MCM:cw attachment : 01 -24-94A11 : 1 ') RC PROCEEDINGS OF THE CITY OF LANSING HUMAN RELATIONS BOARD December 9 , 1993 The regular scheduled December meeting of the Human Relations Board was called to order by Chair Marylou Mason, Thursday, December 9 , 1993 at 7 : 35 a.m. in the Human Relations and Community Services Conference Room, City Hall Annex. ATTENDANCE Present: Bryanton, Egan, Hicks, Johnson, Jones , Mason, Nichols, Bradford, Truscott Absent: Dunnings , Jr. , Pohl Staff : Interim Director, Michael C. Murphy, Gomoll, Lopez, Steinberg, Norris, Walton Police Liaison: Don Dawson APPROVAL OF MINUTES Minutes were approved after a quorum was obtained. MOTION Board Member Nichols moved that the minutes of November 18, 1933 be approved, supported by Board Member Truscott. Motion carried unanimous . COMMUNICATIONS No communications PETITIONS 1) Civil Rights complaint - Received complaint, Pedro Hernandez vs City of Lansing EEOC # 23A945341Q MDCR# 134766 EM09 2 ) Kip Gomoll stated that there are several Civil Rights complaints outstanding (report attached) REPORTS 1) Director & Staff Reports a) Mr. Murphy-Interim Director (report attached) b) Mr. Gomoll (report attached) c) Mr. Hester (report attached) d) Mr. Lopez (report attached) Proceedings of the Human Relations Board December 9 , 1993 Page 2 2 ) Subcommittee Reports : (report attached) a) Employment 1) The Committee did not meet for the month of December. Board Member Hick stated that he contacted the staff to establish a meeting schedule for 1994 . The monthly meeting will be held on the 2nd Wednesday of each month at 8 : 00 a.m. , a place for the meeting has not been as of yet ' been established (report attached) . Board Member Hicks also stated that no Ordinance setting any qualifications for 'the position of the Director of Human Relations and Community Services Department has been passed. b) Housing 1) No report - Housing committee will meet in December to discuss the April fair Housing month program. c) Public Relations 1) Board Member Egan stated that the Public Relations committee met on Monday, December 6 to discuss the Human Rights Dinner for Thursday, February 17 , 1994 (tentative schedule attached) . Proposed theme: "OPENING THE DOOR TO DIVERSITY. " d) Police Community Relations 1) Board Member Bryanton stated that he received communication from Nancy Small of the Lansing Police Department canceling the December meeting of the Police Community Relations Board without comment. 2 ) Police liaison Don Dawson stated that the Lansing Police Department was starting to explore the possibility of having a "mock" police academy, housed at 'Lansing Community College, in conjunction with the Lansing School District to attract High School students into law enforcement. Proceedings of the Human Relations Board December 9 , 1993 Page 3 PUBLIC MAY ADDRESS BOARD Mr. Dave Weiner spoke regarding the Budget for the City of Lansing to include the Human Relations and Community Services Department, as well as the interests that both Mayor-Elect Hollister and himself have in Human Services , and what the transition team is trying to accomplish. Mr. Dave Weiner also asked that the Human Relations Advisory Board give a statement of what is considered to be the five (5) major issues and priorities that the Board is being faced with for the coming year. (This was completed and submitted to Mayor-Elect Hollister November 1993 ) . OLD BUSINESS No Report NEW BUSINESS Mr. Murphy discussed the comment made by the Lansing Police Department dispatcher in regards to Council President Canady and has assigned staff to follow up with the Lansing Police Department. John McComb, Budget Analyst did a presentation regarding the Human Relations and Community Services Department Budget. ADJOURNMENT MOTION Board Member Nichols moved that the meeting be adjourned, supported by Board Member Truscott. Motion carried unanimous . Currently, I am working to complete the department ' s budget for 1994-95 . The department is also coordinating the City of Lansing Dr. Martin Luther King, Jr. Commemoration program which will be held on Friday, January 14 , 1994 at 12 noon in the City Council Chambers . All board members are invited to attend. The staff reports from the Equal Opportunity Specialists are also attached for your review. COMMUNICATIONS No communications PETITIONS a) Mr. Gomoll stated that Mr. Hester and himself are investigating the City Market per City Council request because of citizen complaints . Board Member Bryanton stated that the complaints from citizens regarding the City Market are brought forth because of the City Market guidelines to be a vendor. Mr. Gomoll stated that the guideline was set up to attract horiticultural, agricultural, and homemade craft vendors . Mr. Murphy stated that the Ways and Means Committee Chair, Mr. Benavides might hold the City Market's city allocation until the investigation is complete. REPORTS 1) Human Relations and Community Services Director and Staff Report a) Mr. Murphy-Interim Director stated Mr. John McComb wanted to get direction, in terms of the Budget, from Mayor Elect David Hollister, and until given such direction, there will be no joint board meeting with John McComb, Budget Analyst, and the Human Resources Advisory Board. Mr. Murphy also stated that one ( 1) budget will be submitted to the Mayor but, both the Human Relations Advisory Board and the Human Resources Advisory Board will have an opportunity to review it. Mr. Murphy stated that Mr. Weiner, the Mayor Elect' s transition Director, and himself met to discuss the Human Relations and Community Services department as well as the Human Relations and Human Resources Advisory Boards . Mr. Murphy stated that the Mayor Elect put together a few committees, one being a Youth and Families Committee to be Chaired by Ms . Sherri Hicks . b) Mr. Hester stated that the CSO project was being worked on by staff. Mr. Hester also stated that he is current on the Chief Electical Inspector complaint. c) Mr. Lopez stated that he met with Mr. Emerson Ohl, Economic Development Director regarding the Lansing Center skilled labor workers, and he also did a presentation at Michigan State University for Black Student Accountants on the subject of Sexual Harassment. Proceedings of the Human Relations Board November 18, 1993 Page 3 2) Subcommittee Reports : a) Employment (report attached) 1) Steve Hicks named Chairperson a) Board Member Hicks stated that the employment subcommittee met November 10, 1993 to review the residency report and recommended that the Board go on record to support city residency for all newly hired city employees and that a letter be submitted to the Mayor and City Council indicating the recommendation. Board Member Hicks stated that the subcommittee discussed meeting with various recruitment agencies regarding employment possibilities within the city. Board Member Hicks stated that the possiblity of reinstating the Field Representative Program was discussed for summer jobs for the youth of the City of Lansing. MOTION: by Board Member Hicks-moved that the board support the residency for all newly hired city employees and a letter be directed, January 1, 1994, to Mayor Elect David Hollister and the new City Council. Staff provided committee members with a copy of report submitted to the Director concerning residency of City ' full-time regular employees . The committee discussed the report. Having reviewed the residency report provided the employment subcommittee recommends that the Board go on record to support City residency for all City employees and that a letter be directed to the Mayor and City Council indicating this recommendation. The subcommittee discussed meeting with various. recruitment agencies regarding employment possibilities with the City. This item had been previously discussed by the committee and it was agreed that some meetings will be arranged. Committee members inquired as to the extent of employment possibilities for youth with the City ( i .e. summer jobs ) . Staff explained that the existing summer jobs are represented by the UAW and are seasonal laborer positions . These positions have been cut back over the past few years . The committee discussed other employment possibilities for employment with the City. The possibility of reinstating the Field Representative program within the department was discussed. This data was compiled from records of employee addresses on file with the payroll office of the City. The employees included are those individuals who are employed in full-time regular positions with the City. These tables included those employees on our department ' s records for August 31, 1993 . Table 1 delineates residents and non-residents by City departments . Those departments with less than twenty employees have been combined. In those instances where an employee ' s address was a post office box within the City of Lansing, the employee' s residency status was listed as unknown. It should be noted that the smaller departments that were combined have the highest percentage of resident employees . The second highest percentage of resident employees is the Public Service Department with 51 . 84% . The smallest percentage of resident employees is found in the_ Police Department which has only 30 . 97% residents . Based on the records reviewed, the overall percentage of City employees living within the City limits was 41 . 71% . Table 2 is a residency breakdown based on employee race and sex. Among the three racial groups with significant representation within City employment there is a substantial difference in the percentages of residents . Nearly, eighty percent (80% ) of Black (African American) employees live within the City limits . That contrasts with the fact that only about thirty-seven ( 37%) of White employees in full-time regular positions are City residents . The percentage of Hispanic resident employees falls between the other two groups at approximately sixty percent ( 60%) . Female and male employees reside in the City at almost the same ge of female full-time regular employee's percentage. The percenta living in the City was 41 .42%, while, male full-time regular employees living in the City was 41. 