-Things to consider: (1) did the decision-maker rely on a prohibited factor, (2) did the decision-
maker fail to consider a required factor, (3) did the decision-maker fail to provide explanation,
(4) did the decision-maker make a decision that is contrary to the evidence.
Arbitrary: without adequate determining principle, fixed or arrived at through an exercise of will
or by caprice, without consideration or adjustment with reference to principles, circumstances, or
significance, decisive but unreasoned.
Capricious: apt to change suddenly, freakish, or whimsical.
