December 8, 2009
The December 2009 meeting of the City of Lansing Building Board of
Appeals was called to order at 2:04 p.m. by Chairman Randall Kamm.
The following members were in attendance:

Chairman Kamm asked for the approval of the July 14, 2009 Special
Meeting minutes. Don Heck made a motion to approve the minutes.
Motion seconded by Dean Taylor. Motion carried.

Vanderklok
Chairman Kamm introduced Mr. Vanderklok, Architect, representing
Marketplace Partners LLC. Mr. Vanderklok then presented the appeal
and gave arguments in support of the appeal. The Board then
questioned Mr. Vanderklok to clarify some points. The Board inquired
regarding the Building Safety Office and Fire Marshal's position
regarding the appeal. Neither the Building Safety Office nor Fire Marshal
objected to the appeal.
Mr. Heck made the motion "That the existing City of Lansing park land
south of Shiawassee Street and north of City Market Drive be deemed a
"Public Way" for purposes of Table 704.8 and Table 602 of the Building
Code. Should any development occur on the City park property, it would
be the proposed building owner's (petitioner) responsibility to make any
and all upgrades required for continued use."
Seconded by Mr. Taylor
Motion carried.
At 2:31 PM, Mr. Heck moved to adjourn. Motion seconded by Mr. Drake.
Motion passed unanimously.

The Special meeting of the City of Lansing Building Board of Appeals was called to order at
2:10 p.m. by Chairman Randall Kamm. The following members were in attendance:

Chairman Kamm asked for the approval of the April 14, 2009 minutes. Don Heck made a
motion to approve the minutes. Motion seconded by Dean Taylor. Motion carried.

BBA-003-2009 201 S. Grand Ave. Shawn Elliott
Randall Kamm introduced Shawn Elliott who is requesting the use of the top tier of a privately
owned parking ramp for temporary assembly occupancy to hold a concert event. The concert
would have approximately 2,500 attendees which would be in violation of the Michigan Building
Code.
Mr. Elliott submitted a letter from his architect regarding the floor loading and written arguments
in support of his appeal, and noted that he would work with the Fire Department regarding
exiting plans, fire watch, and security plan in advance of the event.
After some discussion and questioning of Mr. Elliott, Don Heck asked what the position of the
Building Safety Office was.
Jim Bennett responded that there are multiple issues in allowing the space to be used for
assembly occupancy:
Floor load designed for 70lbs not the required 100 Ibs per square foot.
Means of egress exit width is a little over half of that required.
Exit travel distance exceeds that allowed by more than 50%.
No hand rails on ramps.
Ramp slope exceeds 1/12 permitted for means of egress.
Lack of required automatic fire suppression.
Lack of required fire alarm.
After more discussion, Don Heck made a motion to table the appeal until Building Safety, Fire,
Shawn Elliott and the Principal Shopping District could meet to revise the proposal. Further, to
expedite the process, the revised proposal be distributed to the members by email or fax and
the members vote by email or fax to approve or deny the appeal. Seconded by Dean Taylor.
Mr. Heck and Mr. Taylor voted yes, Mr. Kamm abstained. Motion passed.
At 3:15 p.m., Don Heck moved to adjourn. Motion seconded by Dean Taylor. Motion carried.
On July 17tn Mr. Elliott submitted a revised proposal. Mr. Sabon and Mr. Bennett reviewed the
proposal and submitted written comments. The proposal and written comments were distributed
to Mr. Kamm and Mr. Heck by email and Mr. Taylor by fax on July 201n
Mr. Heck replied by email on July 215t and voted to deny the appeal.
Mr. Kamm replied by email on July 215t with a memo attached and voted to deny the appeal.
Mr. Taylor responded by fax on July 215t and voted to deny the appeal.
The petitioner was informed of the vote by Mr. Bennett.

The April 2009 meeting of the City of Lansing Building Board of Appeals was called to order at
2:05 p.m. by Chairman Randall Kamm. The following members were in attendance:

Chairman Kamm asked for a motion to excuse the absence of Dean Taylor. Motion made by
Don Heck, seconded by James Drake. Motion passed unanimously.
Chairman Kamm asked for the approval of the January 13, 2009 minutes. Don Heck made a
motion to approve the minutes. Motion seconded by James Drake. Motion carried.

BBA-04-2007 329-337 Washington Sq. Scott Gillespie
Mr. Scott Gillespie requested the Board grant him an extension of time, beyond the 24 months
originally granted, to complete the installation of fire sprinklers to his building. After questioning
of Mr. Gillespie and discussion by the Board, Mr. Heck moved to an allow an extension of time
to complete the installation to August 15, 2009, provided that a copy of the signed contract
between Mr. Gillespie and the sprinkler contractor is submitted to Mr. Sabon by April 30, 2009.
Motion was seconded by Mr. Drake. Motion passed unanimously.

BBA-01-2009 3300 Express Court Mr. Brian Finos
Mr. Finos introduced his project engineer, Mr. Gregory Minshall, to present his appeal. The
petitioner would like to use the provisions of the 2006 International Fire Code (IFC) for exterior
fire flow at their proposed project rather than the current requirement contained in the 2003 IFC.
The Board questioned Mr. Minshall and also asked for Mr. Sabon's opinion. After discussion,
Mr. Heck moved to accept the provisions of the 2006 IFC as meeting the intent for fire and life
safety of the 2003 IFC as it relates to reduced exterior fire flow. Motion seconded by Mr. Drake.
Motion passed unanimously.

BBA-02-2009 645 Paris Roger Smith
Mr. Smith, the contractor, introduced Ms. Martin, the homeowner. The petitioner's are
requesting the use of a portion of the basement of the owner occupied home as a new
bedroom. The ceiling height is approximately 6 feet 5 inches. The Board questioned the
petitioners and asked the opinion of Mr. Sabon and Mr. Bennett. After discussion, Mr. Heck
moved to allow the addition of a bedroom in the basement with the following conditions;
1. An emergency escape and rescue window in compliance with the Michigan Residential
Code (MRC) be installed.
2. A window well, including ladder, be installed in compliance with the MRC.
3. Hard wired and interconnected smoke detectors are installed throughout the entire home as
outlined in the MRC.
Motion seconded by Mr. Drake. Motion passed unanimously.
At 2:32 PM, Mr. Heck moved to adjourn. Motion seconded by Mr. Drake. Motion passed
unanimously.

BBA-13-2008 3366 Remy Drive. Mr. Tom Reder
Chairman Kamm introduced Mr. Reder and asked him to present his appeal.
Mr. Reder provided the Board with some written materials in addition to those submitted
with his appeal application. Mr. Reder then walked the Board through the materials
outlining the inconsistencies of the current Fire Code and the adopted editorial fixes to
the 2009 edition of the International Fire Code. See attachments 1 and 2.
Mr. Bennett presented the Board with a letter from Mr. Phil Sabon, Fire Marshal, stating
that the Fire Department did not object to Mr. Reder's proposal. See attachment 3.
Mr. Bennett also stated that the Building Safety Office did not object to Mr. Reder's
proposal since compliance with a newer edition of a code is generally accepted to meet
the intent of a previous code edition.
Mr. Heck moved to grant Mr. Reder's appeal. Seconded by Mr. Drake. Motion carried.
At 2:26, Don Heck moved to adjourn. Motion seconded by James Drake. Motion
carried.