79% . Residency November 2 , 1993 Page 2 Table 3 outlines residency of employees based on bargaining unit representation. This -includes those employees not in any bargaining unit. For those unions representing more than one bargaining unit (i .e . Teamsters , FOP) , all units have been combined under one heading. Only the UAW and exempt employees have greater than 50% of their groups as City residents . The FOP and the IAFF mirror the Police and Fire Departments with only 30 . 58% and 37 . 66% City residents among their members respectively. Approximately forty-two (42%) of those employees represented by the Teamsters are City residents . So, in conclusion the most likely individual employed by the City in a full-time regular position and also a City resident would be a Black (African American) individual employed in the either one of the smaller departments or the Public Service Department and in a position represented by the UAW. This information can be used to reflect upon some of the issues currently under discussion. This data provides a benchmark form which the questions of residency for City employees and the question of establishing a goal for contractors doing business with the City can be discussed. This data also reflects upon the City' s equal employment opportunity and affirmative action programs in that the greater percentage of City employees living in the City are minority individuals . In the Police Department, our records indicate that approximately 55% of the minority employees are City residents compared with approximately 28% of White, employees . In the Fire Department, a similar pattern is revealed. A little over 73% of those minorities working in full-time regular positions in the Fire , Department live within the City, whereby, only a little less than 34% of White employees in the Fire Department live in the City. As can be seen, the question of City employee residency can impact the -City' s employment picture in different ways . ATTENDANCE Present: Mason, Johnson, Egan, Truscott, Hicks, Pohl, Nichols Absent: Bryanton, Dunnings, Heard, Jones , Porter-Bradford Staff: Interim Director Michael Murphy, Lopez, Hester, Harvey, Norris, Steinberg, Walton Police Liaison: Captain Don Dawson APPROVAL OF MINUTES Minutes were approved after a quorum was obtained. MOTION Board Chair Mason moved that the minutes of September 9 , 1993 be approved, motion carried unanimous . COMMUNICATIONS No communications PETITIONS a) Mr. Hester stated that there are ongoing complaints, including Civil Rights complaints which are still pending, and a petition, from the Michigan Department of Civil Rights may be forthcoming regarding the Police Complaint pertaining to the activities in the Detention area. Mr. Hester stated that there were reports of neighborhood complaints that are ongoing. b) Mr. Lopez stated that he had a couple of complaints, one involving the Public Service Department. Mr. Lopez ,stated that there are two (2) complaints, regarding the 911 Center, that are still pending. REPORTS 1) Human Relations and Community Services Director and Staff Reports a) Mr. Murphy stated that at the last board meeting a Proceedings of the Human Relations Board October 21, 1993 Page 2 discussion had taken place regarding the Combined Sewer Overflow -£. S.O. ) project which had received attention from the Lansing State Journal and the Coalition for Community Concerns (a handout dated April 14 , 1993 was disbursed) . b) Mr. Murphy discussed the issue of the City of Lansing employee residency. Preliminary research by the Human Relations and Community Services Department indicates that approximately 42% of all the full-time regular employees of the City are city residents . Board Member Pohl inquired as to the board responding publicly or through the newspapers to these issues . Mr. Murphy stated that the newspaper contacted the Human Relations and Community Services department regarding the CSO project. Board Chair Mason stated that the Director of the Department should contact . someone on the Board concerning newspaper inquiries . Board Member Hicks inquired as to whether or not any checking of residency requirements has been done on any other cities . Mr. Murphy stated that to his knowledge we have not. c) Mr. Murphy stated that Mayor Crawford is looking at several options on how to best increase minority participation and address the residency issue. Mr. Hester indicated that the question of residency is something that the Human Relations and Community Services Department started investigating in reference to construction projects . Board Member Truscott stated that a lot of contractors hire on a seasonal basis so the ratios are going to change constantly. d) Mr. Murphy stated that a meeting was held with several Labor leaders and the Mayor concerning the issue of prevailing wages . Proceedings of the Human Relations Board October 21, 1993 Page 3 e) Mr. Murphy stated that the process for the 1994-95 budget will be=;beginning within the next several weeks . He would like to have a joint meeting of the Human Relations and Human Resources boards to include, John McComb, Budget Analyst from the Finance Department. f) Board Chair Mason asked if the Department was going to continue with two (2 ) boards . Mr. Murphy stated yes . Board Chair Mason inquired as to the Department working as separate divisions . Mr. Murphy stated that we are one ( 1) department with two (2) boards and the Police Community Relations Board that we share with the Police Department. Board Chair Mason asked if the Human Resources Advisory Board met. Mr. Murphy indicated they have. g) Board Chair Mason stated that normally at the November meeting the Human Relations Advisory Board gets a copy of the draft that will be sent to the Mayor' s office on the goals and objectives and also, the budget which has to be submitted in December. Mr. Murphy again stated that a joint meeting should be arranged where John McComb from the Finance Department can attend and do a presentation regarding the budget. Mr. Murphy indicated that there are other departments that have multiple boards , and we need to have some initial dialogue with both the Human Relations Advisory Board and the Human Resources Board. Board Chair Mason inquired as to when Mr. Murphy was planning to have a joint meeting of the boards . Mr. Murphy stated that at this point the date is open but he was looking at November being the earliest date. Proceedings of the Human Relations Board October 21, 1993 Page 4 h) Mr. Lopez stateti that he had spoken to Board Member Bradford and she asked him to relay a message in which she stated, "she would rather not be the Chair of the subcommittee. i) Mr. Murphy stated that the Mayor did send a letter to all city employees regarding sexual harassment and a copy of the City' s Sexual Harassment Policy. 2) Subcommittee Reports : a) Employment. 1) No Report b) Housing 2) Mr. Lopez stated that he did receive a housing complaint alleging discrimination based on source of income and race. c) Public Relations 3) Board Member Nichols stated that the Human Relations Dinner is held on the second Thursday in February and a meeting will be scheduled to discuss the dinner. Board Chair Mason stated that there are committee members involved. in the Human Relations Dinner, both Board Member Truscott, and Board Member Egan and a conference call is needed. to schedule a meeting. Board Member Nichols stated that it if anyone present could think of names of people deserving of the Hugo Lumberg Award to please make suggestions . Board Chair Mason stated that we need. a theme. Mr. Murphy inquired as to the staff involvement with the Human Relations Dinner. Board Chair Mason stated that the staff does all the work. Board Member Johnson stated the he felt someone else should be afforded the opportunity to hold the Vice-Chair position. Board Member Egan inquired as to Board Chair Mason' s wanting to continue as Chair•.of the Board or should the Board just open these issues up for nominations . MOTION: by board Member Johnson - nominated Board Member Egan for Vice-Chair of the Board. Board Member Nichols second the motion. Board Member Egan accepted and the vote was unanimous in favor of Board Member Egan becoming Vice-Chair. Mr. Murphy stated that it was moved and supported to elect Mary Lou Mason as Chairperson of the Board, she accepted the vote was unanimous in favor of Board Chair Mason. Board Chair Mason stated that she would like for the Board to meet so that they could work on the committees . Board Member Johnson suggested that with Board Members Pohl ' s expertise in housing, she would be a good person to take over Board Member Bradford' s position. .Board Member Pohl stated that she may want to hold on that because she would like to hear more about what those responsibilities would be. ATTENDANCE Present: Bryanton, Egan, Hicks, Johnson, Mason, Nichols Absent: Dunnings, Heard, Jones, Porter-Bradford, Truscott (one vacancy) Staff: Interim Director Michael Murphy, Gomoll, Harvey, Lopez, Norris, Steinberg Police Liaison: Police Chief Jerome Boles APPROVAL OF MINUTES Minutes were approved after a quorum was present. MOTION Board Member Nichols moved that the minutes of July 8, 1993 be approved, supported by Board Member Johnson. Motion carried unanimous . There were no minutes for August 12, 1993 which was held as the annual picnic at Francis Park on August 18, 1993 . COMMUNICATIONS No communications since the previous board meeting. PETITIONS 1) Staff indicated that one complaint against the City had been dismissed by MDCR for "insufficient grounds on which to issue a charge" (K. Letts -vs- City of Lansing MDCR # 119283- EM07 ) . Notification was received from MDCR that a previously dismissed complaint was being reconsidered at the request of the complainant (A. Parrish -vs- City of Lansing MDCR # 128258-EM07 ) . 