HomeMy WebLinkAbout2019.12.06 minutes.MM Commission MINUTES City of Lansing Medical Marihuana Commission SPECIAL MEETING December 6, 2019 – 2:00 PM City Clerk Election Unit Training Room 2500 S Washington Ave The meeting was called to order at 2:00 PM BOARD MEMBERS PRESENT Jason Peek, Chair Anita Turner, Vice-Chair B Bettie Trice Bryanna McGarry A QUORUM WAS PRESENT STAFF PRESENT: Chris Swope, City Clerk Brian Jackson, Chief Deputy City Clerk Deb Biehler, Office of the City Clerk Amanda O’Boyle, Office of the City Attorney APPROVAL OF AGENDA as amended: Moved – Bryanna McGarry Second – Anita Turner MOTION CARRIED APPROVA APPROVAL OF MINUTES: Moved – Anita Turner Second – Bryanna McGarry MOTION CARRIED PUBLIC COMMENT ON AGENDA ITEMS – None COMMISSION APPEAL HEARING Appeals are heard following the approved Medical Marihuana Commission Appeal Hearing Format. The Commission’s standard of review of an appeal shall not be de novo. The appeal packets are provided to the Commission and the Appellant prior to the meeting and include the following: • Timeline of events • First denial letter with basis for denial and instructions on how to appeal • The Hearing Officer Appeal Packet Copy with decision • The second denial letter outlining how to appeal to the Commission • The applicant’s appeal to the Commission with supporting documentation submitted by the applicant WEISBERGER VENTURES – 4213 S CEDAR ST Paul Weisberger – Representing Weisberger Ventures II The appellant withdrew the appeal. PAGE TWO City of Lansing Medical Marihuana Commission SPECIAL MEETING December 6, 2019 – 2:00 PM City Clerk Election Unit Training Room 2500 S Washington Ave WEISBERGER VENTURES – 511 E HAZEL ST Paul Weisberger – Representing Weisberger Ventures II Bryanna McGarry moved to modify the decision of the City Clerk by adding 1 point to category 6, Marketing, Advertising and Promotion because the decision is not supported by material, substantial and competent facts on the whole record, and, to uphold all other categories because these decisions are supported by material, substantial, and competent facts on the whole record. MOTION SECONDED BY BETTIE TRICE ROLL Jason Peek – Yes Anita Turner - Yes Bettie Trice – Yes Bryanna McGarry - Yes MOTION CARRIED BLACKSTONE HARVEST LLC – 6450 S CEDAR ST Mike Bahoura – Appearing for the Appellant Bettie Trice moved to modify the decision of the City Clerk by adding 1 point to category 22, Net Worth, because the decision is not supported by material, substantial and competent facts on the whole record, and, to uphold all other categories because these decisions are supported by material, substantial, and competent facts on the whole record.
