Francis St. Lansing, MI 48912 Dear Mr. Leeman: We have received your request for the minimum number of signatures required to place a local issue on the November 3, 1992, ballot. Article 2, Chapter 4, .2-403 of the City Charter specifies that "initiative and referendum petitions must be signed by a number of City electors equivalent to at least 5 percent of the registered electors of the City. Petitions shall set forth in full the measure to be initiated or referred. The circulators may submit the petitions to the City Attorney for approval as to form before circulating, but they are not required to do so. Signers of petitions shall be registered electors of the City. Each shall sign his or her name indelibly and shall indicate his or her residence at the date of signing. Each petition shall contain a sworn affidavit of the circulator stating that each signature is, to the knowledge of the circulator, the genuine signature of a registered elector and the person whose name it purports to be; and that it was affixed in the presence of the circulator. Signatures obtained more than 90 days before the petition is filed with the Clerk shall not be counted. The City Clerk shall, within 15 days, canvass the signatures and shall present the petition, if found sufficient and proper, to the City Council at its next regular meeting. The following are voter registration totals based on the May 4, 1992, election counts, and the estimated number of signatures required. The actual number of signatures required will be based on the number of registered voters in the City of Lansing as of the date Petitions ate filed with our Office. Registered voters as of 5/4/92 5% of the total Active registered voters = 83,323 4,167 Petitions must be filed no later than August 11, 1992, and wording must be approved by City Council no later than August 24, 1992, to be on the November 3, 1992, ballot. State statute, MCLA 117.25 dictates the requirements for a valid initiatory petition. I am enclosing for your information and review another copy of it. Essentially, a review of the state statute, MCLA 117.25 and the initiative form you supplied to me on May 18, 1992 reveal the following deficiencies: 1. The verification by the circulator fails to state that the petition was circulated at the request of and pursuant to the directions of the association organization or persons doing the amendment. See, MCLA 117.25(2); and 2. The initiatory petition is not addressed to the City Clerk. See, MCLA 117.25(1); and 3. The initiatory petition does not state what body or organization is primarily interested in and responsible for the circulation of the petition and securing of the amendment. Francis St. Lansing, Mi 48912 Department of Law MEMORANDUM �sCplGp� "Equal Opportunity Employer" TO: JIM BLAIR, City Clerk x FROM: AL KNOT, City Attorney DATE: 07/22/92 RE: LETTER FROM HAROLD LEEMAN, JR., REGARDING PETITION TO AMEND CITY CE -A_ RTER TO LIMIT TERMS OF OFFICE OF ELECTED OFFICIALS Pursuant to your request of Tuesday, July 21, 1992, I have reviewed the above mentioned letter dated July 13, 1992 which was received by this office on July 21, 1992. The first ouestion asks whether your office can begin canvassing petitions filed before the August 11, 1992 deadline, which you have advised Mr. Leeman is the petition filing date deadline. There is no legal prohibition against receiving petitions earlier than the filing deadline so that canvassing can begin. Secondly, Mr. Leeman has inquired as to whether the ten (10) day period for filing supplemental petition papers referenced in Section 2-403.6 of the 1978 City Charter is applicable. It is my understanding that the petition to limit terms of elected official is being proposed as a Charter amendment. The 1978 City Charter only refers to initiative and referendums regarding ordinances. State statute governs patitions to amend Charters. A review of MCLA 117.25 (4) reveals the City Clerk has 45 days from the date of filing the petition to certify the sufficiency or insufficiency thereof. There is no statutory provision (unlike the City Charter) which authorizes a ten (10) day period to file supplemental petition papers to amend a City Charter. It should also be pointed out that if the requisite number of signatures are obtained, the proposed Charter amendment must be submitted to the governor for his review and comment and also no election can be held on the proposed charter amendment until 90 days after the petition filing deadline. In summary, one must remember that in proceeding through the Charter amendment process, State law, not City Charter or ordinance, is applicable. I hope this has been helpful. In that event the proposal shall be submitted at such primary, regular, or special election and a special election shall not be so called. Other proposals, whether initiated by a 5% petition or proposed by the legislative body within the times within this act provided, may be sub- mitted at such special election. A proposal submitted to the electors by the initiative and receiving an affirmative majority of the votes cast thereon shall not be held unconstitutional, invalid, or void on account of the insufficiency of the petition by which submission of the same was procured. (6) Except as provided by subsection (7), any proposal contemplating increased expenditure of funds by the municipality shall become effective, if adopted by the electors, only at the beginning of that fiscal year of the municipality commencing not earlier than 60 days following the election at which the proposal was approved by the electors. (7) If a proposal which increases the city's ad valorem property tax limita- tion applies, by its terms, for a specific year or period commencing before the date the proposal would otherwise take effect under subsection (6), the proposal shall be effective both from the date it is approved by the electors and retroactively for the year or period specified in the proposal. Notwith- standing any charter provision to the contrary, if a proposal is approved by the electors and given effect under this subsection after the city has levied its ad valorem property tax levy for the fiscal year and if the adopted proposal authorizes the levy of a millage rate for the fiscal year during which the proposal was approved in excess of the rate the city was authorized to levy