Don Heck made a motion to approve the minutes. Motion seconded by James Drake. Motion carried. Old Business: None New Business: Case No.: Address: Petitioner: BBA-08-2007 537 Allen Street Mr. Najah Nona Chairman Randall Kamm introduced Mr. Najah Nona who is requesting continued use of an existing second floor area as a sleeping room. The room has insufficient ceiling height and less than the minimum room dimension of seven (7) feet in violation of the Housing Code and the Michigan Residential Code. There was some discussion, but with a ceiling height of 6'2" it was determined that it is not even close to meeting the standing policy of the Board. Don Heck made a motion to deny the use of the existing second floor area at 537 Allen Street as a sleeping room. Seconded by James Drake motion carried unanimously. Option A • Add patios as illustrated in previous Exhibits. • Limit square footage of patios to 200s.£. This would account for 1 occupant per R-use calculation; 10 for A-use calculation. The patio shall be posted with an occupancy sign limiting the number of occupants to 10. • The travel distance from the most remote corner of the roof top patio to the common path of travel shall not exceed 75'-0", including the travel distance as measured across the plane of the stairway nosing) • Extend westerly stair tower through the roof to provide second means of egress to (3) westerly roof top patios (the three westerly patios set the highest above the lowest level of fire department access). Note, the pathways to the stair must remain clear year-around. • Include the top of the roof top patio access stairs as part of the fire suppressed area. • Provide fire department connection in top of central exit stair (currently accesses roof for mechanical/maintenance). This connection will put all proposed patios within 175'-0" of the central stair. • Include emergency telephones at the top of all roof top patio access stairs (similar to those in elevators). Michigan Ave. Gillespie Development Vice Chairman Heck introduced the representatives for Gillespie Development who are requesting to install patios on the roof of a building currently under construction. The patios would constitute an occupied level more than 55 feet above the lowest level of Fire Department vehicle access. Buildings of this height are required to comply with the provisions for High Rise Buildings under section 403 MBC 2003. Mr. Vanderklok, Architect from Studio Intrigue who is a consultant to Gillespie Development and Pat Gillespie, representative of Gillespie Development outlined their vision for the project and the reasons for requesting the appeal. New Business: Case No.: Address: Petitioner: BBA-003-2007 2418 Dunlap St. Charles Pruitt Randall Kamm introduced Charles Pruitt who is requesting to use rooms with 67' ceiling height as sleeping rooms. Craig Whitford, Code Compliance Officer stated that Mr. Pruitt is the new owner and upon inspection the two rooms both north and south had a ceiling height of 62", the windows are not adequate for egress, and there is a restriction at the bottom of the stairs and the doors. Mr. Pruitt's intentions are to occupy both of these rooms as bedrooms. All of the violations on the letter have been met with the exception of the second floor bedroom requirements. The building is currently occupied with the second floor attic being non-habitable space which is written into his lease pending this appeal. The rooms lack two duplex outlets and the south bedroom lacks a heat run. Mr. Pruitt has indicated that he is willing to do whatever it takes to make these two rooms habitable. 1 After much discussion, Dean Taylor made a motion to allow the use of the larger (south) room as a sleeping area provided that hardwired interconnected smoke detection is installed throughout the house including basement, legal emergency escape & rescue windows are installed safety glazing/tempered glass is installed at the bottom of the stair landing, and heat as required by code is provided to the second floor. Scott Gillespie Randall Kamm introduced Scott Gillespie who is requesting that he be allowed to install automatic fire sprinklers in phases in an existing building undergoing alteration to convert the second floor office space into nine (9) dwelling units in a mixed use building. Jim Bennett stated that the building is at the corner of Kalamazoo Street and South Washington Square and currently has a building permit to convert the second floor to 9 dwellings. But as part of that project he has to sprinkle the entire building. The first floor is comprised of 4 Commercial units, one of which is vacant and the other 3 are currently occupied. What Mr. Gillespie wants to do is sprinkle the second floor and the vacant Commercial unit now. The 3 occupied Commercial units he would like to do at a different time rather than disturb his tenants now. Mr. Gillespie stated that he would like to not disturb his tenants until they renovate