Howard Lutz made a motion to approve the minutes with one change, that his name be added to the members present. Motion seconded by Rowland Cornish III. Motion carried. Old Business: NONE New Business: NONE Mel Ott and the Board discussed the challenge that homeowners present when they attempt to install their own electrical wiring. The concern is how many times do we re-inspect for corrections before an additional fee is charged. It was determined that it was a judgment call by the inspector when an additional fee would be charged for additional inspections. Howard Lutz made a motion to accept the minutes as read, seconded by Walt Smiley. Motion carried. Old Business: There was a follow up discussion regarding the appeal that was acted on at the May 20, 2003 meeting. New Business: None The remaining time was used to discuss the bonding of wet niche lighting fixtures for swimming pools. Edgewood Blvd. Mr. Michael E. Tobin,President Willowood Apartments Group 5 Management Company Mr. Tobin was present for the appeal. Brian Carter presented the documents to the Appeals Board members concerning the appeal brought forth by Mr. Tobin. Mr. Tobin was asking to waive the requirement by the Lansing Housing Code of GFCI protection within six feet of a water source. Brian Carter provided the following information: CIS Bulletin - February 2000Nolume 5 Issue 2 — This bulletin contained the State Construction Code Act that was signed into law on December 28, 1999. The Act calls for the adoption of the International Building, Mechanical & Plumbing Code and the National Electrical Code as the State Codes. It states, "Local communities will no longer be permitted to amend Codes". Michigan Rehabilitation Code for Existing Buildings, Section 608 (Electrical) 608.1 New Installations - All newly installed electrical equipment and wiring relating to work done in any work area shall comply with the materials and methods, requirements of Chapter 5. 608.3.4 Ground Fault Circuit Interruption — Ground fault circuit interruption shall be provided on newly installed receptacle outlets if required by the Electrical Code. With this information, the Board discussed the appeal by Mr. Tobin. Mr. Tobin indicated that there were approximately 52 units at Willowood that were inspected by the City of Lansing, Code Compliance Office. GFI protection was present within 6 feet of a water source in the bathrooms, but not in the kitchen areas. The Board recommended that The Building Safety Department has to abide by the State Construction Code Act and cannot require Mr. Tobin to replace the existing receptacles with GFI receptacles. The Board also made the recommendation that future replacements of the receptacles in the kitchen areas be ground fault circuit interrupters. Rowland Cornish III made a suggestion to Mr. Tobin that in his opinion, the receptacles should be replaced to protect the occupants. Meeting adjourned at 9:00 P.M.