before adoption of the proposal, the city may levy an additional tax to be collected either by a supplementary billing by the city or at the same time and in the same manner the county's ad valorem property tax levy is collected. (8) Any person aggrieved by any action, or failure of action, of the city clerk may bring an action against the clerk in the circuit court for writ of mandamus or for other appropriate relief. We are submitting the petitions at this time so that the proposal may be placed on the November 3, 1992, general election ballot in conformance with MCLA 117.25(4) which requires that the election occur not less that 90 days following the filing of petitions. Please note that City Attorney Al Knot, in his memorandum to you of July 22, incorrectly stated that no election can be held on the proposed charter amendment until 90 days after the "petition filing deadline". The law, in actuality, refers to the time of filing rather than the filing deadline. While we realize that 117.25(4) of the Home Rule Act allows the city clerk 45 days to determine the sufficiency of the petitions, we certainly expect you will be able to perform this task within the 15 days allowed by the City Charter, particulary since the minimum number of signatures needed (5o of registered electors) is the same as for city initiative and referendum petitions, which your office has always been able to canvass promptly. We are sure you are sensitive to the fact that any unusual delays in petition certification which may keep the proposal off the No- vember ballot will be perceived by many voters as self-serving since passage of the proposal could affect your term of office. Blair, DATE: August 4, 1992 SUBJ: Citizens for a Office of Citv Clerk City of Lansing Chairperson City Clerk Better Lansing Petition Drive We are in receipt of petitions totalling 4,373 signatures submitted by Citizens for a Better Lansing for a charter amendment proposal limiting the number of terms for the offices of Mayor, City Council Members and City Clerk. It is my staff's understanding that additional signatures are still being collected by this group. They have requested -that we canvass these petitions within 15 days so that they can meet the deadline to be on the November 3, 1992, ballot [final ballot wording must be to County Clerk by August 25, 1992]. Our Office has approximately 1,000 new voter registrations that were received since the close of registration for the August General Primary [close of registration was 7/6/92]. It will take my staff approximately 50 hours to get these new registrations into the system. We need to get these new voters into the computer so that they can receive voter i.d. cards in a timely manner and also to cover in case any of these new voters signed the petitions to be canvassed. The week of an election is consumed with clean-up activities from the election and there will be no time available the week of 8/3/92 to canvass petitions or enter these new registrations. R F f: s Q August 17, 1992 Council President James Crawford and Members of Lansing City Council 10th Floor, City Hall Lansing, Michigan 48933 Dear Councilmembers : The Election Commission of the City of Lansing met on Tuesday, August 11, 1992, for the purpose of reviewing the petitions submitted by Citizens for a Better Lansing, and determining the number of signatures legally required to put the issue of term limitation for elected City Officials on the November ballot. It was the finding of the City Election Commission after reviewing State law that the legally required figure based upon the number of registered voters residing in the City of Lansing at the time of filing the petition was 101, 920. State law requires signatures from not less than 5% of those people, therefor, Citizens for a Better Lansing needed 5,096 signatures filed with the City Clerk 90 days in advance of the date of the Election (November 3, 1992) to place this question on the ballot. It was the consensus of the City Election Commission that the City Clerk's Office should stop canvassing the petitions and reviewing the amount of signatures turned in because the count of 4,800, given by representatives of Citizens for a Better Lansing, is short of the number required to put the issue on the November ballot. There have been no problems requiring service from the Unisys Field Engineer on duty since we started paying for one to be on site election nights — the August primary of 1989. They responded that there are only two options: pay for on-site service as we have been, or put a call in, and they will respond as soon as they can, but with no guarantees. It currently costs $220 per hour for on-site service. A short election takes about 3 hours, the presidential takes 5-7 hours. While the Unisys Field Engineer was on site, he agreed with me that nothing could be done at that time. My staff switched to the backup card reader and re -ran the first precinct as the quickest way to get the election processing back on track. (The failed primary card reader was reported to Unisys and will be repaired at a later, more convenient time.) None of these events was catastrophic. The one which caused the most delay was the weather- related erratic card feeding. And, that, of course, is completely out of our hands. Whenever we have extremely humid conditions preceding and during an election, we can expect to have mis-feeds of the ballots and delayed processing. The polling place, Riddle School, is located at the extreme northwest corner of precinct 8, ward 4. 2. The distance to polls in- creases from 1-5 blocks to lz-2 miles for approximate- ly 200 potential voters. 3. Moores Park School is lo- cated within the boundaries of precinct 8, but no pre- cinct 8 voters can vote there. 4. Either Moores Park School or St. Casimir could readily accommodate a precinct 8A for all voters south of the Grand River. (Does this precinct proposal need an environmental impact statement because of the in- crease in auto emissions that contribute to air pollution?) Suggestions for drawing the next precinct consolidation map: 1. Start earlier so that em- ployees in the clerk's office can work under less pressure. 2. Invite Lansing citizens to help plan the changes in precinct boundaries. 3. Draw precinct boundaries with one basic purpose: to increase voter turnout on election day. 4.