2 ) Two complaints reported previously in the July meeting continue under investigation with responses to interrogatories being returned to EEOC. (B. Mack -vs- City of Lansing and K. Lalone -vs- City of Lansing) . Proceedings of the Human Relations Board September 9, 1993 Page 2 REPORTS 1) Human Relations and Community Services Director & Staff Reports a) Mr. Murphy, Interim Director - Mr. Murphy introduced the two new staff people who were present Melanie Norris and Charles Steinberg. Both of these individuals are Contract Managers and bring good expertise to the department. b) Mr. Murphy discussed the consolidation of the department and the upcoming move of the former Human Relations Department Staff from the 7th Floor of City Hall to the 3rd Floor of the City Hall Annex. Mr. Murphy indicated there was a need to bring all the staff together in one location. Several weeks were spent in trying to make the decision. Many different alternatives were investigated which included ( 1) using some of the 4th Floor of City Hall, (2 ) using some of the 3rd Floor of City Hall, or ( 3) using the 7th Floor of City Hall . There were obstacles to all these alternatives and the best solution at this time was to locate the department on the 3rd floor of the City Hall Annex. Mr. Murphy indicated that in making this move he had informed the administration that it was a temporary move until a study of City Hall space allocation is completed. Also, he was able to negotiate for adequate floor to ceiling offices to meet the needs of staff for privacy in taking complaints . The equipment needs of the office, computers, was also addressed in negotiating the move to the Annex. Board Chair Mason stated that she felt that board members should have been informed regarding the move and that concerns about the "visibility of the department" had been discussed with the Mayor as the "Community" had expressed the "visibility" concern to the board members . Board Member Egan stated that an annex is something separate from City Hall . Mr. Murphy indicated that the merged department needs to be together and that Human Relations will not be diminished. Further it was an administrative decision and one that he made. He did not feel the Board had to be contacted for approval . Proceedings of the Human Relations Board September 9, 1993 Page 3 Board Chair Mason stated that the Board was not requesting that it approve the move but it was a matter of courtesy. Board Member Egan indicated that it was not the intent of the Board to undermine administrative authority. Board Member Bryanton noted that the suggestion of contact was good inasmuch as it will facilitate better understanding. c) Board Member Johnson inquired as to the status of the Human Relations and Human Resources Boards . Mr. Murphy stated that he had met with the City Attorney and discussed this question and no decision has been made. d) Mr. Murphy distributed copies of an article that appeared in the Lansing State Journal in reference to the CSO (combined sewer overflow) projects . In addition to this article there have been meetings with the Coalition of Community Concerns regarding this same topic. The concern seems to center on the perception that there are few people of color working on these projects . Despite this perception and as indicated in the newspaper article, Mr. Hester has been monitoring the contractors and according to Mr. Hester' s analysis the City is in compliance. Mr. Murphy indicated that he has met with Mr. Boyd, the Mayor' s Executive Assistant, and the Mayor concerning this issue and the Human Relations Board recommendation regarding the use of City residents on projects . Board Member Hicks outlined the Human Relations Board' s concern with the lack of City residents on City funded construction projects . The Employment sub-committee had addressed this issue in May 1992 and had brought it to the attention of the full Board which subsequently made a recommendation to the former Mayor. The minutes of the Human Relations Board reflect the Board' s concern in this area. Board Member Hicks stated that it makes him feel as if the Human Relations Board is being ignored. Board Member Johnson agreed and stated that the newspaper article had not reflected any of the Board' s concern. He requested that the report prepared by Mr. Hester be sent to all the Board members . Proceedings of the Human Relations Board September 9, 1993 Page 4 Board Member Nichols stated that if our voices aren' t going to be heard we're spinning our wheels . Mr. Murphy indicated that the Coalition is trying to make an issue of the CSO projects but the administration is investigating this issue and looking at other models . In addition, there are several interesting questions that are raised. One such question is what percent of City employees are residents? Mr. Murphy indicated that he would be willing to get together with a couple Board members to develop strategy and make a good recommendation. e) Mr. Lopez and Mr. Gomoll reviewed some of the activities the office has been involved in recently. Mr. Lopez noted the CHRB may be losing funding from HUD. He further noted that there is a need for "testing" in the area of fair housing. Mr. Gomoll indicated that the department had made a written request for an opinion from the City Attorney regarding the issue of how the City Charter and labor agreements affect the City's affirmative action efforts . 2 ) Subcommittee Reports : a) Employment -- no report b) Housing -- no report c) Public Relations -- Board Member Nichols expressed appreciation to the Board Chair and others for their efforts in making the Human Relations picnic a success . PROCEEDINGS OF THE CITY OF LANSING HUMAN RELATIONS BOARD JULY 8, 1993 The regular scheduled July meeting of the Human Relations Board was called to order by Chair Marylou Mason at 7 : 30 A.M. in Lansing City Hall . ATTENDANCE Present: Bryanton, Dunnings, Johnson, Mason, Nichols, Truscott., Hicks , Jones Absent: Egan, Heard, Porter-Bradford Staff : Hester, Lopez, Acting Manager Michael Murphy Police Liaison: Cpt . Jim Cook APPROVAL OF MINUTES Minutes were approved after a quorum was obtained. MOTION Board Member Dunnings moved that the minutes of June 10, 1993, be approved, supported by Board Member Truscott . Motion carried. COMMUNICATIONS No communications PETITIONS 1) Mr. Hester reported that two Civil Rights complaints have been received within the last week; Mr. Murphy is aware of them. They are from the 911 Center regarding ADA and accommodations in the work place. Mr. Dunnings asked "What is the 911 Center?" Mr. Hester said it is the dispatch center for 911 calls . Mr. Dunnings said he had a dentist call him because a patient threatened to report him for not providing interpreters . Mr. Dunnings wondered if the situations were similar in nature . In these cases the allegation is that reasonable accommodations were denied after being requested by employees affected by dust and fumes during remodeling. Staff is investigating whether or not accommodation requests were made prior to our receiving the complaints . Mr. Hester continued by expounding on Mr. Dunnings comment regarding "signing" . We have been researching, trying to get more information about it, but as a public entity. If we have something going out to the public, we may be required to provide signing. We ' re working now with Ron Onfer' s office, Channel 28, Public Access Channel, especially where the City Council meetings are concerned. Proceedings of the Human Relations Board July 8, 1993 Page 2 REPORTS 1) Staff Reports a) Mr. Hester 1) We' ve had ongoing inquires into the CSO (Combined Sewer Overflow) project. They are in Segment II now. We 're bringing in additional contractors to continue this 30 year project. We ' re still getting complaints from the neighborhoods, dogs , cats, etc . 2 ) We ' re getting feedback from the community from the standpoint of our Police complaints . Internal Affairs has brought on a new person, Sgt . Greg Braun after Sgt . Clevenger' s retirement. We' re still working with them from the standpoint of taking complaints external of the Police Department. We have had a few come in and a few that are ongoing. 3) Still working on the possibility of training City Employees, in all areas of Human Relations responsibility (sexual harassment, ethnic intimidation, etc. ) just good employee/employer relations . We ' re getting feedback from department heads now, regarding affirmative action and equal opportunity hiring. b) Mr. Dunnings asked what is being done to be sure Minority Vendors are included in the City of Lansing vendor contracts . Mr. Hester explained our process of reviewing bid lists and recommending additional Minority Vendors . Mr. Lopez noted that during Pre-Construction/Pre-Bid meetings for City projects, contractors are also reminded of the City' s Minority populations and are encouraged to look at Minorities when hiring or "subbing" out projects . c) Mr. Lopez Community neighborhood concerns; he is working with several "hot spots" which involve neighborhood problems . Police are already involved, and one involves several Police complaints . These problems are not necessarily racial, but have the potential to become racial issues . We are attempting to arrange conciliation meetings . Proceedings of the Human Relations Board July 8, 1993 Page 3 d) Mr. Murphy 1) There have been a couple media inquires on the CSO, King/Logan and Saginaw projects regarding lack of visibility of Minorities . 2 ) A State Journal reporter came and did a tour with Mr. Grear, who has proved to be a person who constantly inquires about ADA issues . He was saying we weren't in compliance with ADA. Nothing was done and Mr. Murphy doesn' t think we ' ll see an article. 3) Nan Reynolds at MDCR is trying to form an informal group from around the state to talk about issues and coordination on a statewide basis . They' ll meet week after next. 4 ) Senator John Schwarz and Representative Morris Hood are talking about doing a conference/seminar on racial conflict on college campuses . More info will follow in the next couple months , they are looking to do something in the Fall . 