The February 2016 meeting of the City of Lansing Building Board of Appeals was called to order
at 2:10 p.m. by Chairman Don Heck. The following members were in attendance:

Chairman Heck asked for the approval of the December 2015 minutes. Don Heck made a
motion to approve the minutes. Motion seconded by Chad Powers. Motion carried.

Ken Jones (JONES) gives brief history of the building and has plans to add a second office
space to the third floor. The building is fully fire suppressed, two stairways in opposing corners
of building and one tenant on the third floor that wants to down size. The current tenant is ok
with unlocked doors for the new tenant at all times to have access to the stairs. The suite that
would have the main egress point to the common stair elevator would be 2,800 sq. They would
have access to rear stair by passing thru the other tenant's suite. The building code allows you
to pass thru another tenant's suite if the smaller tenant is ten percent of the larger tenant.
Building code also allows you to have one exit when you have less than 29 occupants and less
than a certain travel distance. This space is less than 29 occupants but not less than travel
distance to the main stair but will have access to both stairs.
Shawn Elliott (ELLIOTT) states he is willing to make the fire egress attach to the alarm system.
Jon Snyder (SNYDER) has looked thru the commentary book and it says The common practice
is to have a bank or small restaurant located within a large grocery store or department store
these can be separate tenants in these situations the small tenants are not open when the main
store is closed. The intent of the exception is to allow the small tenants to egress thru the large
tenant since there may be times when the larger tenant is open and the smaller is closed. The
larger tenant cannot exit thru smaller tenant. It also mentions the limitations which JONES
mentioned are based on the fundamental principal of egress is to provide means of egress
when all components are capable of being used by the occupants without keys, tools and
special knowledge or effort.
Don Heck (HECK) verified with ELLIOTT that he is willing to alarm a door that would trigger the
whole building to sound. Door will be alarmed, signed and monitored at all times per ELLIOTT.
JONES says the biggest issue with this layout is that if these are two different tenants. The
same physical construction could take place if they were the same entity.
James Drake (DRAKE) asked if the tenant space will be fire separated.
JONES says they do not need to be but they would build a wall with 3 & 5/8 stud, 5/8 layer of
dry wall on each side so they would get the one hour separation.
Marshaun Blake (BLAKE) states separate business, same space, same use, travel distance has
been confirmed, and alarmed, he has no other issue.
SNYDER says that he understands everything that is going on and he agrees with a lot of things
but he has to go with what 1014.2.1 multiple tenant says and that would be the City's stance on
it. Which is you cannot go thru another tenants space as a means of egress.
BLAKE says he does not have a big issue with his code.
HECK asked with occupant load can they physically exceed 29 on that floor.
ELLIOTT states he would not allow that to happen and he would put it in the lease with the
tenant.
BLAKE states the occupant load is dependent upon travel distance, square footage, use and a
portion that speaks to this particular situation that states where path of egress travel includes
intervening room's area or spaces cumulative occupant load shall be determined in accordance
with this section. BLAKE states that in the code occupancy would be calculated for the whole
space.
DRAKE asked if the board approves this against the Building code what happens when Suite B
gets a new tenant.
ELLIOTT says he would make language in the lease that path of travel would never be blocked.
HECK makes motion to approve the use of the 3rd floor of 200 S. Washington Sq. for two (2)
separate tenants with the following provisions:
1) Emergency exit door be alarmed and remotely monitored.
2) A clear egress path be maintained from Suite A through Suite B
3) The lease be written to provide for and allow the path of egress to be through Suite B
Suite A and B referenced to plan sheet labeled "proposed 3rd floor" as prepared by Studio
(Intrigue) Architects dated February 9, 2016.
Motion supported by Chad Powers.
SNYDER states that he opposes this.
Motion carried unanimously.
Don Heck moved to adjourn. Seconded by POWERS, motion carried.
