Capitol Ave. at 7:00 pm October 26, 2000 The October 2000 meeting of the City of Lansing Demolition Board was called to order at 7:00 p.m. by Gloria Jones. The following members were in attendance: Gloria Jones & Robert Cochran Members absent: Mark Hiaeshutter Staff Present: Eleanor K. Love & Teresa De Rose Public Present: John Person & Debra K. Baker Bob Cochran asked for the approval of the 9-28-00 minutes. Gloria Jones made a motion to approve the minutes. Motion seconded by Bob Cochran. Motion carried. Old Business: Eleanor Love presented Bob Cochran with a city pin. Mayors' office will also send letter confirming appointment to Demolition Board. 117 W Oakland has been boarded up from a recent fire and Eleanor Love notified the board that the owner recently obtained a demolition permit. This property was inquired about last month. New Business: The 2001 dates for demolition board meetings were reviewed. Hearing Officer Cochran made a motion to approve 2001 date. Motion seconded by Hearing Officer Gloria Jones. Mr. Cochran inquired on status of last month properties on Averill and Mifflin. Nothing has transpired on either property. Bob Cochran inquired about 420 N Martin Luther King; Eleanor Love stated that this is almost complete. The five properties from last month have been approved by City Council, and given 60 days to initiate final demolition steps. Case No.: Address: 2000-010&011 131 & 133, 135 & 137 S Leslie SEV $30,700; repair estimate $40,000-$46,000 SEV$31,000; repair estimate $40,000-$50,000 Owner John Person (J&E Investment) indicated he bought property from Fochtmen Venture Management. Owner had planning to repair, but other issues intervened. Kids have been breaking into the dwelling, so an orange snow fence was put up. Both dwellings have some historical significance. Eleanor Love contacted Mr. Dave Muylle regarding purchase of these dwellings. He has renovated a similar style home and remodeled it very nicely. Hearing Officer Bob Cochran solicited recommendations from Eleanor Love on what action could be taken. It was decided to table for 90 days, and Hearing Officer Gloria Jones agreed. 2000-08 & 2000-09 415 Whiteley Ct& 409 Beech Whiteley Ct SEV $12,600, estimate to repair$22,500. Beech St SE. `$2,826, estimate to repair $15,700. Notice was given to all interested parties. Maurice & Lynn Green own parcel containing both of these properties. Beech St had originally been used as a store in the early 1900's. Most recently, it has been used for storage by Curtis Drug Store. Mr. Green would like to demolish Beech St on his own (currently indicates that he doesn't have funds), and Whiteley Ct next July. Curtis Drug Store has closed,and subsequently no income to Mr. Green. Work has been delayed, due to his wife's health. Hearing Officer Robert Cochran upon determining the unsafe nature of the buildings, ordered structures demolished on or before February 1, 2001 if not made safe or demolished by the current owner. 1999-22 218 S Mifflin SEV $15,600, 1998 estimate to repair $33,220. Notice was given to all interested parties. The City of Lansing Development Office has no interest in pursuing the loan of$780.00 left unpaid from 1984. Hearing Officer Gloria Jones upon determining the unsafe nature of the building, ordered to make safe, or be demolished by October 31st, 2000 if not made safe. 2000-06 3310 Averill SEV$24,700, estimate to repair$68,000. Notice to all interested parties was given. However, the owner did not respond to the Postal Service attempt to deliver three times before it became "unclaimed". There is major damage by fire in 1999 resulting in personal injury. Insurance company still hasn't settled. Hearing Officer Robert Cochran after determining the unsafe nature of the building, ordered structure to be demolished after October 31,2000 if not made safe. Other Business: Board Member Cochran has never received an appointment letter from the City administration indicating his status as Board Member. It is also his wish to have a city pin. Mr. Cochran is also concerned as to his personal liability under errors and omission, by indicating that he is certifying structures to be dangerous. Mrs. Love reaffirmed his coverage as a representative of the city. Eleanor Love is going to check the status on the boarded up dwelling on Oakland, between Capitol &Washington, at Robert Cochran's request. General discussion about revising codes, which have not been changed since 1998. Staff has proposed entire revision to housing code with expanding definitions, using the International Property Maintenance Code as the basic document. Some of the owners' children had removed cupboards, etc., when moving owner out of the house. Trash has continually been dumped into the back yard by neighbors. Ms. Baker would like to take over property in her name and move grandmother back in when repaired. Board recommended contacting Legal Aid of Mi for assistance, so the debt wouldn't fall on Ms. Baker. 