RULES OF ADMINISTRATIVE PROCEDURE OF
THE DEMOLITION BOARD
FUNCTION & DUTIES: The Demolition Board is a 3-member board. The function and duties of
the Demolition Board are prescribed in the City of Lansing Housing Code and State regulations.
PUBLIC: All meetings of the Demolition Board shall be open to the public.
MEETING DATE: The Demolition Board shall meet on the fourth Thursday of each month during
the months of January through October at 6:00 p.m. There are no regularly scheduled meetings for the
months of November and December. However, other meetings may be scheduled at such other times
as may be deemed necessary by the Secretary of the Board and in accordance with the Open Meetings
Act.
PARLIAMENTARY PROCEDURE: Except where otherwise specified, meetings shall be
conducted according to the Roberts Rules of Order.
ATTENDANCE: Board members shall be regular in attendance. In the event a Board member has
three 3 unexcused absences from regular meetings in any fiscal year, it shall be the duty of the
Secretary to notify the mayor concerning any member's lack of attendance.
NOTIFICATION OF ABSENCE: Board members unable to attend the meeting shall notify the
Secretary three 3 days prior to the meeting. The Board will determine at that meeting whether
persons providing such advance notice will be given an excused or unexcused absence. Members not
providing such advance notice will receive an unexcused absence which may be modified at the
following meeting upon explanation of the circumstances which kept them from the prior meeting.
The Secretary will note the reason for all absences.
QUORUM: There is no quornin for the Demolition Board. Only one member need be present to
conduct business and take action upon agenda items.
SELECTION: The Demolition Board members are appointed by the Mayor and confirmed by City
Council. The Code Compliance Manager shall be the designated Secretary of the Board. In event of
the Secretary's absence, the Code Compliance Manager shall appoint a member of their staff as a
secretary designee.
TENURE: The Demolition Board members serve indefinite terms when appointed by the Mayor and
are not geographically based.
RECORD: The Secretary of the Board shall keep the minutes of all Board meetings. These minutes
shall contain the transactions, resolutions, and determination's of the Board and shall be a public record.
NOTIFICATION: All notifications shall be made in accordance with State law and local ordinance.
BOARD ACTION: Action by the Board on any matter on which a hearing is held shall not be taken
until the hearing has been concluded. Only one member of the Demolition Board is required to take
action on a specific property by ruling the property "make safe or demolish", "tabled", or
"closed/withdrawn" and signing the"Order To Make Safe" documentation.
DISQUALIFICATIONS: Any member of the Demolition Board having a direct or indirect
financial/equitable interest in any matter before the Board, or who may stand to gain or lose financially
or otherwise due to action of the Board on any matter, shall indicate such interest to the Board and be
disqualified from acting on such matter.
DECISION OF THE BOARD: The decision of the Demolition Officer is final. However, each
decision is subject to verification by City Council after notice and public hearing in accordance with
State law.
NOTIFICATION OF DECISION: Applicants shall be notified in writing sent certified mail of the
Hearing Officer's decision within five (5) working days following the meeting. Also, notification shall
be posted on the property.
AMENDMENTS (RULES OF PROCEDURE): Amendments in the Rules of Procedure may be
initiated by any member of the Demolition Board at any regular meeting and voted upon at the next
regular meeting. All Board members must be notified of such amendment by mail at least 5 days
before the amendment is to be voted upon.
PUBLICITY: All public releases regarding the Board's decisions, discussions or any other
information relating to the work of the Demolition Board shall be made through the Secretary.
