COMMISSION APPEAL HEARING
Appeals are heard following the approved Medical Marihuana Commission Appeal Hearing
Format. The Commission’s standard of review of an appeal shall not be de novo. The appeal
packets are provided to the Commission and the Appellant prior to the meeting and include the
following:
• Timeline of events
• First denial letter with basis for denial and instructions on how to appeal
• The Hearing Officer Appeal Packet Copy with decision
• The second denial letter outlining how to appeal to the Commission
• The applicant’s appeal to the Commission with supporting documentation submitted by the
applicant

Bryanna McGarry moved to modify the decision of the City Clerk by adding 1 point to category 6,
Marketing, Advertising and Promotion because the decision is not supported by material, substantial and
competent facts on the whole record, and, to uphold all other categories because these decisions are
supported by material, substantial, and competent facts on the whole record.
