Capitol Ave. at 6:00 pm, � December 7, 2006 The December 2006 meeting of the City of Lansing Demolition Board was called to order at 6:05 p.m. by Jim McCue. The following members were in attendance: David Muylle; Mark Hiaeshutter. MEMBERS ABSENT: None STAFF PRESENT: Jim McCue; Laura Peters; Craig Whitford PUBLIC PRESENT: Norman Witte; Joyce Torres; Luis Gutierrez; Corie Jason; Steven Lonzo J. McCue asked for approval of the 10/26/06 meeting minutes. Demolitions Hearing Officer David Muylle moved to approve minutes as written. OLD BUSINESS: Case No.: 2006-014 Address: 3325 Felt St. J. McCue updated the Board on this case. It was last tabled on 9/28/06 to allow time for the owner to pull remaining permits and continue work. As of today, the electrical and mechanical permits have been pulled with no action on them. The building permit has had no action on it and has been expired since 1/31/06. The required plumbing permit has not yet been pulled. CCO Craig Whitford submitted a status report on this property. Per his report, there has been no activity since the last board meeting. The property is currently in foreclosure and is scheduled to be sold at the sheriff's sale on 1/4/07. The current amount due to Washington Mutual (mortgage holder) is $46,621.92. Staff recommends this property be made safe or demolished in 30 days. Luis Gutierrez, owner, addressed the Board. He stated that he has $30,000 invested in the house. There were problems beyond his control that have now been rectified. He has made the property much safer since he took it over. He admitted that progress has been slow. However, he has spoken with Washington Mutual in the past 24 hours and is working to resolve the foreclosure issue and repair the house. He stated that it is his intention to rehab the house and will get a lot done in the next two weeks. He claims responsibility for the delays. He has licensed contractors working with him on these repairs/plans. He anticipates being completely done by the end of February 2007. Norman Witte, Trott & Trott, addressed the Board. He stated that he represents Washington Mutual on this property. The property has been referred for foreclosure. The bank's position is that either the owner will rehab the property or the bank will take it back and they will rehab it. They would like to give Mr. Gutierrez a chance to rehab the property. They are requesting a specific list of what needs to be done on the property so that the bank can determine if it is cost effective. DEMOLITIONS BOARD MEETING MINUTES December 7, 2006 PAGE 2 J. McCue stated that it is not the responsibility of Code Compliance to provide a specific listing of what repairs need to be made. Our office generates a general letter of code violations that is sent to the owner. It is the owner's responsibility to determine exactly what needs to be done and complete those repairs utilizing licensed contractors. Demolitions Hearing Officer Mark Hiaeshutter ordered the property be tabled to January 25, 2007 in order to give the owner time to continue repairs and show progress. Case No.: 2006-015 Address: 2214 Bolley Dr. J. McCue updated the Board on this case. It was last tabled on 10/26/06 with the following conditions: 1) Remove the snow blade immediately; 2) Clean the site of all trash and maintain grass irrunediately; 3) Submit a timeline and schedule a progress inspection with CCO Whitford to be done BEFORE the next meeting. As of today, all required pen-nits have been pulled. However, no inspections have been done on them. CCO Craig Whitford submitted a status report on this property. Per his report, all of the required conditions have been met along with a note from the owner stating that they should be completed with repairs by February 2007. When he met with the owner, they stated that they were unaware that they had to get rough inspections done. They will be calling to set those inspections. Staff recommends this property be tabled for 60 days to give the owner time to complete repairs and finalize permits. Demolitions Hearing Officer David Muylle ordered the property be tabled until February 22, 2007 to allow time for the owner to complete repairs and finalize permits. NEW BUSINESS: Case No.: 2006-024 Address: 1105 Bement St. J. McCue presented the case. The listed taxpayer of record and interested party is Joyce Torres. The SEV of the property is $32,100. Land value is $4,100. Building value is $28,000. Original red tag date is 7/11/06. The property is zoned `C' Residential. Estimate of repairs is $51,000. As of today, none of the required permits have been pulled. There is a potential new buyer for the property. CCO Daryl Zuk met their contractors on site and they explained what rehab they would do. Based on this information, staff recommends that this property be tabled for 30 days to allow time for rehab. Joyce Tones, owner, addressed the Board. She stated that she has sold the property to Steve Lonzo and the closing is scheduled for tomorrow. Steve Lonzo addressed the board. He stated that he is planning on demolishing the portion of the house that is damaged and will rehab the remainder of it. They should be done in roughly four months. General discussion ensued regarding other properties that Mr. Lonzo has in the City of Lansing that are red tagged and still under repair. The city has major concerns that Mr. Lonzo can rehab this