Abduljaber Public Present: None Chairman Kamm asked for the approval of the June 13, 2000 minutes. Dean Taylor made a motion to approve the minutes. Motion seconded by Brian Taylor. Motion carried. Old Business: ti Case No: BBA 002-2000 Address: 209 Lathrop Petitioner: Mr. M. Abduljaber Jim Bennett would like the appeal evaluated in twoparts. The first issue being the 1st floor bedroom size. The second issue, the ceiling height in the 2' floor. Part 1: Part one of the appeal is for use of a first floor bedroom that does not meet the minimum square foot requirements for a habitable room. Mr. Abjuljaber stated he would install a working smoke detector and verify that the window would open. General discussion as to layout, size of windows, egress ability and smoke detectors. Dean Taylor made a motion to approve use of first floor bedroom with smoke detector being hardwired, the window operable, and pass the next inspection by the Code Compliance officer. Motion seconded by Brian Taylor. Motion carried. Part 2: Part two of the apt. , is to use the second floor space with adequate ceiling height, as a bedroom. Mr. Abduljaber stated the stairway to the upstairs was extra wide and the room had a smoke detector. He felt that with the removal of the vent pipe the room would be adequate for bedroom usage. General discussion as to the size of the window, whether it was accessible to the flat roof outside if there was snow. The pictures of the room showed the smoke detector to be inoperable. The ceiling height-area calculation was only 79%, with a minimum being 83% for administrative modification. Randall Kamm explained to the petitioner, that due to three board members being in attendance, they would all have to agree to approve his appeal. Mr. Abduljaber agreed and understood. Brian Taylor made a motion to deny the use of the second floor space as a sleeping area, sighting that minimum code requirements were not being met. Motion seconded by Dean Taylor. Old Business: none 2 Building Board of Appeals Minutes April'11, 2000 New Business: Case No.: Address: Petitioner: BBA-002-2000 303 W. Kalamazoo Ivars Dzirnis, Wigen Tincknell & Meyer Assoc. Present: Ivars Dzirnis, project architect, John Meyer, principal architect, Ken Pierce, Ingham Co. Purchasing and Property Mr Dzirnis spoke of the addition of benches to the corridors of the Ingham County Court house 2"d and 3`d floor corridors. These are fire exit corridors so code prohibits placement of furniture in these corridors. The request is to the allow placement of permanently affixed benches in these corridors. They are requesting: 2"d flr 211 linear feet of bench would seat 140 persons 3`d flr 187 linear feet of bench would seat 124 persons The corridors would be 1010" wide after the installation of the benches and a corridor this wide is rated to handle 650 people. The corridor is 1 hr fire rated and sprinkled. The maximum occupancy for each floor is less than 650 even with the addition of the maximum person load of the requested benches. Jim Bennett stated that Barrier Free Access regulations do not have requirements for seating in hallways so barrier free access is not an issue in the halls. It is in the court rooms but those are already designed to meet access requirements. Randall Kamm asked if the benches would be steel or some other noncombustible material and be affixed to the floors. The answer was yes. Jim Bennett commented that allowing the benches would not allow placement of planters, magazine racks, or any other moveable items. Brian Davis asked that at the time of occupancy, the person or organization who is the owner/occupant send a letter indicating that they are aware of the conditions of this appeal. Don Heck noted that with the extra 140 possible people and the current maximum load expectation on the corridor, the corridor would be required to be only 9'9" wide by code. With the benches it would still exceed that size. Don Heck moved that the Board approve the appeal with the following conditions: • Seating must be permanently attached to the floor • There will be no loose tables, planters or the like anywhere in the corridors • A letter must sent by the official occupants of the building to the Building Safety Office, Plan Review staff indicating knowledge of and acceptance of these conditions The final selection of benches must be approved by the Fire Department and Building Safety Office Dean Taylor seconded the motion. Building Board of Appeals Minutes 3 April'11, 2000 Dennis Mellott spoke for the appeal indicating that the property in question has been owned by Saga Communication since 1998 and they have done a number or renovations. They now wish to ask for a change in the status of the 3rd floor from R-3 residential to B office. The area is currently an unoccupied apartment and they wish to use it for office space for 4 or less people. Additionally, they ask an exception from the commercial rise and run requirements and the exit separation requirements. They have applied for a Barrier Free Access exemption as well. Additional parking is being leased from Michigan Beer & Wine Wholesalers Assoc. located behind the property in question. After questions from various Board members it was established that: • The stairs are even and have consistent rise and run but the rise and run just doesn't meet commercial standards. They do meet residential standards. • There is adequate head room in the stairwell. • It would be very difficult to correct the stairs. • The outside stairs are approved. • There are two exits from the 3rd floor at opposite ends of the building they don't meet the commercial requirement for exit separation. • There is plenty of handicap access to all necessary facilities on the first floor and any work expected to be done the 3rd floor could be done on the first floor. • The entire building has a hardwired alarm system that is heard on all floors and is above and beyond any current regulations. Don Heck moved that upon approval of Barrier Free Access exemption the applicants be given the change of status from R-3 residential to B office, the variance for the stairway and the variance for the exit distance. Abduljaber Public Present: None Chairman Kamm asked for the approval of the May 11, 1999, Sept. 14, 1999 and Dec. 14, 1999 minutes. Mr. Heck made a motion to approve the minutes with correction as noted in the minutes of Sept. 1999. Motion seconded by Mr. B. Taylor. Motion carried. New Business: BBA-001-2000 