Capitol Ave. at 6:00 pm, v ca December 1, 2005 The December 2005 meeting of the City of Lansing Demolition Board was called to order at 6:00 p.m. by Jim McCue. The following members were in attendance: David Muylle; Robert Cochran MEMBERS ABSENT: Mark Hiaeshutter STAFF PRESENT: Jim McCue; Laura Davis; Craig Whitford PUBLIC PRESENT: Randy Brown J. McCue asked for approval of the 10/27/05 meeting minutes. Demolitions Hearing Officer David Muylle moved to approve minutes as written. OLD BUSINESS: Case No.: 2004-024 Address: 815 E. Grand River Ave. J. McCue updated the board on this case. It was last tabled on 10/27/05 with the following stipulations: 1)all exterior work is completed and the building permit for that work be finalized; 2)all trades permits pulled, work completed and permits finalized; 3)another building permit be pulled for the remainder of work needed, complete the work and finalize the permit. Basically, get everything completed on this structure by the next meeting or it will move forward in the demo process. As of today, the only permit action has been a partial approval of the existing building permit. No new permits have been pulled, nor has any of the work been completed. Mr. McCue also stated that he received a report from Craig Whitford, CCO, stating that repairs have not been completed; inspection of the interior has not been scheduled; and dwelling lacks gas utility and complete electrical work. Mr. Randy Brown, owner, addressed the Board. He stated that he is getting estimates for the trade work. He also stated that the electrician told him that a permit was pulled. He stated that he continues to work on the structure; however, hunting season has hindered him getting estimates for work. Demolitions Hearing Officer David Muylle stated that Mr. Hiaeshutter gave very specific stipulations at the last meeting in regards to this property. He has not seen any of those stipulations met by the deadline of this meeting. Demolitions Hearing Officer David Muylle ordered the property be made safe or demolished by January 26, 2006. NEW BUSINESS: Case No.: 2005-014 Address: 708 East Park Terrace J. McCue presented the case. The listed taxpayer of record and interested party is Randy Brown. The SEV is $28,800. Land value is $2,400. Building value is $26,400. Original red tag date is 6/9/04. The.property is zoned 'C'. Estimate of repairs is $44,500. A building permit was issued on 10/4/05 and an electrical permit was issued on 11/28/05. As of today, there has been no action on issued permits, nor have the required mechanical and plumbing permits been pulled. Staff recommends this property be made safe or demolished in 30 days. It took the bank two months to complete the title work. He is currently getting estimates from contractors. He submitted a plan to the Demolition Board. He stated that he is working on a low budget and is getting things done slowly. Craig Whitford, Code Compliance Officer, addressed the Board at their request. He stated that the property has been severely neglected which would include hanging broken glass in windows; children playing in the house and part of the roof collapsed. The property was recently boarded which included the 2"d floor windows because children were getting into the house. When he did his inspection, he could not get into the basement due to the door being screwed shut as well as human excrement all over the door. This property is a serious attractive nuisance. The listed taxpayer of record and interested party is Richard Adomat. The SEV is $8,200. Land value is $1,200. Building value is $7,000. Original red tag date is 4/6/05. The property is zoned W. Estimate of repairs is $42,800 (new structure). This is a fire-damaged property in which the owner died. As of today, no permits have been pulled for this property. Case No.: 2005-015 Address: 1014 E. North St. J. McCue presented the case. The listed taxpayer of record and interested party is Mabel Jarvis c/o Steven Lee Jarvis. The SEV is $21,300. Land value is $2,600. Building value is $18,700. Original red tag date is 5/31/05. The property is zoned 'C'. Estimate of repairs is $28,500. As of today, there is an electrical permit pulled which expired on 7/4/05 with no action. No other required permits have been pulled. Staff recommends this property be made safe or demolished in 30 days. Craig Whitford, Code Compliance Officer, addressed the Board at their request. He gave them the history on this property which includes the fact that it is a vintage log cabin in severe condition. There is a tree growing through the house. He did speak with the owner regarding the structure. Apparently, there is a possibility that it will be purchased and repaired. McCue stated that Mr. Cochran has requested an excused absence from the meeting tonight. Demolitions Hearing Officer Dave Muylle moved to approve the request for an excused absence for Mr. Cochran. It was last tabled on 7/28/05 with the stipulation that the exterior work will be done by