RULES OF PROCEDURE
Rule 1. Pursuant to Public Act 267 of 1976, all meetings shall be open to the
public and the public shall have a reasonable opportunity to be heard.
The Board will meet regularly on the last Wednesday of each calendar
month at 7:30 p.m. , at the City Hall. Special meetings of the Board
may be held subject to the call of the Chairman upon notice to all Board
members at least seven (7) days in advance of the meeting. Notice of
all meetings will be posted by the City Clerk for perusal by the public.
Rule 2. All meetings of the Board shall be conducted in accordance with Roberts
Rules of Order.
Rule 3. A quorum at all meetings shall consist of the Chairman or Vice-Chairman
and four (4) members of the Board.
Rule 4. The Board shall elect its officers at the June meeting of each year and
shall elect, from its members , a Chairman and Vice-Chairman, each of
whom shall hold office for a term of one (1) year.
Rule 5. The Secretary of the Board shall prepare a record of all proceedings
at Board meetings and shall file a copy, attested to by the Chairman,
with the City Clerk within fifteen (15) days following the date of the
meeting for which the record has been prepared. The Secretary shall
provide each member of the Board with a copy of the record of proceedings
of any meeting at least seven (7) days prior to the next subsequent
regular meeting.
Rule 6. Complaints of violations of the Air Pollution Control Ordinances of the
City of Lansing shall be made in writing to the Department of Buildings
and Properties on an appropriate form. Said complaints shall be directed
to the Air Pollution Control Engineer. The Air Pollution Control Engineer
shall report on all complaints received since the previous Board meeting.
Rule 7. The Board shall make determinations upon complaints filed following inves-
tigation by the Air Pollution Control Engineer and shall notify all parties
in the proceedings of such determinations in writing. Appeals from said
determinations of the Board shall be held at the monthly meeting of the
Board or at a special meeting called by the Chairman, and said hearings
shall be conducted by not less than a quorum of the Board which shall con-
stitute itself as an Air Pollution Board of Appeals for the purpose of
the hearing.
Rule 8. Notices of hearings shall be served in writing by mail to all parties
in the proceedings .
Rule 9 . Appearances at hearings shall be made either in person, by a duly authorized
agent or by counsel.
Rule 10. The person or persons determined by the Board to be in violation of the
Air Pollution Control Ordinance and who have been served with notice to
appear for a hearing may at his option file a written statement prior to
the date set for hearing or at said hearing may appear and present an
oral or written statement on the determination made.

Rule 11. Prior to taking action on any findings made as the result of investi-
gations by the Air Pollution Control Engineer, the Board may provide a
public hearing at which evidence and views of all persons will be
received. Public notice of the hearing will be given by the Board
through publication in a newspaper having general circulation in the
City of Lansing at least two (2) weeks before the scheduled hearing
date.
Rule 12. At all hearings there shall be read into the record a fair and accurate
statement of the information contained in the files of the Board. The
files and records of the Board shall be available for inspection by
parties in the proceedings prior to or at the hearing and the whole or
any part thereof may be offered at said hearing as evidence on behalf
of the Board.
Rule 13. Following a hearing on appeal or hearing preceding a determination the
Secretary shall prepare a written. report thereof, including the evidence
presented with the findings and decisions of the Board. Such written
report shall be served upon the parties to the proceeding and a copy
shall be filed with the City Clerk.