5 ) The merger has taken place as of July lst. The new entity is called "Human Relations and City Supported Services" . The Mayor has expressed concern about the length of our title and hopefully we can get it shortened to "Human Relations and Human Services" . We' re looking to hire two contract managers on the Human Resources side and hopefully by mid-August a permanent secretary for the department. The staff will be composed of six staff persons, the director and the secretary. We are also one budget now. Mr. Murphy has expressed concern to the Mayor about finding appropriate space here in City Hall for the new department. Hopefully in the next month or so we will have this resolved. Mr. Dunnings suggested the name of "Human Relations and Services" . Chair Mason asked if the Mayor has said anymore about combining the boards . Mr. Murphy said that is still an issue of debate . 2 ) Subcommittee Reports : a) Employment No Meeting Proceedings of the Human Relations Board July 8 , 1993 Page 4 b) Housing 1) No meeting 2 ) Mr. Lopez received an inquiry from National Federation for Neighborhood Diversity in Washington D.C. They are putting together a resource book and they have requested a copy of our Fair Housing Ordinance for the City of Lansing to include. c) Public Relations The picnic will be August 18th at Francis Park ( instead of our regular meeting) right after work. Mr. Hester or the secretary will send out a letter to invite all the different agencies . We' ll ask for a dish to pass and $5 (or whatever you can give) from each Board Member so we can get meat. We ' ll put a menu together so everyone doesn' t bring the same thing. The Staff will be in charge of games . d) Police Community Relations 1) No meeting 2 ) This Board may be requested to meet in the community, as in the past, with the Police Community Relations Committee. The mechanics haven't been worked out yet, but they are talking about a possible meeting on the Southside with all that is going on over there. 3) Mr. Johnson asked about the process of people getting appointed to a board because he has encouraged several men to apply and he doesn' t want them to get discourage because of no response from the Mayor. Mr. Murphy will check into the process and see what we can find out for these men. PETITIONS 1 ) Mr. Hester reported that the Covello case (the school crossing guard, based on age and disability) has been dismissed by the MDCR due to lack of probable cause. 2 ) Mr . Gomoll reported that we received two complaints from the EEOC based on the ADA. No complainant was named, no information was provided, no action is required. EEOC said they are still in the "intake" process and just wanted to notify us . Mr. Gomoll suspects these complaints originate from the Board of Water and Light, an employee there has some complaints and wants the City to act as the ADA coordinator for. the Board of Water & Light and is claiming the City has that jurisdiction. The Charter specifies that the Board of Water & Light will do their own administration and take care of their own employees and it has always acted that way. Mr . Gomoll feels this is just a formal notification so the EEOC can have the complaint on file whil.P they gather ; n.fnrmation. REPORTS 1 ) Chair Mason reported that she had tried to arrange a meeting with the Mayor as discussed at last month' s meeting but could not because the Mayor was out for health reasons . However, she did have an opportunity to meet with the Mayor briefly on Monday. An Interim Manager has been hired. He will come on board Monday and has a contract through the end of December . His name is Mr. Mike Murphy; he is minister at St. Steven' s Church. Chair Mason met Mr. Murphy when he worked for Proceedings of the Human Relations Board June 10, 1993 Page 2 Governor Blanchard; his most recent position has been as Interim Director of the Multicultral Office at Olivet College . Mr. Murphy will be meeting with the Mayor and his staff at 8 : 30 a .m. Monday morning. The Mayor told Chair Mason that because of the merging of the two offices the ordinance has to be changed and that will take time, putting the job description together is going to take some time, so he felt, after meeting with some community people, that hiring an ?nterim Manager was best at this time . Ch.A r Mason told the P`ayor she thought the board would still want to meet. with him, ie has no problem with that. She will arrange a meeting if the Board still wants to meet with him. One major concern is whether the department will be moving or not . Chair Mason also discussed Board vacancies while talking with Jo Flaherty yesterday. Board Members Nichols , Porter-Bradford and Heard have terms expiring this year, the Mayor will be glad to reappoint them if they so desire . They were instructed to call Jo with their intentions . Board Member Porter-Bradford said she will be denying reappointment as she has returned to MSU as a student. Board Member Johnson wanted to know what would be the purpose of meeting with the Mayor, would it be to discuss the moving of the department. Board Member Hicks stated that he felt we didn ' t need a meeting since an Interim Manager has been hired. Chair Mason said she will still arrange a meeting with the Mayor to discuss whether we will have any input in the job description or anything else as far as the directorship is concerned, all Board Members are welcome to attend. Mr. Hester expressed his feelings that the Board should maintain as much input as possible to avoid the removal of any Board duties . Board Member Nichols said she felt the Board should review the job description before it was finalized. Chair Mason will contact the Board regarding a meeting time . 2 ) Staff Reports a) Mr. Hester reported on the NAHRW Conference he attended in Chicago last month. It was a very rewarding training time . A lot of issues pertaining to human and civil rights were addressed, one workshop was on conflict resolution and of course, "hate violence crimes" was the main focus . Chair Mason asked when the national conference would be held; Mr. Hester replied that it is sometime in October. Chair Mason suggested that some Board Members might like to attend at their own expense . b) Mr. Gomoll reported on the question of orientation for new employees raised at the last meeting. He distributed Proceedings of the Human Relations Board June 10 , 1993 Page 3 a checklist Personnel uses with new employees . They go through a variety of things, including the sexual harassment and reasonable accommodation policies, ethics ordinance, benefits, etc . Mr. Lopez reported that Personnel will be purchasing a video, "Myths & Facts" on sexual harassment that will be shown to all new employees . Chair Mason asked if it would also be shown to current employees ; Mr. Lopez said the main emphasis right now will be new employees . Mr. Lopez said he shared with the Mayor how the Police Department brings new Police & Detention officers to our office where staff discusses our function and complaint processes with them. He felt the Mayor was unaware of this policy and hopes the new Manager might instill such a program. c) Other brief reports by Mr. Gomoll 1) 24 positions were reviewed last month for promotion or new hire 2 ) Employment complaint about Meijer' s warehouse regarding race discrimination, complainant never returned follow-up phone calls 3 ) Employee from a local restaurant called inquiring about being fired after making remarks to a customer he felt was sexually harassing him, told him to come in and file a complaint or go to MDCR, he never came in 4 ) Numerous ADA concerns have come in a) Parks Department has developed a draft policy allowing service/assist dogs in the zoo with some restricted areas b) There has been a concern about accessibility to some City buildings, getting in through the doors 2 ) Subcommittee Reports : a) Employment The Employment Subcommittee report was distributed. One point emphasized was that the City is not doing anything special to recruit Minorities . If anything is to be done, the Board will have to do it . Board Member Bryanton asked if the excuse of "short of staff and funds" would be accepted from the Police Department for Proceedings of the Human Relations Board June 10, 1993 Page 4 not recruiting Minorities, and if not, why should it be from the City. He wants the idea of an overall City recruitment program addressed in the meeting with the Mayor. b) Housing 1 ) No meeting has been held. 2 ) Mr. Lopez has had several housing situations arise a) A woman with children was denied housing. Her first priority was finding housing because her building had been condemned and she was living in a hotel with her father. We referred her to several housing possibilities and she hasn' t returned. She either found housing and forgot the complaint or took her complaint to Civil Rights . Her father felt that our ordinance was not sufficient in that the punishment was not adequate. b) We had a few phone calls regarding Landlord/Tenant situations, but no office visits so nothing to follow-up on c) Public Relations d) Police Community Relations 1) The Committee has not met. 2 ) Our Board needs a liaison to the Police Community Relations Board. Chair Mason asked Board Member Bryanton if he could attend those meetings, he consented. Mr. Hester was also asked to attend whenever possible. 3) While at the NAHRW conference Mr. Hester discussed his opportunity to attend Hate Violence Training with the condition of accompanying a Police Officer. The Justice Department people present said Lansing is one of the few, if not the only city they know of to send someone from Human Relations with the Police Department . Proceedings of the Human Relations Board June 10, 1993 Page 5 OLD BUSINESS Mr. Lopez thanked Chief Boles for his willingness to let Noel Garcia lead the Capital Area Hispanic Officers Association in their efforts to raise funds for the Lansing School District Chicano Advisory Committee ' s scholarships during the "Images of the Mexican Revolution" display last month. They gave the CAC a check for over $2000 . The CAHOA also volunteered their time to provide crowd control at the Cristo Rey (church) Fiesta. NEW BUSINESS 1) Chair Mason asked if the Board desired to have a picnic this summer. Discussion followed. 