COMMISSION APPEAL HEARING
Appeals are heard following the approved Medical Marihuana Commission Appeal Hearing
Format. The Commission’s standard of review of an appeal shall not be de novo. The appeal
packets are provided to the Commission and the Appellant prior to the meeting and include the
following:
• Timeline of events
• First denial letter with basis for denial and instructions on how to appeal
• The Hearing Officer Appeal Packet Copy with decision
• The second denial letter outlining how to appeal to the Commission
• The applicant’s appeal to the Commission with supporting documentation submitted by the
applicant

capital investment, job creation, charitable plans, entrance and exit on main streets,

points be added to tangible capital investment, 1 point added to % of employees earning $15/hr

streets and quality of security plan.