the end of August and that a timeline for the interior work be submitted by the next meeting. Mr. McCue also stated that he received an email from Craig Whitford, CCO, stating that he spoke with Mr. Brown regarding another property of his and Mr. Brown told him that he was going to use 815 E. He said that the vinyl siding is complete; the windows are done except for the wrapping around them. He also stated that the vehicle is gone and the garage is cleaned out. Demolitions Hearing Officer Dave Muylle asked for clarification of Mr. Whitford's report stating that the owner was going to use this property for storage. Mr. Brown explained that Mr. Whitford took what he said out of context. He wants to store some of his tools in this house while he is working on the property on East Park Terrace. He doesn't have any other place to put his tools/equipment. Demolitions Hearing Officer Mark Hiaeshutter stated that enough time has been spent on this case. There seems to always be a reason why the requested things are not completed. At the last meeting, it was stipulated that the exterior work would be done by the end of August and that a timeline for the interior work would be submitted by the next meeting. Love asked for approval of the 7/28/05 meeting minutes. Demolitions Hearing Officer Mark Hiaeshutter moved to approve minutes as written. OLD BUSINESS: None NEW BUSINESS: Case No.: 2005-007 Address: 714 S. Magnolia Ave. E. Love presented the case. The listed Taxpayer of Record & Interested Party is Joseph Davis Jr. The SEV of the property is $14,500. The land value is $2,800. The building value is $11,700. The estimate of repairs is$20,000. This property is in the 100 year flood plain for the Red Cedar River and is also non-conforming. This makes repairs extremely limited. As of today, no permits have been pulled. Staff recommends that this property be made safe or demolished. Demolitions Hearing Officer David Muylle asked for clarification of what repairs can be made due to the fact that it is in the flood plain. E. Love explained that when the permit is pulled, the cost of the requested repairs cannot exceed 35%of the value of the structure and the footprint of the structure cannot be altered or added on to. This particular structure has excessive damage and, in the opinion of the Code Compliance Office, could not be repaired and brought up to code based on the said criteria. The listed Taxpayer of Record & Interested Parties are Robert and Lori Rutter. The SEV of the property is $40,500. The land value is $3,300. The building value is $37,200. The estimate of repairs is$39,000. She stated that the owner has been living in the structure for some time and refuses to leave. A letter was received from the mortgage company representing the property. They stated that the property is in foreclosure and their intentions are to repair the property. As of today, no permits have been pulled. Staff recommends that this property be made safe or demolished. Craig Whitford, Code Compliance Officer, addressed the Board. He stated that the property was originally inspected in 2003 and has deteriorated since then. He has tried to speak with the owners and has informed them that they cannot live in the structure while it is red tagged. He has been met with hostility and uncooperativeness from the owner. It is extremely unsafe and dangerous at this time. Jim McCue, Chief Code Compliance Officer, verified this information and stated that the owners are apparently heating with a propane heater. Terry Parisian, 1527 Massachusetts, addressed the Board. He stated that he has lived there for 5 years and the owner has never done anything with the property. They continue to live there along with having junk trucks with brush in the back of them. They don't mow their lawn, nor dump their trash. There are rodents in and out of the property all the time. They have called LPD on numerous occasions, but can never get anything rectified. The owner also ties their dog up on the front porch to allow it to reach the sidewalk and has tried to bite him and his daughter as they walk by. Keri Frayer, 1524 Massachusetts, addressed the Board. She stated that she has lived there for 10 years. She has seen no action from the owner to take care of his property in all the time she has lived there. They are living in the house without utilities and have been for quite some time. Demolitions Hearing Officer Mark Hiaeshutter ordered the property be made safe or demolished by September 22, 2005. Case No.: 2005-009 Address: 1125 Warwick Dr. E. Love presented the case. The listed Taxpayer of Record & Interested Parties are Micah and Tamah Winzeler. The SEV of the property is $26,800. The land value is $5,300. The building value is $21,500. The estimate of repairs is $80,000. This is a fire damaged property. As of today, no permits have been pulled. Staff recommends that this property be made safe or demolished. Demolitions Hearing Officer Robert Cochran ordered the property be made