2 ) Mr. Hester asked Chief Boles if there has been any follow-up information from the McConnel Commission. Chief Boles replied that there has not been. Chair Mason suggested we check with former Human Relations Secretary Cathy Milett to see where we were on it . 3 ) Chief Boles discussed the use of interpreters and trained negotiators for use with their tactical team. Dawson APPROVAL OF MINUTES MOTION Board Member Johnson moved that the minutes of April 8, 1993 , be approved, supported by Board Member Truscott . Motion passed. COMMUNICATIONS 1) Invitation from Lansing Regional Chamber of Commerce & the Business Division of Lansing Community College was passed around. Mr. Letts will be honored in the Business Hall of Fame . 2 ) Brochures for the annual Understanding Cultural Diversity in our Community Conference "Bridging the Cultural Gap" were distributed as requested by R. L. Hester in his absence . PETITIONS 1 ) Mr. Gomoll reported that one complaint involving age discrimination in the City Clerk' s office has been resolved. MDCR dismissed the complaint due to insufficient grounds . Complainant retired the day after MDCR' s decision. 2 ) Mr. Gomoll also reported another complaint involving the City Clerk' s office filed with the U. S . Department of Justice having to do with ADA/voting accessibility. The issue was raised last summer when an individual went to Sexton to vote and the accessible entrance was blocked. When the Justice Department made inquiry to the City Clerk' s office, the previous City Clerk refused to discuss the problem over the telephone so a complaint was filed and the present City Clerk has responded on that. The U. S. Justice Department takes complaints involving ADA and that is why this complaint came from that office. Proceedings of the Human Relations Board May 13, 1993 Page 2 REPORTS 1) Staff Reports a) Mr. Gomoll reported on several ADA (American with Disabilities Act) concerns . 1) There have been two recent problems at Potter Park Zoo concerning admittance of guide/assist dogs into certain portions of the zoo. The zoo has had a long standing policy of no dogs allowed in the zoo. No formal complaints have been filed, but MDCR has contacted the City regarding that policy. Zoo policies throughout the nation vary widely, some allow assist/guide dogs with no problems, some do not allow any dogs, some provide kennels while the person is assisted by someone, some allow limited access . It is a conflict of handicapper independence verses safety of zoo animals and a middle ground must be found. 2 ) The Parks Department annually (this is the 7th year) provides a field trip to Cedar Point for Lansing area residents . They try to keep the cost as low as possible so people who normally would not have the opportunity to go to Cedar Point have that opportunity. They have already chartered their buses . A wheelchair user wants to go on the trip this year. The charter carrier does not have a lift equipped bus that can handle a wheelchair. The City, as a municipality, is obligated to provide its programs to ALL individuals and make sure they are accessible; the charter service is not, at this time. Mr. Gomoll has been investigating alternatives . The last thing we want to do is to carry the individual on the bus, but that option is there, interim regulations from the U. S . Dept . of Transportation view that as an acceptable method at this time. Indian Trials has 3 or 4 lift equipped buses but they cannot be used for charter services because they were purchased with State funds . A big area of concern are restrooms on the bus; if a stop must be made at a rest area, it ' ll add an hour or so to the length of the already long trip. We 've tried to find other solutions . CATA cannot go outside their service area. Dean Transportation cannot go outside the state. Chair Mason suggested renting a van to follow the bus . Mr. Gomoll said that may come around, but it denies the person the participation Proceedings of the Human Relations Board May 13 , 1993 Page 3 of riding the bus and adds additional costs . The City does not own such a van, any need of that nature has been contracted with Dean Transportation. Now that we have viewed our options, we will go back to the individual and see what they think is the best accommodation. 3) The issues with ADA will continue to come up. Hopefully we have addressed most of them in our self-evaluation, but little problems like these will continue to come up and need to be worked out. b) The work of the office has been going quite well . R. L. Hester, Mr. Gomoll and Mr. Lopez have been doing the daily operations and have not had a whole lot of things they need to work with Jo Ellen Flaherty, Interim Manager from the Mayor' s Office, on. One thing is the qualifications for the Director of the new department. No meeting has been held since April 26 . A job description complied by Personnel was distributed to Board Members . The job has not been posted yet. This position is appointed by the Mayor and contractual; it does not need the approval of this or any other board. The Department will be getting a Director and a Secretary plus two Contract Managers to work under Theophilis Harvey. Chair Mason said she would try to arrange a meeting with the Mayor' s office to get some things clarified regarding this position. Rev. Jones asked if this department had anything to do with internal investigates in the Police Department. Mr. Gomoll told them that we do and as far as we know it will continue. Then Rev. Jones asked if there was an internal investigative mechanism within the Department itself . Cpt . Dawson assured him that there is , however investigations by Human Relations staff normally, generally are done with Internal Affairs . Mr. Hicks asked why aren't we looking at our own staff? Why do they have to go outside to find an individual with all this expertise . Mr. Gomoll explained that it is the Mayor ' s call, as to how he envisions this new department within the whole organization of the city. When it is posted, it will be open to all . Mr. Hicks pointed out that it is now the middle of May and nothing has been done to fill this position. Rev. Jones asked who wrote the job description that was distributed to them. Chair Mason explained that it was her understanding that Jo Flaherty, of the Mayor' s office, and the Personnel Director combined both job descriptions then Karen from Personnel was going to put something together and reference to meeting with the City Attorney to be sure Proceedings of the Human Relations Board May 13, 1993 Page 4 both areas were covered. Mr. Gomoll said his understanding was that Karen took information provided by both departments and along with Susan Wager, Assist Deputy Director, developed the description from all that they had gathered. He did not know if the City Attorney had been consulted. Rev. Jones asked if support staff had been decided. Chair Mason said we know that the Department will be getting a Director and a Secretary. Mr. Gomoll explained that the 2 positions of Contract Managers have been posted. Chair Mason asked how could they hire people for supervision by the Director without first hiring a Director and having his/her input on the hiring of support staff . Mr. Gomoll said there is an organizational chart that shows Theophilis Harvey as having supervision over those 2 individuals, so they are probably working with him. Chair Mason said we will try to get a meeting with the Mayor ' s office to get all this cleared up. Mr. Gomoll added that it was noted at the April 26th meeting that some changes may occur after a new director has been chosen. c) Mr. Lopez reported that he had a couple cases come through the department this month. 1) Police harassment complaint received on May 5, 1993 . Mr. Lopez and Sgt. Ried (of Internal Affairs ) met with complainant and took a recording of her complaint and Esther transcribed it . They are now in the process of investigating her allegations . 2 ) An internal sexual harassment complaint involving a department head. After the initial allegation, the complainant decided not to pursue her complaint . A meeting was held between Mr. Lopez, the complainant and her department head where the sexual harassment policy was reviewed again. A couple days passed and we received a memo that she had decided not to sign a complaint. However, the City is still obligated to deal with sexual harassment in the work place by, at the minimum, having a meeting with the alleged respondent. It is felt that some training needs to be done at the supervisory level on sexual harassment. Mr. Gomoll noted that training has been done several times in the past, especially at the department head/supervisor level, however, we have lost many department heads and supervisors . Chair Mason suggested that after the reorganization is worked out maybe training needs to be done for all City employees . Equal Employment Opportunity and ADA are other areas that Proceedings of the Human Relations Board May 13, 1993 Page 5 the City needs to consider doing training on. This case is not closed, she can always change her mind and file a complaint. 3 ) Yesterday Mr. Lopez received a call at home from a concerned parent regarding bias attitudes . A coach made a derogatory comment to Hispanic baseball players and it has given leeway to White students making other remarks . He is meeting with the Principal and Mr. Lopez advised him of his options . d) Mr. Lopez also reported that the he has been working with a Mexican Photo Exhibit that has been brought to Lansing. Hispanic Police officers have rallied into an association that will hopefully continue after this event is gone. The display is at the Michigan State Library and Historical Museum. The Hispanic Officers Association is sponsoring a reception on Friday, May 21, 6-9 p.m. featuring entertainment and food, tickets are $5 . 