60 + Law Clinic could also be contacted on behalf of owner Virginia Booth for legal assistance. Historic Planner indicated that the dwelling be rehabilitated if economically feasible. Hearing Officer Gloria Jones recommended the property be tabled for six months. 1998-22 612 Isbell SEV$14,900; repair estimate in 1998 $17,500 Interested parties, Raymond Whitford & Karen Welford have not been located to send certified notice. Mrs. Lottie Vermett (who purchased property from the bank in 1999) is in the process of repairing structure, work slowed due to her husbands death in June of 1999. Structure suffered fire damage in 1997. Son Richard is a builder and will assist in repairs. Intent is to have Woodsman Plumbing, and Custom Electric contracted for repairs. Hearing Officer Gloria Jones upon determining that the building was unsafe, has ordered building to be made safe by the current owner or demolished by April 30, 2001. Code Compliance officer will re-inspect 30 days prior. 2000-07 222 Hill SEV$6,100, estimate to repair$22,3000. Notice was given to all interested parties. Barbara & Eddie King, and Rex Menzer are listed taxpayers. Structure suffered fire damage in 1999. Randy & Elizabeth Ebright sold home to Rex Menzer, who never filed the quit claim deed with the Record of Deeds. Menzer has since sold to King's, and both parties are currently listed as taxpayers. Barbara & Eddie King have paid taxes for approximately five years, even though they didn't sign paper work making them the recorded taxpayer. All paperwork that has transpired regarding the sale of the house was lost due to the fire in the structure. Considering the issues, staff sends all communication to each interested party. Hearing Officer Gloria Jones reviewed, stated there is nothing to make safe due the fire loss and ordered demolished by September 22, 2000 if not made safe. Case No.: D1998-001 Address: 414 Dorrance Place SEV is $13,900, cost of repairs is $25,501. Hearing Officer Mark Hiaeshutter reviewed, ordered demolished by September 22, 2000 if not made safe by the owner. Case No.: D1998-008 Address: 807 Mahlon SEV is $2,400, cost of repairs is $25,500. House as presently configured is less than the 20 x 20 foot minimum square foot regulation as a non-conforming dwelling. Maximum amount to be spent on reconstruction is 35% of the value of the building. In this case, the maximum would be $840.00. Hearing Officer Gloria Jones ordered demolished by September 22, 2000 if not made safe. Realtor Rick Robbins representing owner who is out of town. Case No.: D1999-002 Address: 1015 Clear Property tabled for 60 days until October, owner Patricia Ovieda is working on repairs Case No.: D1995-021 Address: 923 E Park Terrace i SEV is $11,400, cost of repairs is $11,100. Owner Sam Usman's property has gone before this board in 1995, hasn't completed repairs. Hearing Officer Hiaeshutter ordered property demolished on or before September 25, 2000 if not made safe. Case No.: D1999-010-C Address: 3500 S Waverly SEV is $69,900, cost of repairs is undetermined. Hearing Officer Gloria Jones wants property tabled for 90 days. Currently on their third round of financing, structure was started in 1995. Kevin Lovell, Lovell Contractors, submitted a letter stating that he would like steel from the property as repayment. After clarification, Hearing Officer Gloria Jones would like to proceed with the order to make safe, rather than table. The building will be demolished on or before Nov. 27, 2000 if no progress has been made to make safe as ordered. Let the record show that the Building Safety Office will send a letter that designates what will maintain the integrity of the structure, and that the value of the repairs will be based on requirements outlines in the letter.