safe or demolished by September 22, 2005. OTHER BUSINESS: Status of 326 S. Foster—E. Love explained that this property was already sent out to bid for demolition and was awarded to Mint City Excavating. The owner of the property filed a Temporary Restraining Order(TRO)today and the court date is 917/05. We cannot take any further action until the judge reviews the case and signs the order. Retirement—E. Love announced to the Demolition Board that she will be retiring on September 14, 2005. It has been a pleasure working with the board. J. Terry Parisian, 1527 Massachusetts, addressed the Board. He stated that he has lived there for 5 years and the owner has never done anything with the property. They continue to live there along with having junk trucks with brush in the back of them. They don't mow their lawn, nor dump their trash. There are rodents in and out of the property all the time. They have called LPD on numerous occasions, but can never get anything rectified. The owner also ties their dog up on the front porch to allow it to reach the sidewalk and has tried to bite him and his daughter as they walk by. Keri Frayer, 1524 Massachusetts, addressed the Board. The SEV of the property is $21,000. The land value is $13,400. The building value is $7,600. The estimated repairs are$20,000. The soil on the property is listed by the Michigan DEQ as a 301 (hazardous material)site. There is also asbestos siding on the exterior of the structure. E. Love also explained that that MI DEQ informed our office that we can proceed with the demolition process on this property. However, due to contamination of the soil, it cannot be dug up. Soil samples will have to be taken around the cement slab underneath the house to determine what area is contaminated. As of today, no permits have been pulled. Staff recommends that this property be made safe or demolished. Patrina Hoppe, daughter of deceased owner Gerald Huckaba, addressed the Board. She stated that the county took possession of the property last March 2005 and they have until March 2006 to pay the back taxes and take possession of the property. They do not wish to do this. However, she did ask why was the house being demolished. E. Love explained the demolition process and the need for this property to either be made safe or demolished. It is being demolished from the top down and the site is not properly secured, nor does it have any barriers around it. The debris around the site is accessible to the many children in the area. It was also reported that the workers that are demolishing the site are not using proper safety attire. The porch also appears very unstable. Mr. Whitford stated that this demolition needs to be expedited immediately. Howard Casey, owner, addressed the Board. He stated that the structure is being demolished piece by piece and put into containers. This is the most logical way to demolish the structure due to its close proximity to the neighbors. By Monday, only the 1 st floor will be left to remove. He has worked closely with the neighbors during this time and has their support. He stated that he is doing the demolition safely and logically. He will be done in two weeks. It is taking a little more time due to the container company requiring that the unfinished wood be separated from the painted wood for recycling purposes. E. Love stated that she understands that the owner is doing the demolition correctly based on the code. She is merely concerned with the safety of the owner and his workers during the demolition of the structure. Grand River is now in foreclosure. His attorney is looking into the redemption period to see what Mr. Brown's options are. If these conditions are not met at the next meeting, it will be ordered "make safe or demolish in 30 days". As of today, there has been no current action on the issued building permit. There is, however, a pile of trash at the SE corner of the dwelling-that needs to be removed. Virginia Pulido, owner, addressed the Board. She stated that she will have the electrical permit pulled tomorrow and the work done by the end of June. She submitted a new work schedule for the electrical work as well. She has spoken with a couple of HVAC people, but has not yet hired anyone. She also needs to speak with some plumbing contractors. Her plans are to finish the electrical, then move on to plumbing and mechanical. E. Love explained that the Code Compliance Office is researching new tools to deal with red tagged homes. They are taking some of the oldest red tagged properties and issuing "Court Ordered Compliance"tickets. This will go through the court system which, hopefully, will be faster than the demolition process. Also, using the judicial system may also take some political pressures out of the decisions. Trying to use the ticket system has taught us that we need to move to these options (court or demo)earlier because properties go into foreclosure and responsible parties cannot be identified. The tickets that were written were