00 each available from Cpt. Dawson or at the door that night. The purpose of the reception is to raise funds for the Chicano Advisory Committee Scholarship Fund. Cpt . Dawson is expecting a good turn out, he said the officers asked him to get 500 tickets printed and then came back and wanted 250 more. e) Rev. Jones asked about the City' s approach for orientation of new employees . Mr. Gomoll said it is up to the individual departments . There is no standard program provided by this department or personnel . Mr. Egan asked how information was gotten out concerning ADA, sexual harassment, etc . Mr. Gomoll replied that usually it is done through training for supervisors . As far as sexual harassment, the posters (and in many cases, the procedures as well) are posted in all departments, we have done walk throughs and seen them. All most every position in the City is covered by a union bargaining unit and they each have their contracts and rules . The Police Department does an intensive orientation. Cpt. Dawson said all new employees meet with their legal advisor to go over sexual harassment laws and spends eight hours at Lansing Community College in a special program contracted with them. When an individual goes to Personnel they get a packet with a number of policies and information about work rules of the City but as far as sitting down in a full scale orientation with all new employees , the Personnel Department is to understaffed to do that. Mr. Bryanton asked if the City had a Personnel Manual . Mr. Gomoll replied that we do have rules and Proceedings of the Human Relations Board May 13, 1993 Page 6 most positions are covered by a bargaining unit. Mr. Bryanton asked Mr. Gomoll to follow up on that and see if Personnel goes over that or provides new employees with a copy of those rules . 2 ) Subcommittee Reports : a) Employment 1) Mr. Johnson summarized the report of the Employment Subcommittee that was distributed to Board Members along with the March City Employment Statistics . 2 ) Subcommittee feels that the City is not doing an adequate job of hiring protected group members . It is uncertain if it is a lack on their part or a lack of qualified applicants from protected groups . 3 ) Mr. Hicks spoke further to the issue. Reports show that promotions, hiring, etc . are still predominately White. He feels the postings are not getting to the right people. Chair Mason mentioned that time constraints are a major problem for her organization. Rev. Jones asked if there was any relationship with employment offices, such as MESC; they seem like a logical place to seek such people. MOTION 4 ) Board Member Hicks moved that this Board form a Subcommittee to go out into the community to meet with the various agencies (NAACP, Cristo Rey, etc . ) and see if we can promote the qreater hiring or applications of Minority people within the Community; supported by Board Member Johnson. Motion carried. 5) Board Member Bryanton wanted to know why he had not been contacted for several months regarding the Police Community Relations Subcommittee and why he was left out of the telephone meeting the other day. The telephone conversation was between R. L. Hester, PCR Staff Person, and a PCR Board Member and not a conference call . A PCR conference call with Staff and Board Committee will be scheduled. b) Housing 1) Mr. Gomoll mentioned that MDCR is no longer approved by HUD to handle fair housing complaints for HUD. He suggested that this Board may want to ask the Mayor and City Council to go on record as asking legislature to bring Michigan in line with those Federal laws so MDCR can again start taking Proceedings of the Human Relations Board May 13, 1993 Page 7 MOTION those complaints . Board Member Jones moved that the Board write a letter to the Mayor and City Council requesting them to contact the State legislature to bring Michigan into equivalent status with the Federal law in the area of housing so that MDCR can again start receiving those complaints; supported by Board Johnson. Motion carried. c) Public Relations d) Police Community Relations 1) Mr. Hester was absent but gave a verbal report to Chair Mason yesterday. The Committee has not met. Officer Smith, on suspension from LPD for felonious assault, met with him to share information about his case but is in court so this office cannot get involved. 2 ) Jim Pecora of Personnel had filed a complaint, that has been taken care of and he is back to work. 3) He also reminded us that the Police Community Relations Committee needs members . 4 ) Rev. Jones asked if our involvement in a case was always based on someone filing a complaint or does this department ever take the initiative to help people, such as Officer Smith, when they are looking for support . Chair Mason related that we become involved when a person comes to the department and files a complaint or seeks assistance. In this case Officer Smith just wants to share information, he ' s not asking for support or filed a formal complaint because his case is in court . Mr. Gomoll added that our department is here to take complaints but we aren' t attorneys and we cannot help with legal matters . COMMUNICATIONS PETITIONS 1) Mr. Lopez was not present to report on his petitions . 2 ) Mr. Hester reported that Mr. Pecora has returned to work and Mr. Covello ' s case is in the fact finding process, no conference has been held, still gathering data. 3) Mr. Gomoll reported that one new compliant was received from MDCR this month regarding age discrimination against the City in the selection of an Assistant Solid Waste Supervisor. Several old petitions still pending. Firefighter Brent Gillespie complaint has been resolved, Guillermo has info. Mr. Hester pointed out that some MDCR complaints pending are not necessarily being handled totally by our Staff but by MDCR Staff and they keep our staff posted. REPORTS 1) Staff Reports a) Mr. Gomoll reported on the Merger Meeting held with Jo Flaherty of the Mayor ' s office. We had Board Members Mason, Egan and Dunnings and Staff in attendance, there was no representation from the other Board but one Staff member was present. The City reorganization was approved by Council Monday night, April 5, 1993 . Another meeting is schedule for 5 p.m. tonight to finalize the job Proceedings of the Human Relations Board April 8, 1993 Page 2 description of the new Human Relations/Human Resources Director and to discuss the location of the new department. Board members were invited to attend or at least submit recommendations to Marylou today. Marylou asked that any Board member who could to please stay after the meeting and go to the Annex with Kip to see the Human Resources office location. Mr. Bryanton asked if there was any indication that the two boards would be merged. Kip said Stuart Dunnings recommended that they be merged. The other Board only has five members and rarely meets . The possibility exists of appointing their active members to our Board as terms expire. b) Mr. Gomoll distributed the February, 1993, employment report and pointed out that the City is recruiting to hire people and he still feels this is the greatest opportunity the City will have to hire affirmatively. He stated that we are not getting Minority or Female applicants for certain positions . Marylou suggested that Board Members and/or their organizations might start receiving the postings and referring applicants . Mr. Hester pointed out that receiving the posting was important because it contains qualifications and many positions have specific qualifications to be met. c) Mr. Gomoll reported that he had one complaint regarding Race discrimination in the Parking Division of Public Service. The complainant feels Blacks are the only employees being discharged. He is still investigating the matter. He also has a neighborhood problem referred to our department from the City Attorney' s office. d) Mr. Hester reported that staff has been invited to speak to the City of Saginaw' s Human Relations Commission at 5 p.m. on April 14 and invited Board Members to accompany him. Staff will also be making presentations at several local schools . e) Mr. Bryanton asked about the numbers for the Mayor' s Staff on the employment report handed out. Discussion followed regarding contractual employees . 2 ) Subcommittee Reports : Chair Mason asked that she be notified as early as possible regarding dates of meetings and special programs so she can put it on her calendar as there was a conflict with the Fair Housing program, she had a Commission Meeting. a) Employment: No meeting held, but Mr. Gomoll touched on a few things . Proceedings of the Human Relations Board April 8, 1993 Page 3 b) Housing 1) Ms . Porter-Bradford gave a report on the Fair Housing Program held Friday, April 2nd, in Council Chambers . The program went well, approximately 35 people attended. A delicious lunch was served. During the workshop that followed, some discussion was held regarding the revival of a Fair Housing Center in Lansing. The program was taped and will be aired on Cable Channel 28 . Chair Mason asked that Mr. Lopez check into the schedule and notify the Board of airing times . c) Public Relations d) Police Community Relations 1) Our committee has not met, however, Mr. Hester has received minutes from the Police' s Community Relations Committee. There has been some concern over the type of media coverage of the Lansing Police Department. 2 ) Mr. Hester again mentioned the need for people to serve on the Police Community Relations Committee. In the past our Board has had a liaison to the committee appointed by the Mayor but since Cathy' s retirement we have not had any representation. PUBLIC MAY ADDRESS BOARD There was no public to address the Board but Chair Mason asked Chief Boles if he had any comments . Chief Boles mentioned that the Police Department is actively recruiting and making referrals to City personnel . Mr. Bryanton asked about the training at LCC. Chief Boles replied that reaction has been good to very good with some excellent; most walk away saying they learned something. During 2 years of training every active officer will have received 3 days of that type of multi-cultural training. The grant has not been renewed by the State but current components will remain intact and all new employees will be sent. We will probably look at some ongoing component between the department and LCC for subsequent years . OLD BUSINESS 1) Kip has already reported on the reorganization meetings . 