RULES OF ADMINISTRATIVE PROCEDURE
The Building Board of Appeals(Board)shall meet on the second Tuesday of each month,providing the
secretary of the Board has on file, appeals and/or other business to be brought before the Board.
Cancelations of meetings shall be posted and filed with the City Clerk.
All meetings of the Board-shall be open to the public. The public shall be given an opportunity to speak
on matters before the Board.
The function and duties of the Board are prescribed in Section 14 of the Stille-DeRossett-Hale Single
State Construction Code Act, Public Act 230 of 1972(MCL 125.1514), and local ordinance. The Board
shall consist of not less than three(3) members or more than seven (7) members.
The Chief Plan Review Analyst, or their designee, and the Fire Marshal, or their designee, shall serve as
technical staff to the Board with voice but not vote in the proceedings of the Board.
The Board shall elect a Chairperson and Vice-Chairperson at the first meeting of each calendar year to
serve until the election of new officers at the first meeting of the following calendar year. The Chief Plan
Review Analyst, or their designee, shall serve as the Board Secretary
Meetings shall be conducted using"Robert's Rules of Order'.
A quorum of the Board shall be three(3)voting members.
Special meetings may be called when all members of the Board and Applicant(s)are notified of such
meetings by the Secretary of the Board. Notice of a special meeting shall be posted in the Building Safety
Office and filed with the City Clerk not less than 24 hours prior to the meeting.
The Secretary of the Board shall keep the minutes of all Board meetings. Minutes, resolutions, and
determinations of the Board shall be a part of the public record and placed on file with the City Clerk.
All appeals for variance or exception from the Michigan Building Code or the Michigan Residential
Code, must be filed, with the filing fee as shown in the building permit fee schedule and approved by City
Council, in the Building Safety Office not later than twenty(20) calendar days before the regularly
scheduled hearing date. A schedule of regular hearing dates and filing deadlines shall be posted in the
Building Safety Office
Notice of the hearing shall be given to the Board Members, Applicant(s), and other interested persons by
regular mail not less than ten (10) days prior to the hearing date.
The affirmative vote of a majority of the members of the Board present and voting is required on-all rya
matters to come before the board.
A board member may be removed from the board after three(3) unexcused absences in a calendar y94S. by[

The Building Board of Appeals shall meet on the second Tuesday

Special meetings may be called when all members of the board
are notified of such meetings by the secretary of the board. Notice of
a special meeting shall be filed with the City Clerk 24 hours prior to
the meeting.
The secretary of the board shall keep the minutes of all board
meetings. Minutes, resolutions, and determinations of the board shall
be a part of the public record and placed on file with the City Clerk.
The function and duties of the Board of Appeals are prescribed
in Section 204 of the Uniform Building Code, 1982 Edition.
All appeals for variance or exception from the Building Code must
be filed, with a $25.00 filing fee, in the office of the secretary not
later than fifteen (15) days before the hearing.
Notice of the hearing shall be given by certified mail to the appli-
cant and by regular mail to other interested persons five (5) days
prior to the hearing date.
The affirmative vote of three (3) members of the Board of Appeals is
required on all matters to come before the board.
BOARD OF APPEALS - NOTICE OF MEETING
Building Board of Appeals Secretary gives you the Appeals
for the next months meeting.
Fifteen days before the next monthly meeting, send a form
letter by Certified Mail to Appellants informing them of
the date and time of the meeting. Put a copy of letter
sent to them and a copy of Appeal in Black Book.
Send copies of Appeals and any other important information,
and minutes of previous meeting to the Board members and
the Fire Marshal along with a copy of the agenda. Put
copies of agenda and copies of Appeals in Black Book.
Post agenda in Building Safety lobby and send agenda to
Personnel , City Council and City Clerk.
Place original appeal , and filing fee, in bottom right hand
drawer under Board of Appeals.
Call Board members and Fire Marshal a day or two before
the meeting to see if there is a quorum. Let the Building
Board of Appeals Secretary know.
AFTER MEETING
Secretary gives you the minutes to be typed. Return to
Secretary of BBA for signature.
Type the Board' s decision of original Appeals. Make copies
to send to Appellants and one copy for Black Book. Take
original Appeals, with fees, to the City Clerk, along with
a copy of minutes .
File completed Appeals, minutes of meeting, and agenda in
Black Book.

Gentlemen:
Building Board of Appeals
The Building Board of Appeals , with the support of the Department of Building
Safety & Development, has been involved in several activities relating to the
interpretation of the City' s Building Codes to include determining the
suitability of alternate materials and methods of construction. The Board
feels , through its broad base of experience and knowledge, that it has been
very effective in dealing with the issues brought before it. Activities of
special importance include the following:
1 . The Board conducted hearings and reached decisions on 18 appeals regarding
the interpretation of the City's Building Codes.
2. Provided assistance to the Department in preparing recommendations on code
change matters which resulted in an Ordinance change adopting the latest edition
of the Uniform Building Code as amended.
3. Advised the Department on several code and administrative matters pertaining
to the operation of the Department.
4. With the July 1 appointment of Mr. Jones , representing professional engineers ,
the reorganization of the Board has been completed in accordance with Code of
Ordinances ' requirements. The Board is comprised of five appointed members
representing a cross-section of the construction industry.
The Board has received excellent support from the Chief Building Inspector and
the Fire Marshal in conducting its business.