for"failure to complete repairs in a timely manner". We are suggesting to the Judge that each defendant be given 90 days to comply by bringing the house up to current code. If this is not done, then the owner may be liable to pay the $500 ticket, court fees and jail/receivership. This process has been researched for a while with the properties on the list(approximately 66 of them—which are the most urgent). This has caused a delay in submitting properties into the demolition process. However, there will be three (3) new properties on the June 23`d agenda. This was last tabled on 8/26/04 in order to give the new owner time to complete repairs and finalize permits. As of today, there has been no action on the building permit which was pulled for a re-roof and front porch repair ONLY. None of the required trades permits have been pulled. E. Love also explained that a letter was received from BF Partners, who hold the land contract. They are planning on going through the land contract forfeiture procedure due to non-payment and expect to have possession of the property within 90-120 days. BF Partners requested, in their letter, a reasonable extension to get the paperwork done and the repairs started. Terry Tejkl, land contract holder, addressed the Board. He stated that he has been out of work which caused financial complications. He stated that a new furnace has been put in; the old plumbing has been taken out and the new plumbing has been laid out to be installed. He has worked on the windows as well. He stated that he paid for the plumbing permit. However,when he was in Building Safety, they told him that there were computer problems and it would be taken care of. He is planning on catching up on the land contract payments by selling an old car he has for approximately$1,500 to $2,000. Demolitions Hearing Officer David Muylle stated that there are a couple of issues that need to be addressed—mainly,to get the land contract issue rectified and to find the money necessary to make the repairs. Also, there is a very large brush pile in the back yard that needs to be removed immediately. He asked Mr. Tejkl on what day there would be a dumpster at the property to remove the brush. Mr. Tejkl stated that a dumpster would be on site by next Thursday. There has been a plumbing report given to our office by David Burton, Plumbing Inspector, after he was out at the house today. There are several code issues that need to be addressed and corrected. The plumbing is far from being up to code and the work that has been done was not done correctly. Brian Carter, Chief Electrical Inspector, also submitted a report after making an inspection at the house today. He stated that the electrical work that was done was the worst he has ever seen. There are several safety issues and wiring that was done completely wrong. Drywall has been ripped out and the wiring done on the outside of the walls. He informed Mr. Espinosa that he should have had a licensed electrician do the work. At this point,the house is imminently dangerous due to the faulty wiring. E. Love also stated that, according to the numerous pictures submitted by Craig Whitford, Code Compliance Officer,who was also at the property today, the owner is living in the house. There is substantial proof from the pictures that someone is, indeed, living there. E. Love voiced her disapproval and concern for anyone living in the structure due to the established safety issues and also the new problems that have been created by faulty work and wiring. The property has been, and remains, red tagged for a reason. It is substandard and unsafe to occupy. Ian Espinosa, owner, addressed the Board. He stated that he does not live in the house. He just works in it and likes to take breaks there. He said that he has re-wired most of the house and learned that he was supposed to drill holes in the studs to run the wiring through. He is planning on fixing this. He also understood the plumbing issues and stated that they were small problems that were easily fixed. A representative from the Fair Neighbors Association addressed the Board. He stated that their association, as well as Eastside Neighborhood Organization, has had enough with this structure. It has been this way for quite some time. It either needs to be repaired by a qualified person or it needs to be demolished. This house is a problem. He stated that he had insurance on the house when the fire took place. He explained that he has been in and out of court in regards to getting the insurance money. Love stated that the administrative fee of$1,000 covers these expenses, but only when the City of Lansing demolishes the structure. If the property is repaired or demolished by the owner, we cannot recover our costs of processing. PUBLIC COMMENT: A. Ian Espinosa addressed the Board. He stated that he wanted to be sure that the building issues were taken care of. He asked Mr. Kloosterman if the steps to the attic were OK. Mr. Kloosterman stated that they were.