2 ) Copies of letters (regarding hiring practices and city funded construction projects) to the Mayor, as discussed at last Proceedings of the Human Relations Board April 8, 1993 Page 4 month' s meeting, were distributed. Mr. Hester said that in relation to CSO projects he has received some complaints regarding minority representation on those projects . Mr. Lopez joined the meeting while Old Business was being discussed and mentioned that there are minorities working on the Lansing Center, but they are not visible. Hiring of minorities is mentioned in pre-construction meetings with contractors . The Mayor addressed the Board on the issue of the City' s Reorganization Plan and its affect on the Human Relations Department. The Human Relations Department and the Human Resources Department will be combined into one department called the Human Relations and City Supported Services Department and will be located on the 3rd floor of the Annex. Human Relations and Human Resources will each maintain their separate functions and their own boards . The new department will consist of one Director, a secretarial Administrative Assistant position, the three existing Human Relations employees, the one existing Human Resources employee (Theophilis Harvey) and two additional employees to be hired as contract managers. Discussion followed. Mayor Crawford, Jo Flaherty and Cleophus Boyd left for other commitments. APPROVAL OF MINUTES: Approval of Minutes was postponed until the next meeting due to the lack of a quorum. Proceedings of the Human Relations Board March 3.1, 1993 Page 2 PETITIONS/STAFF REPORTS 1) Kip has been dealing with four Michigan Department of Civil Rights complaints against the City. a) Ernest Carter vs . City, a resolution conference was held. Civil Rights dismissed the case due to insufficient evidence. b) Karen Letts vs . City, RE: handicap issue. Dealing with Sherri Booker at MDCR. Resolution conference was held, we are waiting to hear more from them. c) Complaint against the City Clerk' s office, RE : race and age discrimination. Resolution conference was held. A union grievance was also filed. MDCR is awaiting results of the meeting between the Union & the City before proceeding. d) David Springstead vs . City, a complaint from last November. A written response has been sent but no response has been received from MDCR. 2 ) Hester has two Michigan Department of Civil Rights complaints against the City. a) Gasper Covello, who re-applied for School crossing guard. RE: age and disability. He was removed from the job because of hearing loss, our physician said he did not meet our minimum standards for school crossing guard. We have spoke with an investigator but are waiting further action. Mr. Hicks asked if he was on the street with no job. Hester replied that he has no city job now but he is a Senior Citizen and should qualify for any benefits available to Seniors, surely Social Security and possibly another pension. b) James Pecora, RE: ADA, complaint pending. 3) Guillermo has two Michigan Department of Civil Rights complaints against the City. a) Complaint filed by a firefighter applicant who was denied employment because of disability. He worked with his doctor and the City doctor and it was determined he could perform the job of Firefighter. The resolution is that he will be included in the next round of Fire Department hiring. b) Person who filed a complaint based on non-payment of back pay, he thought there was a disciplinary action. He filed with Civil Rights, back pay was given according to an agreement reached with the City. His basic complaint was resolved but a Conference was held on other issues he Proceedings of the Human Relations Board March 11, 1993 Page 3 brought up (without a formal complaint) . We feel it is resolved but have received nothing in writing to know for sure. The door was left open for him to return to MDCR or us if he felt there was a future need. 4 ) Other Staff Reports : We are continuing on, doing the best we can with the Staff we have. Things may not get done as expeditiously as they used to but they are getting done. REPORTS 1) Subcommittee Reports a) Employment 1) Written report of Employment committee meeting was distributed. 2) The Committee recommends that the Board send a letter to the Mayor and City Council requesting that the City make every effort to hire affirmatively during this unprecedented period of time. It is the Subcommittee ' s belief that if protected group members are to be hired now is the time. Affirmative action should not be forsaken in a speeded up hiring process. MOTION was made by Mr. Hicks, seconded by Mr. Egan to accept this recommendation. 3) The Committee also recommends that the Board forward to the new Mayor the recommendation regarding City Residents and City-funded construction projects that was sent to Mayor McKane in October, 1992, with the addition of a new recommendation for the City to adopt policy goals for minorities and females on City projects . These goals should, at a minimum, be equal to the U.S . Department of Labor goals for our area of 5 .5% for Minorities and 6 . 9% for Females. 4) Kip gave a brief report on the Early Retirement program, pointing out percentage breakdown of groups (i .e. Male/Female, White/Black/etc. ) and the impact on various departments as far as how many employees they lost. b) Housing 1) Guillermo reminded the Board of the Fair Housing Program on April 2, 1993 and distributed a tentative program and biography of Charles Jung, Proceedings of the Human Relations Board March 11, 1993 Page 4 this year' s featured speaker. He encouraged all to attend and to invite someone to fill the Council Chambers. This year is the 26th Anniversary of Lansing's Fair Housing Ordinance and the 25th Anniversary of the Federal Fair Housing Act. There will be a reception and a workshop. 2) Written report from the Housing Subcommittee meeting was distributed. Guillermo reported that the medium cost of a house in Lansing is $48, 000 according to Miklojcik Consultants and $44, 000 according to the City Assessor. Miklojcik will also give a brief overview of report he did for the City at the Fair Housing Program. 3) Guillermo mentioned that there is an effort in the works to revive the Fair Housing Center and he has been invited to attend their meetings . When they were active previously, they were not City funded. Hester noted they were not City funded because that was one of the charges of Human Relations . Guillermo pointed out that Human Relations is in charge of investigating housing complaints but does not do testing to bring about complaints like a housing center could. Kip explained the importance and use of testing and that a housing center could extend into surrounding communities where our department cannot reach. c) Public Relations 1) Ms . Nichols gave a report on the Human Relations dinner. We are showing a $90 deficit, but that is misleading because two board members have not paid for all their tickets . When their money comes in we will be $10 to good. She recommended that those members be contacted to submit their money, and asked Hester to do so. She thanked Hester for his help. Hester replied that we have received many favorable responses to the dinner. d) Police Community Relations 1) Police complaints seem to be down. The department still interviews and orientates incoming officers about Human Relations . The training in multi- cultural awareness is still going on at LCC and is reported as being beneficial by officers who have gone through it. Proceedings of the Human Relations Board March 11, 1993 Page 5 2) Hester asked that Human Relations Board members to look for viable people in the community who could serve on the Police Community Relations Board. It is in danger of disbandment due to lack of community involvement. Mr. Johnson asked if they should contact a person directly or just give the name to the Mayor. Hester recommended that both be done. OLD BUSINESS 1) Update on bus station situation: Hester contacted Mr. Letts and found that he did not get anything formal in writing to the State Police. He said it may not take place because it was not an issue of the Lansing Police Department. 2) Martin Luther King Jr. Program: Hester thanked the Board for their participation and appearances and said it was a success . There was some discussion on how to improve promotion and thus attendance. 