or their leases come up for renewal. After much additional discussion, Jim Bennett stated that Building Safety doesn't oppose this if Smoke Detection is added in the occupied commercial spaces and tied to the existing sprinkled space notification and an expiration date to be required to sprinkle by 24 months or if vacated or sold. James Drake made a motion to sprinkle the building throughout with the exception of 3 leased spaces at this time, provided that smoke detection is installed in these 3 spaces and tied to the flow switch notification of the sprinkler system, and that the 3 currently leased spaces be sprinkled when the leases are renewed or the tenants renovate or change. In any case the units will be sprinkled within 24 months. Seconded by Dean Taylor, motion carried unanimously. Other Business: Jim Bennett gave an update regarding Mr. Ferguson's appeal. Mr. Ferguson was mailed, by first class mail and sent a fax that went through, a letter that outlined what was still needed to comply with the conditions of his appeal. Mr. Bennett suggested that a Show Cause Letter be sent to report to the Board within 15 days before pursuing the next step. James Drake made a motion to follow Jim's suggestion. Seconded by Dean Taylor, motion carried. Phil Sabon submitted a letter from the Fire Chief (see attachment A) requesting that the Board approve a policy that when a pitched roof is going to be added over a flat roof, that the flat roof surface and decking be removed. Mr. Sabon explained that with both roofs (existing flat and new pitched) in place it creates a concealed space that can interfere with standard fire fighting operations, and can be life threatening to the Fire Fighters. A policy like this is covered under section 102,8 of the Fire Code being "Matters Not Provided For". Jim Bennett stated that there is no provision for this in the Building Code. So they are asking that the Board make this a policy of the Building Safety Office. It would be effective from this point forward. 2 After some discussion, James Drake made a motion to accept the Fire Marshal's proposal effective March 13, 2007. Attachment A(continued) The Lansing Fire Marshal Division proposes that during the plan review process in a situation that involves the addition of a pitched roof over a flat roof, that the flat roof be removed, This process would give firefighters the ability to adequately ventilate fire conditions in a building of this nature. During firefighting operations a procedure often used by firefighters is to ventilate to the exterior of a structure with a hole in the ceiling and roof over the fire. This relieves the smoke, heat, and toxic fumes that gather in the space thus making firefighting operations safer. In buildings that add a pitched roof over an existing flat roof, venting the exterior roof over the fire would give fire crews a false assumption that the fire is vented because of the concealed space. The delay in ventilating the building would cause more hazardous conditions for firefighters. Fire conditions would continue to deteriorate thus making the extinguishment of the fire more difficult. During normal fire scene exterior size up, fire crews may not recognize the concealed space created by the flat roof. The best accepted practice for firefighting operations, in the event of a fire in a building of this type, is to remove the top surface of the flat roof when a pitched roof is installed. This would remove the concealed space between the interior ceiling and the roof. During the process of ventilating the roof during a fire the products of combustion then would vacate the building and create a safer work environment for fire crews. Mr. Pruitt's intentions are to occupy both of these rooms as bedrooms. All of the violations on the letter have been met with the exception of the second floor bedroom requirements. The building is currently occupied with the second floor attic being non-habitable space which is written into his lease pending this appeal. The rooms lack two duplex outlets and the south bedroom lacks a heat run. Capitol Ave. Andre Pulford Randall Kamm introduced Mr. Pulford regarding 1232 N. Capitol Avenue, who is requesting to finish the basement to provide two (2) bedrooms, remodel a bathroom & reconfigure the remaining space as habitable space. The existing ceiling height is 6 feet 9 inches. This does not comply with section 304.1 of the 2003 Michigan Residential Code. Mr. Pulford explained that he had purchased 1232 N. Capitol Avenue in July of 2006. At that time it was considered a two bedroom. The house was built in 1860 and the house was raised in 1960 and placed on poured floors and block walls. The finished ceiling height is 610". At the time I purchased the home it was my intent to remodel the bedrooms and the bathroom. I pulled some permits setting in to tear out some of the basement and at that point I became aware that the finished ceiling height would not be 7' which is