318 Mifflin Karim Maem Alsaedi and Mohamad H. Abduljaber Chairman Kamm asked the petitioners to explain their Request. Mohamad Abduljaber spoke for himself and Karim Maem Alsaedi, describing the structure as a small house with 1 bedroom, a living room, kitchen, bath and basement, but no dining room or other bedroom. The petitioners want permission to use the converted attic space as a second bedroom. There were some initial questions about the status of the property. Mr. Alsaedi is buying from Mr. Abduljaber on a land contract so the property does not have to meet rental property guidelines but it is still not meeting residential Code guidelines. The attic room is only 64% compliant. _Building Board of Appeals Minute 3/14/00 2 Mr. David described the height of the room (6), the narrow, steep stairs and the 17" opening between a vent pipe and the stairs and other measurements. Mr. Kamm noted that a new, larger window had been installed at the opposite end of the house from the room the petitioners are requesting to use as a bedroom. He also noted that Code limits 1 bedroom house occupancy to 2 people. Mr. Heck brought up the fact that-Mr. Alsaedi has signed an affidavit stating that he would not use the house as anything more than a 1 bedroom house. He also asked how old the child was who would be occupying the space. The child is 16. Mr. David reported that the house had been closed more than once in recent time for too many people and for a bad foundation. The foundation has been repaired. Mr. Abduljaber stated that they would be willing to put in a new window at the bedroom end of the house and could move the electrical wiring to another wall as needed but they believed that raising the roof was too expensive. He claims that they did not know of the occupancy restrictions when he bought the house or when he sold it to Mr. Alsaedi. Mr. Heck asked if Mr. Abduljaber had other rental properties and was aware of the code standards. Mr. Abduljaber said he had 10 others. There was a further discussion of the exact dimensions of the room, where the knee walls were positioned, how the stairs functioned, how the window opened, whether or not there were electrical outlets and heat ducts (no to both), and whether fire fighters would be able to access the upstairs when in full gear. Whether the smoke detector currently in place is too close to the light and therefore will suffer heat damage from it (yes). The fire issue was of particular concern because there had been a number of fires in that block in recent months and several deaths. Mr. B. Taylor made suggestions as to bring the room into compliance without excessive work. Mr. B. Taylor moved that the appeal be denied and Mr. Alsaedi look for different housing for himself, his wife and their son. The motion was seconded by Mr. Heck. The motion carried. Capitol Ave. at 2:00 pm March 14, 2000 The March 2000 meeting of the City of Lansing Building Board of Appeals was called too der at-2:22 p.m. by Chairman Randall Kamm. The following members were in attendance: Randall Kamm, Chairman Donald Heck, Vice Chairman Brian Taylor Members absent: Dean Taylor Staff Present: Christine Segerlind, Secretary Dan David, Code Compliance Inspector Brian Davis, Assistant Fire Marshal Peggy Gerber, Recording Secretary Petitioners Present: Karim Maem Alsaedi Mohamad H. Abduljaber Public Present: None Chairman Kamm asked for the approval of the May 11, 1999, Sept. 14, 1999 and Dec. 14, 1999 minutes. Mr. Heck made a motion to approve the minutes with correction as noted in the minutes of Sept. 1999. Motion seconded by Mr. B. Taylor. Motion carried. New Business: BBA-001-2000 318 Mifflin Karim Maem Alsaedi and Mohamad H. Abduljaber Chairman Kamm asked the petitioners to explain their Request. Mohamad Abduljaber spoke for himself and Karim Maem Alsaedi, describing the structure as a small house with 1 bedroom, a living room, kitchen, bath and basement, but no dining room or other bedroom. The petitioners want permission to use the converted attic space as a second bedroom. There were some initial questions about the status of the property. Mr. Alsaedi is buying from Mr. Abduljaber on a land contract so the property does not have to meet rental property guidelines but it is still not meeting residential Code guidelines. The attic room is only 64% compliant. Building Board of Appeals Minute 3/14100 2 Mr. David described the height of the room (6), the narrow, steep stairs and the 17" opening between a vent pipe and the stairs and other measurements. Mr. Kamm noted that a new, larger window had been installed at the opposite end of the house from the room the petitioners are requesting to use as a bedroom. He also noted that Code limits 1 bedroom house occupancy to 2 people. Mr. Heck brought up the fact that Mr. Alsaedi has signed an affidavit stating that he would not use the house as anything more than a 1 bedroom house. He also asked how old the child was who would be occupying the space. The child is 16. Mr. David reported that the house had been closed more than once in recent time for too many people and for a bad foundation. The foundation has been repaired. Mr. Abduljaber stated that they would be willing to put in a new window at the bedroom end of the house and could move the electrical wiring to another wall as needed but they believed that raising the roof was too expensive. He claims that they did not know of the occupancy restrictions when he bought the house or when he sold it to Mr. Alsaedi. Mr. Heck asked if Mr. Abduljaber had other rental properties and was aware of the code standards. Mr. Abduljaber said he had 10 others. There was a further discussion of the exact dimensions of the room, where the knee walls were positioned, how the stairs functioned, how the window opened, whether or not there were electrical outlets and heat ducts (no to both), and whether fire fighters would be able to access the upstairs when in full gear. Whether the smoke detector currently in place is too close to the light and therefore will suffer heat damage from it (yes). The fire issue was of particular concern because there had been a number of fires in that block in recent months and several deaths. Mr. B. Taylor made suggestions as to bring the room into compliance without excessive work. Mr. B. Taylor moved that the appeal be denied and Mr. Alsaedi look for different housing for himself, his wife and their son. The motion was seconded by Mr. Heck. The motion carried.