property in the time frame given considering all of the other projects that he is currently working on. Demolitions Hearing Officer David Muylle ordered the property be tabled to January 25, 2007 with the following conditions: 1) complete the sale of the property and supply Code Compliance with the necessary paperwork proving ownership before the next meeting; 2) pull ALL required permits before the next meeting; 3) submit to Code Compliance a specific timeline of completion which includes dates that rough- ins will be done before the next meeting. The listed taxpayer of record and interested party is Deutsche Bank National Trust. The SEV of the property is $42,800. Land value is $4,900. Building value is $37,900. Original red tag date is 10/23/06. The property is zoned `C' & `DM-3' Residential. Estimate of repairs is $40,000. As of today, no permits have been pulled. Due to soil issues in that neighborhood, the house is sinking and tipped severely causing a tremendous stress on the walls. Due to this fact, a complete inspection is not possible. This property was recently quit claimed back to the bank on 9/28/06. Staff recommends that this property be made safe or demolished in 30 days. Corie Jason, who lives at 1406 Prospect and represents Prospect Protectors, addressed the Board. She submitted a letter to the board in favor of demolition. She stated that the house has been vacant for 3-4 years with no action on it. Demolitions Hearing Officer Mark Hiaeshutter ordered the property be made safe or demolished by January 27, 2007. Case No.: 2006-026 Address: 513 Isbell St. J. McCue presented the case. The listed taxpayer of record is Dolores Risper (deceased). Interested parties include Dolores Risper and Thelma Bibbs. The SEV of the property is $23,400. Land value is $1,300. Building value is $22,100. Original red tag date is 7/22/04. The property is zoned `C' Residential. Estimate of repairs is $51,000. This is a fire-damaged structure that has been vacant for 2 years. As of today, none of the required permits have been pulled. J. McCue had a phone conversation with the owner, Thelma Bibbs, who stated that she received the insurance money from the fire. That money was used to pay off the house. Case No.: 2006-028 Address: 1108 Bement J. McCue stated that the garage at this address was in severe condition and was demolished as an emergency demolition on 9/12/06. Case No.: 2006-029 Address: 717 S. Francis J. McCue stated that the garage at this address was in severe condition and was demolished as an emergency demolition on 11/7/06. McCue asked for approval of the 9/28/06 meeting minutes. Demolitions Hearing Officer Mark Hiaeshutter moved to approve minutes as written. OLD BUSINESS: Case No.: 2006-018 Address: 129 E.Reasoner St. J. McCue updated the Board on this case. It was last tabled on 9/28/06 with the following conditions: 1)yard must be cleaned up and ALL trash & debris, as well as wood piles, be removed; 2) rough-ins are worked on and significant progress shown; 3) remaining required permits are pulled. As of today, the only action on permits is a mechanical permit for the furnace that was pulled on 10/18/06. There has been no action on the building or the electrical permit; nor has the required plumbing permit been pulled. CCO Craig Whitford submitted a status report on this property. Per his report, there has been no activity on site, nor has he been able to view the interior since the last Demolition Board meeting. An After Hours letter HAS NOT been issued since the last meeting due to the fact that the owner did not supply a time line of completion that was requested by both CCO Whitford as well as Jim McCue. Staff recommends this property be made safe or demolished in 30 days. Troy Dick, owner, addressed the Board. He stated that he can't afford to pull a plumbing permit for the water heater yet. Also, he doesn't understand what the problem is with the wood piles. He will use wood as his primary source of heat. Steve Dick, brother of the owner, addressed the Board. He stated that the furnace is in and the wood stove will be hooked up soon. He then gave a time line of completion to the Board. He asked for an extension on the After Hours letter so that they can work on the house. He also asked what the problems were with the wood piles. He stated that his brother has the right to heat with wood if he wants to. J. McCue clarified that the Mechanical Code does not recognize wood heat as a primary heat source; only as a secondary heat source. The primary heat source has to be constant. None of the items have been picked up that he requested be done at the last meeting. Basically, all of the conditions that were stated at the last meeting have not been met. Also, based on the new letters that he received from the neighbors, the owner is not attempting to be a good neighbor either. Demolitions Hearing Officer Mark Hiaeshutter ordered the property be made safe or demolished by November 26,2006. Case No.: 2006-015 Address: 2214 Bolley Dr. J. McCue updated the Board on this case. As of today, none of the required permits have been pulled. This property is located in the flood plain. Staff recommends that this property be made safe or demolished in 30 days. Laura Clement, owner, addressed the Board. She stated that she is working with demolition contractors right now getting bids to demolish the