Barnard Attorney at Law CITY OF LANSING HEARING OFFICER DECISION RECOMMENDATION In Re: TNT Industries, LLC Provisioning Center License Scoring and Ranking Denial This decision is remitted to the Clerk of the City of Lansing by Hearing Officer, Hilary M. Barnard, Esq., having been read and informed on the issues recommends that in regard to TNT INDUSTRIES, LLC and its license application for a Medical Marihuana Provisioning Center that the application remain denied. FACTS TNT INDUSTRIES, LLC ("Appellant")submitted an application to the City of Lansing to operate a Medical Marihuana Provisioning Center within the city limits. On or about February 21, 2018 Appellant's application was denied. Appellant then appealed on February 22, 2018 and submitted additional documentation on or about April 6, 2018. This recommendation follows an appeal received on May 31, 2018 simultaneously with a Freedom of Information Act (FOIA) request addressed to the City Attorney. By letter dated May 18, 2018, Appellant was informed that its license application was denied because of its score and rank, having received a score of 42 out of 100. Appellant was informed that this score eliminated the possibility of scoring in the top twenty applicants. Appellant was also informed that it had the right to appeal the denial within 14 (fourteen) days of the letter's date by written statement with grounds for appeal. With the May 18 letter, Appellant was provided a copy of the City of Lansing Provisioning Center Ranking sheet. On the document, appellant is able to view the total possible points, its attained points, and short insight statements The largest deficient categories of Appellant's scoring indicate that under Tangible Capital Investment Appellant earned a 9 out of possible 15; Sufficient Financial Resources with a 0 out of 5; and 3 out of 10 in Entrance and Exit on Main Streets etc. Appellant states in its Notice of Appeal of Application Evaluation that it was eliminated from the possibility of licensure and its application denied. Appellant stated "[t]he scored numbers and the proposed scoring insights were not indicative of the application materials submitted."' The appeal request also referenced a FOIA request in which Appellant requested "City of Lansing scoring guidelines, scoring criteria, scoring evaluations, notes, [and] insights[.]"' ' See Bruce F. APPLICABLE LAW & REASONING The issue is whether Appellant's score and rank for a Provisioning Center License for the City of Lansing was erroneously calculated resulting in license application denial. It is not enough for an appellant to"simply announce a position or assert an error[.]"' Thus leaving the overseer of appeal to"discover and rationalize the basis for his claims, or unravel and elaborate for him his arguments, and then search for authority to either sustain or reject his position."' "Failure to brief a question on appeal is tantamount to abandoning it."' Here, Appellant has not provided an articulable reason why documentation provided should have been sufficient or why its score is inaccurate. Appellant instead submitted a FOIA request for materials that are available since the moment of application and prior.' Appellant's strongest deficient areas were not addressed in this appeal, no additional documentation was submitted, nor were arguments made for why the documents originally provided should have been sufficient. Thus, this Hearing Officer is forced to conclude Appellant has abandoned its argument on this appeal.' CONCLUSION For the foregoing reasons, it is recommended that Appellant's application for a provisioning center license remain denied. In reviewing original materials submitted with application, it appears that though Appellant provided documentation it was not sufficient in detail or in breadth to merit a higher score in the categories.From insight statements and document review it does not appear that the deficient categories could be allocated any more points than already given. Deficiencies in the application are noted in the scoring insight statements and documentation or argument to refine the respective scores could have been provided but was not.
