Capitol Ave. at 2:00 pm December 8, 2015 The December 8, 2015 meeting of the City of Lansing Building Board of Appeals was called to order at 2:15 PM. by Chairman Don Heck. The following members were in attendance: Don Heck, Chairman James Drake, Vice Chairman Barry Wood Tom Knoy Members Absent: Chad Powers Staff Present: Marshaun Blake, Fire Marshal = Jon Snyder, Plan Review Analyst/Secretary `a Chad Wakley, Building Inspector Petitioners Present: Ken Jones, Studio Intrigue Public Present: None Chairman Don Heck asked for the approval of the November 10, 2015 meeting minutes. Barry Wood made a motion to approve the minutes. Motion seconded by Tom Knoy. Motion carried unanimously. Old Business: None New Business: Case No.: Address: Petitioner: BBA-005-2015 1218 Turner Street Ken Jones (These minutes of the Building Board of Appeals are not intended to be a transcript.) Chairman Don Heck (HECK) gives an introduction of the appeal stating the petitioner was not yet present and that Ken Jones (JONES) is asking for relief from section 1208.2 Michigan Building Code 2012 ceiling heights. Chad Wakley (WAKLEY) states that he was at the location for inspection and found a food prep area being built without a building permit. He submits a site plan of the area showing ceiling height measurements as low as 6 feet 5 inches. Marshaun Blake (BLAKE) states that the biggest issue is that no permits were pulled and the plan review process was skipped for this specific area of concern. HECK calls for a pause in the meeting to try to contact the petitioner to see if he will be attending the meeting. HECK calls the meeting to order now that JONES is present. JONES gives a brief introduction of the food prep area stating that putting in another door giving two means of egress and installing smoke detection would make the area safer. HECK states that different ceiling heights were given and all of them were below the required 7 feet. BLAKE states the reason for plan review is to prevent situations like this. Also regarding the ceiling heights he brings up that fire fighters have a wide variety of heights and there are important reasons for having a minimum ceiling height in the Code. Discussion ensues regarding the building being over 100 years old, the basement being used for storage and the fire rating of the basement ceiling. James Drake asks if it would make sense to table this issue to give JONES time to review options and to submit plans to bring to code. Jon Snyder asks if the food prep area is currently being used. WAKLEY states that he told them they cannot occupy the area but is not sure it is not being used. HECK asks JONES if he would want a definitive answer from the Board or to table the matter to have more time. JONES answers he would prefer to have more time. Tom Knoy (KNOY) makes a motion to table the meeting. Motion supported by Barry Wood (WOOD). Motion carried unanimously. It is agreed that JONES can submit construction documents 5 business days before the meeting for plan review. Other Business: None Public Comment: None James Drake makes a motion to adjourn. KNOY and WOOD support. Motion carried unanimously. Introductions were made. HECK asked for the approval of the September 8, 2015 meeting minutes. James Drake made a motion to approve the minutes. Motion seconded by Barry Wood. Motion carried unanimously. Rick McKinstry (MCKINSTRY) gives brief history of the building and has plans to renovate ten apartments and one retail space. MCKINSTRY states that there are windows on the east side of the property that are within five feet of the property line. He states the Building Code does not allow windows in a building within zero to five feet of the property line. MCKINSTRY states that the building will be fully sprinklered and they would provide a fully sprinklered window curtain at the openings, similar to what they did on the old Rycus Floor building. Tom Knoy asks about the precedence set at the Rycus building. MCKINSTRY states the situation is very similar in relation to the windows on the second floor overlooking a parking lot. It was discussed that the Rycus building was different in that the windows were fire rated. Jim Bennett (BENNETT) states that the Rycus building did not have smoke detection like 308 E. Grand River will have as a trade off. BENNETT talks about the benefit of getting a permanent easement from the owner of the parking lot so no one could build next to the building. Kevin McIntyre states they are currently in negotiations with the owner to these regards. HECK states the issue is the windows on the property line, and the solution is to sprinkle the windows. HECK asks Tony Phillips if he had any issues and he answered as long as the windows are sprinklered then he has no issues. Tom Knoy makes a motion to approve the request. Motion supported by Barry Wood. Motion carried unanimously. Barry Wood made a motion to approve the minutes. Motion seconded by James Drake. Motion carried unanimously. Chairman Don Heck (HECK) asked everyone to introduce themselves. Introductions were made. Mary Swanson (SWANSON) gives brief history of when Mr. Cook purchased the property and that the offices were existing and a mezzanine was then constructed by him. She states Mr. Cook started the work without any permits. She states that only the back half of the mezzanine meets ceiling height requirements. Douglas Cook (COOK) states he knows he was wrong to begin work without permits and that he really did not know proper procedure, but is asking for variance. HECK asks COOK the heights of the mezzanine. SWANSON answers 8 feet to 6 foot 3 inches. HECK asks Jon Snyder (SNYDER) is there any additional information missing. SNYDER answers that the existing offices were not built when the original building was built. There were no other permits pulled to construct these offices until this year, therefore the offices were built illegally. SNYDER brings out copies of the original construction documents showing no offices or furnace room-, and the proposed drawings from Mary Swanson showing the mezzanine on top of these spaces. The members and petitioners review the construction documents. HECK confirms from SWANSON that the actual ceiling heights in the mezzanine range from 7 feet 7 112 inches to 6 feet 6 inches. This gives approximately 50% of the mezzanine area as being non-compliant. Members and Petitioners discuss many options that were explored. Barry Wood (WOOD) states that from an historical perspective he has issues with this. He has seen a lot of developers that make changes and then ask for forgiveness. He states he has a fundamental problem with that. WOOD makes a motion to deny the request due to the fact that there exist other options for meeting the code. This does not meet a request for hardship. Motion seconded by Chad Powers. Motion carried unanimously. Other Business: None Public Comment: None James Drake moved to adjourn.
