MONDAY - APRIL 23, 1984
The Board of Ethics met in regular session on Monday - April 23, 1984 at
2:00 P.M. in the City Council Conference Room - 10th floor - City Hall.
Present: Don Cook, Margaret Groves, John Mertz, Rita Bauman - City Clerk
and City Attorney - Steve Sawyer.
Absent: None.
Guest: Jim Blair, Alfreda Schmidt - Councilmembers.
The meeting was called to order by Chairman John Mertz at 2:15 P.M.
Roll Call vote was taken - all were present.
Motion by Margaret Groves that the minutes of the meeting of February 13, 1984
be approved as printed - motion seconded by Don Cook - Motion carried.
Old Business - None.
Reports of City Officers - None.
New Business: Letters presented from Councilmembers James Blair and Alfreda
Schmidt requesting the Board of Ethics to submit an opinion in regard to
Conflict of Interest for James Blair in his purchase of property at 410 So.
Cedar St.
Chairman John Mertz asked Mr. Blair to make a presentation on his letter of
request for the opinion from the Board of Ethics. Mr. Blair submitted his
presentation with back up material and documents, and answered many questions
asked.
City Attorney Sawyer made a comment inasmuch as he may be in Conflict of Interest
when it came time to make a decision on this matter as he had advised Mr. Blair
on how to handle this matter.
Councilmember Schmidt was asked to join the meeting at 2:50 P.M. to make her
presentation on the matter.
Councilmember Schmidt made her presentation on why she has asked the Board for an
opinion on this matter and answered questiones asked of her.
After the presentations and questions Chairman Mertz excused Councilmembers Blair
and Schmidt from the remainder of the meeting.
City Attorney Steve Sawyer asked to be excused from the discussion and asked
permission that he be allowed to abstain from discussing the issue - request granted.
Discussion was held by the other Board members on this issue.
Motion was made by Rita Bauman that we study the issue for one week and
meet on Monday, April 30, 1984 for a decision to be made - Motion
seconded by Margaret Groves. - Motion carried.
The meeting was adjourned at 4:00 P.M. for one week to meet on Monday,
April 30, 1984 at 2:00 P.M. in the City Council Conference Room.