what the current Code requires. So I stopped work and took some pictures and filed to have the meeting today to discuss what I can do to complete the project. I'm asking for a variance to allow ceiling height of 69" so I could put ceramic tile on the floor and drywall on the ceiling. There was some discussion and the petitioner stated that the house will be homeowner occupied. He stated that he would like to install egress windows in each bedroom and anywhere else were they are necessary. He said it is his intention to replace the water pipes. There was some additional discussion and Jim Bennett stated that the Code requires 7'. He has done everything by the numbers, He already has a Building Permit, Plumbing Permit & Electrical Permit. When he got the Building Permit one of the conditions that was put on the permit was that he would have to install egress windows & smoke detection. The Building Safety Office's position is that we don't oppose his proposal, we would like to see the furnace/mechanical room closed with at least a 1 hour fire resistant construction and put in at least a 20 minute fire rated door. Also the policy for ceiling heights in attics allows for ceiling as low as 68"to be approved by the inspector in the field. Don Heck asked if the requirements on the Mechanical Room were required on the Building Permit. Jim Bennett stated, no, that's what he would be offering in addition to what's already required. After more discussion Brian Davis stated that it would be best if the smoke detection would all be hardwired, interconnected. Don Heck made a motion that we allow the finished ceiling height of 69" in the basement of the house at 1232 N. Capitol Avenue with the following conditions: 1. Smoke Detectors are interconnected between all floors. 2. That the Mechanical Room has a 1 hour fire rating on the walls. 3. The door to the Mechanical Room is self closing & latching with a 20 minute rating. Seconded by Dean Taylor, the motion carried unanimously. Jim did explain to Mr. Pulford that he would need to amend his Building Permit to add the additional work. Capitol Ave. Andre Pulford Randall Kamm introduced Mr. Pulford regarding 1232 N. Capitol Avenue, who is requesting to finish the basement to provide two (2) bedrooms, remodel a bathroom & reconfigure the remaining space as habitable space. The existing ceiling height is 6 feet 9 inches. This does not comply with section 304.1 of the 2003 Michigan Residential Code. Mr. Pulford explained that he had purchased 1232 N. Capitol Avenue in July of 2006. At that time it was considered a two bedroom. The house was built in 1860 and the house was raised in 1960 and placed on poured floors and block walls. The finished ceiling height is 610". At the time I purchased the home it was my intent to remodel the bedrooms and the bathroom. I pulled some permits setting in to tear out some of the basement and at that point I became aware that the finished ceiling height would not be 7' which is what the current Code requires. So I stopped work and took some pictures and filed to have the meeting today to discuss what I can do to complete the project. I'm asking for a variance to allow ceiling height of 69" so I could put ceramic tile on the floor and drywall on the ceiling. There was some discussion and the petitioner stated that the house will be homeowner occupied. He stated that he would like to install egress windows in each bedroom and anywhere else were they are necessary. He said it is his intention to replace the water pipes. There was some additional discussion and Jim Bennett stated that the Code requires 7'. He has done everything by the numbers. He already has a Building Permit, Plumbing Permit & Electrical Permit. When he got the Building Permit one of the conditions that was put on the permit was that he would have to install egress windows & smoke detection. The Building Safety Office's position is that we don't oppose his proposal, we would like to see the furnace/mechanical room closed with at least a 1 hour fire resistant construction and put in at least a 20 minute fire rated door. Also the policy for ceiling heights in attics allows for ceiling as low as 68" to be approved by the inspector in the field. Don Heck asked if the requirements on the Mechanical Room were required on the Building Permit. Jim Bennett stated, no, that's what he would be offering in addition to what's already required. After more discussion Brian Davis stated that it would be best if the smoke detection would all be hardwired, interconnected. Don Heck made a motion that we allow the finished ceiling height of 69" in the basement of the house at 1232 N. Capitol Avenue with the following conditions: 1. Smoke Detectors are interconnected between all floors. 2. That the Mechanical Room has a 1 hour fire rating on the walls. 3. The door to the Mechanical Room is self closing & latching with a 20 minute rating. Seconded by Dean Taylor, the motion carried unanimously.
