concerned about the safety of the occupants, but also was concerned that the
water heaters in question are installed according to the 1994 UPC and/or 2000 Michigan Plumbing
Code. The question was raised to Brian Shields, Plumbing Inspector/Mechanical Inspector, if it is
possible to get the pans in there. According to Mr. Shields, it can be done, but they have to cut
into the walls and tie into the existing drain to meet the intent of the Codes. Mr. Shields is the
inspector who was working with the Petitioner to get the water heaters into compliance.
After a lengthy discussion with the Board, the Inspector and the Petitioner regarding how to install
the water heater pan's drain to the existing drain, a motion was made by Lynn Gunthorpe,
supported by Bill Pond, to table the decision until the next meeting on November 12, 2001 at 7:00
pm, in order to allow the Petitioner additional time to investigate and/or consult with the Plumbing
Inspectors.
Backflow Prevention &Testing Program
Bill Myers, from the Board of Water and Light, attended the meeting to discuss the City of Lansing
Plumbing Board how to implement a backflow presentation and testing program that is presently
part of the 2000 Michigan Plumbing Code, Section 312.90, "Inspections and testing of Backflow
Assemblies". The Code reads, "All backflow devices shall be tested and inspected to determine
whether they are operable".
Mr. Myers state that the Board of Water and Light is well on its way to having a backflow testing
and inspection program. The BW&L is willing to work with the City of Lansing's Plumbing
Department. The dialogue between Bill Myers, the Plumbing Board and Mr. Nelson included:
o How the program should work
o Who will update the database
o Will it interfere with the State Code
o Develop a City ordinance to gain access to the public buildings
The BW&L's major concern is protect the water system from contamination. The Plumbing Board
and the Plumbing Department are also concerned about inspection and testing of packflow

assembly devices. The Board will develop a program and/or ordinance that would work for the
BW&L and the City Of Lansing's Plumbing Department. Mr. Myers indicated he would keep in
contact with the Plumbing Board/Plumbing Department.
The meeting was adjourned at 9:17 pm.

A motion was made to remove the case from the table for this appeal that was brought forward by
the Petitioner on October 8, 2001. The Petitioner is appealing the City of Lansing's correction
order to bring the discharge off the water heaters to Code and provide a water heater pan with a
drain in the Bardaville Apts. Complex. The Board allowed the Petitioner additional time to
investigate and/or consult with the Plumbing Inspectors. The Petitioner did not consult with the
Plumbing Inspector, Brian Shields, or any other Inspector. The Petitioner feels that it should not be
changed because it is existing and would cost the owner additional monies to bring it up to Code.
The Board showed its concern about additional cost: however, the intent of the Code has to be
met. After lengthy discussion, the Petitioner stated to the Board they changed at least 90% of the
water heaters in one building and all existing drains of the temperature and pressure relief valve
are terminating in the mechanical room. There are 200 total units there and the apartment
complex changed to new ownership. The Board stated that they are concerned about the safety of
the occupants, but also were concerned that the water heaters in question are installed according
to the 1994 UPC and/or 2000 Michigan Plumbing Code. The Board also stated that they gave the
Petitioner ample time to investigate and/or meet with one of the Plumbing Inspectors to come up
with a practical working solution. The Board addressed the question to Inspector Shields if it is
possible to get pans in there. According to Mr. Shields, it can be done, but they have to cut walls
to tie it into the existing drain to meet the intent of the Code. After a lengthy discussion, Tim