structure. The property has sentimental value to her and it was difficult for her to come to this decision. However, she understands the issues with the flood plain and is working as quickly as possible to demolish the structure. The listed taxpayer of record is Carl Seeley. Interested parties include Carl Seeley and Naomi Christle. The SEV of the property is $27,500. Land value is $3,400. Building value is $24,100. Original red tag date is 8/8/06. The property is zoned `C' Residential. Estimate of repairs is $43,000. As of today, the only required permit pulled is a building permit for interior & exterior repairs. There are also issues with ownership as Mr. Seeley is deceased. Per CCO Craig Whitford,Naomi Christle is the daughter who is taking over the property. However, a search of Assessor's records as well as Ingham County Register of Deed's records as of this afternoon does not show proof of that. Staff recommends that this property be made safe or demolished in 30 days. DEMOLITIONS BOARD MEETING MINUTES October 26,2006 PAGE 3 Naomi Christle, daughter of recorded owner Mr. Seeley, addressed the Board. She stated that she is working with an attorney who is getting the property in her name via a Quit Claim Deed. She provided a copy of a receipt for $164 for a Quit Claim Deed& filing fee. However, it does not identify where it is from; nor is there a copy of the Quit Claim Deed—only a letter from the Gallagher Law Firm regarding a Quit Claim Deed—Retainer Agreement. She also stated that it is her intention to fix up the property and live in it. J. McCue explained to Ms. Christle that the documents she provided do not prove ownership of the property. Our office requires a recorded copy of a Quit Claim Deed showing ownership. CCO Craig Whitford addressed the Board. He stated that the property is in severe shape and needs considerable work done to bring it up to code. Demolitions Hearing Officer David Muylle encouraged the owner to re-evaluate her intentions for this property considering its severe condition. The listed taxpayer of record is Zelma Palmer. Interested parties include Zelma Palmer and Dale Palcios. The SEV of the property is $32,700. Land value is $2,700. Building value is $30,000. Original red tag date is 3/30/06. The property is zoned `C' Residential. Estimate of repairs is $63,000. As of today, the only permit pulled is a building permit for a tear off& re-roof ONLY. She stated that the owner was planning on attending the board meeting tonight, but was stranded in Ann Arbor. She stated that Dale Palcios, new owner, is using the same attorney that she is in obtaining a Quit Claim Deed for the property. CCO Craig Whitford addressed the Board. He stated that he has been inside this structure. It is in extremely bad shape. There are animals inside as well as water on the 1s`floor that is coming from the roof being open. Resignation of Demolitions Hearing Officer Robert Cochran — Mr. Cochran submitted his Letter of Resignation from the Demolition Board due to a new appointment as Commissioner of the Board of Water & Light. She stated that the roof of this house has caved in, there are other properties in the area owned by Mr. Gempel that are red tagged and she is very concerned about the neighborhood. She stated that this particular owner has not done any repairs on his properties. Zoreta Mackie, 1549 Knollwood, addressed the Board. She stated that the house has been an eye sore in the neighborhood for quite some time. The owner has not done anything with it and has several other properties in the area that are red tagged. There are also kids in the neighborhood and she is concerned for their safety. This property needs to be demolished. Demolitions Hearing Officer David Muylle ordered the property be made safe or demolished by February 23, 2006. Case No.: 2006-003 Address: 1821 Olds Ave. J. McCue presented the case. The listed taxpayer of record and interested party is Ivy Vinton. The SEV is $39,700. -Land value is $1,800. Building value is $37,900. Original red tag date is 6/3/05. The property is zoned 'B'. Estimate of repairs is $58,568. As of today, none of required permits have been pulled. Staff recommends this property be made safe or demolished in 30 days. Joe Mullaney, Remax—representing the owner, addressed the Board. He stated that the property was in foreclosure which started last June 2005. The redemption period ended December 2005 and the bank has just taken the property back. They would like to either sell the property as is or obtain demolition estimates from contractors and demolish the structure. Paul Raine, attorney for the owner, addressed the Board. He verified the information that Mr. Mulhany gave the Board. He stated that they will require more than the 30 day recommendation from Mr. McCue in order to either sell or demolish the structure. Demolitions Hearing Officer Mark Hiaeshutter ordered the property be tabled until February 23, 2006 in order to allow time for the bank to pursue their plans of either selling the property as is or demolishing it. OTHER BUSINESS: A. Problems @ 1443 & 1524 Knollwood—Demolitions Hearing Officer David Muylle gave information to Jim McCue relating to these two properties. He is requesting that the Code Compliance Officer follow-up on these due to the condition of the structure. He believes that they both should be in the demolition process.