3) South Washington Apartments: Guillermo reported that of the three men evicted all were black, two became homeless again, one had a mental health problem so he had other support services and all three had an alcohol problem. According to the manager there have been no problems at that facility since their eviction. Population breakdown: Total 188 : 116 White, 47 Black, 13 Hispanic and majority are Female. The ones evicted have gone through a process, bringing them to court, showing cause for eviction. After that the Housing Commission thinks it has no further responsibility for housing them. Mr. Hicks expressed concern for the homeless . They were discussed in the Housing Subcommittee. Who is responsible for them once they are evicted? Do we trace them, to see where they end up? Or do we just let them go? There must be some mechanism we can use, to at least see that they have adequate shelter and things like that; after all we are a Human Relations Department and to just put them on the street and not have any concern, we should be more concerned than that as a Department. Society is responsible and we will pay one way or another. Mr. Hicks feels we should try to track the individuals that are homeless and evicted. Captain Dawson said Human Resources has worked with the police department in the past locating where the homeless were so they could be helped. This is an issue the Board needs to investigate further. Mr. Johnson suggested that we get with the other Board and see what has been done and if we could help. Proceedings of the Human Relations Board March 11, 1993 Page 6 NEW BUSINESS Kip mentioned that the Personnel Department has gone to an electronic application process by telephone to help enhance recruiting, with an 800 number for those outside the area. Motion passed. COMMUNICATIONS 1) Introduction of Jo Flaherty by Chair, as Interim Manager for Human Relations Dept. during transition. Ms . Flaherty emphasized strongly that she does not want to be Department head. She is eager to facilitate and assist board and staff in any way possible. She thanked staff for their cooperation and said she was pleased with the positive attitude she encountered among employees in the department specifically and in City Hall in general. While the reorganization makes for some departmental uncertainty, the important functions of Human Resources and Human Relations will continue to exist (her emphasis) . Ms . Flaherty pointed out the letters regarding the job descriptions of remaining staff members contained in packets distributed to board members . Letters were received and noted by members present. No comments noted. PETITIONS 1) A petition regarding restriction of gay rights was received by the City Council at its meeting on 1-4-93 and referred to Human Relations Board by the City Clerk' s office. 2) Bob Egan commented that he had asked the Mayor about the petition and the mayor said he had received it but planned no action. Mr. Egan suggested it might be worthwhile to meet with the people who signed the petition, that the more opportunities for dialogue the better. He stated that in Grand Rapids there was an initiative proposed, originated by Mr. Carl Kellogg, similar to the one in Colorado. Proponents have since been moved to drop it. There will be a Gay-Bi board meeting next week in which Mr. Egan will present the local petition and will report the response to the Human Relations Board in February. Proceedings of the Human Relations Board January 14 , 1993 3 ) Several other petitions (complaints) were being investigated and meetings are scheduled. One new complaint was received from MDCR alleging discrimination based on handicap. Responses have been provided to MDCR in reference to complaints received against the City Clerk' s office and the Wastewater Treatment Plant. _ 4 ) Mr. Hester stated that Public Service has received the annual Civil Rights Lawsuits or Complaints - Pre-Award Compliance Review Report, which is done on a city-wide basis . 5) Chair Mason stated there were no further pending petitions of which she was aware. REPORTS 1) Subcommittee Reports - a) Employment - Mr. Gomoll presented the full-time employment chart contained in the packet distributed to the board prior to today' s meeting. All retiring employees are off the payroll after January 4 , 1993 . b) Housing - 1) Mr. Lopez referred to the report regarding the South Washington apartments, contained in the board packet. A meeting with the Human Relations Dept. was requested by the residents and a meeting which Mr. Letts scheduled then took place. It was found that there were three types of people living in the apartments : homeless , disabled, and senior citizens . Problems between the three groups were discussed. Mr. Letts was able to bring a consensus among the groups . A resident, Ms . Layton, will continue to contact the office as needed for advice and counsel. Ms . Mason had questions regarding the April resolution mentioned in the report. Mr. Lopez stated that South Washington will continue to be a senior citizen complex. Non-senior citizen residents who were problems are being evicted. Mr. Bryanton had questions on criteria used. Mr. Lopez said evictions were based on lease violations, loud noise, radios, coming in late, intoxication, etc. Rev. Jones stated he had received a complaint from a gentleman who said he was on vacation when he was accused of a noise violation. He had fallen behind on rent. This individual had a heart condition, and his belongings were put out on the curb. Rev. Jones helped him move . Proceedings of the Human Relations Board January 14 , 1993 Mr. Lopez said the window of opportunity was still open for complaint process . Mr. Hicks asked if the evicted were homeless . Mr. Lopez replied some were, but most were evicted for cause, Mr. ks said he following existing court process . . stated would guess that most were homeless . Mr. LopezLop that it could be. Ms . Mason stated that was everyone' s concern. Discussion continued. Mr. Hicks asked where were they (evicted ez said residents) going - are we tracking them? Mr.. lease . Ms . explore that, that some assistance was being g a court Mason said there should be documentation, process. Mr. Lopez said the eviction process can be lengthy. Mr. Bryanton stated that the system is not "user friendly" to the homeless, and rather than fight, they leave. Mr. Egan asked if we had a population breakdown. . Mr. Lopez said April 2nd will be target date for Fair Housing Month program. Rev. Jones asked if he was still a t mb bco of the tee committee? He wasn't notified of the pa meeting. 2) Mr. Gomoll received an inquiry from an individual get alleged that an apartment complex is attempting rid of its minority tenants . The individual did not come into the office. Mr. Gomoll noted that the Human Relations Department does not have "testers" , which limits the department' s ability to investigate some housing complaints . 3) Mr. Lopez said that a senior citizen made an application at a senior citizen complex. iHe h danittle v credit to report, but had a felony to work was denied rental . Proceedings of the Human Relations Board January 14 , 1993 d) Public Relations - Ms . Nichols has reviewed what has been done regarding the upcoming board dinner. Cathy Milett gave her a summary to date. Mr. Hester said the tickets are done; they will be numbered and distributed. He mentioned there was an addendum to the invitation. The letter to the Radisson is the only "loose end" at this time. The signatures on the plaques have not changed. Sgt. Clevenger is getting the torch. Chief Boles said to get hold of him quickly; he 's retiring the end of this month. Ms. Nichols read the insert re: the retirements of Mr. Letts and Cathy. She will have a resolution (tongue-in- cheek) made up. She also is getting a case of film for Mr. Letts, a case of Tums and aspirin for Olivia, to keep it light. Ms . Mason said a concurrent resolution from the House and Senate for both should be done . Ms . Nichols said tickets are $20, just like last year, that a real effort had been made to hold the price down. Ms . Mason noted the Rev. Jones has the first 10 tickets , and that a placque should be discussed for Mr. Letts and Cathy. She asked if there were any questions - none noted. OLD BUSINESS 1) Ms . Mason reported on the questioning incident related at the last board meeting. The State Police, not the Lansing Police Department, was involved. Chief Boles said the matter has been taken care of . A letter of thanks from Mr. Davis has been received. Mr. Hester said that follow-up was the issue. Ms . Flaherty asked that the department check with Mr. Letts to see if a request to the State Police for an apology has been done. NEW BUSINESS 1) Mr. Hester stated the 12th Annual Martin Luther King, Jr. program will be televised on Channel 28, with a proclamation from the mayor and a resolution from the Council expected. Co-sponsors include the Ingham County Bar, Alpha Phi Alpha Fraternity, the Martin Luther King, Jr. Center for Non Violent Social Change, the City Council, the Mayor and the Human Relations Dept. It is a free program from 12 Noon to 1: 00 p.m. , with a pre-reception in the Council Chambers Conference Room. Proceedings of the Human Relations Board January 14 , 1993 Ms. Flaherty named other MLK activities, including information on the Greater Lansing Dr. Martin Luther King, Jr. Holiday Commission. She noted the Saturday Jiffy Lube Commission fundraiser on Saginaw and Pennsylvania, the Michigan Historical Museum programs ongoing between 10 : 00 a.m. and 4 : 00 p.m. , the Jan. 18th 11 :00 a.m. luncheon at the Civic Arena, and the press conference at the Civic Arena. Deanna Hopkins has tickets for the luncheon. The MLK booklet calendar was distributed to board members . 2 ) Mr. Gomoll commented re: layoffs and job-specific applicants, please refer qualified applicants, especially qualified females and minorities to Personnel. 3) Mr. Lopez informed the board that the Lansing Center contract compliance responsibility is ours . They are working on pre- bids . It is a 25 million dollar expansion. We also have the ongoing CSO (Combined Sewer Operation) project. 4) Mr. Egan said a list of activities would be helpful . Mr. Lopez said interim reports are being prepared. Ms . Flaherty pointed out that prioritizing is ongoing, but because of time and staff restraints, verbal reports are ( for the next couple of months) preferable to generating written reports . She complemented the HR staff on their efforts , expressing gratitude for their being "on board" . Mr. Hester said Channel 26 has an update of all CSO projects continuously. 5) Mr. Lopez said that groundbreaking for the Lansing Center expansion would be Tuesday, Jan. 19 at 9 : 30 a.m. 6) Ms . Mason asked if the board thought another meeting before the Feb. event would be necessary or desirable? Asked for feedback. Consensus was that the dinner usually took the place of the February meeting. Mr. Egan suggested that another meeting might be important during reorganization. After short discussion, Ms . Mason said she would follow up any requests . 7) Ms. Flaherty commented that though the times are stressful, the attitudes of city employees and services being provided were excellent and she was grateful for their support.
